    Abstract: This volume brings together the full range of modalities of social influence - from crowding, leadership, and norm formation to resistance and mass mediation - to set out a challenge-and-response 'cyclone' model. The authors use real-world examples to ground this model and review each modality of social influence in depth. A 'periodic table of social influence' is constructed that characterises and compares exercises of influence in practical terms. The wider implications of social influence are considered, such as how each exercise of a single modality stimulates responses from other modalities and how any everyday process is likely to arise from a mix of influences. Leading commentators, United Kingdom courts, and the European Court of Human Rights have de-emphasised the special importance of religious liberty. They frequently contend it falls within a more general concern for personal autonomy. In this liberal egalitarian account, religious liberty claims are often rejected when faced with competing individual interests - the neutral secular state must protect us against the liberty-constraining acts of religions. Joel Harrison challenges this account. He argues that it is rooted in a theologically derived narrative of secularisation: rather than being neutral, it rests on a specific construction of 'secular' and 'religious' spheres. This challenge makes space for an alternative theological, political, and legal vision. Drawing from Christian thought, from St Augustine to John Milbank, Harrison develops a post-liberal focus on association. Religious liberty, he argues, facilitates creating communities seeking solidarity, fraternity, and charity - goals that are central to our common good"--

    Abstract: Comparative constitutional law has a long pedigree, but the comparative study of constitution-making has emerged and taken form only in the last quarter-century. While much of the initial impetus came from the study of the American and French constituent assemblies in the late eighteenth century, this volume exemplifies the large comparative scope of current research. The contributors discuss constituent assemblies in South East Asia, North Africa and the Middle East, Latin America, and in Nordic countries. Among the new insights they provide is a better understanding of how constituent assemblies may fail, either by not producing a document at all or by adopting a constitution that fails to serve as a neutral framework for ordinary politics. In a theoretical afterword, Jon Elster, an inspirational thinker on the current topic, offers an analysis of the micro-foundations of constitution-making, with special emphasis on the role of crises-generated passions.

However, a cursory look at just a handful of constitutional systems suggests important differences in the practices of constitutional judges, whether in matters of form, style, or language. Focusing on independently-verified leading cases globally, a combination of qualitative and quantitative analysis offers the most comprehensive and systematic account of constitutional reasoning to date. This analysis is supported by the examination of eighteen legal systems around the world including the European Court of Human Rights and the European Court of Justice. Universally common aspects of constitutional reasoning are identified in this book, and contributors also examine whether common law countries differ to civil law countries in this respect.--

Die Erörterung der rechtlichen Problematik hat die Darstellung des verfassungsrechtlichen Privatsphären- und Persönlichkeitsschutzes in Deutschland und in den USA zum Ausgangspunkt. Eingehend erläutert und verglichen werden die unterschiedlichen Ansätze zur verfassungsrechtlichen Bewertung von Videoüberwachungen in den beiden Ländern, und es werden die ersten Ansätze einer Normierung in den USA vorgestellt. Die durch die einzelnen deutschen Bundesländer geschaffenen Ermächtigungsnormen werden genauer betrachtet und auf ihre Verfassungsmäßigkeit hin untersucht. Hier wird zum einen der Frage der Gesetzgebungskompetenz betreffend der Videoüberwachung als doppelfunktionaler Polizeimaßnahme (insbesondere dem umstrittenen Problem der Gesetzgebungskompetenz im Rahmen der Strafverfolgungsvorsorge) nachgegangen.     Abstract: Society is faced with a variety of undesirable behaviours and conditions such as crime, mental and physical illnesses and disabilities, that usually provoke different responses in people such as emotions of anger, fear or pity. In our evolutionary past, these emotions adaptively motivated the repair of interpersonal relationships, whereas more recently they may also result in other types of social control such as stigmatization or tolerance. Dijker and Koomen show, on the basis of elementary psychological processes, how peoples' responses are not only dependent on type of deviance but also on personality, situation, historical period and culture. They also examine the implications of these responses for the well-being and coping of people with deviant conditions or stigmas. This book provides conceptual tools for developing interventions to reduce stigmatization and offers a deeper understanding of the psychological basis of social control as well as opportunities to influence its potentially harmful consequences

    Abstract: In his important book, first published in 1997, Thomas Scheff offers an approach to researching human behavior which relates the smallest parts of social interaction to the greatest wholes of social structure. These are the details and connections usually found only in the finest novels, but Scheff combines the insights of the humanities and social sciences to capture the same evocative details of sight, sound, and context, better to understand what he calls 'human reality'. He puts a fresh emphasis on the importance of emotions in the social bond, and describes in newly subtle ways the outer and inner lives of persons in real life, such as inner-city children, and in fiction, such as Jane Austen's heroines. By closely observing the significance of words and gestures in the context in which they occur, he is able to illuminate the connection between people's lives and the society in which they live

    Abstract: Biology and Freedom, first published in 1989, is an essay on human nature: an attempt to make a just assessment of a species often presented as predominantly and unavoidably violent, grasping, selfish and stupid. Likening human beings to animals is a traditional method of influencing attitudes on morals and politics. But in this book Professor Barnett shows that modern ethology, experimental psychology, genetics and evolutionary theory give the now fashionable misanthropy no authentic support. The result is that researchers in different disciplines construct their own implicit, and often unsatisfactory, models of either individual or collective phenomena, which in turn influence their theoretical and empirical work. In this 1985 book, Drew Westen attempts to cross these boundaries, proposing an interdisciplinary approach to personality, to culture, and to the relation between the two. Throughout the book, Westen provides reviews of a variety of fields, including personality theory, moral development, ego development, and culture theory.
