    Abstract: To further benefit from trade liberalisation, developed and developing countries must get their policies right, in trade and other spheres, such as the web of domestic regulations that affect commerce within and between countries. In the run-up to the November 1999 WTO Ministerial in Seattle, Washington, and a possible new round of multilateral trade negotiations, a Conference on trade and competition was held on 29-30 June 1999 at the OECD to explore the various options towards better coherence between trade and competition policies. This Conference provided OECD countries and 30 non-member countries, academics and representatives of business, trade unions and advocacy groups a unique opportunity to discuss ways to strengthen trade and competition policies in the interests of more open global markets. They examined the effects of trade measures on competition. They also debated whether private anticompetitive practices, and certain domestic regulations, point to the need for multilateral trade and competition rules. This publication summarises those discussions and includes keynote addresses by Sir Leon Brittan and U.S. Assistant Attorney General for Antitrust Joel Klein, as well as an issues paper drafted by the OECD Secretariat to serve as a background note for the Conference.

    Abstract: The constitution establishes the principle of legal continuity of the Republic of Estonia, which was proclaimed independent on 24 February 1918, occupied by the Soviet Union on 17 June 1940 and subsequently annexed thereto on 6 August 1940. The constitution reflects the idea of legal restoration, which served as a basis for the return to independence and liberation from the Soviet Union on 21 August 1991. The Riigikogu has recently begun to consider the results of a review carried out by the government expert committee on constitutional revision. The committee’s proposals, if adopted, would not alter the basic principles of the constitution but would reinforce the parliamentary and constitutional system of government. The most important proposals are the establishment of a separate constitutional court, reinforcement of civil control over the defence forces, and attribution of the powers of an ombudsman to the legal chancellor. Moreover, amendments may have to be made in view of the accession of Estonia to the European Union; these amendments touch upon a basic principle of the constitution, the principle of sovereignty.

    Abstract: As the 20th century draws to a close, powerful forces of change are converging that could set the stage for a long, sustained economic boom in the next few decades -- the transition to a knowledge-based society with its potentially huge productivity gains; the emergence of more deeply integrated, global markets for goods, services, capital and technology; and a fast-growing environmental awareness that could greatly accelerate the shift to new, less resource-intensive production and consumption patterns. The result could be several decades of above-average economic growth, substantial increases in income and wealth, and significant improvements in well-being across the world. But what will it take to unleash these dynamic forces? Not only will it call for a range of initiatives to establish the rules and frameworks for guiding the transition to a sustainable global knowledge economy, but above all, it will require exceptional efforts among decision makers in government, business and society at large to encourage continuous innovation, creativity and high levels of investment, and to promote bold new approaches to closer international co-operation and institution building.     Abstract: On 2 April 1997, the National Assembly adopted a new Constitution. It replaced the Constitutional Law on the Relationships between the Legislative and Executive Powers and on Local Self-government, known as the Small Constitution, which had been in force since 1992. The new Constitution was approved in a popular referendum on 26 May 1997, signed by the President and published on 16 July 1997. The Constitution finally entered into force on 17 October 1997. The new Constitution had been under discussion since 1989, but several earlier attempts to adopt a new constitution had failed. According to the new constitutional provisions, constitutional amendments may only be proposed by at least one-fifth of the statutory number of Sejm deputies, by the Senate, or by the President of the Republic. A Bill to amend the Constitution needs to be adopted by the Sejm by a majority of at least two-thirds of the votes and in the presence of at least half of the statutory number of deputies, and by the Senate by an absolute majority of votes in the presence of at least half the statutory number of senators. If changes are to be made to chapters I, II or XII of the Constitution, the initiators of such changes may call for a popular confirmatory referendum. Poland has traditionally been part of the continental law tradition. Even under communism, the country did not break with this legal heritage. The legal system of Poland is based on a hierarchy of legal norms.

This paper reviews recent trends in market openness indicators and assesses whether barriers to international trade and investment have risen. It finds that tariffs, the most transparent form of protection, have fallen steadily over a long period. Usage of non-tariff barriers also declined up to 1996.     Abstract: Climate change is an increasing concern across the world. In 1997, a number of countries, including most OECD countries, agreed the Kyoto Protocol, which sets targets for future emissions of greenhouse gases that drive climate change. But the Kyoto Protocol left many decisions to be made, and while these are being discussed the clock ticks and the date for meeting the targets draws closer. Uncertainties are even larger as to policy requirements over the longer term. The Kyoto targets in themselves will do little to avert climate change but are best seen as a first step towards ambitious worldwide action. This puts the focus on how to achieve worldwide consensus for taking action and the economic impacts such action may have. Whatever action is taken, and on the basis of available scientific evidence, some climate change may take place in any case, raising questions about its impacts and how best to adjust. What are the main outstanding issues concerning the Kyoto Protocol? What will it cost to implement the Protocol? How can it be done so as to minimise costs? How could economic burdens be shared among countries so as to achieve broad consensus for global action? What will be the impact of such climate change as may happen and how should policy be set so as to smooth adjustment? This publication presents analysis which bears on the above questions as well as others in the climate change debate.     Abstract: Severe environmental problems were a key issue in the protests that marked the end of communist regimes in Central and Eastern Europe and the former Soviet Union. This groundbreaking book provides new insights into the interaction between economic policy reforms, environmental protection efforts and environmental conditions in the region's subsequent transition to market-based economies and democratic societies over the past eight to ten years. The unique contribution of the book is its synthesis of a vast amount of information and cumulative experience together with detailed examples and case studies to provide a coherent analysis of the challenges and achievements in institutional strengthening and policy reform, environmental policy instruments, environmental financing, and environmental management in enterprises. It also reviews the development of domestic public participation and international co-operation for the safeguarding of the region's environment and discusses trends in industrial pollution and biodiversity protection. The book shows that economic reforms provided a crucial stimulus for environmental improvement, leading to reductions in high pollution levels. Moreover, several countries have strengthened their domestic environmental policies, institutions, and financing, resulting in further improvements. Nonetheless, many serious problems remain, and others have grown worse over the transition period: in many countries of the former Soviet Union in particular, economic crises and political stagnation have impeded environmental protection efforts. Continued partnerships between governments of the region, OECD donor countries, international financial institutions and organisations, environmental NGOs, businesses and trade unions, as well as public support for these, will be essential to reinforce the environmental improvements achieved thus far.

    Abstract: The future of rural areas is high on the domestic and international policy agenda. Restructuring of the agricultural sector, and accompanying reform of agricultural policies, and the challenge of meeting sustainable development objectives are key preoccupations in OECD countries. In the search for forward-looking and durable policy strategies, building on natural and cultural amenities is emerging as an important area of policy action, one which complements traditional, agriculture-oriented rural policies and places rural policy in the broader territorial development arena. In most rural areas, the potential of many natural and cultural resources remains untapped. Harnessing such amenities, however, involves striking a balance between use and conservation. In many cases, maintenance of rural amenities depends on a degree of local economic activity -- without it there is a danger of degradation. At the same time, over-exploitation risks spoiling, often irreversibly, the essential value of the amenity. Because many natural and cultural features are public goods, with limited markets and hazy property rights, public policies are needed to strike the delicate balance between supply and demand.

These developments motivate countries to review and monitor the operation of their tax rules in this area, notably the interaction of domestic tax rules with tax systems and practices in other countries, to ensure that policy goals are being addressed. This book analyses the taxation of cross-border portfolio investments by means of collective investment institutions. Possible tax distortions specific to the area of collective investment institutions are identified for a representative group of OECD countries. The analysis and calculations contained in the book, while illustrative and not capturing the full richness of the possible permutations under tax regimes, draw out key tax distortions, neutrality conditions and policy options.

    Abstract: Fears of the prospect of growing social exclusion have become important concerns in recent years for many countries. Improving the quality of education and the standards attained by students to improve employability is one of the tools being used to prevent exclusion. However, changing social realities are leaving young children and students more exposed than ever to failure at school and unemployment. It is becoming increasingly clear that communities, education systems, schools and teachers are not equipped to deal with the many problems which arise and when social or health services become involved conflicts of interest can arise leading to actions which are not always in the clients' best interests. The necessity to provide greater co-ordination among these services, to improve their efficiency and effectiveness and to provide a seamless support to meet the holistic needs of students and their families is now becoming more accepted. Such an approach, inter alia, is community-based, emphasises prevention rather than being crisis-oriented, is customer-driven rather than being focused on an agency, and is accountable through outcomes rather than inputs. For many, better co-ordination of services is seen as the only solution available which is commensurate with our present democratic societies. All of the papers in this book were presented at a conference held in Toronto, Canada. They are original and have been written by policy-makers from different ministries, researchers from different disciplines and clients who come variously from Canada, Finland, France, Germany, the Netherlands, Spain, the UK, and the USA.

Identified as a priority by the Japanese Government as early as 1994, considerable progress in regulatory reform has already been made. But today it is essential that regulatory reform be deepened and accelerated. This report calls for a "sharp break" with the regulatory practices and doctrines of the past. Energetic measures, including both sectoral reform and reform of framework conditions, need to be adopted quickly to complete the transition from a state-led growth model, now largely ineffective, to a market-driven growth model, the only model capable of laying the foundation for sustainable competitiveness and prosperity in Japan. Japan was one of the first OECD countries to request a broad review by the OECD of its national regulatory practices and domestic regulatory reforms. This report -- the result of intensive assessment by the OECD and review by its Member countries -- is unique in that it presents an integrated assessment of regulatory reform in framework areas such as the macroeconomic context, the quality of the public sector, competition policy and enforcement, and integration of market openness principles in regulatory processes, and in sectors such as electricity and telecommunications. The policy recommendations present a balanced plan of action for both short and longer-term based on best international regulatory practices.

    Abstract: Plutonium and minor actinide burning or recycling in thermal and fast reactors is being studied in many countries with the aim of maintaining and developing fuel cycle options which can be adjusted to changing demands and constraints. The conclusions of the technical sessions are synthesised and the results of a round table discussion on international co-operation are presented.

    Abstract: Despite the fact that the freight transport market in Europe almost doubled in volume over the period 1970 to 1995, growth in the inland waterway sector has remained stagnant. Until now the waterways have primarily been used to transport goods produced by sectors that have been hard hit by industrial restructuring. However, the past does not necessarily hold the key to the future. Waterways can be readily incorporated into logistics chains in which regular supply streams and low transport costs are more important than speed. The transportation of hazardous materials and container transport also offer promising markets. The Round Table identified a number of policy measures which could help to promote development in the inland waterways sector (discontinuation of scrapping policies, support for the grouping of enterprises and the creation of co-operatives, incentives for private-sector investment). Reading the proceedings of this Round Table offers an opportunity to look at the inland waterways in a wholly new light which shows that there is a genuine future for this mode provided that operators are prepared to become entrepreneurs.

    Abstract: The OECD Development Assistance Committee's 1999 review of Denmark's development aid programmes and policies. It finds that Denmark is the top performer among the 22 Members of the OECD Development Assistance Committee (DAC) in terms of the volume of its official development assistance (ODA). Denmark’s ODA volume has been maintained at around 1% of gross national product (GNP) since 1992, thanks to a strong consensus and public support for development aid. The quality of Denmark’s aid effort is also most impressive. In particular this high volume of aid is supported by a strong long-range strategy, whose directions - and especially the central emphasis on poverty reduction - are in harmony with the Development Partnership Strategy agreed by the DAC in 1996. Denmark has succeeded in concentrating its bilateral assistance on 20 countries, 18 of which are low-income or least developed countries. Aid is concentrated on sectors of particular relevance to the poor and on programmes in the poorest areas of these countries, thus working towards the goal of poverty reduction. Since 1996, Denmark has pursued a policy of "active multilateralism" to promote its concerns for increased focus and efficiency in multilateral aid programmes. However, there is no clear evidence that this policy has greatly advanced the intended results, as it still reflects a largely unilateral approach more than a joint endeavour. Denmark is a long-standing positive example of the integration of the aid system with other aspects of foreign relations. This approach combines policy coherence in Denmark’s relations with developing countries and professionalism in the aid programme, enhanced by an effective decentralisation of responsibility to embassies in programme countries. This integrated approach has helped Danish development assistance (Danida) to pioneer since 1994 a shift in aid implementation from project support to Sector Programme Support (SPS), an approach which should be mutually reinforcing with the DAC’s Partnership Strategy. It implies also a stepping up in co-ordination activities, both between donors and with partner countries, which Denmark has fully backed.

Regulatory reform is the most recent element in the reshaping of the Dutch model. Following reforms to labour markets and the social welfare system in the 1980s, Dutch governments in the 1990s have sought a "new balance between protection and dynamism" based on competition policy, regulatory reform, and market openness. Today, the Netherlands ranks among the top OECD countries by many measures of economic performance, including employment growth. Though still in its early phases, regulatory reform has already produced major gains for the Netherlands in terms of competitiveness, flexibility, and consumer benefits. Yet major challenges are still to be faced. Some important reforms have been slow, indicating that the balance between domestic consensus-building and policy responsiveness is still being adjusted in the modern Dutch model. Further reforms in many areas will bring important gains in boosting the employment rate, improving sectoral performance, and providing social protection at lower cost. The Netherlands is one of the first OECD countries to request a broad review by the OECD of its national regulatory practices and domestic regulatory reforms. This report -- the result of intensive assessment by the OECD and review by its Member countries -- is unique in that it presents an integrated assessment of regulatory reform in framework areas such as the macroeconomic context, the quality of the public sector, competition policy and enforcement, and integration of market openness principles in regulatory processes, and in sectors such as electricity and telecommunications. The policy recommendations present a balanced plan of action for both short and longer-term based on best international regulatory practices.

While opening their economies to trade and investment is a necessary condition for developing countries to achieve sustained high growth and reduce poverty, it is by no means a sufficient condition. Initiating a sustainable dynamic growth requires sound, market-oriented economic policies; appropriate social policy frameworks, including strong investment in human capital and adequate social safety-nets; and good governance. But, as shown by the Asian financial crisis, weaknesses in any of these basic foundations make even successful developing economies vulnerable to crisis. OECD countries have a pivotal role to play in facilitating developing countries' efforts to fully exploit the benefits of open trade and investment. The key objective of this report is to identify how OECD countries can promote policy coherence by improving the framework for international investment and capital flows; addressing environmental concerns; facilitating participation of developing countries in the global information society; and enhancing the coherence of development co-operation policies. To be successful, policy coherence implies the broader agenda of consciously taking account of the needs and interests of developing countries in order for them to be effective rather than vulnerable and marginal players in the global economy.

    Abstract: Integrity is a fundamental pre-condition for governments seeking to provide a trustworthy and effective framework for the economic and social life of their citizens. The cost of corruption to governments is increasingly well known and documented. It is now widely recognised that countering corruption and promoting public integrity are critical for sustained economic development. Corruption, however, is not a cause but a consequence: as much the result of systemic failure as individual dishonesty. Preventing corruption is as complex as the phenomenon of corruption itself and a combination of interrelated mechanisms, including sound ethics management systems, specific prevention techniques and effective law and law enforcement, are needed for success. It is therefore invaluable, in taking action against corruption, to have an understanding of the relevant legal, civil service and management systems employed by a range of countries to counter corruption. This book surveys the measures that 15 OECD countries are currently using to protect their domestic public institutions against corruption. It is a companion to Ethics in the Public Service: Current Issues and Practice, OECD 1996.

    Abstract: The financial crisis in Asia has brought to the fore the question of the appropriate policies for recovery and for future sustainable development. One area of particular importance is the treatment of foreign investors. Foreign direct investment has played a leading role in many of the economies of the region, particularly in export sectors, and has been a vital source of foreign capital during the crisis. The four countries reviewed in this study - Indonesia, Malaysia, the Philippines and Thailand - have all tended to welcome inward investment for its contribution to exports but have often been less willing to open up the domestic market to such investors. This study discusses the role assigned to foreign firms in the development strategies of the four countries in the past and looks at how a more balanced approach to the treatment of foreign investors could contribute to a more sustainable development path in the future.

Hence the need for coherent trade and competition policies. Trade and competition policies each seek to improve the allocation of resources; they complement and reinforce each other. These papers from the OECD Joint Group on Trade and competition examine aspects of those complementarities and relationships and in so doing draw on the OECD’s capacity to analyse questions in a multidisciplinary way.     Abstract: OECD's 1999 review of regulatory reform in Mexico. It finds that regulatory reform has been key to the transformation of the Mexican economy over the past 15 years. Formerly inward-looking and heavily regulated, the Mexican economy today is relatively open and market-based. The rapid pace, broad scope, and depth of regulatory reforms exceed those of most OECD countries. These reforms have already produced major benefits for Mexico, not least by increasing economic flexibility so that Mexico rebounds more quickly from economic crises. But benefits of reforms have been slowed by the macroeconomic crises of the 1990s. Sustained attention is needed now to complete and implement reforms to establish conditions for vigorous market competition and entry, while strengthening the capacity of the Mexican state to use high quality and transparent regulatory instruments in carrying out public policies. A multi-year period of policy stability supportive of market-led growth could produce enduring and broad-based benefits for Mexican consumers and businesses. Mexico was one of the first OECD countries to request a broad review by the OECD of its national regulatory practices and domestic regulatory reforms. This report -- the result of intensive assessment by the OECD and review by its Member countries -- is unique in that it presents an integrated assessment of regulatory reform in framework areas such as the macroeconomic context, the quality of the public sector, competition policy and enforcement, and integration of market openness principles in regulatory processes, and in sectors such as telecommunications. The policy recommendations present a balanced plan of action for both short and longer-term based on best international regulatory practices.

However, besides the everyday congestion faced by motorists, differences of opinion are now starting to appear with regard to the scale of the problem and the ways in which it should be tackled. This Round Table attempted to define congestion and to determine the scale of the problem. It addressed the trends in congestion and the consequences of those trends. The Round Table then considered possible solutions to the congestion problem. Considering the extent of this problem in the European context, the Round Table report sheds light on one of the most visible malfunctions of transport systems.

    Abstract: The launch of the euro reinforces the foundations for unprecedented economic integration encompassing 11 countries, 16 per cent of world GDP and 290 million people. For the first time, the OECD has studied the euro-area as a fully-fledged economic entity and has analysed the intensive preparations that led to the single currency, as well as the economic issues raised by its introduction. Despite the macroeconomic convergence already achieved and the institutional framework that has been established, the fact is that many uncertainties remain. An approach to co-ordinating monetary and budgetary policies that is up to the issues at stake has still to be fully defined. And the euro area's ability to absorb economic shocks must be assessed and strengthened. In this respect it is vital for labour markets to become more flexible and adaptable if they are to compensate for the loss of national monetary autonomy which EMU implies and if adjustment is not to be at the expense of jobs. A special chapter discusses the obstacles to geographic labour mobility and the rigidity of wage setting mechanisms. These are some of the challenges that must be faced in the years to come, and this study discusses them in the light of the most penetrating and informative analysis today’s economists can provide. It does not prescribe set remedies, but drawing on analyses and figures never published before, attempts to identify the best policies for ensuring the success of the monetary union. This is a complex study that takes a hard look at the issues and will be of great interest to anyone wishing to understand the economic mechanisms at work.

    Abstract: This paper examines the main determinants of the decision to retire from the labour market in OECD countries, and in particular the role of social security systems in driving down the labour-force participation rate of older people in recent decades. It demonstrates that old-age pension systems in virtually all OECD countries in the mid-1990s made it financially unattractive to work after the age of 55, and the implicit tax on continued work has risen strongly since the 1960s in most countries. Financial disincentives to continued work have been amplified by various de facto early-retirement programmes, including unemployment-related and disability schemes.     Abstract: In this paper, a structural VAR model is estimated for 11 EU countries in order to assess the effect on the government deficit ratio of four independent economic disturbances: supply, fiscal, real private demand and monetary shocks. Based on the estimated distribution of these shocks, stochastic simulations are performed to derive estimates of cyclically-adjusted budget balances that would have to be maintained to avoid breaching the Stability and Growth Pact’s 3 per cent of GDP deficit limit over different time horizons and with varying degrees of confidence. In order to capture the movement in the deficit stemming from automatic stabilisation, fiscal policy shocks are turned off during the simulations. The results suggest that, for the majority of countries, if governments were to aim for a cyclically-adjusted budget deficit between 1.0 and 1.5 per cent of GDP, the actual deficit would, with a 90 per cent likelihood, remain within the 3 per cent limit over a three-year horizon ...

    Abstract: The Republic of Bulgaria was restored in January 1990, following amendments to the communist-inspired constitution, which put an end to the single-party rule of the Bulgarian Communist Party, and the conclusion of the round table agreement between the communist government and representatives of the democratic opposition. The new Bulgarian Constitution was adopted by the Grand National Assembly in July 1991. It marked the return to multi-party democracy. Since the beginning of democratic transformation in Bulgaria, four general parliamentary elections have been held, including the elections to what was then called the Grand National Assembly of June 1990, and elections to the national assembly in October 1991, December 1994 and, most recently, April 1997. The next parliamentary elections are scheduled for spring 2001. Presidential elections were held in January 1992 and November 1996. The next elections for the presidency will be held in autumn 2001. Democratic local government elections took place in October 1991 and in November 1995. The next round of local elections will take place in the autumn of 1999.
