    Abstract: Inklusion von Menschen mit Behinderungen ist zu einem der vordringlichen Ziele der Sozialpolitik der Europäischen Union und in der Russischen Föderation geworden, u. a. aufgrund der zunehmenden Zahl von Ländern, die die UN-BRK1 ratifizierten, sowie Herausforderungen wegen, die eine "alternde" Gesellschaft verursacht. Jedoch werden Menschen mit Hörbehinderung und deren spezielle Bedürfnisse im Vergleich zu anderen, eher sichtbaren Behinderungen, oft übersehen. Das zentrale Anliegen der vorliegenden Untersuchung ist es, die Mechanismen und Ergebnisse der sozialen Inklusion schwerhöriger Menschen in Russland und Deutschland näher zu betrachten und zu vergleichen, sowie mit empirisch belegten Befunden zur Forschung über schwerhörige Personen beizutragen. Der Forschungstand hierzu ist in den Disability Studies noch sehr lückenhaft. Eine Analyse der Sozial- und Behindertenpolitik in beiden Ländern sowie ein Vergleich der rechtlichen und institutionellen Maßnahmen als auch der Chancen bildet den Rahmen für eine empirische Analyse (Fragebogen, Interviews mit schwerhörigen Personen, NGOs und Experten). Die Einschätzung der politischen Maßnahmen und der Infrastrukturen folgt den konzeptionellen und normativen Bewertungsmaßstäben der Disability Studies. Die vergleichende Analyse konzentriert sich auf den Zugang schwerhöriger Menschen zu Bildung und Arbeitsmarkt, zu Wiedereingliederung, Information und Kommunikation – Bereiche welche für Inklusion und Teilhabe entscheidend sind. Die empirischen Erhebungen enthalten explorative, nicht-repräsentative Fragebögen-Untersuchungen unter a) 190 jungen Befragten, 18-35 Jahre alt (davon 136 aus Deutschland; 150 aus Russland) b) 110 älteren Befragten, 65 bzw. 60 Jahre alt — abhängig vom betreffenden Land — und älter (43 aus Deutschland; 67 aus Russland) und Experten-Interviews mit Schlüsselpersonen zum Thema (Forscher, politische Entscheidungsträger, medizinische und pädagogische Experten, schwerhörige NGO-Aktivisten); darüber hinaus Leitfaden-Interviews mit schwerhörigen Personen (11 in Deutschland, 16 in Russland). Übereinstimmungen und Abweichungen in den nationalen politischen Richtlinien werden diskutiert, Beispiele von positiven Praktiken in medizinischer, ausbildungsbezogener und beruflicher Rehabilitation und potentielle politische Maßnahmen werden vorgeschlagen.
    Abstract: Inclusion of people with disabilities has become one of the priorities of the social policy in the European Union and in the Russian Federation, in part, in connection with the increasing ratification of the UN CRPD worldwide and problems induced by the “ageing” society. However, people with hearing loss and their specific needs are often overlooked in comparison with more visible disabilities. The main purpose of this study is to look into and compare the mechanisms and results of social inclusion of hard of hearing people (HoH) in Russia and Germany and to contribute with empirically grounded findings to the research on hard of hearing people of which there is a lack in the disability research field. An analysis of the social and disability related policies in both countries and a comparison of the legal and institutional arrangements and opportunities provides the framework for the empirical analysis (questionnaire, interviews with HoH persons, NGOs and with experts). The appraisal of the policies and infrastructures is following the conceptual and normative benchmarks of the Disability studies. The comparative analysis is focused on access of HoH people to education and employment, to rehabilitation, information and communication – the fields critical to inclusion and participation. The empirical research comprises an explorative non-representative questionnaire survey with a) 190 young respondents aged 18-35 years (136 from Germany, 150 from Russia) b) 110 elderly respondents (65 or 60 years old and older; 43 from Germany, 67 from Russia), and expert interviews with the key persons in the field (researchers, political decision-makers, medical and educational professionals, hard of hearing NGO activists); furthermore, guided interviews with HoH people (N=11 in Germany, N=16 in Russia) were conducted. Commonalities and discrepancies in the national policy directions are discussed, examples of positive practices in medical, educational and professional rehabilitation and potential policy measures are suggested.

    Abstract: This book offers a comprehensive analysis of the legal questions that arise for the legislative branch when implementing the crime of aggression into domestic law. Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

    Abstract: This book explores the impact of 'Fintech' on the information asymmetry between the financial regulator and the markets. It details the growing regulatory mismatch and how Fintech exacerbates the “pacing problem”, where the regulator struggles to keep up with innovation.     Abstract: In dieser Studie wird untersucht, wie auf Fähigkeiten basierende soziale Erwartungen, die in weibliche Normen eingebettet sind, die Konzeptualisierung von Behinderung beeinflussen und subjektive Strategien zur Aushandlung des Behindertenstatus im Prozess des Werdens einer "behinderten Frau" formen. Ich stützte mich auf die Theorie des sozialen Konstruktivismus (Berger und Luckmann 1966) und untersuchte Erfahrungen von zwanzig körperbehinderten Frauen in Pakistan. Ziel war es, die soziokulturellen Prozesse und Praktiken zu untersuchen, die behinderten Frauen in ihrem Lebensverlauf Wissen über Geschlecht und Behinderung vermitteln. Biographien von drei blinden Frauen wurden für eine detaillierte Fallrekonstruktion ausgewählt. Die Analyse ergab, dass die Interpretation der Behinderung durch die Familie die soziale Integration behinderter Frauen und ihr Verständnis von Behinderung erheblich beeinflusst. In Familien mit einem niedrigeren sozioökonomischen Hintergrund verstärken tief verinnerlichte Weiblichkeitsnormen die soziale Ausgrenzung blinder Frauen. Umgekehrt wurde festgestellt, dass die Familien der Oberschicht aktiv an der Überwindung der Behinderungsbarrieren mitwirken, indem sie behinderten Frauen instrumentelle Unterstützung gewähren. Die Wertschätzung der Familie für die Hochschulbildung ist mit dem Wunsch verbunden, die Heiratsaussichten ihrer jungen, körperlich behinderten Tochter zu verbessern. Die behinderten Frauen sehen jedoch in der Hochschulbildung ein Mittel, um unabhängig zu werden. Da die gesellschaftliche Anerkennung als "Frau" eng mit der Fähigkeit von Frauen verbunden ist, die Erwartungen an die Geschlechterrolle zu erfüllen, beziehen sich körperlich behinderte Frauen stark auf die kulturelle Vorstellung von Weiblichkeit, um dem Behinderungsaspekt ihrer Identität zu widerstehen. Folglich stellen sie die repressiven Normen der Weiblichkeit nicht unbedingt in Frage, obwohl sie gebildete und wirtschaftlich unabhängige Frauen sind.
    Abstract: This study investigates how ability based social expectations embedded in feminine norms affect the conceptualisation of disability and shape subjective strategies for negotiating disabled status in the process of becoming a ‘disabled woman’. I drew on the theory of social constructivism (Berger and Luckmann 1966) and researched the biographical experiences of twenty (20) young physically disabled women, living in Pakistan. The purpose was to investigate the sociocultural processes and practices that provide disabled women with knowledge about gender and disability in their life course. Among twenty interlocutors, the biographies of three blind women were selected for detailed case-reconstruction. Analysis revealed that the family’s interpretation of their daughter’ disability significantly influences the social integration of disabled women and their understanding of disability. In families with a lower socioeconomic background, deeply internalised norms of femininity intensify the social exclusion of blind women. Conversely, the upper class families were found to be active in overcoming the disabling barriers by providing means of instrumental support to disabled women. The research demonstrated that higher education is comprehended by the interlocutors and their families as the key source of gaining social inclusion. The family’s appreciation of higher education is intertwined with their desire to enhance the marriage prospects of their young physically disabled daughter. However, disabled women perceive higher education as a means of becoming economically independent. Since social recognition as ‘woman’ is closely associated with women’s ability to fulfil gender role expectations, physically disabled women relate strongly to the cultural notion of femininity to resist the disability aspect of their identity. Consequently, they do not absolutely challenge the repressive norms of femininity despite being educated and economically independent women.

    Abstract: "This book charts the path to revitalisation for trade unions in Australia, the USA, the UK, and Italy. It examines the examples of innovation and digital campaigning that are enabling unions to build new forms of worker power - and overcome decades of declining membership wrought by neoliberalism, globalisation, and hostility from employers and the state. The study evaluates the responses of unions in each country to falling membership levels since the 1980s. It considers the US 'organising model' and its adoption in Australia and the UK, comparing this with the strategies of Italian unions which have been more deliberately focused on precarious and migrant workers. The increasing reliance of US unions on community alliances, as seen in the 'Fight for $15' and similar campaigns, is scrutinised along with new union prototypes like Hospo Voice in Australia, the Independent Workers' Union of Great Britain and SI Cobas in Italy. The book includes an in-depth analysis of union responses to the gig economy in the four countries, and the emergence of self-organised worker collectives to combat this exploitative business model. The vital role played by unions in defending the interests of workers during the COVID-19 pandemic is also examined. As well as highlighting the most successful union initiatives to meet the challenges of the past 30 years, the book assesses the strengths and deficiencies of the legal framework for union representation in the four nations. It identifies the labour law reforms needed to rebuild collectivism, but argues that more is needed than favourable laws. This cross-national study provides a rich basis for identifying the combination of reforms, strategies and linkages required to ensure that unions can remain relevant for a new generation of digitally-active workers"--

    Abstract: This book thoroughly discusses the concept of sovereign immunity in international law and how the problems normally associated with the said subject can be resolved in order to promote justice. In part one, the author shows through a careful analysis of the law that restrictive immunity does not have vox populi in developing countries and that it lacks usus. He also argues that forum law, i.e., the lex fori is a creature of sovereignty and between equals before the law, only what is understood and acknowledged as law among states must be applied in as much as the international legal system is horizontal. Furthermore, the state never acts as a juridical or natural person and, therefore, in logical terms, its functions cannot be divided into potere politico and persona civile as a prelude to determine jurisdiction. The said Italian doctrine, therefore, is ex-facie erroneous, and that a simple dichotomy between absolute immunity and restrictive immunity wholly predicated on the nature test alone would not be helpful in promoting justice. Hence the contextual approach, arbitration and comparative dominant theory are suggested as essential tools to supplement the UN Treaty on state immunity when it comes into force because some states are likely to stay out of the said treaty regime. In part two, of the book, the author provides a comprehensive analysis of international criminal justice i.e., the prosecution of heads of state before international tribunals and the means or tools available to defend these leaders. To that end, it is apposite that a distinction between immunity ratione personae and immunity ratione materiae be made clear, whereby emphasis must be placed on their differences and legal consequences in regard to the verticality of international tribunals and foreign criminal jurisdiction of states e.g., the ICC and SCLC. The author further argues forcefully that the law has not changed and that despite the reforming zeal of some important states to change the law, in reality however, the law remains almost intact wholly structured on the presumption of immunity subject to certain limited acknowledged exceptions duly supported by opinio juris, thus eclipsing the suggestion by some scholars, senior courts and international tribunals that the law be instead based on an acknowledged exception to a presumed jurisdiction. This is because international law is a decentralized public order system without a compulsory jurisdiction.

    Abstract: This timely book comprehensively examines whether the worst human rights violations directed specifically at sexual and gender minorities are punishable under international criminal law, as codified in the Rome Statute of the International Criminal Court. Drawing on general rules of interpretation, the development of human rights for sexual and gender minorities, and the social construction of gender, this monograph reveals that the worst crimes committed against persons because of their sexual orientation or gender identity can amount to crimes against humanity, particularly the crime of persecution under Article 7(1)(h). It also shows how legislators can be held individually criminally responsible for passing laws that criminalize consensual same-sex sexuality. The book not only makes a significant and original contribution to the literature but is also highly relevant for international criminal law practitioners, since, so far, no cases regarding this topic exist.     Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

    Abstract: Based on economic theory, this book offers a novel approach to understanding the marital dynamic, explaining the substantive regulation of marriage and modeling legal outcomes at the conflict of laws level. On this ground the author proposes specific rules to regulate the party autonomy for the law governing the relationship, and to determine the applicable law in absence of a choice of law agreement for key aspects of the relationship: maintenance obligations, divorce, and property regime.The book is organized in two parts, preceded by an introductory section, where the results achieved by the harmonization of conflict rules promoted by the EU are examined critically.     Abstract: “Can I choose to die?” As the number of requests for euthanasia and physician-assisted suicide continues to rise, human rights law faces a new conflict: the right to die vs. the right to life… The right to die or, in other words, ‘the right to choose the time and manner of one’s own death’ is a question of personal autonomy and its limits. This book provides a comprehensive understanding of the right to die and sheds light on its possible future under the European Convention on Human Rights. After setting a clear framework by defining the key terminology, the book takes a two-part approach to achieving its aim. The first part focuses on the right to die in practice by examining selected jurisdictions. Switzerland, which is famous for its assisted suicide organizations, and the Netherlands, which was the first country to legalize euthanasia, are examined in detail. Belgium, Germany, the United Kingdom, and -as an exception to the Convention perspective - Canada are also included. While this examination offers a better understanding of what the right to die looks like in practice, it also provides insights on the slippery slope argument, which serves as a counterweight to personal autonomy, without making a definitive statement on its validity. This part also illustrates the different paths that led or did not lead to the right to die in practice. The second part is an analysis of the European Court of Human Rights case law on the right to die. The Court has made important statements in only very cases, while its caution when approaching such a delicate and controversial topic among its 47 members is understandably emphasized. This analysis of the Court’s approach to the balancing of personal autonomy against other interests allows us to take a look back at the practice in more permissive jurisdictions through the lens of the Convention. Taken together, the book’s two parts provide valuable lessons for countries that decide to practice assisted dying, which are outlined in the conclusion. In addition, given that a purely legal approach can only offer a partial picture, the book argues that an interdisciplinary approach would be much more favorable in terms of providing the necessary basis for the right to die debate.

    Abstract: "Based on legal-philosophical research informed by insights gleaned from empirical case studies, this book sets out three central claims about integration requirements as conditions for attaining increased rights (ie family migration, permanent residency and citizenship) in Europe: (1) That the recent proliferation of these (mandatory) integration requirements is rooted in a shift towards 'individualised' conceptions of integration. (2) That this shift is, on the one side, counterproductive as it puts barriers to participation and inclusion of newcomers (who will most likely permanently settle) and on the other, normatively problematic, insofar as it produces status hierarchies between native-born and immigrant citizens. (3) That the remedy for this situation is a firewall that disconnects integration policy from access to rights. The book draws on perspectives on immigrant integration in multiple EU Member States and includes legal and political reactions to the refugee/migrant crisis"--

    Abstract: The idea that a claim for international protection can be rejected on the basis that the claimant behave 'discreetly' in their country of origin has remained resilient in asylum claims based on sexual orientation, but also other grounds of claim. This is significant because requiring an asylum-seeker to forgo the reason for which they are persecuted questions the very rationale of refugee protection. This book represents the first principled examination of concealment in refugee law. Janna Wessels connects the different strands of the long-standing debate in both common and civil law jurisdictions and scholarship concerning the question of whether and under which circumstances a claimant must conceal to avoid persecution. In so doing, Wessels uncovers a fundamental tension at the core of the refugee concept. By using sexuality as a lens, this study breaks new ground regarding sexual orientation claims and wider issues surrounding the refugee definition.

    Abstract: This book inves­ti­gates an Egyp­tian scandal about paternity and marriage in the years 2004 to 2007. It asks about legal change in Egyp­tian family law and Islamic juri­s­pru­dence while also inqui­ring into the effects of media coverage. The study draws from a variety of sources, inclu­ding news­paper arti­cles, court rulings, univer­sity text­books, fatwas, etc. The resul­ting presen­ta­tion tells two diffe­ring stories about the affair of Hind al-Ḥinnāwī and Aḥmad al-Fīšāwī: one is dramatic and promises change, the other is tech­nical and purports routine. In order to make sense of this, both stories are situated in a discourse analytical frame­work. Buil­ding on the distinc­tion of special discourse, inter­dis­course, and elemen­tary discourse, the combined analysis of both tales deve­lops a new perspec­tive on the issue of change and arrives at an inter­dis­cur­sive view of legal deve­lop­ment in Egyp­tian family law

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: More and more people are turning to human rights courts to seek protection against prejudice, disadvantage or exclusion on account of their cultural and economic particularities. Human rights courts are thus increasingly faced with the difficult task of deciding these cases, which raise a number of complex and contested legal questions. 0To what extent can courts accommodate cultural diversity, protect all kinds of groups or interfere in socio-economic policy? This book argues that one of the problems encountered in dealing with such cases is the courts? tendency to assess them from a compartmentalised or fragmentary perspective. 0To counterbalance this tendency, an innovative, integrated and person-centered approach to adjudicating claims of cultural difference and economic disadvantage is put forward. Drawing on the concepts of intersectionality, indivisibility and normative interdependence, the book presents specific notions and methods for approaching the appreciation of rights holders, harms and norms in a holistic manner. A wide selection of case law from both the European and the Inter-American courts of human rights supports the normative framework developed in this book. The sample mostly includes cases brought by Muslims, Roma, Travelers, indigenous peoples, afro-descendants and people living in poverty

Adopting an original theoretical framework, the author demonstrates that legal empowerment can change the distribution of power in a given refugee situation, facilitating the exercise of individual agency and assisting in the reform of the opportunity structure available to the individual. Thus, by helping to increase the capability of refugees to participate actively in the decisions that most affect their core rights and interests, participatory approaches to legal empowerment can also assist in securing other capabilities, ultimately ensuring that refugees are able to live dignified lives while in protracted exile. Ultimately, the book demonstrates that legal empowerment for refugees can bring lasting benefits in establishing trust between refugees, the state, and local communities. It will be of interest to researchers within the fields of refugee studies, international law, development studies, and political science, as well as to policy makers and practitioners working in the fields of refugee assistance and humanitarian intervention"--

    Abstract: Mit dem Betreuungsrecht soll die Selbstbestimmung rechtlich betreuter Menschen gestärkt und deren Entmachtung auf das erforderliche Maß beschränkt werden. Inwieweit diese Zielsetzung realisierbar ist, wird hier anhand der Rollen von Macht und Pädagogik untersucht. Die an Michel Foucault angelehnte Machtanalyse ergibt ein hohes Machtpotenzial rechtlicher Betreuer, eine geringe staatliche Kontrolle sowie ein Risiko von unbewussten und bewussten Machtmissbrauch. Zudem wird die Notwendigkeit einer pädagogisch geprägten Professionalisierung der rechtlichen Betreuung diskutiert. Diese sollte darauf abzielen, dass Betreute aktiv dabei unterstützt werden, die teils weitreichenden Sachverhalte nach ihren Möglichkeiten zu erfassen und so ihren eigenen Willen bilden zu können. Dieser Handlungsbedarf erlangt vor dem Hintergrund des zu erwartenden starken Anstiegs der Betreuungszahlen besondere Relevanz.

    Abstract: Jakob Weissinger nähert sich der zentralen rechtstheoretischen Frage nach einem Begriff subjektiver Rechte, indem er fundamentale Strukturelemente normativer Praxis und deren Verflechtungen analysiert. Darauf aufbauend entwickelt er einen eigenen Begriff, der bewährte Ansätze grundlegend in Frage stellt.
    Abstract: Just what is a right? Jakob Weissinger approaches this central problem of jurisprudence by critically examining the purpose of such normative concepts and carefully analysing the fundamental elements of normative practice like actions, decisions, the logic of norms and values as well as the plurality of normative practice. Interlinking the insights won, he outlines a stand-alone theory of rights which emphasises the empowering dimension of rights in the process of justifying (legal) rules. Not only does he question well-established theories, such as Hohfeld's famous analysis of legal conceptions, but aspires to set future debates in legal theory, especially those surrounding rights such as the long-standing dispute between interest and choice theories of rights, on new and more solid meta-theoretical ground.

    Abstract: Durch die Analyse der Beziehungen zwischen NGOs, dem UN-Sicherheitsrat und den Menschenrechten wird in diesem Buch argumentiert, dass sowohl NGOs als auch der UN-Sicherheitsrat die Menschenrechtssemantik selektiv in Bezug auf die Orte und Akteure, die sie betreffen, anwenden. Es beobachtet Wissen und Macht als Kräfte, die sich gegenseitig beeinflussen, was eine Erklärung dafür sein kann, wie Global Governance funktioniert. Darüber hinaus untersucht das Buch die Idee, dass Recht, abgesehen von der Durchdringung traditioneller Strukturen, von der Basis der Gesellschaft in Richtung institutioneller Bereiche aufsteigen kann. In diesem Zusammenhang schlägt der Autor vor, dass das Zusammenspiel zwischen nichtstaatlichen Akteuren und politischen Institutionen die Bottom-up-Prozesse im Zusammenhang mit der Gesetzgebung und der Gestaltung politischer Entscheidungen fördert. In Anbetracht der kritischen Probleme, die sowohl die NRO als auch der UN-Sicherheitsrat in Bezug auf Repräsentation und Reaktionsfähigkeit haben, stellt die Arbeit fest, dass die Beziehung zwischen ihnen auf eine ausschließende, technokratische und arkane Weise stattfindet.

    Abstract: This book documents the findings and recommendations of research into the question of how IT laws should develop on the understanding that today's information and communication technology is shaped by cloud computing, which lies at the foundations of contemporary and future IT as its most widespread enabler.     Abstract: Amicus curiae participation in international courts is steadily growing since the late 1990 despite lack of clarity on the concept's nature, function and utility in international dispute settlement. Does amicus curiae infuse international judicial proceedings with alternative views, including the public interest in a case, as often advocated by NGOs? Does it increase the legitimacy and transparency of international dispute settlement, or the coherence of international law? Or is it an unhelpful impostor that impedes negotiated solutions and derails the proceedings at the expense of the parties to advance its own agenda? By way of an empirical-comparative analysis of the laws and practices of the ICJ, the ITLOS, the ECtHR, the IACtHR, the IACtHPR, WTO panels and the Appellate Body, and investment arbitration the dissertation examines the status quo of amicus curiae before international courts and tribunals to determine if the current amicus curiae practice is of added value to international proceedings and international dispute settlement in general. The dissertation shows that there is no common concept of international amicus curiae, but that amicus curiae before the international courts examined share a few characteristics. A proposed functional systematization highlights overlaps and diverging uses of the concept before international courts and helps scholars and practitioners to assess the opportunities and limits of the concept. Analysis of the concept's current regulatory framework and its substantive effectiveness reveals a hesitation in particular by courts with a strong adversarial tradition to take into account the views of a non-party despite the positive experience with the concept in regional human rights courts. The dissertation concludes that neither the expectations nor the concerns attached to amicus curiae participation in international proceedings have materialized. It argues that the concept can contribute to improved decisions and decision-making in international dispute settlement if regulated and used properly

    Abstract: This Companion provides a broad, historically informed introduction to the study of the US constitutional system. In place of the usual laundry lists of cases, doctrines, and theories, it presents a picture of the constitutional system in action, with separate sections devoted to constitutional principles, organizational structures, and the various legal and extra-legal 'actions' through which litigators and average citizens have attempted to bring about constitutional change. Finally, the volume covers a number of subjects that are rarely discussed in works aimed at a general audience, but which are critical to ensuring that constitutional rights are honored in the day-to-day lives of citizens. These include standing and causes of action, suits against officeholders, and the inner workings of the Foreign Intelligence Surveillance Court (FISC). This Companion places present-day constitutional controversies in historical context, and offers insights from a range of disciplines, including history, political science, and law.
