    Abstract: In 2015 many camps were opened to accommodate newly arriving migrants in Berlin. Christian Sowa studies this form of accommodation. Moving beyond an exclusive focus on borders and migration, he argues that camp accommodation must be thought of and studied as part of the urban context and as a specific form of housing. The study provides an in-depth case study, discusses policy alternatives, argues for »housing for all instead of camps«, and contributes to bringing urban and migration studies into public discussion. In times of new waves of migration, the topic of migrant accommodation within urban environments remains highly relevant today.

    Abstract: Detroit’s shrinking size has resulted in an overabundance of single-family homes in this single-family home metropolis. On the one hand, the abandoned houses have led to Detroit being declared bankrupt, while on the other hand, it has paved the way for other ways of working and living with and using houses and vacant lots that may not make an immediate profit on the real estate market and may be considered “unreal” estate (Herscher, 2012), but that keep people together as a neighborhood and community. This thesis looks at the circumstances in which residents become homeowners and how as homeowners, artists and immigrants ascribe value to single-family homes and how they make place with their homes in a neighborhood context. The focus is on homeowners’ everyday practices that determine the value of single-family homes when the latter is not considered use value or economic value in a real estate market, but recognized as a social and cultural value.

    Abstract: This book offers a comprehensive analysis of the legal questions that arise for the legislative branch when implementing the crime of aggression into domestic law. Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

    Abstract: This book explores the impact of 'Fintech' on the information asymmetry between the financial regulator and the markets. It details the growing regulatory mismatch and how Fintech exacerbates the “pacing problem”, where the regulator struggles to keep up with innovation. With information as a point of reference, the book adds a new perspective on the latest phenomenon in financial innovation and presents a novel framework for navigating structural changes in the financial sector. Based on this analysis, a number of proposals to reduce the information gap and avoid regulatory mismatch are discussed. Thereby, new and promising regulatory concepts, such as regulatory sandboxes and SupTech applications are also covered.     Abstract: Diese Dissertation untersucht das Ausmaß der Spendenbereitschaft für Flüchtlinge und dessen individuelle sowie kontextuelle Korrelate unter einheimischen Deutschen zwischen Jahren 2015 und 2018. Die Dissertation enthält drei originäre empirische Beiträge. Im ersten empirischen Beitrag wird das Ausmaß des Spendenverhaltens für Flüchtlinge, seine regionale Variation und Veränderung im Zeitverlauf beschrieben. Das Kapitel beschreibt, wie Einstellungen und soziodemografische Merkmale mit Spenden für Flüchtlinge zusammenhängen. Ich stelle fest, dass die Spenden für Flüchtlinge besonders hoch waren bei Frauen, Menschen mit einer höheren sozioökonomischen Position und Personen mit einer positiven Einstellung zur Einwanderung. Im zweiten und dritten empirischen Beitrag werden mögliche kontextuelle korrelate für solche Spenden betrachtet. Dies wird erreicht durch die Kombination von individuellen Panelerhebungsdaten mit Sozialindikatoren auf Stadtteilebene. Die zweite empirische Studie prüft, ob das Geben an mit der Anwesenheit von Ausländern im Wohnumfeld korreliert ist. Umgebung korreliert. Es gibt keine robusten Beweise dafür, dass die Anwesenheit von verschiedenen Gruppen von Ausländern negativ mit Spenden für Flüchtlinge verbunden ist. Im letzten empirischen Kapitel wird untersucht, ob die ethnische Segregation auf Stadtebene und der Wohnsitz in den Clustern der Einheimischen negativ mit Spenden für Flüchtlinge verbunden ist. Einerseits wird manchmal eine negative Korrelation zwischen der Segregation auf Stadtebene und Spenden für Flüchtlinge festgestellt. Es gibt jedoch keine Hinweise darauf, dass Einheimische die in den Clustern der Einheimischen leben, weniger wahrscheinlich Flüchtlinge unterstützen.
    Abstract: This doctoral thesis analyzes extent of charitable giving to refugees and its individual as well as contextual correlates among native Germans between years 2015 and 2018. Dissertation contains three original empirical contributions. In the first empirical contribution the extent of charitable giving to refugees, its regional variation and change over time is described. Chapter describes how attitudes and socio-demographic characteristics are correlated with giving to refugees. I find that giving to refugees was especially high among females, people of higher socio-economic position and those holding positive attitude towards immigration. In the second and third empirical contributions possible environmental correlates of such giving are considered. This is achieved by combining panel survey data with fine-grained neighborhood level social indicators. Second empirical study tests if giving to refugees is correlated with presence of foreigners in the residential environment. There is lack of robust evidence that presence of various foreigner groups is negatively associated with giving to refugees. Final empirical chapter investigates if city-level ethnic segregation and residing in the clusters of natives is negatively associated with donating to refugees. On the one hand, negative correlation between city-level segregation and giving to refugees is sometimes found. There is, however, no evidence that natives living in the clusters of natives are less likely to support refugees with their donations.

    Abstract: Based on economic theory, this book offers a novel approach to understanding the marital dynamic, explaining the substantive regulation of marriage and modeling legal outcomes at the conflict of laws level. On this ground the author proposes specific rules to regulate the party autonomy for the law governing the relationship, and to determine the applicable law in absence of a choice of law agreement for key aspects of the relationship: maintenance obligations, divorce, and property regime.The book is organized in two parts, preceded by an introductory section, where the results achieved by the harmonization of conflict rules promoted by the EU are examined critically. The first part puts forward economics as the approach to better comprehend the couple's expectations of marriage. It focuses on explaining the economic rationale behind marriage, underlining its contractual nature, and demonstrating that common legal remedies as well as several mandatory and default rules in modern marriage law indeed have an economic foundation. The second part is devoted entirely to the conflict of laws dimension of marriage. The book will therefore be of interest to scholars and lawmakers attempting to launch reforms anywhere or looking for a practical and novel application of economics in the analysis of the law.

    Abstract: “Can I choose to die?” As the number of requests for euthanasia and physician-assisted suicide continues to rise, human rights law faces a new conflict: the right to die vs. the right to life… The right to die or, in other words, ‘the right to choose the time and manner of one’s own death’ is a question of personal autonomy and its limits. This book provides a comprehensive understanding of the right to die and sheds light on its possible future under the European Convention on Human Rights. After setting a clear framework by defining the key terminology, the book takes a two-part approach to achieving its aim. The first part focuses on the right to die in practice by examining selected jurisdictions. Switzerland, which is famous for its assisted suicide organizations, and the Netherlands, which was the first country to legalize euthanasia, are examined in detail. Belgium, Germany, the United Kingdom, and -as an exception to the Convention perspective - Canada are also included. While this examination offers a better understanding of what the right to die looks like in practice, it also provides insights on the slippery slope argument, which serves as a counterweight to personal autonomy, without making a definitive statement on its validity. This part also illustrates the different paths that led or did not lead to the right to die in practice. The second part is an analysis of the European Court of Human Rights case law on the right to die. The Court has made important statements in only very cases, while its caution when approaching such a delicate and controversial topic among its 47 members is understandably emphasized. This analysis of the Court’s approach to the balancing of personal autonomy against other interests allows us to take a look back at the practice in more permissive jurisdictions through the lens of the Convention. Taken together, the book’s two parts provide valuable lessons for countries that decide to practice assisted dying, which are outlined in the conclusion. In addition, given that a purely legal approach can only offer a partial picture, the book argues that an interdisciplinary approach would be much more favorable in terms of providing the necessary basis for the right to die debate.

    Abstract: This book thoroughly discusses the concept of sovereign immunity in international law and how the problems normally associated with the said subject can be resolved in order to promote justice. In part one, the author shows through a careful analysis of the law that restrictive immunity does not have vox populi in developing countries and that it lacks usus. He also argues that forum law, i.e., the lex fori is a creature of sovereignty and between equals before the law, only what is understood and acknowledged as law among states must be applied in as much as the international legal system is horizontal. Furthermore, the state never acts as a juridical or natural person and, therefore, in logical terms, its functions cannot be divided into potere politico and persona civile as a prelude to determine jurisdiction. The said Italian doctrine, therefore, is ex-facie erroneous, and that a simple dichotomy between absolute immunity and restrictive immunity wholly predicated on the nature test alone would not be helpful in promoting justice. Hence the contextual approach, arbitration and comparative dominant theory are suggested as essential tools to supplement the UN Treaty on state immunity when it comes into force because some states are likely to stay out of the said treaty regime. In part two, of the book, the author provides a comprehensive analysis of international criminal justice i.e., the prosecution of heads of state before international tribunals and the means or tools available to defend these leaders. To that end, it is apposite that a distinction between immunity ratione personae and immunity ratione materiae be made clear, whereby emphasis must be placed on their differences and legal consequences in regard to the verticality of international tribunals and foreign criminal jurisdiction of states e.g., the ICC and SCLC. The author further argues forcefully that the law has not changed and that despite the reforming zeal of some important states to change the law, in reality however, the law remains almost intact wholly structured on the presumption of immunity subject to certain limited acknowledged exceptions duly supported by opinio juris, thus eclipsing the suggestion by some scholars, senior courts and international tribunals that the law be instead based on an acknowledged exception to a presumed jurisdiction. This is because international law is a decentralized public order system without a compulsory jurisdiction.

    Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

    Abstract: This timely book comprehensively examines whether the worst human rights violations directed specifically at sexual and gender minorities are punishable under international criminal law, as codified in the Rome Statute of the International Criminal Court. Drawing on general rules of interpretation, the development of human rights for sexual and gender minorities, and the social construction of gender, this monograph reveals that the worst crimes committed against persons because of their sexual orientation or gender identity can amount to crimes against humanity, particularly the crime of persecution under Article 7(1)(h). It also shows how legislators can be held individually criminally responsible for passing laws that criminalize consensual same-sex sexuality. The book not only makes a significant and original contribution to the literature but is also highly relevant for international criminal law practitioners, since, so far, no cases regarding this topic exist.     Abstract: This comparative and multi-level study of state responses is confronted with huge complexity. Almost all existing theoretical and methodological approaches -such as secularism (including multiple secularisms or post-secularism)- do not take these complexities seriously into account, focusing on one concept only (wrong Leitdifferenz). They neglect different meanings of terms for agents in the field and they neglect the importance of different levels of governance, times, issues and minorities. This study, however, highlights minimally necessary complexity without drowning in this complexity. It draws clear conceptual, theoretical and methodological lessons, also in a broader sense for the study of governance of religious and cultural diversity and for the governance of migrations. Van den Breemer’s fascinating study of the religious governance of cemeteries by secular state institutions proves that cemeteries have become a privileged site to observe empirically the various ways in which the dual accommodation of religious-secular and multi-religious diversity takes place in today’s post-secular Western European societies.     Abstract: Gender equality rights are fundamental human rights that are recognized in international human rights treaties, which bind states to eliminate gender discrimination formally and in practice. Islam is recognized as the official religion in the constitutional law of Islamic countries; religious scholars have the competence to interpret Islamic law, resulting in creating a series of unequal rights for women based on Islamic law, which often continues in legal structures. Nevertheless, a majority of Islamic countries have ratified the international human rights treaties but have put reservations in place based on Sharia concerning articles on gender equality rights. Therefore, this dissertation addressed that the degree to which international law has accepted gender discrimination for religious reasons.

    Abstract: Blick ins Buch In Europa tritt verstärkt ein "neuer antizionistischer Antisemitismus" auf. Mit dem Verblassen der Erinnerung an die Shoah, Sekundärantisemitismus und dem Glauben an ein geeintes Europa, das nationalstaatliche Denkweisen überwindet, findet sich ein zunehmend kritisches Denken gegenüber dem Zionismus. Israel wird zum "Juden unter den Völkern". Antisemitische Kritik am Staat Israel kommt aus verschiedenen Richtungen: von rechts (Rassismus), links (Kapitalismuskritik und Antizionismus) und vom politischen Islam (Übernahme antijüdischer Polemik aus religiösen Schriften). Diese Mischung zeigt sich in sogenannten "Cultural Codes", in Form von teils christlich, teils muslimisch geprägten Motiven, die jedoch einen antisemitischen Hintergrund haben. "Auge um Auge, Zahn um Zahn", "Rache" oder "Wallstreet" sind solche codierten Schlagwörter, die sich regelmäßig auch in deutschsprachigen Medien finden. Raimund Fastenbauer vergleicht erstmals die Verwendung solcher antisemitischen Motive im Internet und anderen Medien islamisch geprägter Länder mit jenen in deutschsprachigen Printmedien und weist so den starken Einfluss nach, den diese "Codes" in der öffentlichen Wahrnehmung haben

    Abstract: The idea that a claim for international protection can be rejected on the basis that the claimant behave 'discreetly' in their country of origin has remained resilient in asylum claims based on sexual orientation, but also other grounds of claim. This is significant because requiring an asylum-seeker to forgo the reason for which they are persecuted questions the very rationale of refugee protection. This book represents the first principled examination of concealment in refugee law. Janna Wessels connects the different strands of the long-standing debate in both common and civil law jurisdictions and scholarship concerning the question of whether and under which circumstances a claimant must conceal to avoid persecution. In so doing, Wessels uncovers a fundamental tension at the core of the refugee concept. By using sexuality as a lens, this study breaks new ground regarding sexual orientation claims and wider issues surrounding the refugee definition.

    Abstract: "Based on legal-philosophical research informed by insights gleaned from empirical case studies, this book sets out three central claims about integration requirements as conditions for attaining increased rights (ie family migration, permanent residency and citizenship) in Europe: (1) That the recent proliferation of these (mandatory) integration requirements is rooted in a shift towards 'individualised' conceptions of integration. (2) That this shift is, on the one side, counterproductive as it puts barriers to participation and inclusion of newcomers (who will most likely permanently settle) and on the other, normatively problematic, insofar as it produces status hierarchies between native-born and immigrant citizens. (3) That the remedy for this situation is a firewall that disconnects integration policy from access to rights. The book draws on perspectives on immigrant integration in multiple EU Member States and includes legal and political reactions to the refugee/migrant crisis"--

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

Adopting an original theoretical framework, the author demonstrates that legal empowerment can change the distribution of power in a given refugee situation, facilitating the exercise of individual agency and assisting in the reform of the opportunity structure available to the individual. Thus, by helping to increase the capability of refugees to participate actively in the decisions that most affect their core rights and interests, participatory approaches to legal empowerment can also assist in securing other capabilities, ultimately ensuring that refugees are able to live dignified lives while in protracted exile. Ultimately, the book demonstrates that legal empowerment for refugees can bring lasting benefits in establishing trust between refugees, the state, and local communities. It will be of interest to researchers within the fields of refugee studies, international law, development studies, and political science, as well as to policy makers and practitioners working in the fields of refugee assistance and humanitarian intervention"--

    Abstract: "In many contemporary and popular forms of religious practice, digital technology and the spiritual are inseparable. Ranging from streaming broadcasts of spiritual possessions to screenings of mass prayer conferences in stadiums, spirits and divinities now have new forms in which they can materialise. By offering the notion of 'digital spirits', this book critically attends to the intersections of digital media and spiritual beings. It also puts forward a new performative perspective on how they interact. Taking cues from the work of Stewart Hoover and Heidi Campbell, among others, the book begins with an outline of the current debates around religion, performance and digital media. It then moves on to examine how mediality and religion, where embodied practices are carried out alongside virtual practices, work together in contemporary Asia. These case studies focus on lived religious practices in combination with various forms of media, and so help demonstrate that digital technology in particular reveals the layered processes of spirituality in practice. Gods and divinities have always relied on media to manifest, and this book is a fascinating exploration of how digital media has continued that tradition and taken it in new directions.     Abstract: Centering Pakistan in a story of transnational Islam stretching from South Asia to the Middle East, Simon Wolfgang Fuchs offers the first in-depth ethnographic history of the intellectual production of Shi'is and their religious competitors in this 'Land of the Pure.' The notion of Pakistan as the pinnacle of modern global Muslim aspiration forms a crucial component of this story. It has empowered Shi'is, who form about twenty percent of the country's population, to advance alternative conceptions of their religious hierarchy while claiming the support of towering grand ayatollahs in Iran and Iraq.     Abstract: This book inves­ti­gates an Egyp­tian scandal about paternity and marriage in the years 2004 to 2007. It asks about legal change in Egyp­tian family law and Islamic juri­s­pru­dence while also inqui­ring into the effects of media coverage. The study draws from a variety of sources, inclu­ding news­paper arti­cles, court rulings, univer­sity text­books, fatwas, etc. The resul­ting presen­ta­tion tells two diffe­ring stories about the affair of Hind al-Ḥinnāwī and Aḥmad al-Fīšāwī: one is dramatic and promises change, the other is tech­nical and purports routine. In order to make sense of this, both stories are situated in a discourse analytical frame­work. Buil­ding on the distinc­tion of special discourse, inter­dis­course, and elemen­tary discourse, the combined analysis of both tales deve­lops a new perspec­tive on the issue of change and arrives at an inter­dis­cur­sive view of legal deve­lop­ment in Egyp­tian family law

    Abstract: Diese Doktorarbeit untersucht die Rolle die Bürgerinitiativen an der Schnittstelle zwischen städtischen und digitalen Räumen spielen können. Sie folgt drei Untersuchungslinien. Zunächst wird untersucht, wie die Forschung zu aus Graswurzelbewegungen entstandenen Alternativen für nachhaltige und gerechte Städte von einer besonderen Art des digitalen Gemeinguts profitieren kann: des kollaborativen kartografischen Mappings. Zweitens wird die Verflechtung von digitalen Gemeingütern mit physischen städtischen Gemeingütern untersucht, um zu verstehen, wie die gemeinsame Nutzung zu transformativen Effekten in der Stadt führen kann. Drittens wird versucht, das transformative Potenzial der Gemeingüter als ein Narrativ des Wandels für nachhaltige und gerechte Städte im digitalen Zeitalter zu bewerten. Methodisch stützt die Arbeit sich auf Aktionsforschung, primäre Einzelfallstudien sowie eine vergleichende Fallstudienanalyse. Ein vorläufiges Ergebnis ist die Identifizierung von basisgeleiteten kollaborativen Mappings – hier betrachtet als Initiativen des gemeinsamen Wirkens (Commoning) – als wertvolle Wissensquellen zu alternativer Stadtökonomik. Die Hauptergebnisse zwingen uns dazu, das klassisch-naturalistische Verständnis des Gemeinguts in Frage zu stellen, welches dazu neigt, ein Gemeingut als gegeben zu betrachten. Stattdessen wäre es für die Forschung von Vorteil, einen gemeinsamen Prozess zu untersuchen: die Rückgewinnung, Schaffung und Nutzung gemeinsamer städtischer Ressourcen. Über die künstliche Trennung zwischen materiellen und immateriellen Facetten des Gemeingutes hinaus lässt sich (urbanes) Commoning am besten als eine relationale Praxis in Pflege und Aufbau von Partnerschaften für die Reproduktion von Leben in der Stadt definieren. Dies ist umso wichtiger, dass digitale Werkzeuge zwar neue Potenziale eröffnen können, aber im Gegensatz zu anderen Diskursen (Sharing Economy, Smart Cities) für das Commoning der Stadt nicht von zentraler Bedeutung sind.
    Abstract: This doctoral research investigates the role that citizen-driven initiatives can play at the intersection of the urban and digital spaces. It follows three lines of investigation. First, it explores how research about grassroots alternatives for sustainable and just cities may benefit from a particular type of digital commons: collaborative cartographic mappings. Second, it investigates the intertwin of digital commons with physical urban commons to understand how commoning may lead to transformative impacts in the city. Third, it seeks to evaluate the transformative potential of the commons as a narrative of change for sustainable and just cities in the digital age. Methodologically, it relies on action research, primary individual case-studies as well as a comparative case-study analysis. A preliminary result is the identification of grassroots-led collaborative mappings – seen as commoning initiatives – as valuable sources of knowledge about alternative urban economies. Main results compel us to question the classical/naturalist understanding of the commons that tends to consider it as a given. Instead, research would benefit to investigate a commoning process: the reclaiming creation, and use of shared urban resources. And, further, transcending artificial divides between the tangible and intangible facets of the commons, (urban) commoning is best defined as a relational practice of caring for and building partnerships for the reproduction of life in the city. This is all the more important that another significant result of the present work is that, while they may open new potential, digital tools are not central to commoning the city, in contrast other discourses (Sharing Economy, Smart Cities). Epistemologically, the author recommends aligning the effort of researching urban commoning to the Diverse/Community Economies research agenda which calls for performative studies of more-than-human urban commoning-communities.

    Abstract: This book sets out a rationale for the compatibility of Islam and Feminism and shows that Islamic Feminism is a diverse and valuable lens through which to analyse religion and gender. In addition, including scholarship written in Arabic, it promotes the decolonisation of knowledge production around Islam, gender and sexuality. Islamic feminism is a field of study that has been marginalised both in contemporary Islamic discourse and in feminist discourse. This study counters this marginalisation in two ways. Firstly, it enumerates the diversity of approaches used in Islamic feminist scholarship. Secondly, it foregrounds voices that are often neglected in discussions of Islam, gender and sexuality by highlighting and contrasting the work of two key scholars: Kecia Ali based in the USA and Olfa Youssef based in Tunisia. The book suggests that in addition to geo-political positioning, language, as a prior-text', also influences an individual's personal interpretation of Islamic feminism. This comparison, therefore, enables broader issues to be dissected, such as the interrelationships between life experiences, strategies of resistance to patriarchal and other forms of oppression, and the production of knowledge. This is a unique study of Islamic Feminism that will be of great use to any scholar of Religion and Gender, Islamic Studies, Gender Studies and the Sociology of Religion

    Abstract: How the Jewish and Christian communities that emerged in the early Roman Empire navigated a 'Hellenistic' world is a longstanding and unsettled question. Recent scholarship on the intellectual cultures that developed among Greek speaking subjects of Rome in the so-called Second Sophistic as well as models for culture and competition informed by mathematical and economic game theories provide new ideas to address this question. This study offers a model for a kind of culture-making that accounts for how the cultural ecosystems of the Roman Empire enabled these religious communities to win legitimacy and build discourses of self-expression by competing on the same cultural fields as other Roman subjects. By considering a range of texts and figures-including Justin Martyr, Tatian, the 'second' Paul of the Acts of the Apostles, Lucian of Samosata, 4 Maccabees, and Favorinus of Arelate-this study contends that competing for legitimacy enabled those fledgling religious communities to express coherent cultural identities and secure social credibility within the complex milieu of Roman Imperial society

    Abstract: More and more people are turning to human rights courts to seek protection against prejudice, disadvantage or exclusion on account of their cultural and economic particularities. Human rights courts are thus increasingly faced with the difficult task of deciding these cases, which raise a number of complex and contested legal questions. 0To what extent can courts accommodate cultural diversity, protect all kinds of groups or interfere in socio-economic policy? This book argues that one of the problems encountered in dealing with such cases is the courts? tendency to assess them from a compartmentalised or fragmentary perspective. 0To counterbalance this tendency, an innovative, integrated and person-centered approach to adjudicating claims of cultural difference and economic disadvantage is put forward. Drawing on the concepts of intersectionality, indivisibility and normative interdependence, the book presents specific notions and methods for approaching the appreciation of rights holders, harms and norms in a holistic manner. A wide selection of case law from both the European and the Inter-American courts of human rights supports the normative framework developed in this book. The sample mostly includes cases brought by Muslims, Roma, Travelers, indigenous peoples, afro-descendants and people living in poverty

    Abstract: There is a palpable tension between the planning and implementation of climate targets, for instance as regards renewable energy resources - among which wind power plays a significant role. This tension comes to the fore when assessing the effectiveness of spatial planning approaches to the deployment of wind energy. Planning approaches to wind power are evaluated in three European urbanised regions: South Holland (Netherlands), Lower Austria (Austria) and East Flanders (Belgium). Each region has adopted wind energy targets and introduced zoned areas in its regional planning agenda. The theory of ‘new institutionalism’ and the comparative case study method are the two pillars of this investigation. Zoning may be considered as a form of institutional design, for the introduction of zoned areas not only determines the territorial spread of wind turbines, but also configures socio-organisational entities and actors involved in implementation (developers, local residents, consultants, and public authorities). The comparative approach demonstrates that planning choices in the three case studies often yield to the concerns of higher governance levels, clearly prioritising energy policy goals above local, contextual values. In consequence, ‘zones for wind energy’ do not always gain public acceptance at the local level. Indeed, the foundation for locally supported wind energy zones is laid down in the planning process itself. This process has the potential to institutionalise a trade-off between collective purposes at a higher governance level and locally changing contexts and values. On the other hand, planning agents need to be more aware of path dependencies in spatial decisions concerning renewable energy. One of the wider implications of the planning approaches studied is that they restrict, rather than promote development. Thus, when zoned areas had to be redrawn, local opposition or ‘unwillingness’ seriously restricted the amount of leeway for reaching a consensus about alternative locations. The reason was that the formal planning exercise (zoning wind energy) implied more than an impartial territorial designation: it also communicated social consensus on land-use decisions of ´where wind turbines would come´ and ´where they would not´

    Abstract: The Hui are predominantly Muslim Chinese who claim ancestry from Persian and Arabicspeaking regions in Central Asia and the Middle East. According to the 2010 census, the Hui are the largest Muslim group in China and its third largest ethnic minority with a total population of 10.6 million. Due to their extensive geographic distribution and longterm acculturation by the atheist Han majority, the question of Hui identity is rarely raised in humanities and social sciences both in China and abroad. This book examines Hui identity in the rural area of Ningxia Hui Auto­no­mous Region, while taking account of China's rapid modernisation and indu­s­tria­li­sa­tion in the twentyfirst century. Speci­fi­cally, it focuses on the massive internal migra­tion of rural popu­la­tions, which has been playing an essen­tial role in the socioe­co­nomic life of Chinese peasants in the past few decades. Based on field data collected between 2011 and 2013 among the Jahriyya Hui, the study seeks to clarify the impacts of migra­tion on the Hui's ethno­re­li­gious iden­tity by inves­ti­ga­ting three key issues: the Hui's purity concept, fasting and their belief in the after­world. In rela­tion to these refe­rence points, reli­gious rituals, inclu­ding comme­mo­ra­tion cere­mo­nies and the Ramadan fast as well as their chan­ging forms and values, are illu­s­t­rated and analysed. The thesis shows that Islam conti­nues to play a crucial part in drawing boun­da­ries and main­tai­ning iden­tity for the Hui both before and after migra­tion. However, popu­la­tion move­ments in Ningxia are resul­ting in increased inter­ac­tions between Hui and Han popu­la­tions as well as between Hui from diverse ›menhuan‹ (Sufi paths). Conse­qu­ently, the Hui's unique ›menhuan‹ aware­ness is being weakened and their purity concept subjected to many queries, doubts, ambi­gui­ties, and tensions

    Abstract: Dejan Petkov explores the tramway renaissance in Western Europe from a socio-technical standpoint and focuses on the development in Germany, France, and England. A multiple case analysis reveals the drivers, impact forces, actors and interest constellations behind the tramway renaissance in these countries and demonstrates the large variations in local systems and their style. A key finding is that there can be quite different paths to the success of tramway systems, but this success usually comes at a cost and can have a comprehensive character only if the systems are considered an integral part of the overarching strategies and concepts for urban and regional development.     Abstract: Durch die Analyse der Beziehungen zwischen NGOs, dem UN-Sicherheitsrat und den Menschenrechten wird in diesem Buch argumentiert, dass sowohl NGOs als auch der UN-Sicherheitsrat die Menschenrechtssemantik selektiv in Bezug auf die Orte und Akteure, die sie betreffen, anwenden. Es beobachtet Wissen und Macht als Kräfte, die sich gegenseitig beeinflussen, was eine Erklärung dafür sein kann, wie Global Governance funktioniert. Darüber hinaus untersucht das Buch die Idee, dass Recht, abgesehen von der Durchdringung traditioneller Strukturen, von der Basis der Gesellschaft in Richtung institutioneller Bereiche aufsteigen kann. In diesem Zusammenhang schlägt der Autor vor, dass das Zusammenspiel zwischen nichtstaatlichen Akteuren und politischen Institutionen die Bottom-up-Prozesse im Zusammenhang mit der Gesetzgebung und der Gestaltung politischer Entscheidungen fördert. In Anbetracht der kritischen Probleme, die sowohl die NRO als auch der UN-Sicherheitsrat in Bezug auf Repräsentation und Reaktionsfähigkeit haben, stellt die Arbeit fest, dass die Beziehung zwischen ihnen auf eine ausschließende, technokratische und arkane Weise stattfindet.

    Abstract: Jakob Weissinger nähert sich der zentralen rechtstheoretischen Frage nach einem Begriff subjektiver Rechte, indem er fundamentale Strukturelemente normativer Praxis und deren Verflechtungen analysiert. Darauf aufbauend entwickelt er einen eigenen Begriff, der bewährte Ansätze grundlegend in Frage stellt.
    Abstract: Just what is a right? Jakob Weissinger approaches this central problem of jurisprudence by critically examining the purpose of such normative concepts and carefully analysing the fundamental elements of normative practice like actions, decisions, the logic of norms and values as well as the plurality of normative practice. Interlinking the insights won, he outlines a stand-alone theory of rights which emphasises the empowering dimension of rights in the process of justifying (legal) rules. Not only does he question well-established theories, such as Hohfeld's famous analysis of legal conceptions, but aspires to set future debates in legal theory, especially those surrounding rights such as the long-standing dispute between interest and choice theories of rights, on new and more solid meta-theoretical ground.

    Abstract: Mit dem Betreuungsrecht soll die Selbstbestimmung rechtlich betreuter Menschen gestärkt und deren Entmachtung auf das erforderliche Maß beschränkt werden. Inwieweit diese Zielsetzung realisierbar ist, wird hier anhand der Rollen von Macht und Pädagogik untersucht. Die an Michel Foucault angelehnte Machtanalyse ergibt ein hohes Machtpotenzial rechtlicher Betreuer, eine geringe staatliche Kontrolle sowie ein Risiko von unbewussten und bewussten Machtmissbrauch. Zudem wird die Notwendigkeit einer pädagogisch geprägten Professionalisierung der rechtlichen Betreuung diskutiert. Diese sollte darauf abzielen, dass Betreute aktiv dabei unterstützt werden, die teils weitreichenden Sachverhalte nach ihren Möglichkeiten zu erfassen und so ihren eigenen Willen bilden zu können. Dieser Handlungsbedarf erlangt vor dem Hintergrund des zu erwartenden starken Anstiegs der Betreuungszahlen besondere Relevanz.

The United States justifies its blockage with allegations of judicial overreach, claiming that the Appellate Body in its jurisprudence has not complied with the WTO treaties

    Abstract: What would it mean to imagine Islam as an immanent critique of the West? Sayyid Ahmad Khan lived in a time of great tribulation for Muslim India under British rule. By examining Khan's work as a critical expression of modernity rooted in the Muslim experience of it, Islam as Critique argues that Khan is essential to understanding the problematics of modern Islam and its relationship to the West. The book re-imagines Islam as an interpretive strategy for investigating the modern condition, and as an engaged alternative to mainstream Western thought. Using the life and work of nineteenth-century Indian Muslim polymath Khan (1817-1898), it identifies Muslims as a viable resource for both critical intervention in important ethical debates of our times and as legitimate participants in humanistic discourses that underpin a just global order. Islam as Critique locates Khan within a broader strain in modern Islamic thought that is neither a rejection of the West, nor a wholesale acceptance of it. The author calls this "Critical Islam". By bringing Khan's critical engagement with modernity into conversation with similar critical analyses of the modern by Reinhold Niebuhr, Hannah Arendt, and Alasdair MacIntyre, the author shows how Islam can be read as critique

    Abstract: "Guided by awareness of the problematic relationship between polemical text and history, Opponents and Identity in Philippians seeks to establish a historical context for the letter to the Philippians. The study re-evaluates the relationship between Paul and the Jerusalem-based Christ-believing community from the time of the Jerusalem meeting and the Antioch incident. A more detailed analysis centers on how this relationship is reflected in Philippians. The book argues that Paul was continuously on problematic terms with the Jerusalem community, which means that they are the Jewish Christ-believing opponents referred to at several places in Philippians as well. With the help of the social identity approach (SIA), the book illustrates how Paul engages in identity formation through polemical rhetoric in his last letter"--
