Abstract: This open access book examines the conflict of law rules in East Asian states. With a focus on the laws in Mainland China, Japan and South Korea, the book also looks at the rules of Hong Kong and Taiwan. Beyond a description of the substance of the current law, the book highlights the evolution these jurisdictions have undergone since being adopters of rules developed in European and North American legal systems. As evidenced by recent modernisations in their private law regimes, these East Asian states are now innovators, creating rules that are more suited to the local concerns. Significantly, the new approaches to private international law taken by China and Japan are themselves being adopted by other jurisdictions, shifting the locus of influence in this important area of law. The chapters in Part 1 give a contextual overview of the legal regimes of Mainland China, Japan, and South Korea. This part is intended to foster a deeper understanding of how the systems are changing to better fit the particular national approaches to law. A more in-depth view of the rules on private international law follows in Part 2, where the rules of Hong Kong and Taiwan are set forth in addition to those of the rest of China, Japan and South Korea. Part 3 provides a detailed look at the conflict rules relevant to commercial law, specifically as regards international jurisdiction of courts, while Part 4 examines the rules applying to family and succession law. Written in an easily accessible style, the book is a valuable resource for scholars as well as practitioners of East Asian law, private international law, and comparative law. Abstract: How did Asia come to be represented on European World maps? When and how did Asian Countries adopt a continental system for understanding the world? How did countries with disparate mapping traditions come to share a basic understanding and vision of the globe? This series of essays organized into sections on Jesuit Circuits of Communication and Publication; Jesuit World Maps in Chinese; Reverberations of Matteo Ricci's Maps in East Asia; and Reflections on the Curation of Cartographic Knowledge, go a long way toward answering these questions about the shaping of our modern understandings of the world

Abstract: This open access book offers a comparative and inter-disciplinary perspective on the unique competition law challenges presented by the converged digital markets. Following the digitalisation of even the most traditional bricks-and-mortar sectors of the economy, a well-functioning internal market can only be guaranteed by ensuring the competitiveness of the digital markets. What role do intellectual property law and competition law play in this digital world? How can a more economic analysis strengthen innovation policies to achieve a truly competitive digital single market? The book provides a rigorous discussion of the many reasons why the regulatory responses, not just in Europe but in other jurisdictions too, may fall short. It addresses an array of procedural, substantive and other issues that are generating intense debate across the antitrust community. This includes the scope and objectives of digital regulation, whether the application of ex-ante rules would result in fragmentation and inconsistencies, and whether such regulatory regimes are an appropriate tool for substantive assessment. The book explores whether the application of these rules would effectively tackle the competition enforcement challenges seen under the competition laws, whether they can be applied without undermining other rights such as privacy, and whether they are appropriate for this digital age as well as the new digital era ahead of us. Part 1 offers a detailed inter-disciplinary perspective on the most recent legislative solutions in the European Union, namely, the Digital Services Act, the Digital Markets Act, and the Data Act. Part 2 offers competition and regulatory responses to these ever-emerging digital challenges by the UK, Latin American, Indian and Chinese regulators. Abstract: This book provides a rare account of China’s market reform in the own words of the Chinese: politicians, intellectuals, the media, and journalists. The Chinese rhetoric―complex, ironic, argumentative, and abstruse―may hold the key to understanding China’s unique style of elite politics, state-citizen relationship, and institutional development. Topics include the establishment and change of the stock market and the recent institutionalization of the private equity industry. Rhetoricizing the Chinese capitalist transformation provides a glimpse into how the Chinese minds work as Chinese people participate in the process of changing the country and themselves. Adopting both an indigenous perspective and an outsider view on China, this book serves as a guide for anyone interested in learning how Chinese reason, persuade, debate, and resist. ; This book provides a rare account of China’s market reform in the own words of the Chinese: politicians, intellectuals, the media, and journalists. Abstract: References to community interests appear from time to time in scholarly writings in the field of international relations and international law. The concept of community interests refers to interests protected by international law binding either all or a group of states and go beyond the delimitation of a sovereign sphere of influence. In the literature, there are existing examples of research, such as in books and journal articles, that consider the various manifestations of what has been described as “community interests” in many areas regulated by international law, including natural resources, global markets, human rights, and the use of force, and observe how law has evolved from a legal system based on more or less specific consent and aimed at promoting the particular interests of states, to one that is more generally oriented towards collectively protecting common interests and values. However, this topic has not been thoroughly researched, meaning that there is a huge gap in the existing literature, particularly in the context of ocean governance and sustainability. This Special Issue attempts to fill this gap, so as to attract more studies on this important topic in academia

Abstract: Speaking to the Twentieth National Congress of the Communist Party of China, in October 2022, President Xi Jinping reiterated his commitment to the 'opening up' policy of his predecessors — a policy that has burnished the party’s political legitimacy among its citizens by enabling four decades of economic development. Yet, for all the talk of openness, 2022 was a year of both literal and symbolic locks and chains — including, of course, the long, coercive, and often brutally enforced lockdowns of neighbourhoods and cities across China, most prominently Shanghai. Then there was a vlogger’s accidental discovery of the ‘woman in chains’, sparking an anguished, nationwide conversation about human trafficking. That was part of a broader (if frequently censored) conversation about gendered violence and women’s rights, in a year when women’s representation at the highest levels of power, which was already minimal, decreased even further. There was trouble with supply chains and, with the Fourth Taiwan Strait Crisis, in August, island chains as well. Despite the tensions in the Asia-Pacific, the People’s Republic of China expanded its diplomatic initiatives among Pacific island nations and celebrated fifty years of diplomatic links with both Japan and Australia. As the year drew to a close, a tragic fire in a locked-down apartment building in Ürümqi triggered a series of popular protests that brought an end to three years of ‘zero COVID’. The China Story Yearbook: Chains provides informed perspectives on these and other important stories from 2022

Abstract: In China between Peace and War, Victor S. C. Cheng explores the gripping history of peace talks and international negotiations from 1945 to 1947 that helped determine the shape of the Chinese Civil War. The book focuses on the efforts of the two belligerent parties—the Chinese Nationalists, or Guomindang, and the Communists—to achieve an enduring peace. It presents previously unexplored major elements of the peace talks: ambiguous treaties, package deals and short-term solutions. It identifies the burning challenges that confronted attempts at peacemaking, including the two warring parties' high-risk decision-making styles and the temptation to veto agreements and resume fighting. Cheng argues against popular notions that differences between the two belligerents in the Chinese Civil War were irreconcilable, that the failure of the peace talks was predetermined and that the US government mediators needed to remain neutral. Because the actions around the negotiating table occurred in a developing theatre of war, Cheng also explores the military decision-making of the opposing sides as well as the conflicts that ultimately plunged China into the world’s largest military engagement of the seven-plus decades since World War II. China between Peace and War highlights the contradictory role of political leaders who micromanaged the military, including their struggle to connect political objectives and military power, their rhetorical use of the 'decisive war’ concept, and their pursuit of radical military-political goals at the expense of a negotiated peace

Abstract: This essay considers how early modern Chinese romance novels conceive of female agency and how this conception was received by prominent cultural elites in eighteenth-century England. In his notes to Hau Kiou Choaan, the first English translation of a full-length Chinese novel, Thomas Percy referred to the novel’s heroine as a “masculine woman”, displaying a peculiar misreading of its trope of female cross-dressing. The essay argues that the increasing association of women with the private sphere in eighteenth-century English culture is a crucial context to consider when we study the initial spread of Chinese fiction in England

Abstract: In August 1855, 16-year-old Chaloner Alabaster left England for Hong Kong, to take up a position as a student interpreter in the China Consular Service. He would stay for almost 40 years, climbing the rungs of the service and eventually becoming consul-general of Canton. When he retired he returned to England and received a knighthood. He died in 1898. Throughout his adult life, Alabaster kept diaries. In the first four volumes of these diaries, collected here by Benjamin Penny, the teenage Alabaster recorded his thoughts and observations, told himself anecdotes, and exploded in outbursts of anger and frustration. He was young and enthusiastic, and the everyday sights, sounds and smells of Hong Kong were novel to him. He describes how the Chinese people around him ironed clothes, dried flour and threshed rice; how they gambled, prepared their food and made bean curd; and what opera, new year festivities and the birthday of the Heavenly Empress were like. Like many a young Victorian, he was also a keen observer of natural history, fascinated by fireflies and ants, corals and sea slugs, and the volcanic origins of the landscape. Alabaster's diaries are a unique, vibrant and riveting record of life in the young British colony on the cusp of the Second Opium War. With A Young Englishman in Victorian Hong Kong, Penny sheds new light on the history of the region

Abstract: Italy’s officially joining the China-led Belt and Road Initiative sparked a fierce debate. By analysing five fields of cooperation, the volume sheds light on whether the bilateral agreement has brought about an intensification of bilateral collaboration as wished by the Italian government at the time and whether the concerns around it have materialised. The contributions will show that potential risks coexist alongside unsubstantiated ones

Abstract: Shépa: ‘explanation’ or ‘elucidation’ in Tibetan. A form of oral poetry sung antiphonally in a question-and-answer style. This book contains a unique collection of Tibetan oral narrations and songs known as Shépa, as these have been performed, recorded and shared between generations of Choné Tibetans from Amdo living in the eastern Tibetan Plateau. Presented in trilingual format — in Tibetan, Chinese and English — the book reflects a sustained collaboration with and between members of the local community, including narrators, monks, and scholars, calling attention to the diversity inherent in all oral traditions, and the mutability of Shépa in particular. From creation myths to Bon and Buddhist cosmologies and even wedding songs, Shépa engages with and draws on elements of religious traditions, historical legacies and deep-seated cultural memories within Choné and Tibet, revealing the multi-layered conceptualization of the Tibetan physical world and the resilience of Tibetan communities within it. This vital and unique collection, part of the World Oral Literature Series, situates Shépa in its ethnographic context, offering insights into the preservation and revitalization of intangible cultural heritage in the context of cultural Tibet, Indigenous studies and beyond. Scholars and students in the fields of anthropology, linguistics, ethnic and minority relations, critical Indigenous studies, Tibetan studies, Himalayan studies, Asian studies and the broader study of China will find much to reward them in this book, as will all readers interested in the documentation and preservation of endangered oral traditions, intangible cultural heritage, performance and textuality, and Tibetan literature and religions

Abstract: As the first study of manuscript collections, this book asks what changes when sayings, stories, songs, and spells are brought together on the same carrier. Covering a plethora of manuscripts from the Warring States and early empires, and spanning sources from philosophy, historiography, poetry, and technical literature, this study describes the whole life-cycle of multiple texts collected on a single manuscript. Drawing on comparative and interdisciplinary advances and based on careful study of manuscript materiality and textuality, this book shows the importance of collections in the development of and access to text and knowledge in early China

Abstract: The day after the epidemic broke out in Wuhan, Chinese people in France are already busy sending masks across borders and sharing media information; at the same time, a significant number of Chinese people are victims of racist attacks, insults and discrimination in France. Based on both quantitative and qualitative empirical data, this book reveals the new dynamics and interactions generated by the Covid-19 pandemic not only between different sub-groups of Chinese in France, but also between ethnic Chinese and their both countries: China and France. Mutual aid, local or transnational solidarity, inclusion initiatives, like any act of exclusion and hostility, invite you to question the essence of humanity in transnational settings, beyond the racialization of the Covid-19 virus

Abstract: Land use is the projection of human activities in space, and it has become an important insight into the transformation and reconstruction of human society and economy. Rural land use in China is undergoing rapid transformation driven by the rapid development of science and technology. Effectively grasping the change and transformation process of rural land use and its internal mechanism provides an important reference for revealing the inherent laws of China's rural development. Rural land use is closely related to the rural vitalization strategy and urban–rural integration in the new era. An in-depth study of China's rural land use and policy reform provides the basis of knowledge for formulating and optimizing urban–rural relations. This Special Issue focuses on the changes, effects, and regulation of rural land use in China, focusing on its main contradictions and solutions, building a cooperative network and sharing platform for rural land use research from a multidisciplinary perspective, and further deepening the theoretical innovation and practical application of rural land use research. We invited scholars from various disciplines to contribute to the Special Issue, especially with papers on the subjects of theoretical innovation, technological innovation, and practical innovation in this field

Abstract: «As Italy tends to be studied increasingly in transnational and transcultural perspective, there is an ever-greater need for studies that explore the country's relationship with other geographical areas and cultural configurations. Linetto Basilone's work is an important contribution to research of this kind. The work provides a panoramic view of how journalists and travel writers from the late nineteenth century to the 1980s have sought to represent China, its relationship with Italy, and its growing geopolitical significance. The ideological and cultural context in which Italian observers were writing is always appropriately foregrounded; the analysis of the work of individual writers is nuanced and sophisticated; and the exploration of the inter-relation of different positionalities is intriguing throughout. The text will be of interest to anyone interested in understanding the cultural history of Italy's relationship with China.» (Charles Burdett, Director, Institute of Languages, Cultures and Societies, University of London) Over the course of the twentieth century, China became a destination of choice for hundreds of the most prominent Italian writers, journalists, and politicians. Informed by the cultural, economic, and political relationship between Italy and China since the late 1890s, the travel narratives of these authors contributed to the creation of multiple and varied representations of the country. This book fills a gap in the study of the development of Italian travel narratives on twentieth-century China. It classifies the major portraits of China under five chronologically and ideologically ordered types of representation and offers readers a structured understanding of the processes of «writing» China in Italy. The study sheds new light on how China was associated with the specific cultural, political, and social traits of Italy and Italian culture; how it reinforced ideological indoctrination among Italian intellectual elites; and how significant such travel narratives were for the ideological orientation of the Italian readership. The authors discussed in the book include, among others: Luigi Barzini Sr., Mario Appelius, Arnaldo Cipolla, Franco Fortini, Carlo Cassola, Curzio Malaparte, Alberto Moravia, Goffredo Parise, Maria Antonietta Macciocchi, Gianni Rodari, Luigi Malerba, Alberto Arbasino, Edoarda Masi, and Tiziano Terzani

Abstract: From prehistoric bone flutes to Confucian bell-sets, from ancient divination to his beloved qin, this book presents translations of thirteen seminal essays on musical subjects by Jao Tsung-i. In language as elegant and refined as the ancient texts he so admired, his journey takes readers through Buddhist incantation, the philosophy of musical instruments, acoustical numerology, lyric poetry, historical and sociological contexts, manuscript studies, dance choreography, repertoire formulation, and opera texts. His voice is authoritative and intimate, the expert crafting his arguments, both accessible and sophisticated, succinct and richly tapestried; and concealed within a deft modesty is a thinker privileging us with his most profound observation. The musician’s musician, the scholar’s scholar, bold yet cautious, flamboyant yet restrained, a man for all seasons, a harmoniousness of time and place

Abstract: The Zhou Changes, better known in the West as I Ching, is one of the masterpieces of world literature. This book, the climax of more than forty years of research in Chinese archaeology, explores the text’s origins in the oracle-bone and milfoil divinations of Bronze Age China and how it transformed over the course of the Zhou dynasty into the first of the Chinese classics. The book provides an in-depth survey of the theory and practice of divination to demonstrate how the hexagram and line statements of the text were produced and how they were understood at the time

Abstract: Dunhuang: China’s traditional northwest frontier and overland conduit of exchange with the Old World. Jao Tsung-i: China’s last great traditional man of letters, polymath, and pioneer of comparative humanistic inquiry during Hong Kong’s global heyday. Jao and Dunhuang had a special relationship that this book makes accessible in English for the first time. Inside, Jao proposes an entirely new school of Chinese landscape painting, reconsiders Dunhuang’s oldest manuscripts as its newest research field, and explores topics ranging from comparative religion to medieval multimedia

Abstract: Dr. Hu Shih (1891-1962) was one of China's top scholars and diplomats and served as the Republic of China's ambassador to the United States during World War II. As early as 1941, Hu Shih warned of the fundamental ideological conflict between dictatorial totalitarianism and democratic systems, a view that later became the foundation of the Cold War narrative. In the 1950s, after Mao's authoritarian regime was established, Hu Shih started to analyze the development and nature of Communism, delivering a series of lectures and addresses to reveal what he called Stalin's "grand strategy" for facilitating the International Communist Movement. For decades--and today to a certain extent--Hu Shih's political writings were considered sensitive and even dangerous. As a strident critic of the Chinese Communist Party's oligarchical practices, he was targeted by the CCP in a concerted national campaign to smear his reputation, cast aspersions on his writings, and generally destroy any possible influence he might have in China. This volume brings together a collection of Hu Shih's most important, mostly unpublished, English-language speeches, interviews, and commentaries on international politics, China-U.S. relations, and the International Communist Movement. Taken together, these works provide an insider's perspective on Sino-American relations and the development of the International Communist Movement over the course of the 20th century

Abstract: Commissioned by the Qianlong emperor in 1751, the Qing Imperial Illustrations of Tributary Peoples (Huang Qing zhigong tu 皇清職貢圖), is a captivating work of art and an ideological statement of universal rule best understood as a cultural cartography of empire. This translation of the ethnographic texts accompanied by a full-color reproduction of Xie Sui’s (謝遂) hand-painted scroll helps us to understand the conceptualization of imperial tributary relationships the work embodies as rooted in both dynastic history and the specifics of Qing rule

Abstract: The ERC-funded research project BuddhistRoad aims to create a new framework to enable understanding of the complexities in the dynamics of cultural encounter and religious transfer in pre-modern Eastern Central Asia. Buddhism was one major factor in this exchange: for the first time the multi-layered relationships between the trans-regional Buddhist traditions (Chinese, Indian, Tibetan) and those based on local Buddhist cultures (Khotanese, Uyghur, Tangut) will be explored in a systematic way. The second volume Buddhism in Central Asia II—Practice and Rituals, Visual and Materials Transfer based on the mid-project conference held on September 16th–18th, 2019, at CERES, Ruhr-Universität Bochum (Germany) focuses on two of the six thematic topics addressed by the project, namely on "practices and rituals", exploring material culture in religious context such as mandalas and talismans, as well as “visual and material transfer”, including shared iconographies and the spread of ‘Khotanese’ themes

Abstract: "The Dumbarton Oaks Anthology of Chinese Garden Literature is the first comprehensive collection in English of over two millennia of Chinese writing about gardens and landscape. Its contents range from early poems using plant imagery to represent virtue and vice, through works from many dynasties on both private and imperial gardens, to twentieth-century prose descriptions of the reconstruction of a historic Suzhou garden. Most passages have been translated for this publication, but a number of previously published translations, some of which are now hard to find, are also included. The anthology is divided into nine chapters: five chronological, covering the pre-Qin period to the Qing dynasty; and four thematic, on rocks and flora, the evolution of a single site (Canglang Pavilion in Suzhou), gardens of the mind, and the interplay between garden and landscape as seen through Mount Tai and West Lake. An introductory essay positions Chinese gardens and garden literature in their cultural context. Care has been taken to translate plant names as accurately as possible (given the limitations of the sources), and the anthology includes a glossary showing translated names, Chinese names, and binomials"

Abstract: This book is concerned with socially engaged art projects in the Chinese countryside, with the artists and intellectuals who are involved, the villagers they meet and the local authorities with whom they negotiate. In recent years an increasing number of urban artists have turned towards the countryside in an attempt to revive rural areas perceived to be in a crisis. The vantage point of this book is the Bishan Commune. In 2010, Ou Ning drafted a notebook entitled Bishan Commune: How to Start Your Own Utopia. The notebook presents a utopian ideal of life based on anarchist Peter Kropotkin's idea of mutual aid. In 2011 the Commune was established in Bishan Village in Anhui Province. The main questions of this book thus revolve around how an anarchist, utopian community unfolds to the backdrop of the political, social and historical landscape of rural China, or more directly: How do you start your own utopia in the Chinese countryside?

Abstract: "Explores the politics of representation during the Han dynasty (206 BCE-220 CE), a pivotal time when China was asserting imperialist power on the Eurasian continent and expanding its local and long-distance markets.
