Abstract: "Endangered species conservation is a critical challenge for sustainable development. Although serious attempts are being made to reverse current trends, many species and their crucial habitats continue to be degraded and lost at alarming rates. Various international agreements, notably the venerable Convention on International Trade in Endangered Species of Flora and Fauna (CITES), have aimed to regulate trade in listed species through the development of national frameworks and international collaborative measures. In spite of these initiatives, the implementation of international regulations remains a challenge for developing countries, especially for countries with limited scientific, human, technical and financial capacity and resources"--

Abstract: Since the mid-twentieth century, 'international law' and 'international development' have become two of the most prominent secular languages through which aspirations about a better world are articulated. They have shaped the both the treatment and self-understanding of the 'developing' world, often by positing the West as a universal model against which developing states, their citizens, and natural environments should be measured and disciplined. In recent years, however, critical scholars have investigated the deep linkages between the concept of development, the doctrines and institutions of international law, and broader projects of ordering at the international level. They have shown how the leading models de-radicalise, if not derail, initiatives to redefine development and pursue other forms of global well-being. Bringing together scholars from both the Global South and the Global North, the contributions in this Handbook invite readers to consider the limits of common normative and developmentalist assumptions. At the same time, the Handbook demonstrates how disparate but still identifiable set of ideas, imaginaries, norms, and institutional practices - related to law, development and international governance - shape today's profoundly unequal material conditions, threatening the future of human and nonhuman life on the planet. The book focuses on five distinct areas: existing disciplinary frameworks, institutions and actors, regional theatres of international law and development, competing social and economic agendas, and alternative futures.

Abstract: "International responsibility law today is in great need of theorizing, or, at least, that is the present volume's argument. This introduction sets the stage for that argument. It unfolds in four steps: first, it clarifies the reasons that led to putting this collection of essays together and explains what it hopes to achieve; second, it introduces the main theoretical challenges addressed in the volume; third, it provides some information about how the book is organized; and, finally, it sketches out the content of its successive chapters and their articulation"

Abstract: "In 1956, ICJ judge Philip Jessup highlighted the gaps between private and public international law and the need to adapt the law to border-crossing problems. Today, sixty years later, we still ask what role transnational law can play in a deeply divided, post-colonial world, where multinationals hold more power and more assets than many Nation States. In searching for suitable answers to pressing legal problems such as climate change law, security, poverty and inequality, questions of representation, enforcement, accountability and legitimacy become newly entangled. As public and private, domestic and international actors compete for regulatory authority, spaces for political legitimacy have become fragmented and the state's exclusivist claim to be law's harbinger and place of origin under attack. Against this background, transnational law emerges as a conceptual framework and method laboratory for a critical reflection on the forms, fora and processes of law making and law contestation today"--

Abstract: Who is a child’s legal mother? Must a child have exactly one mother, can it have two or three, or can it have two fathers, but no mother? Or has the concept of motherhood become obsolete and should we just talk of parenthood in a gender neutral way? Questions such as these would have appeared esoteric only a few decades ago, but as a result of new social developments (such as frequent family reconstitutions, gay and lesbian emancipation or surrogacy) and of technological innovations (such as egg and embryo donations) they have become issues in a vehement debate. The interdisciplinary contributions to this book focus on the legal definition of motherhood, on the way in which legal conceptions structure the social discourse on motherhood (and vice versa), and on the influence of legal rules on power relations between mothers, fathers, children and the state. Among the issues addressed are - the challenges to our understanding of the legal regulation of motherhood by developments in reproductive medicine; - the challenges to our understanding of the legal regulation of motherhood by parental constellations deviating from the mother-father-model (single motherhood by choice, same-gender parenthood, multiple parenthood); - the exercise of parental rights in case of parental separation and the impact of legal rules on the bargaining positions of mothers and fathers.

Abstract: "This volume contains a collection of papers presented at the twenty-second British Legal History Conference held at the University of Reading. The conference coincided with the 800th anniversary of Magna Carta; the conference was thus concerned not only with Magna Carta itself but also with its enduring legacy. The theme around which this legacy is explored is that of challenges to authority and how these challenges result in the recognition of rights. Magna Carta now occupies a quasi-mythical status - particularly within common law jurisdictions - as an instrument which gave people liberty. Lord Denning described it as 'the greatest constitutional document of all times... the spirit of individual liberty which has influenced our people ever since'. Such a description omits the struggle which gave rise to these rights"--
Abstract: Magna Carta : the emergence of the myth / John Baker -- Benefit of clergy and the authority of Magna Carta / Margaret McGlynn -- How to get rid of a king : lawyering the revolution of 1399 / David Seipp -- Magna Carta and the fragmented authorities of the later Middle Ages / Anthony Musson -- Revolution principles and the revolution bench / Mike Mcnair -- Magna Carta clauses 4 and 5 and the problem of account / Joshua Getzler -- Some effects of war on the law in late 18th and Early 19th-century England / James Oldham -- Tax, freedom and social expectations : fiscal impact on the built environment in nineteenth-century England / Chantal Stebbings -- The Magna Carta in the German discourse about English constitutional law between the 18th and the early 20th century / Andreas Thier -- A Magna Carta for the world? : the constitutional protection of foreign subjects in the Age of Revolution / Daniel Hulsebosch -- The state of slavery : the slave, grace, and the rise of pro-slavery constitutionalism in the nineteenth-century Atlantic world / Patricia Hagler Minter -- The royal proclamation of 1763 : an indigenous Magna Carta's rough ride in British Columbia / Hamar Foster -- Law : challenges to authority and the recognition of rights : examples from British India / Raymond Cocks -- Unfortunate necessities of warfare? : Australia's national security regulations and the right to free speech during World War I / Diane Kirkby

Bandung 1955
Abstract: "In 1955 a conference was held in Bandung, Indonesia that was attended by representatives from twenty-nine developing nations. Against the backdrop of crumbling European colonies, Asian and African leaders forged a new alliance and established anti-imperial principles for a new world order. The conference captured the popular imagination across the Global South. Bandung's larger significance as counterpoint to the dominant world order was both an act of collective imagination and a practical political project for decolonization that inspired a range of social movements, diplomatic efforts, institutional experiments and heterodox visions of the history and future of the world. This book explores what the spirit of Bandung has meant to people across the world over the past decades and what it means today. Experts from a wide range of fields show how, despite the complicated legacy of the conference, international law was never the same after Bandung"--

Abstract: The book explores how international organizations (IOs) have expanded their powers over time without formally amending their founding treaties. IOs intervene in military, financial, economic, political, social, and cultural affairs, and increasingly take on roles not explicitly assigned to them by law. The proposed book will contend that this 'mission creep' has allowed IOs to intervene internationally, most often in the Global South, in a way that has allowed them to recast institutions within and interactions among states, societies, and peoples on a broadly Western, liberal model. Adopting a historical and interdisciplinary, socio-legal approach, it supports this claim through detailed investigations of historical episodes involving three very different organizations: the International Labour Organization in the interwar period; the United Nations in the two decades following the Second World War; and the World Bank from the 1950s through to the 1990s. The book draws on a wide range of original institutional and archival materials, bringing to light little-known aspects of each organization's activities, identifying continuities in the ideas and practices of international governance across the twentieth century, and speaking to a range of pressing theoretical questions in present-day international law and international relations --Front flap of the book

Abstract: "This book [analyzes]...parental care regimes in Muslim jurisdictions, both in a comparative and country-specific sense...[This book contains] 15 country reports presented on questions of custody, guardianship and their development within different Muslim jurisdictions (ranging from Indonesia to Morocco), a number of which are included in full in the book. Each of these country reports contains a historical perspective on the evolution of domestic rules regarding custody and guardianship, and on the introduction and development of the notion of the best interests of the child. Most importantly, the prevailing legal norms, both substantive and procedural, are explored and particular attention is given to legal practice and the role of the judiciary. In addition to a selection of country reports from the workshop, the volume includes two comparative analyses on questions of parental care in both public and private international law. With a high practical relevance for legal practitioners working in the area of cross-border custody disputes and the most up-to-date assessment of parental care regimes beyond a pure analysis of statutory law, this book combines a number of country reports authored by experts who have worked or are still based in the respective countries they are reporting on and thus contains in-depth discussions of legal practice and custody law in action."--

Abstract: Providing an analysis of global regulation and the impact of international organizations on domestic laws, this collection grew out of a central objective to explore methods of domestic engagement with international trade and human rights norms, and the inherent difficulties in establishing balanced links between these two international law regimes. The common thread of the papers in this collection is a focus on the application of socio-legal normative paradigms in building knowledge and policy support for coordinating local performance with international trade and human rights standards in ways that are mutually sustaining.--

Abstract: Norms Without the Great Powers" examines the nature of power in world politics, and the particular role that law plays in defining the meaning and deployment of power in the international system. Specifically, it seeks to further explicate the social dimensions of power as the capacity to shape how actors think about the world, in contrast to the more typical conception emphasizing material properties such as military or economic capabilities. Participating in international institutions and being seen as 'law-abiding' is a potent source of status for states and non-state actors alike. In engaging with the law, actors are inducted into a complex set of collective expectations that profoundly shape the way they frame their interests and pursue their policy goals. This process is first examined theoretically, and then through a detailed evaluation of two prominent-and challenging-multilateral institutions, the ban on antipersonnel mines and the International Criminal Court

Abstract: "This book explores the right to democracy in international law and contemporary democratic theory, asking whether international law encompasses a substantive or procedural understanding of the notion. The book considers whether there can be considered to be a basis for the right to democracy in international customary law through identification of the relevant state practice and opinio juris, as well as through an evaluation of the Universal Declaration of Human Rights and whether the relevant provisions might be interpreted as forming customary law. The book then goes on to explore the relevant provisions in international treaties including the International Covenant on Civil and Political Rights before looking at the role of regional organizations and human rights regimes including the European Court of Human Rights and the Arab human rights regime. [The author] draws on the work of John Rawls in order to put forward a theoretical basis for the right to democracy."--

Abstract: "A ... personal detective story, an uncovering of secret pasts, and a book that explores the creation and development of world-changing legal concepts that came about as a result of the unprecedented atrocities of Hitler's Third Reich. East West Street looks at the personal and intellectual evolution of the two men who simultaneously originated the ideas of "genocide" and crimes against humanity," both of whom not knowing the other, studied at the same university with the same professor, in a city little known today that was a major cultural center of Europe, "the little Paris of Ukraine," a city variously called Lemberg, Lwów, Lvov, or Lviv... Sands... realized that his own field of international law had been forged by two men - Rafael Lemkin and Hersch Lauterpacht - each of whom had studied law at Lviv University in the city of his grandfather's birth, each of whom had come to be considered the finest international legal mind of the twentieth century, each considered to be the father of the modern human rights movement, and each, at parallel times, forging diametrically opposite, revolutionary concepts of humanitarian law that had changed the world. Abstract: Equal is not Enough? is the title of a series of conferences that has aimed, over the years, to generate a better understanding of what shapes and reshapes inequalities by inviting and promoting multi-disciplinary insights and reflection. One of the conferences focused on discrimination law. The conveners welcomed papers on the relationship between social policy and discrimination law (or closely related human rights issues), which investigate the tensions and (in)compatibilities between the respective aims and tools of social policy and discrimination law. They were particularly interested in contributions that transcend legal technicalities and reflect on the function of discrimination law as part of a wider social policy in the European Union and its member states. A collection of papers from the conference now appears in this book, which takes its name from the title of the conference
