    Abstract: This report reviews the achievements of the Korean 3-Year Market Reform Road Map. This assessment is carried out in light of the OECD’s previous recommendations to shift KFTC priorities and resources toward core competition problems related to efficiency goals and away from its historic focus on conglomerate financial structure and governance; the need for further improvements in investigative powers and a clearer rule against hard-core cartels; implementation of recommendations to repeal exemptions for “small” business and exclusions of professional services and co-ordination with sectoral regulators about competition problems; and recent institutional changes to join the KFTC with the system for applying consumer protection law. This report was the basis for a monitoring review in the October 2006 session of the Competition Committee.

    Abstract: Circumstantial evidence is employed in cartel cases in all countries. The better practice is to use circumstantial evidence holistically, giving it cumulative effect, rather than on an item-by-item basis. Complicating the use of circumstantial evidence are provisions in national competition laws that variously define the nature of agreements that are subject to the law. There are two general types of circumstantial evidence: communication evidence and economic evidence. Of the two, communication evidence is considered to be the more important. Economic evidence is almost always ambiguous. It could be consistent with either agreement or independent action. Therefore it requires careful analysis. National treatment of cartels, such as whether they are prosecuted as crimes or as administrative violations, can affect the burden of proof that applies to the cases, and hence the use of circumstantial evidence. It can be difficult to convince courts to accept circumstantial evidence in cartel cases, especially where the potential liability for having violated the anti-cartel provisions of the competition law is high. There are circumstances in countries that are relatively new to anti-cartel enforcement that could affect the extent to which they rely on circumstantial evidence in their cases.

    Abstract: Corporate sanctions rarely are sufficiently high to be an optimal deterrent against cartels. Sanctions against natural persons can thus complement them. There is no systematic evidence proving the deterrent effects of sanctions on individuals, and/or assessing whether such sanctions can be justified. There is a trend among countries to accept as self-evident that individual sanctions, including imprisonment, can be a useful part of effective anti-cartel enforcement. If a country provides for individual sanctions, a strong argument can be made that relatively short prison sentences are the most cost effective deterrent. However, there are also reasons why countries may provide for longer prison sentences, most importantly that only longer statutory sentences adequately express a society’s condemnation of hard-core cartels. In addition to increasing levels of deterrence, sanctions against individuals can be a powerful incentive for individuals to reveal information about existing cartels and to cooperate in investigations. International law does not recognise the principle of double jeopardy that would prevent authorities in different countries from prosecuting the same person for participation in the same cartel. Nevertheless, where cartels are investigated in a multi-jurisdictional context, jurisdictions may consider arrangements to ensure that only one of them prosecutes an individual.

    Abstract: China has made enormous progress in developing the modern legal and regulatory foundation for the market economy. The private sector is now the main driver of growth, and new laws have gone a long way toward establishing private property rights, competition, and mechanisms for entry and exit comparable to those of many OECD countries. At the same time important challenges remain, including further clarification of the scope of state ownership, reform of relations among central and local governments, firmer establishment of the rule of law, and strengthening of regulatory institutions and processes. This review of China's regulatory system focuses on the overall economic context for regulatory reform, the government’s capacity to manage regulatory reform, competition policy and enforcement, and market openness. The review also examines the regulatory framework in the electricity, water and health care sectors. As for OECD countries, the review follows a multidisciplinary and highly interactive approach. A number of OECD instruments and policies are used in this assessment, although the review also takes into account the specific challenges faced by the Chinese authorities. The review includes a comprehensive set of policy recommendations.

    Abstract: Few other countries feature the combination of very low population densities and difficult topography that hinders communication, in addition to a variety of contrasting climates. But the “Nordic welfare model” strives, with a good degree of success, to offer equal living conditions to all citizens by providing proper access to quality public services across the country. This comes, however, at great cost. This publication asks whether such a model can be sustainable in the long run, when population ageing and the reduction of petroleum reserves will reduce the leeway that the rapidly growing economy offers. It examines whether competitiveness and innovation could be further developed, given the high share of resource-based and traditional activities and whether urban policy could be better integrated into regional policy so as to better harness the energy of regional growth engines in different areas of the country, including the northern most parts. Lastly, it looks at whether impending regional reform could facilitate the necessary adaptations by transferring more power to regional councils.

    Abstract: The OECD has collectively underlined the importance of a high quality regulatory environment since the mid 1990s when the Council adopted the 1995 Recommendation on Improving the Quality of Government Regulation and its checklist as the first international standard on regulatory quality, and the 1997 Report on Regulatory Reform and its Principles of good regulation. Since 1997, the OECD has carried out a series of country reviews based on the Principles, which have documented progress in the reviewed countries. Twenty OECD countries have been reviewed. The reviews have been multidisciplinary, covering the broader economic context, competition policy, market openness, sectoral reforms and not least, the development of regulatory policies, institutions and tools to build up capacities for a high quality rule-making environment supportive of economic growth and specific policy goals. This work has been complemented by the specific research of the OECD secretariat and others on issues such as the link between product market reforms and economic performance. Ample material is now available to take stock of the progress made in OECD countries and to reflect on the continued relevance of the 1997 Principles.This report integrates more detailed papers prepared for the committees and working parties responsible for regulatory management, competition policy and trade, as well as relevant papers prepared for the Economic Policy Committee.

    Abstract: Istanbul has established itself as the industrial, financial and logistics centre of the country, producing almost one-third of the national output and absorbing the bulk of foreign direct investment. And, on the international scale, Istanbul ranks among the fastest growing OECD metro-regions. This review finds, however, that Istanbul faces challenges that could hamper its ambition to become a Eurasian hub for finance, logistics, culture and tourism, as well as its development in general. Its economy is changing from one driven by labour-intensive activities to one based on knowledge industries, while traditional and labour-intensive sectors (e.g. textiles and its supply chain) are shifting only gradually and slowly to other complementary industry segments. Constraints on human capital development and the informal sector have hindered productivity levels and increased income disparities. Over-migration is putting a burden on Istanbul’s transport, public infrastructure and housing, and earthquake risk management. The scale and variety of these challenges necessitates improving local public management and implementing a national strategy to reduce regional disparities and to limit migration flows towards the megalopolis.

    Abstract: This report discusses some of the major challenges for implementing regulatory reform, from a political perspective. It draws on the experience and evidence from OECD countries when building the case through results and developing strategies for advocacy. This reflects the discussions held at the meeting of the OECD Group on Regulatory Policy in December 2007. Core issues concern how to create common consensus to support reform and which actors and stakeholders to integrate in achieving reforms. The issues of sequencing and timing are extremely relevant. Citizens and the public also need to understand the economic benefits of liberalisation and cutting red tape through regulatory reform.Specific chapters analyse the role of advocacy bodies for regulatory reform, as well as competition policy, discussing their incentives and how they operate in their cultural, political and administrative environment. They should perform as powerful drivers and engines for reform, integrating the views of business and citizens in the policy process. An example is presented in the form of a case study assessing the political viability of centralised regulatory oversight as an institutional strategy based on the United States’ experience. Concerning competition policy advocacy, the report examines the balance between institutional independence and objectivity that are necessary for enforcement. Finally, the report also discusses how to interlink market-openness policies in a friendly reform environment, drawing lessons from trade and structural adjustments. It underlines the role of international negotiations as a means to harness political support, and strategies for managing and sustaining market-opening reforms.

    Abstract: Cutting red tape and improving business conditions have become a priority in OECD countries. This study of the Netherlands, one of the front runners in the field, is the first OECD review of a national programme for administrative simplification. The report describes the key features of the Dutch programme including the measurement of burdens, the use of incentives and targets, and whole-of-government co-ordination. The OECD assessment of the success of the Dutch programme is based on comparisons with other countries, and on evidence of the economic impact of reforms. The report explores options for future work on administrative simplification relevant to OECD countries, highlighting the need to communicate better with stakeholders, cover compliance costs for business more broadly, and look at burdens on citizens and administrations.

    Abstract: This review discusses the challenges and opportunities of German rural areas. Significant differences between East and West persist and many of these have clear rural dimensions. Factors such as CAP reforms, ageing of the German population and migration trends will also have important rural implications. Many of these issues involve more than rural policy, but rural policy has a place in resolving all of the key issues. However, for rural policy to be an effective part of the policy process it will have to evolve beyond the existing limits in Germany. This review states that Germany's current approach to rural development and rural policy is mainly sectoral and thus does not fully capture the diversity of rural regions.

    Abstract: The harmful effects of corruption on social welfare, political stability and economic development are well known. Combating corruption has gained high priority throughout the world. In Asia and the Pacific, 23 countries have in the framework of the ADB/OECD Anti-Corruption Initiative for Asia and the Pacific endorsed an Anti-Corruption Action Plan that guides reform efforts in their respective countries. While significant progress has been achieved under this regional instrument, the battle against corruption is far from being won. To address this challenge and build capacity in a number of particularly crucial areas, the ADB/OECD Initiative's fourth regional anti-corruption conference has brought together more than 150 senior representatives of governments, the private sector, non-governmental organizations and the international development partner community in Kuala Lumpur, Malaysia, in December 2003. The present publication offers an insight into the most recent national anti-corruption strategies of Asian and Pacific countries, as well as an overview of preventive and enforcement policies and practices developed in the region, with special focus on the management of conflict of interest, measures aimed at curbing corruption in public procurement, corporate ethics, whistleblower protection, forensic accounting and mutual legal assistance.

    Abstract: Despite general agreement that consumers benefit from lower prices that are not predatory, several nations have laws against loss leader sales even when they are unlikely to foreclose competition. These laws appear to protect competitors rather than competition. The Competition Committee’s roundtable discussion in October 2005 focused on efforts to reform or remove laws against loss leader sales and efforts to prevent such restrictions from being enacted. The Secretariat background note argued that rules again loss leader sales should be sunsetted because they are likely to harm consumers and protect inefficient competitors, fail to account adequately for pro-competitive business justifications for loss leader sales and detract from economic dynamism and growth. Japan, Germany and France, defended their rules against price competition, although France was in the process of a reform. Members of a second group of countries were working to remove laws against loss leader sales. The nations in a third group with no law against loss leader sales, reported efforts by groups of competitors to have such rules applied either at the national level or at the state/provincial level. Both the consumer and business submissions argued that prohibiting loss leader sales is likely to harm consumers and protect competitors, rather than competition.

    Abstract: Because of the high percentage of national income and government budget typically associated with the provision of hospital services and because there is substantial evidence of hospital services could often be delivered more efficiently than they are, a number of OECD countries have increased the extent to which competitive mechanisms are adopted to increase the efficiency of hospital care delivery. Hospital services are complex set of products and services than comprise many different types of patient-oriented activities and not all services are equally subject to competition. For some services, such as emergency services, a hospital may have few if any competitors. For other services, such as inpatient scheduled surgeries, a hospital may compete for patients with other hospitals that offer comparable care. For still other services, such as diagnostic services, specialist consultations and outpatient services hospitals may at times compete with diagnostic centers, doctors’ offices and ambulatory surgery centers. Competition between providers of hospital services can have a number of impacts, including reducing excessive hospital stays, reducing costs of providing care and improving quality of care. Mechanisms for increasing competition or market forces identified in this paper include: collecting and distributing improved information on provider performance; supporting new entry when entry and exit costs are low; encouraging independent or private operation of facilities; improving allocation of human resources, particularly through reducing anticompetitive restrictions by professionals; introducing prospective pricing in combination with benchmarking; physician-led purchasing; providing for greater consumer choice, particularly when waiting lists are long; introducing contestable management of hospitals; and applying competition law in circumstances where public policy focuses on pro-competitive mechanisms. A competitive mechanism that might work in one system will not necessarily transfer well to another. Moreover, competitive mechanisms may at times increase costs. As health policy makers increase reliance on competitive mechanisms, they may need to think carefully about structural market conditions and potentially involve competition authorities when it appears that participants in the market are acting to restrain or eliminate competition.

    Abstract: Environmental protection and competitive markets are two of the highest policy priorities. In June 2006 the Competition Committee held a roundtable discussion on potential restrictions to competition due to environmental protection. Environmental regulations can constitute substantial barriers to entry in some markets, can provide a basis for predatory behaviour in some markets and can be harmful to competition and welfare through a variety of other channels. Environmental rules can thus raise prices to consumers by reducing competition in the market. Any assessment of the costs and benefits of an existing or proposed environmental rule is incomplete without an analysis of the costs generated by any resulting reduction in competition. On the other hand, there is no firm empirical evidence that environmental policy affects the competitiveness of firms and countries. Ideally, environmental policies should be effective and among equally effective policies, the policy that is least restrictive of competition should be chosen. Environmental policy makers should ensure that environmental benefits continue to outweigh costs, including the indirect costs associated with effects on market structure. Environmental policy is first and foremost about securing public environmental goods which are demanded in their own right and which are fundamental to a well-functioning market.

The most common method of ensuring practitioner quality is professional licensure. Because health care expertise is necessary to establish the appropriate program of study, training, and examination for new professionals, a licensed profession often directly or indirectly controls its own licensure rules. In this process of selfregulation, a profession exercises its legitimate interest in maintaining the quality of its members.     Abstract: Dominant firms can use various strategies to eliminate or deter competition, including unlawful price cuts or “predatory pricing”. That strategy involves a willingness to absorb losses in the near term that are rational only because they lead to greater profit in the longer term, after competitors have been disciplined or eliminated. Despite differences in statutes across jurisdictions, the roundtable discussion held in October 2004 in the Competition Committee quickly revealed a virtually unanimous view that the purpose of competition laws is to protect and promote competition, not competitors. With respect to methods for detecting predatory prices, including price-cost tests, there was a greater diversity of views because different cost measures are appropriate in different situations. There was broad agreement among Members that investigations should include an examination of whether an alleged predator would likely be able to recoup its predatory losses, with a negative finding indicative of a low probability of harm to competition.

    Abstract: The Competition Committee (WP2 on Competition and Regulation) hold a roundtable discussion in June 2004 on Competition and Regulation in Agriculture: Monopsony Buying and Joint Selling. Monopsonistic purchasing practices and joint price-setting activities in the agro-food sector were examined, with a particular focus on regulation and on the potential improvements that could arise from more pro-competitive regulations. Joint activity by producers can have a number of beneficial effects, such as from promoting a brand or food that would not otherwise be promoted, promoting a style of production (like organic production) or purchasing in large quantity in order to obtain quantity discounts. Harms may arise when the joint activity involves price or qualitysetting and there is little competition from close substitutes. Cartellike activity by producers has often been supported by governments but is unlikely to achieve stated public policy goals because it often leads to higher consumer prices but enhance land values more than farmer income. Potentially monopsonistic purchasing practices in the agricultural sector were also considered. At times, price manipulation by large purchasers may occur. Competition authorities play an important role in assuring that activities of purchasers do not involve market power, particularly when purchases are concentrated in few, large firms and sellers have limited options besides selling into a highly concentrated market. However, to the extent that purchasers wish to contract for very specific forms of production, such as specific varieties of grain, there can be good commercial reasons that a purchaser would wish to focus on a specific forms of production and agriculture products should not be considered different from supplies in other sectors, which are customized for different purchasers.

    Abstract: Madrid has experienced impressive dynamic economic growth in recent years, making the best of the positive business cycle in Spain. The capital region absorbs more than a half of the total FDI in Spain and has extended its economic relations with Latin American countries. Growth has occurred largely in the service sector (financial, banking, business services) as well as in logistics (Madrid Barajas Airport is the largest employer in the region). The large investment in public goods, and particularly in transportation infrastructure and cultural amenities, has contributed to attracting firms and workers, creating a virtuous cycle of accumulated wealth. Unemployment has reached a low level (6.5% in 2006) and the growth rate has surpassed the national average as well as the average for OECD metro-regions. There is, however, a concern with how to sustain this positive economic path in the long run. The main challenges to be addressed include a relatively low productivity level, insufficient specialisation in high-value added manufacturing activities, a low innovation capacity, job-skills mismatches (especially for immigrants), transport congestion and housing rental shortage. Public policy making and the governance framework have evolved to provide the metro-region with many of the institutional resources that are needed to make decisions and effectively implement public policies. However, some adaptations will be necessary to effectively address the forthcoming challenges. The Territorial Review of Madrid is integrated into a series of thematic reviews on metropolitan regions undertaken by the OECD Territorial Development Policy Committee. The overall aim of these case studies is to draw and disseminate horizontal policy recommendations for national governments.

    Abstract: Prosecution of corruption is a particularly difficult endeavor and successes in this field still too rare. The detection rate is often low due to the lack of verifiable information that is received from public servants or other citizens. Particular difficulties arise when an investigation involves prominent politicians and wealthy businessmen, or when dealing with international bribery cases that require the assistance from foreign jurisdictions in order to collect evidence. Shortcomings that are at the root of these problems can be found at legislative level; in addition, many law enforcement agencies are technically not apt to deal with complex crimes such as corruption in an appropriate manner. Considering the need for capacity building that countries of the Asian and Pacific region have expressed for capacity building in this reform area of the Action Plan, the ADB/OECD Initiative organized a master training seminar on Effective Prosecution of Corruption. This document assembles the seminar’s background papers and case studies, and the experts’ and participants’ views on the key topics that formed the basis for discussion at the seminar. As such, the publication aims to make the expertise exchanged and acquired during the seminar accessible to a broader public and thus to contribute to the overall aim of combating corruption in the new millennium.

    Abstract: Turkey’s e-government efforts received new emphasis in the last three years. The election of a new government brought forward an agenda including public sector modernisation using e-government. Turkey has since made considerable progress with e-government. This review identifies several strategic opportunities. One opportunity is to stimulate the provision of e-services and e-commerce by increasing access to high-speed Internet throughout the country. A second opportunity is to skip the initial stages of e-government applications -- characterised by isolated islands of development -- and instead promote a more “joined up” government. A third opportunity is to use the existing base of 46 million mobile telephones as a communication channel between the government and its citizens. The review also identifies several major challenges. One challenge is bridging the digital divide between urban and rural populations, men and women, and young and old. A second challenge is public sector modernisation in terms of increased transparency and accountability. A third challenge is making sure that investments in e-government are valuable, i.e. that benefits are larger than costs.

    Abstract: The European Commission requested Sigma to carry out a study on the regulatory management capacities of the ten countries that joined the EU on 1 May 2004 to learn more about their Better Regulation practices, exchange good practices and make suggestions for further improvements. This study was carried out by way of peer reviews taking place between March 2005 and October 2006. The topics examined were notably: the origins of EU Better Regulation policy, regulatory management processes, the tools used in these processes (impact assessment, consultation, simplification, alternatives and accessibility), enactment processes and the enforcement and compliance of laws in the NMS, with reference to intellectual property law and environmental laws. Each peer reviews led to a country report that was sent to the Commission and the Member State in question. Publication of each country report was left to the discretion of the Member State in question. A synthesis was drawn up summarizing all findings and making recommendations addressed to all new Member States in general.

    Abstract: The Indian Ocean tsunami that hit South and Southeast Asia in December 2004 was one of the worst natural calamities of recent times, the scale of the devastation to coastal communities across the region almost incomprehensible. As befits a disaster of such magnitude, the humanitarian response was massive. In the course of the relief operations, however, Asian governments and donors increasingly expressed the need for measures to prevent corruption amid widespread concern that significant amounts of tsunami aid may be being diverted to unscrupulous hands. In response to growing concerns about corruption, the ADB-OECD Anti- Corruption Initiative for Asia-Pacific and Transparency International organized an experts meeting on corruption prevention in tsunami relief operations hosted by the Government of Indonesia. The meeting, which brought together the six worst-affected countries—India, Indonesia, Malaysia, Maldives, Sri Lanka and Thailand—aimed to identify concrete priority measures to be taken by each stakeholder, including governments, donor agencies, civil society and private sector organizations involved in aid delivery and reconstruction work, to prevent and curb corruption in service delivery and procurement related to tsunami relief. This publication synthesizes the meeting’s most important deliberations and conclusions, providing a useful resource for the wide range of individuals and organizations working to ensure equitable tsunami assistance. It assembles the issue papers and the conclusions and framework for action developed as a result of discussions and presentations by experts.

    Abstract: The Mexican state of Yucatán, with its strategically important location near the United States, Central America and the Caribbean, is one of the most dynamic regions in the OECD. Yucatán is also a land of contrasts. It is a lagging but growing region, offering a high quality of life and vast natural resources, yet suffering from problems of sustainability. Its tourism attractions are located in rural areas that do not benefit from them. It has both state and Peninsula medical services, but its health services coverage is uneven. Yucatan is a centre for higher education in the Peninsula, yet its graduates do not find jobs. It has a number of marginalised communities in fragmented administrative bodies, and although the Peninsular states share a common cultural heritage and attractiveness, their institutions do not co-operate.Clearly, Yucatán is not taking full advantage of its many resources, and in fact, challenges in the region threaten to undermine local assets. Among these is the need to upgrade activities to higher value-added innovation and design processes, and to foster primary activities to reach international markets. While the state government has proposed programmes to spur formalisation of the informal economy, measures such as better regulation, cutting red tape and providing employment opportunities and access to formal credit could have a greater impact. The lack of a shared, coherent long-term vision is a fundamental challenge to improving regional competitiveness and social cohesion in Yucatán. The OECD’s recommendations can only be part of a larger strategy to develop a collective vision of the state’s future.

    Abstract: This review analyses the Swedish institutional framework for better regulation. In recent years Sweden has made a remarkable recovery, benefiting from deregulation efforts undertaken in the early to mid 1990s. Sweden places a strong emphasis on high standards of social welfare and a strong governance framework, which foster consensus. To preserve its ambitious social and environmental goals, Sweden needs to maintain its strong economic performance. A number of challenges should be addressed, such as the labour market, the performance of the public sector and the strengthening of competition. Entrepreneurship also should be stimulated, and further efforts have to be made to reduce administrative burdens. To create momentum for reform, Sweden needs to promote a strategic vision, improve the process for impact assessment, and strengthen co-ordination between national and local levels of government. The benefits of reform need to be more widely understood by all stakeholders and citizens. Regulatory reform will help Sweden take advantage of globalisation and technological innovation, and meet the demands of citizens for high-quality public services. Sweden is one of many OECD countries to request a broad review by the OECD of its regulatory practices and reforms. This review presents an overall picture, set within a macroeconomic context, of regulatory achievements and challenges including regulatory quality, competition policy, and market openness. Its special focus is on regulatory governance across levels of government as well as environmental policy.     Abstract: The Randstad is a poly-centric urban area in western Netherlands, comprising Amsterdam, Rotterdam, The Hague, Utrecht and several smaller cities. It is one of the most densely populated areas in the OECD, and has developed into an advanced urban economy with many leading sectors, such as logistics, horticulture and financial services. The Randstad has one of the lowest unemployment rates in all OECD countries, and it is one of the most attractive metropolitan areas for FDIs. However, even though the Randstad had high growth rates over the 1990s, it performed less well in the 2000s. In particular, the Randstad has witnessed relatively low labour productivity growth over the last decade - much lower than cities such as Munich or Stockholm for instance. This Review aims to provide a detailed diagnosis and solutions for improving the competitiveness of the Randstad. The Randstad does not seem to exploit well the proximity of its four large cities, and therefore it does not represent an integrated functional urban system. Key recommendations are: improve internal accessibility within the area; facilitate knowledge transfers to the private sector; increase flexibility in housing and labour market; and strengthen the coordination of the economic specialities of its cities, such as higher education and tourism. Changing the governance framework is a key condition of success: individual city-regions within the Randstad should be granted more responsibilities, and a Randstad agenda should be created, prioritising improvement of regional public transport. This Territorial Review of the Randstad is integrated into a series of thematic reviews of metropolitan regions undertaken by the OECD Territorial Development Policy Committee. The overall aim of these case studies is to draw and disseminate horizontal policy recommendations for national governments.

The review draws several important lessons from the Hungarian experience: Hungary has moved forward by adopting international good practices, rather than re-inventing the wheel. In order to continue progress, however, Hungary needs to focus on the bigger picture which means using e-government to improve the efficiency and effectiveness of the public sector, i.e. better government, not more government. This review also identifies the challenges that Hungary will face in order to meet these new objectives.

    Abstract: In a competition roundtable focused on separation of rail track ownership from that of train operations, accumulating evidence is examined that suggests the value of structural separation in the railways sector may be less than previously thought. Integration may yield benefits for a number of reasons, including externalities between train operations and rail maintenance, and difficulties in overseeing traffic in an environment with delays and imperfect information for the train dispatcher. The potential value of separation may differ between passenger operations and freight operations. While passenger operations often require subsidies and, in a separated regime, are often provided via competition for the market (concessions), freight operations offer more potential for beneficial vertical separation. For international traffic between moderate-sized countries, the ability to operate across borders may be limited by a number of factors, including language and technical specifications which need to be addressed in order to broaden the potential for international rail-based freight. This Roundtable on Structural Reform in the Rail Industry was held in 2005 in the Working Party on Regulation of the Competition Committee.

    Abstract: The Structural Separation Report was prepared by the OECD Competition Committee to review the implementation of the 2001 OECD Council Recommendation concerning structural separation in regulated industries. The report shows that many countries have implemented legislation that seeks to promote non-discriminatory access to noncompetitive infrastructure. In a number of jurisdictions, there is dissatisfaction with the access provided by integrated companies to their non competitive infrastructure, leading a number of jurisdictions to strengthen the barriers that separate noncompetitive and competitive parts of a company. One new approach seeks to create managerial incentives that are equivalent to those that would be faced by managers in fully structurally separated companies while maintaining unified ownership of noncompetitive and competitive lines of business. This approach can be termed functional separation and has recently been pursued in the telecommunications sector in at least two jurisdictions. The results of implementing functional separation will be of considerable importance for future policy decisions related to structural separation. The OECD Council endorsed the report’s conclusion relating to maintaining the Recommendation in its current form and invited the Competition Committee to report back in three years’ time on the implementation of the Recommendation.

    Abstract: Universal service obligations are common in many of the infrastructure sectors. The obligations are often cited as a justification for limiting entry of new providers because the new providers would cherry-pick the highprofit customers who provide the basis for subsidization of another group of customers. When obligations are beneficial, there are a number of policy traps that can be encountered: Obligations are often poorly defined and not well-focused on the customers who are meant to receive help; Obligations are frequently defined narrowly in ways that disfavour new technologies and cause extensive waste; and financing for the noncommercial obligations can often be raised in more efficient ways than through cross-subsidies and can often be spent on multiple service providers rather than one preferred provider. Falling into these traps can create incentives for over-investment in certain infrastructure technology and under-investment in other technology. This paper provides guidance on the competition problems that can arise from universal service obligations and on some ways to limit these problems. This OECD Competition Committee roundtable was held in October 2003.

    Abstract: This chapter compares the extent to which law is used to specify budget players and processes, with a particular focus on 13 OECD countries. Although budget system laws serve differing purposes, new budget-related laws are often adopted to introduce budget reforms. Differences in the laws underpinning the main budget players – especially legislatures, the political and non-political executive, and external audit offices – are found to be wide. Important differences are observed in the extent to which law is used for specifying each stage of the budget processes: preparation, presentation, adoption (by the legislature), execution, government accounting and fiscal reporting arrangements. Comparative “models” or tables are provided for various budget-related issues and processes, including: budget timetables (legal requirements); fiscal rules; medium-term budget frameworks; the nature, structure and duration of appropriations; annual and in-year accounts, as well as for specific budget players such as parliamentary budget committees or external audit offices.

    Abstract: Canada has a Westminster model of government and therefore does not highlight the legal basis for annual budget processes. A combination of laws, regulations and conventions govern budget preparation, adoption and budget reporting to Parliament. Although the principle of the supremacy of Parliament is enshrined in the Constitution, in practice, the executive – in particular the Cabinet of Ministers – has strong powers regarding the policies and amounts provided in annual budgets. The government has exclusive power to introduce the budget, and the legislature’s power to amend the budget proposed by the executive is extremely limited. Legislation does not provide a deadline for the executive to submit the budget to Parliament. In practice the budget is submitted to Parliament about one month before the fiscal year and adopted about three months after the fiscal year begins. The Constitution Act 1867, the Financial Administration Act 1985 (FAA) and the Auditor General Act 1977 (AGA) are the fundamental statutes governing budgetary processes (Box 1).1 The FAA has played a particularly important role in establishing the budget and financial management system. The Parliament of Canada Act 1875 does not contain any provisions on the parliamentary budget review process.

    Abstract: This part aims to identify reasons for the wide differences in budget system laws in advanced countries. Comparative research on budget system laws is virtually non-existent. The economics and public finance literature provides little explanation as to why budget system laws differ so widely across countries. Comparative law studies are more promising, particularly those relating to the hierarchy of law. The differences in the relative importance of the constitution, statutes and regulations provide some explanation as to why countries’ budget-related laws are so different. However, there is no theory to explain why the relative weight of each of these sources of law differs across countries. Political variables are also important, particularly the past and present forms of government. The degree of separation of powers between the executive and the legislature partly explains the extent to which law is used for specifying budget processes and actors.

    Abstract: Public finance specialists and constitutional theorists are very reluctant to establish legal norms for budget systems. International organisations have published guidelines for desirable features of budgetary transparency. Except for external audit standards, international bodies have not specified which features should be incorporated in domestic law. As a result, there are no international standards that specify legal requirements for desirable features of national budgeting systems. Classical and new budget principles, as well as the distinct functional responsibilities of the legislature and the executive in budgetary processes, should guide policy makers who wish to establish a “good” law for their national budget system. For budget preparation, adoption, execution, reporting and auditing, this section identifies desirable features that should be included in the law. Suggestions are also made as to which budget principles should be included in constitutions, primary law and secondary law.

    Abstract: The following principles should guide competition authorities when devising remedies in merger cases: i) remedies are to be considered only if a threat to competition has been identified; ii) remedies should be the least restrictive means to effectively eliminate competition concerns; iii) remedies should address only competition concerns, and should not be used for industrial planning or other non-competition purposes; and iv) flexibility and creativity are key in devising remedies. Competition authorities in general strongly prefer structural remedies in the form of divestitures even though they might consider behavioural remedies, alone or in conjunction with divestiture remedies, appropriate in certain cases to address competitive concerns raised by a merger. Where several competition authorities consider remedies in the same transaction, coordination and cooperation among them is important to ensure consistency between remedial solutions. Despite differences in substantive tests and procedures, such cooperation and coordination with respect to remedies has been successful in an increasing number of transnational mergers.     Abstract: Electricity markets are prone to the exercise of market power due to a combination of factors including: inelastic demand, lack of extensive practical storage of electricity, transmission congestion, transmission loop flows and capacity constraints coupled with diversity in the marginal costs of different types of generators. The level of market power can vary rapidly in time according to changes in transmission congestion and fluctuating load levels. Given the propensity of the electricity market to market power, horizontal structural separation (or divestiture) of the generation market is a key policy tool.     Abstract: This publication continues efforts by the OECD’s Development Assistance Committee (DAC) to develop tools and instruments for conflict prevention and for improving security and stability in the long term. The guidance underlines the positive role that the integrated reform of a country’s security system can play in stabilising fragile, conflict-prone or conflict affected states. This includes not only the armed forces, police and gendarmerie, intelligence services and justice and penal systems, but also the civil authorities responsible for oversight and democratic control.Part I contains a policy statement and paper endorsed in 2004 by development ministers and agency heads of the DAC and by the OECD council. It sets out the key concepts of security system reform (SSR) and suggests ways to support it in developing countries, taking into account regional dynamics. In Part II, a lead consultant examines the origins of the SSR agenda and the challenges that donors face in promoting it in partner countries. The Annex to the publication contains work by an expert working in each of the four regions: Africa, Asia-Pacific, Latin America and the Caribbean, and South-east Europe, the Baltics and the CIS. It sets out their assessment of the changes that are taking place in the way that developing countries in these regions think about security and provides an account and analysis of individual reform activities currently being undertaken.

    Abstract: This review of regulatory reform in Russia covers the overall economic context for regulatory reform, the government’s capacity to manage regulatory reform, competition policy and enforcement, and market openness. The review also examines specifically the regulatory framework in the electricity and railway sectors. The analysis in this review assesses Russia against a number of OECD instruments. At the same time, the review has been adjusted to take into account the specific regulatory challenges faced by the Russian authorities, as well as administrative re-organisation required. The review contains comprehensive and detailed policy recommendations that will assist the Russian authorities in structuring and implementing regulatory reforms in order to boost economic growth, job creation, innovation and investment. The review will also help the authorities develop a more comprehensive approach in order to produce results more quickly.
