    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment.     Abstract: This book presents both a new theoretical framework for the criminalisation of hate, referred to as “law as social justice liberalism”, and a comprehensive analysis of hate crime laws that have been enacted globally. The book begins by reflecting back on 30 years of theorisation on hate crime laws, arguing that there has been a failure to adequately capture the distinct harms of hate-based criminal conduct within legal frameworks. The book posits that liberal societies interested in advancing social equality ought to expand conventional paradigms of harm used in criminal law by comprehending hate-based conduct as a form of social injustice. Drawing on the work of Iris Young, the book sets out a comprehensive analysis of the harms of hate crime as a form of group-based oppression and uses this to set out criteria for the inclusion of protected characteristics under legislation. The second half of the book presents findings from a comparative study of hate crime laws enacted in 190 different legal jurisdictions. This includes a new taxonomy of types, models and legal tests used by legislatures to capture the myriad forms of hate-based criminal conduct that occur globally. Further evaluation of case law and empirical research on the application of these diverging legislative approaches is used to provide recommendations on how legislators ought to construct hate crime laws. The book completes its analysis of law as social justice liberalism by synthesising law, punishment and restorative justice as a means of ensuring that liberal systems of “justice” are more firmly anchored to the advancement of “social justice”. Mark Austin Walters is Professor of Criminal Law and Criminology at the University of Sussex, UK. Mark's research interests are focused primarily on hate crime studies and more broadly on criminal law theory and criminal justice reform, including restorative justice practice and theory.

    Abstract: "The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. In der Geschichtswissenschaft wird etwa die Frage nach der Kriegsschuld seit jeher intensiv erörtert. In der Wissenschaftsgeschichte wird über die mit wissenschaftlichen Entdeckungen einhergehende Schuld disputiert. Soziologie, Kunst- und Kulturwissenschaften befassen sich mit in den heutigen pluralistischen Gesellschaften medial und diskursiv präsenten Formen von Schuld. In der Medizin und in den Naturwissenschaften wird die Quantifizierung und Messbarkeit von Schuld sowie ihr eventueller evolutionärer Vorteil erforscht. Und in der Theologie ist die persönliche Schuld Maßstab für die Beurteilung des Menschen am dies irae. Diese Wissensfelder werden in dem vorliegenden Band miteinander in Beziehung und somit ein fruchtbarer interdisziplinärer Diskurs ins Werk gesetzt.

    Abstract: This volume in honour of Stephen Ellis is a follow-up to the public presentation of his book on the history of organised crime in Nigeria This Present Darkness (Hurst, 2016) at the University of Lagos, Nigeria on 28 October 2016.     Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

    Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. Diego Acosta uses this analysis to assess whether the laws are truly innovative and exceptional, as well as evaluating their feasibility, strengths and weaknesses. By analysing the legal construction of the national and the foreigner in ten South American countries during the last two centuries, he demonstrates how different citizenship and migration laws have functioned, as well as showing why states have opted for certain regulation choices, and the consequence of these choices for state- and nation-building in the continent. We are so accustomed to living in a forest of monuments, to having the past represented to us through museums, historic sites, and public sculpture, that we easily lose sight of the recent origins and diverse meanings of these uniquely modern phenomena. In this volume, leading historians, anthropologists, and ethnographers explore the relationship between collective memory and national identity in diverse cultures throughout history.     Abstract: Law and economics are interdependent. Using a historical case analysis approach, this book demonstrates how the legal process relates to and is affected by economic circumstances. Glen Atkinson and Stephen P. Paschall examine this co-evolution in the context of the economic development that occurred in the nineteenth and early twentieth centuries as well as the impact of the law on that development. Specifically, the authors explore the development of a national market, the transformation of the corporation, and the conflict between state and federal control over businesses. Their focus on dynamic, integrated systems presents an alternative to mainstream law and economics. The authors apply John R. Commons's approach to three main law and economics issues: the changing relationship between corporations and the state, the application of the Commerce Clause and the Fourteenth Amendment of the US Constitution to state and federal regulation of business, and the relationship of antitrust law to industrialization. They provide a valuable linking of law with changing economic circumstances such as antitrust policy changes and the development of the corporate form. Marie Mercat-Bruns, a Franco-American scholar, examines the differences in how the two countries approach discrimination.     Abstract: This book, which originated from the broadly held view that there is a lack of Rule-of-law in Mexico, and from the emphasis of traditional academia on cultural elements as the main explanation, explores the question of whether there is any relationship between the system of constitutional review ― and thus the ‘law’ as such ― and the level of Rule-of-law in a given state. To do so, it elaborates a theoretical model for achieving Rule-of-law and compares it to the constitutional review systems of the United States, the Federal Republic of Germany, and Mexico. The study concludes that the two former states correspond to the model, while the latter does not. This is fundamentally due to the role each legal system assigns to ordinary jurisdiction in carrying out constitutional review. Whereas the US and Germany have fostered the policy that constitutional review regarding the enforcement of basic rights is the responsibility of ordinary courts, Mexico has relied too heavily on the specialized constitutional jurisdiction. .

    Abstract: This book tackles the regulatory issues of Unmanned Aerial Systems (UAS) or Remotely-Piloted Aerial Systems (RPAS), which have profound consequences for privacy, security and other fundamental liberties. Collectively known as “drones,” they were initially deployed for military purposes: reconnaissance, surveillance and extrajudicial executions. Today, we are witnessing a growth of their use into the civilian and humanitarian domain. They are increasingly used for goals as diverse as news gathering, aerial inspection of oil refinery flare stacks, mapping of the Amazonian rain-forest, crop spraying and search and rescue operations. The civil use of drones is becoming a reality in the European Union and in the US.The drone revolution may be a new technological revolution. Proliferation of the next generation of “recreational” drones show how drones will be sold as any other consumer item. The cultural perception of the technology is shifting, as drones are increasingly being used for humanitarian activities, on one hand, but they can also firmly be situated in the prevailing modes of postmodern governance on the other hand. This work will be of interest to researchers in Criminology and Criminal Justice interested in issues related to surveillance, security, privacy, and technology. It will also provide a criminological background for related legal issues, such as privacy law, aviation law, international criminal law, and comparative law.

    Abstract: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.

    Abstract: Das Werk beschäftigt sich mit der Frage, was genau unter indigenen Landrechten zu verstehen ist, wie sie im internationalen Vergleich realisiert werden, und ob der Schutz und die Durchsetzung indigener Landrechte in den einzelnen Ländern den völkerrechtlichen Mindestanforderungen entsprechen. Es bewegt sich hierbei auf der Schnittstelle zwischen öffentlichem Recht, Rechtsvergleichung und Völkerrecht. Im Ergebnis wird gezeigt, dass der Umgang der Staaten mit Landrechten indigener Völker den völkerrechtlichen Mindestanforderungen oftmals nicht entspricht. Ferner wird dargelegt, dass die Regierungen nicht auf die unterschiedlichen historischen Vorgehensweisen, durch die indigene Gebiete kolonisiert und indigene Völker in der Vergangenheit enteignet wurden, verweisen können, um eine Ungleichbehandlung indigener Völker in den unterschiedlichen Staaten oder in verschiedenen Regionen innerhalb ein und desselben Staates zu rechtfertigen. Stattdessen sind allein der politische Wille einer Regierung, die Einstellung der Mehrheitsgesellschaft gegenüber indigenen Völkern und das Auftreten und die Organisation der indigenen Völker ausschlaggebend dafür, ob und in welchem Umfang diese ihre Rechte an ihren traditionellen Gebieten durchsetzen können.

    Abstract: This book explores California’s prison system in the context of vocational education reform. For prisons in the early twenty-first century, ideologies of evidence-based management meant that reform efforts to change the purpose of prisons from punishment to rehabilitation through vocational education required “evidence” to justify policy prescriptions. Yet who determines what constitutes evidence? In political environments, solutions are typically pre-conceived, which means that the nature of the evidence collected is also preconceived. As a result, key assumptions about outcomes are often wished away to show improvement and be accountable. Through a detailed analysis interspersed with stories from the authors’ experiences “behind the wall” among California’s prison population, the authors challenge the nature of evidence-based research as used in the prison environment. It examines constitutional developments based on a periodization scheme that partly reflects important changes in constitutional governance, from the Jacksonian Era to the beginning of the 1980s. The book's general historical institutionalist orientation blurs precise distinctions between political science and law, with particular reference to the role of political parties, interest groups, and bureaucrats in operating a constitution designed to prevent the rise of parties, interest-group politics, and an entrenched bureaucracy.

    Abstract: In recent decades, religion's traditional distinctiveness under the First Amendment has been challenged by courts and scholars. As America grows more secular and as religious and nonreligious convictions are increasingly seen as interchangeable, many have questioned whether special treatment is still fair. In its recent decisions, the Supreme Court has made clear that religion will continue to be treated differently, but we lack a persuasive account of religion's uniqueness that can justify this difference. This book aims to develop such an account. Drawing on founding era thought illumined by theology, philosophy of religion, and comparative religion, it describes what is at stake in our tradition of religious freedom in a way that can be appreciated by the religious and nonreligious alike. From this account, it develops a new framework for religion clause decision making and explains the implications of this framework for current controversies regarding protections for religious conscience

Besides a detailed overview of the sources of Roman law, the book also includes sections on private and criminal law and procedure, with special attention given to those aspects of Roman law that have particular importance to today's lawyer. The last three chapters of the book offer an overview of the history of Roman law from the early Middle Ages to modern times and illustrate the way in which Roman law furnished the basis of contemporary civil law systems. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the ‘common law’ of Continental Europe. Combining the perspectives of legal history with those of social and political history, the book can be profitably read by students and scholars, as well as by general readers with an interest in ancient and early European legal history. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history.     Abstract: This book is highly topical. The shift from the multilateral WTO negotiations to bilateral and regional Free Trade Agreements has been going on for some time, but it is bound to accelerate after the WTO Doha round of negotiations is now widely regarded as a failure. However, there is a particular regional angle to this topic as well. After concluding that further progress in the Doha round was unlikely, Pacific Rim nations recently have progressed with the negotiations of a greatly expanded Trans-Pacific Partnership Agreement that includes industrialised economies and developed countries such as the United States, Japan, Australia and New Zealand, recently emerged economies such as Singapore, but also several developing countries in Asia and Latin America such as Malaysia and Vietnam. US and EU led efforts to conclude FTAs with Asia-Pacific nations are also bound to accelerate again, after a temporary slowdown in the negotiations following the change of government in the United States and the expiry of the US President’s fast-track negotiation authority. The book will provide an assessment of these dynamics in the world’s fastest growing region. It will look at the IP chapters from a legal perspective, but also put the developments into a socio-economic and political context. Many agreements in fact are concluded because of this context rather than for purely economic reasons or to achieve progress in fields like IP law. The structure of the book follows an outline that groups countries into interest alliances according to their respective IP priorities. This ranges from the driving forces of the EU, US and Japan, via Asia-Pacific resource-rich but IP poor economies such as Australia and New Zealand, recently emerged economies with strong IP systems such as Singapore and Korea to leading developing countries such as China and India and ‘second tier industrializing economies’ such as Thailand, Malaysia and Indonesia

    Abstract: This is a study of law, wrongdoing and justice as conceived in the minds of the ordinary people of England and Wales from the later eighteenth century to the First World War. Official justice was to become increasingly centralised with declining traditional courts, emerging professional policing and a new prison estate. However, popular concepts of what was, or should be, contained within the law were often at variance with its formal written content. Communities continued to hold mock courts, stage shaming processions and burn effigies of wrongdoers. The author investigates those justice rituals, the actors, the victims and the offences that occasioned them. He also considers the role such practices played in resistive communities trying to preserve their identity and assert their independence. Finally, whilst documenting the decline of popular justice traditions this book demonstrates that they were nevertheless important in bequeathing a powerful set of symbols and practices to the nascent labour movement. This book will be of interest to scholars and students of legal history and criminal justice as well as social and cultural history in what could be considered a very long nineteenth century.     Abstract: This book provides the most current thinking on effective interventions in the lives of criminal offenders. Original articles by leading criminologists provide in-depth analyses of “turning points” in the desistance process experienced by criminal offenders. An understanding of the sources of turning points (or interventions) across the life course is vital to assessing their impact on criminal behavior. Three sources of interventions in criminal careers are identified in the literature: structural location, human agency and situated choice. Structural location refers to the social place occupied by an individual in the social structure: including marital and occupational status, education and income, and so on. Human agency means the active will of an individual to change his or her behavior, that is, the decision to stop engaging in criminal activities. In addition, situated choice coordinates the offender’s willingness to end a life of crime with the social structural supports that increase the odds of criminal desistance. This comprehensive book considers all three sources of turning points-structural location, human agency, and situated choice-across the life course of criminal offenders. The book also provides a section on cross-cultural perspectives on the effectiveness of interventions in the careers of criminal offenders. The policy implications of each intervention are considered in individual chapters. In addition, the authors suggest a research agenda to further the understanding of the interplay among the key interventions across the life course.     Abstract: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany. The research recognizes that despite seemingly very different legal traditions and structures, prosecutors in these systems are similar enough that each system might learn from the others. Drawing upon the experiences of other nations, this research proposes solutions to the problems identified in connection with the position and powers of public prosecutors in the United States.     Abstract: The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration.

    Abstract: The more international law, taken as a global answer to global problems, intrudes into domestic legal systems, the more it takes on the role and function of domestic law. This raises a separation of powers question regarding law-making powers. In this book the author considers that specific issue.In contrast to other studies on domestic courts applying international law, the author’s constitutional orientation focusses on the presumptions concerning the distribution of state power. He collects and examines relevant decisions regarding treaties and customary international law from four leading legal systems, the US, the UK, France, and the Netherlands. Those decisions reveal that institutional and conceptual allegiances to constitutional structures render it difficult for courts to see their mandates and powers in terms other than exclusively national. What follows is a constitutional asymmetry between international law and national law generating an inevitable dualism which cannot necessarily be overcome by express constitutional provisions accommodating international law. The separation of powers thus frames the two principal horizons for any future, practicable attempts at integrating of the two legal orders. Either established concepts of constitutional law and constitutionalism will have to be revised, or what international law may do within a municipal legal system will have to be recalculated. This book offers new insight and new approaches in dealing with international law questions before domestic courts. It is an interesting work of reference and a basis for further debate on this topic among academics and practitioners in the fields of international and constitutional law.     Abstract: The key question for the history of universal human rights is why it took so long for them to become established as law. The main theme of this book is that the attainment of universal human rights required heroic struggle, first by individuals and then by ever-increasing numbers of people who supported those views against the major historical trends. Universal human rights are won from a hostile majority by outsiders. The chapters in the book describe the milestones in that struggle. The history presented in this book shows that, in most places at most times, even today, for concrete material reasons a great many people oppose the notion that all individuals have equal rights. The dominant history since the 1600s has been that of a mass struggle for the national-democratic state. This book argues that this struggle for national rights has been practically and logically contradictory with the struggle for universal rights. It would only be otherwise if there were free migration and access to citizenship on demand by anybody. This has never been the case. Rather than drawing only on European sources and being limited to major literary figures, this book is written from the Gramscian perspective that ideas mean little until they are taken up as mass ideologies. It draws on sources from Asia and America and on knowledge about mass attitudes, globally and throughout history.

    Abstract: How does copyright law take into account the interests of third parties, especially the general publics interest in the greatest possible dissemination of knowledge and culture? Twelve basic questions give copyright law experts from more than forty countries the opportunity to provide answers related to their national law on the following matters: categories of works and subject matter, eligibility conditions, duration, "users rights, the three-step test, misuse, differentiations between categories of right holders, TPM, and relations of copyright law to other legal areas such as fundamental rights, competition law, consumer protection law, media law etc. The standardized form of the reports makes it easy to see the impacts of copyright law in the industrialized countries as well as in emerging economies; in common-law and civil-law approaches; in countries of the Andean Community and of the European Union, as well as in countries that are not party to the WIPO Treaties. A detailed preliminary chapter provides an approachable overview of issues and results. This chapter also discusses the voice of academia, represented by the European Copyright Code of the "Wittem Group.

    Abstract: Corporate governance encompasses the free enterprise system, which is treated comprehensively in this book from a German perspective. This distinguishes the book from other books written in English in this subject area, not only because of the comprehensive way it covers German corporate law and corporate governance, but also because of the fact that it provides international and European perspectives on these important topics. This second edition is an extensively revised and updated version of the first edition, in particular with a view to the worldwide debt crisis. The authors provide readers with an overview of the unique features of German business and enterprise law and an in-depth analysis of the organs of governance of German public limited companies (general meeting, management board, supervisory board). In addition, approaches for reforms required at the international level are also suggested and discussed, including, among others, the unique interplay and dynamics of the German two-tier board model with the system of codetermination, referring to the arrangement of employees sitting on the supervisory boards of German public limited companies and private companies employing more than 500 employees; also covered are significant recent legal developments in Europe. The book highlights the core function of valuation and financial reporting at the international, European and German levels, with accounting as the documentary proof of good corporate governance.     Abstract: The study conducted by the Centre of European Economic Research (ZEW), the University of Mannheim and Ernst Young contributes to the ongoing evaluation of the proposal for a Draft Council Directive on a Common Consolidated Corporate Tax Base (CC(C)TB) released by the European Commission on March 16, 2011. For the first time, details on the determination of taxable income under the proposed Council Directive are compared to prevailing corporate tax accounting regulations in all 27 Member States, Switzerland and the US. The study presents evidence on the scope of differences and similarities between national tax accounting regulations and the Directive's treatment in a complete, yet concise form. Based on this comprehensive comparison, it goes on to discuss remaining open questions and adjustments needed if the Directive is to be implemented in national tax law.     Abstract: The private international law of intellectual property is currently much debated both in Europe and abroad. Art. 8 of the Rome II Regulation of 2007, which codifies a territorial approach for the infringement of intellectual property, has provoked an intensive discussion in Europe as to whether the lex loci protection is still appropriate for intellectual property litigation in the age of worldwide networks. A condensed outcome of this debate is summarized in the »Principles for Conflict of Laws in Intellectual Property« (CLIP Principles) drafted by the European Max Planck Group on Conflict of Laws in Intellectual Property (CLIP), published recently in a second preliminary draft. On the international scale, the American Law Institute's »Intellectual Property: Principles Governing Jurisdiction, Choice of Law, and Judgments in Transnational Disputes« of 2007 (ALI Principles) are the focal point of the debate. A Japanese project (»Transparency Proposal«) was finalized in 2009. This volume provides a comparative analysis of the three proposals. It compiles papers presented at an international conference held in Tokyo in May 2009

    Abstract: All societies must deal with the possibility of violence, and they do so in different ways. This book integrates the problem of violence into a larger social science and historical framework, showing how economic and political behavior are closely linked. Most societies, which we call natural states, limit violence by political manipulation of the economy to create privileged interests. These privileges limit the use of violence by powerful individuals, but doing so hinders both economic and political development. In contrast, modern societies create open access to economic and political organizations, fostering political and economic competition. The book provides a framework for understanding the two types of social orders, why open access societies are both politically and economically more developed, and how some 25 countries have made the transition between the two types
