    Abstract: This book analyzes Russian and Chinese revisionism in the face of US and Western post-Cold War liberal international order building and asks why both powers have turned revisionist in the late 2000s. The study develops a neoclassical realist model of international order building and contestation and posits to view revisionism as a strategic choice. States go revisionist if the status quo international order threatens their vital security needs (broadly defined not only as territorial security, but also political, economic, normative and ontological) and if they have the means to challenge the undesirable status quo. Russia and China were both unhappy with the post-Cold War international order of American designs, but had to opt for accommodation in the 1990s and early 2000s (“strategic accommodation” in the Chinese case, “resentful accommodation” in the Russian case), before revisionism became even more of a necessity and a real policy option from the late 2000s onward (“constructive revisionism” in the Chinese case, “destructive revisionism” in the Russian case). The author calls for a policy of neo-containment to counter Moscow’s and Beijing’s efforts to game and erode the international order.     Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: This open access book considers a pivotal era in Chinese history from a global perspective. This book’s insight into Chinese and international history offers timely and challenging perspectives on initiatives like “Chinese characteristics”, “The New Silk Road” and “One Belt, One Road” in broad historical context. Global History with Chinese Characteristics analyses the feeble state capacity of Qing China questioning the so-called “High Qing” (shèng qīng 盛清) era’s economic prosperity as the political system was set into a “power paradox” or “supremacy dilemma”. This is a new thesis introduced by the author demonstrating that interventionist states entail weak governance. Macao and Marseille as a new case study aims to compare Mediterranean and South China markets to provide new insights into both modern eras’ rising trade networks, non-official institutions and interventionist impulses of autocratic states such as China’s Qing and Spain’s Bourbon empires.

    Abstract: The topic of human sacrifice, which tends to provoke both fascination and disgust, leaves few people indifferent and remains a highly contested academic issue. The present volume is not concerned with the historical reality of human sacrifice, a question that continues to divide historians and anthropologists. Rather, it is interested in how different ancient cultures represented human sacrifice differently, both theirs and that of others, either as an event or a symbol. How does a society confront what might have been -or what it thought was- its own cruel and bloody past? What are the culturally specific values through which human sacrifice was understood in each group, and how did they differ in the case of other related practices, such as anthropophagy? How have these perceptions changed over time, and how have they adapted to the transformations of ideology? The core of the volume is concerned with the abundantly detailed material of ancient Greece.     Abstract: "In BEIJING FROM BELOW, Harriet Evans weaves together oral history, archival research, and ethnographic knowledge to tell the story of the residents of Dashalar, an under-resourced Beijing neighborhood adjacent to Tiananmen Square. In popular thinking about China, the Mao and post-Mao development of Beijing's cityscape has often been understood as the result of teleological progression and entrance to a market economy. However, what is lost in such narratives are the effects that development has had on Beijing's urban underclass; for example, during the 1950s, construction projects throughout Beijing led to the mass displacement of many urban dwellers, and current development projects still require the forced movement of residents. In this book, which focuses on events from the 1950s onwards, Evans attends to the experiences of the working-class residents of Dashalar, using their own oral testimony and state records to understand how they interpret and relate to the changing city. In this regard, BEIJING FROM BELOW is a study on the interwoven nature of subaltern lives and state authority, as it seeks to discern subalternity within dominant state systems by shedding light on Beijing's overlooked residents. Through deft readings of the historical record, Evans also reveals how Dashalar's residents have been left out of the historical record, thereby providing an alternative historiography of Beijing outside of the progressive version offered by the People's Republic. This book is organized around the stories of individual families, and each chapter is followed by a critical interlude analyzing the main themes of the family's story. Through these narratives, Evans draws out historical and theoretical topics such as: reworking traumas from the past in service of surviving the present; the experiences of migrant families in an already under-resourced neighborhood; and the negotiations families and individuals are willing to make to find stability.     Abstract: This book examines the two most populous nations on earth – India and China – in an effort to demystify the interaction between intellectual property rights (IPR) regimes, innovation and economic growth by critically looking at the economic and legal realities. In addition, it analyzes the question of how innovation can best be transformed into IPR, and how IPR can best be exploited to encourage innovation. Comparing and contrasting these two giant nations can be highly beneficial as China and India were the two fastest-growing economies in the last three decades, and together their populations make up one third of the world’s total population; as such, exploring how to sustain their growth via innovation and commercialization of IPR could have a tremendous positive impact on global well-being. While a study of these two mega countries with such diverse dimensions and magnitudes can never be truly comprehensive, this joint effort by scholars from law, business management and economics disciplines that pursues an empirical approach makes a valuable contribution. Divided into three parts, the first offers an in-depth doctrinal and empirical analysis. The second part exclusively focuses on India, while the last is dedicated to China.

    Abstract: The book examines the rights of defendants in infringement procedures and those of the notifying parties in merger proceedings before the European Commission and the Chinese competition authorities. The initial chapters offer a general introduction to EU and Chinese competition law respectively, paying particular attention to the substantive rules of competition law. Subsequent chapters present an overview of the procedural rights of the notifying parties in merger cases in both legal systems surveyed, address the procedural rights of defendants in infringement cases, and provide an international perspective on differences in the notification and enforcement procedures between legal systems. The final chapter draws comparative conclusions and includes a number of suggestions for improvement.

    Abstract: This book is highly topical. The shift from the multilateral WTO negotiations to bilateral and regional Free Trade Agreements has been going on for some time, but it is bound to accelerate after the WTO Doha round of negotiations is now widely regarded as a failure. However, there is a particular regional angle to this topic as well. After concluding that further progress in the Doha round was unlikely, Pacific Rim nations recently have progressed with the negotiations of a greatly expanded Trans-Pacific Partnership Agreement that includes industrialised economies and developed countries such as the United States, Japan, Australia and New Zealand, recently emerged economies such as Singapore, but also several developing countries in Asia and Latin America such as Malaysia and Vietnam. US and EU led efforts to conclude FTAs with Asia-Pacific nations are also bound to accelerate again, after a temporary slowdown in the negotiations following the change of government in the United States and the expiry of the US President’s fast-track negotiation authority. The book will provide an assessment of these dynamics in the world’s fastest growing region. It will look at the IP chapters from a legal perspective, but also put the developments into a socio-economic and political context. Many agreements in fact are concluded because of this context rather than for purely economic reasons or to achieve progress in fields like IP law. The structure of the book follows an outline that groups countries into interest alliances according to their respective IP priorities. This ranges from the driving forces of the EU, US and Japan, via Asia-Pacific resource-rich but IP poor economies such as Australia and New Zealand, recently emerged economies with strong IP systems such as Singapore and Korea to leading developing countries such as China and India and ‘second tier industrializing economies’ such as Thailand, Malaysia and Indonesia

    Abstract: This book provides a unique empirical study of criminal trials in China. Western observers such as the media, politicians and the legal scholars alike, have rarely had the exposure to the vast majority of the ordinary criminal trials in China. A number of legal reforms have been implemented in Chinese criminal courts in recent years, but there has been little research on whether these reforms have been effective. This book fills that gap, by unveiling the day-to-day reality of criminal cases tried by the lowest level courts in China. The data used in this study include hundreds of criminal trial observations, complete criminal case dossiers, and a comprehensive questionnaire survey of criminal justice practitioners from one large province located in China’s Southeast coast. These data were collected over a two-year period, with a generous research grant from the John D. and Catherine T. MacArthur Foundation, by scholars already working in the Chinese legal system.     Abstract: This volume addresses the role of the judge and the parties in civil litigation in mainland China, Hong Kong and various European jurisdictions. It provides an overview and an analysis of how these respective roles have been changed in order to cope with growing caseloads and quality demands. It also shows the different approaches chosen in the jurisdictions covered. Mainland China is introducing far-reaching reforms in its system of civil litigation. From an inquisitorial procedure, in which the parties play a relatively minor role, the country is changing to a more adversarial system with increased powers for the parties. At the same time, case management and the role of the judge as it is understood in mainland China remains different from case management and the role of the judge in Western countries, mainly as regards the limited powers of individual Chinese judges in this respect. Changes in China are justified by the ever-increasing case load of the Chinese courts and the consequent inability to deal with cases in an adequate manner, even though generally speaking Chinese courts still adjudicate civil cases within a relatively short time frame (this may, however, be problematic when viewed from the perspective of the quality of adjudication). Growing caseloads and quality concerns may also be observed in various European states and Hong Kong. In these jurisdictions the civil procedural systems have a relatively adversarial character and it is some of the adversarial features of the existing systems of procedure which are felt to be problematic. Therefore, the lawmakers have opted for increasing the powers of the judge, often making the judge and the parties mutually responsible for the proper conduct of civil cases. Starting from opposite directions, mainland China and the various European states and Hong Kong could meet half way in their reform attempts. This is, however, only possible if a proper understanding is fostered of the developments in these different parts of the World. Even though in both China and Europe the academic community and lawmakers are showing a keen interest in the relevant developments abroad, a study addressing the role of the judge and the parties in civil litigation in both China and Europe is still missing.     Abstract: What happens when UNESCO heritage conventions are ratified by a state? How do UNESCO’s global efforts interact with preexisting local, regional and state efforts to conserve or promote culture? What new institutions emerge to address the mandate? The contributors to this volume focus on the work of translation and interpretation that ensues once heritage conventions are ratified and implemented. With seventeen case studies from Europe, Africa, the Caribbean and China, the volume provides comparative evidence for the divergent heritage regimes generated in states that differ in history and political organization. The cases illustrate how UNESCO’s aspiration to honor and celebrate cultural diversity diversifies itself. The very effort to adopt a global heritage regime forces myriad adaptations to particular state and interstate modalities of building and managing heritage.

    Abstract: This book examines the ways in which China’s universities have changed in the dramatic move to a mass stage which has unfolded since the late 1990s. Twelve universities in different regions of the country are portrayed through the eyes of their students, faculty and leaders. The book begins with the national level policy process around the move to mass higher education. This is followed by an analysis of the views of 2,300 students on the 12 campuses about how the changes have affected their learning experiences and civil society involvement. The 12 portraits in the next section are of three comprehensive universities, three education-related universities, three science and technology universities, and three newly emerging private universities. The final chapter sketches the contours of an emerging Chinese model of the university, and explores its connections to China’s longstanding scholarly traditions.

    Abstract: How does copyright law take into account the interests of third parties, especially the general publics interest in the greatest possible dissemination of knowledge and culture? Twelve basic questions give copyright law experts from more than forty countries the opportunity to provide answers related to their national law on the following matters: categories of works and subject matter, eligibility conditions, duration, "users rights, the three-step test, misuse, differentiations between categories of right holders, TPM, and relations of copyright law to other legal areas such as fundamental rights, competition law, consumer protection law, media law etc. The standardized form of the reports makes it easy to see the impacts of copyright law in the industrialized countries as well as in emerging economies; in common-law and civil-law approaches; in countries of the Andean Community and of the European Union, as well as in countries that are not party to the WIPO Treaties. A detailed preliminary chapter provides an approachable overview of issues and results. This chapter also discusses the voice of academia, represented by the European Copyright Code of the "Wittem Group.

    Abstract: Für die Kolonialkriege im Zeitalter des Imperialismus galt nationenübergreifend der Grundsatz: Jede Form militärischer Gewalt - also auch gegen Frauen und Kinder - ist erlaubt, sofern sie der eigenen Kriegführung dient. In dieser empirischen Untersuchung der »großen« deutschen Kolonialkriege zu Beginn des 20. Jahrhunderts, dem Boxerkrieg in China 1900/01, dem Herero- und Namakrieg in Deutsch-Südwestafrika 1904-07 sowie dem Majimajikrieg 1905-08 in Deutsch-Ostafrika, wird dargelegt, dass Form und Ausmaß der Gewalt in jenen Kriegen durch das situative Zusammenspiel verschiedener Faktoren bestimmt wurden. Es entwickelte sich vor Ort jeweils eine eigene, nicht vorhersehbare Dynamik. Die Ausübung extremer Gewalt bis hin zum Genozid war immer möglich. "Im Gesamten ist das Buch von Susanne Kuß eine hervorragend recherchierte und gut in den wissenschaftlichen Diskurs eingebettete Untersuchung zur Gewalt in der deutschen Kolonialgeschichte. Eine umfassende vergleichende Studie zu den kolonialen Kriegen war besonders angesichts der hitzig geführten Debatte um Kontinuitäten zwischen Kolonialismus und Nationalsozialismus sicherlich wünschenswert. Susanne Kuß nimmt diese Debatte auf und gibt mit ihrem Konzept des Kriegsschauplatzes wichtige Denkanstöße" (hsozkult.geschichte.hu-berlin.de)
