    Abstract: Constitutional bargains are seen as cornerstones of democratic transitions in much of the world. Yet very few studies have theorized about the link between constitution-making and democratization. Shifting the focus on democratization away from autocratic regime break down, this book considers the importance of inclusive constitution-building for democratization. In this pathbreaking volume, Tofigh Maboudi draws on a decade of research on the Arab Spring to explain when and how constitutional bargains facilitate (or hinder) democratization. Here, he argues that constitutional negotiations have a higher prospect of success in establishing democracy if they resolve societal, ideological, and political ills. Emphasizing the importance of constitution-making processes, Maboudi shows that constitutions can resolve these problems best through participatory and inclusive processes. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

Nowhere is this more evident than in their promotion of the map of greater Kurdistan, a unified ideal homeland which encompasses large swathes of Turkey, Iraq, Syria and Iran, and a small part of Armenia, in a region with a complex history of ethnic, cultural and political background. The main Kurdish political actors in each of these states claim some ownership or control over a part of a state's territory and they are usually careful to restrict their claims to within the state they reside. All these Kurdistans have been geographically, economically and culturally marginalised in each state and have historically been buffer zones between regional and colonial powers. The idea of greater Kurdistan combines these areas and puts Kurdistan at the centre rather than in the margins. The map of greater Kurdistan is embedded in the consciousness of the majority of Kurdish people, both within the region and, perhaps even more strongly, in the diaspora. The territory it depicts, Kurdistan, has never been a recognised state and does not have a unified political leadership. Yet the concept of Kurdistan, as a cultural and political abstract, survives the reality and exists in the minds of Kurdish nationalists, their supporters as well as those who deny it. A number of specific cases are examined to illustrate this analysis, including Colombian negotiations with the FARC, Greece and the EU, Iran nuclear proliferation, French friendship treaties with Germany and Algeria, Chinese business negotiations, and trade negotiations in Asia.     Abstract: Since the elections of 2002, Erdogan's AKP has dominated the political scene in Turkey. This period has often been understood as a break from a 'secular' pattern of state-building. But in this book, Ceren Lord shows how Islamist mobilisation in Turkey has been facilitated from within the state by institutions established during early nation-building. Lord thus challenges the traditional account of Islamist AKP's rise that sees it either as a grassroots reaction to the authoritarian secularism of the state or as a function of the state's utilisation of religion. Tracing struggles within the state, Lord also shows how the state's principal religious authority, the Presidency of Religious Affairs (Diyanet) competed with other state institutions to pursue Islamisation. Through privileging Sunni Muslim access to state resources to the exclusion of others, the Diyanet has been a key actor ensuring persistence and increasing salience of religious markers in political and economic competition, creating an amenable environment for Islamist mobilisation.

    Abstract: Transformative peace operations fall short of achieving the modern political order sought in post-conflict countries because the interventions themselves empower post-conflict elites intent on forging a neopatrimonial political order. The Peacebuilding Puzzle explains the disconnect between the formal institutional engineering undertaken by international interventions, and the governance outcomes that emerge in their aftermath. Barma's comparative analysis of interventions in Cambodia, East Timor, and Afghanistan focuses on the incentives motivating domestic elites over a sequence of three peacebuilding phases: the elite peace settlement, the transitional governance period, and the aftermath of intervention. The international community advances certain forms of institutional design at each phase in the pursuit of effective and legitimate governance. Yet, over the course of the peacebuilding pathway, powerful post-conflict elites co-opt the very processes and institutions intended to guarantee modern political order and dominate the practice of governance within those institutions to their own ends.     Abstract: The book’s main contribution is its interdisciplinary approach to the issue of sedation at the end-of-life. Because it occurs at the end of life, palliative sedation raises a number of important ethical and legal questions, including whether it is a covert form of euthanasia and for what purposes it may legally be used. Many of the book chapters address the first question and almost all deal with a specific form of the second: whether palliative sedation should be used for those experiencing “existential suffering”? This raises the question of what existential suffering is, a topic that is also discussed in the book. The different chapters address these issues from the perspectives of the relevant disciplines: Palliative Medicine, Bioethics, Law and Theology. Hence, helpful accounts of the clinical and historical background for this issue are provided and the importance of drawing accurate ethical and legal distinctions is stressed throughout the whole book. So the volume represents a valuable contribution to the emerging literature on this topic and should be helpful across a broad spectrum of readers: philosophers, theologians and physicians

    Abstract: This volume addresses some of the most prominent questions in contemporary bioethics and philosophy of medicine: ‘liberal’ eugenics, enhancement, the normal and the pathological, the classification of mental illness, the relation between genetics, disease and the political sphere, the experience of illness and disability, and the sense of the subject of bioethical inquiry itself. All of these issues are addressed from a “continental” perspective, drawing on a rich tradition of inquiry into these questions in the fields of phenomenology, philosophical hermeneutics, French epistemology, critical theory and post-structuralism. At the same time, the contributions engage with the Anglo-American debate, resulting in a fruitful and constructive conversation that not only shows the depth and breadth of continental perspectives in bioethics and medicine, but also opens new avenues of discussion and exploration. For decades European philosophers have offered important insights into the relation between the practices of medicine, the concept of illness, and society more broadly understood. These interventions have generally striven to be both historically nuanced and accessible to non-experts. From Georges Canguilhem’s seminal The Normal and the Pathological, Michel Foucault’s lectures on madness, sexuality, and biopolitics, Hans Jonas’s deeply thoughtful essays on the right to die, life extension, and ethics in a technological age, Hans-Georg Gadamer’s lectures on The Enigma of Health, and more recently Jürgen Habermas’s carefully nuanced interventions on the question of liberal eugenics, these thinkers have sought to engage the wider public as much as their fellow philosophers on questions of paramount importance to current bioethical and social-political debate. The essays contained here continue this tradition of engagement and accessibility. In the best practices of European philosophy, the contributions in this volume aim to engage with and stimulate a broad spectrum of readers, not just experts. In doing so the volume offers a showcase of the richness and rigor of continental perspectives on medicine and society.

It also looks in detail at the case of Japan, and identifies the parallels between the process by which Japanese and Indonesian nationalist scholars drew on European romantic organicist ideas to forge 'anti-Western' national identities and ideologies. The book then turns to Indonesia's tumultuous history from the revolution to 1965, the rise of Soeharto, and how his regime used organicist ideology, together with law and terror, to shape the political landscape consolidate control. In turn, it shows how the social and economic changes wrought by the government's policies, such as the rise of a cosmopolitan middle class and a rapidly growing urban proletariat led to the failure of the corporatist political infrastructure and the eventual collapse of the New Order in 1998. Finally, the epilogue surveys the post Soeharto years to 2014, and how growing disquiet about the inability of the government to contain religious intolerance, violence and corruption, has led to an increased readiness to re-embrace not only more authoritarian styles of rule but also ideological formulas from the past"--

Despite increased sub-national activity in immigration regulation in several federal states, very little research has been dedicated so far to comparing how federal states deal with immigration federalism. Comparative studies on the human rights implications of immigration federalism have received even less attention. This book seeks to fill the gap in this area and is an important contribution to the field, providing the reader with a better understanding of the complex issues surrounding immigration federalism and its impact on non-citizens

    Abstract: Why does Islam seem to dominate Egyptian politics, especially when the country's endemic poverty and deep economic inequality would seem to render it promising terrain for a politics of radical redistribution rather than one of religious conservativism?     Abstract: This book is concerned with two intimately related topics of metaphysics: the identity of entities and the foundations of classification. What it adds to previous discussions of these topics is that it addresses them with respect to human-made entities, that is, artefacts. As the chapters in the book show, questions of identity and classification require other treatments and lead to other answers for artefacts than for natural entities. These answers are of interest to philosophers not only for their clarification of artefacts as a category of things but also for the new light they may shed on these issue with respect to to natural entities. This volume is structured in three parts. The contributions in Part I address basic ontological and metaphysical questions in relation to artefact kinds: How should we conceive of artefact kinds? Are they real kinds? How are identity conditions for artefacts and artefact kinds related? The contributions in Part II address meta-ontological questions: What, exactly, should an ontological account of artefact kinds provide us with? What scope can it aim for? Which ways of approaching the ontology of artefact kinds are there, how promising are they, and how should we assess this? In Part III, the essays offer engineering practice rather than theoretical philosophy as a point of reference.     Abstract: "Ever since China and Vietnam resumed diplomatic contacts and reopened the border in 1991, the borderland region has come been part of the vibrant growing economies of both countries and drawn many from the interior provinces to the borderland for new economic adventures. This book examines Chinese-Vietnamese relationships at the borderland through every day cross-border interactions in trade and tourism activities. It looks into the historical underlining of bilateral relations of the two countries which often shape people's perceptions of the 'other' and interpretation of intentions of acts in their daily interactions. Albeit Chinese and Vietnamese have lived side by side for centuries, their interactions in the space of trade and modern tourism activities in post-war and post-reform China and Vietnam are something novel to both people. The book provides a 'bottom-up' approach to examine localized experiences of inter-state relations. It illustrates the changes the vibrant economic process has brought to the borderland communities, and how the newly revived contacts and interactions have provided a contested space for testing Vietnamese-Chinese interactions and demonstrating trans-border cultural politics.     Abstract: A logic is called 'paraconsistent' if it rejects the rule called 'ex contradictione quodlibet', according to which any conclusion follows from inconsistent premises. While logicians have proposed many technically developed paraconsistent logical systems and contemporary philosophers like Graham Priest have advanced the view that some contradictions can be true, and advocated a paraconsistent logic to deal with them, until recent times these systems have been little understood by philosophers. This book presents a comprehensive overview on paraconsistent logical systems to change this situation. The book includes almost every major author currently working in the field. The papers are on the cutting edge of the literature some of which discuss current debates and others present important new ideas. The editors have avoided papers about technical details of paraconsistent logic, but instead concentrated upon works that discuss more "big picture" ideas. Different treatments of paradoxes takes centre stage in many of the papers, but also there are several papers on how to interpret paraconistent logic and some on how it can be applied to philosophy of mathematics, the philosophy of language, and metaphysics

    Abstract: This book provides the first comprehensive account of Humes conception of objects in Book I of A Treatise of Human Nature. What, according to Hume, are objects? Ideas? Impressions? Mind-independent objects? All three? None of the above? Through a close textual analysis, Rocknak shows that Hume thought that objects are imagined ideas. But, she argues, he struggled with two accounts of how and when we imagine such ideas. On the one hand, Hume believed that we always and universally imagine that objects are the causes of our perceptions. On the other hand, he thought that we only imagine such causes when we reach a "philosophical level of thought. This tension manifests itself in Humes account of personal identity; a tension that, Rocknak argues, Hume acknowledges in the Appendix to the Treatise. As a result of Rocknaks detailed account of Humes conception of objects, we are forced to accommodate new interpretations of, at least, Humes notions of belief, personal identity, justification and causality.

    Abstract: This book provides an analytical interpretation of Leibniz's 'Essais de Théodicée' with wide-ranging references to all his works. It shows and upholds many thesis: Leibniz's rational conception of faith, his rational notion of mystery, the reformation of classical ontology, and the importance of Leibniz's thought in the tradition of the critical idealism. In his endeavor to formulate a theodicy, Leibniz emerges as a classic exponent of a non-immanentist modern rationalism, capable of engaging in a close dialogue with religion and faith. This relation implies that God and reason are directly involved in posing the challenge and that the defence of one is the defence of the other. Theodicy and logodicy are two key aspects of a philosophy which is open to faith and of a faith which is able to intervene in culture and history.

    Abstract: This profound exploration of one of the core notions of philosophy-the concept of existence itself-reviews, then counters (via Meinongian theory), the mainstream philosophical view running from Hume to Frege, Russell, and Quine, summarized thus by Kant: “Existence is not a predicate.” The initial section of the book presents a comprehensive introduction to, and critical evaluation of, this mainstream view. The author moves on to provide the first systematic survey of all the main Meinongian theories of existence, which, by contrast, reckon existence to be a real, full-fledged property of objects that some things possess, and others lack. As an influential addition to the research literature, the third part develops the most up-to-date neo-Meinongian theory called Modal Meinongianism, applies it to specific fields such as the ontology of fictional objects, and discusses its open problems, laying the groundwork for further research.In accordance with the latest trends in analytic ontology, the author prioritizes a meta-ontological viewpoint, adopting a dual definition of meta-ontology as the discourse on the meaning of being, and as the discourse on the tools and methods of ontological enquiry. This allows a balanced assessment of philosophical views on a cost-benefit basis, following multiple criteria for theory evaluation. Compelling and revealing, this new publication is a vital addition to contemporary philosophical ontology.

    Abstract: Relevant to, and drawing from, a range of disciplines, the chapters in this collection show the diversity, and applicability, of research in Bayesian argumentation. Together, they form a challenge to philosophers versed in both the use and criticism of Bayesian models who have largely overlooked their potential in argumentation. Selected from contributions to a multidisciplinary workshop on the topic held in Lund, Sweden, in autumn 2010, the authors count legal scholars and cognitive scientists among their number, in addition to philosophers. They analyze material that includes real-life court cases, experimental research results, and the insights gained from computer models.The volume provides a formal measure of subjective argument strength and argument force, robust enough to allow advocates of opposing sides of an argument to agree on the relative strengths of their supporting reasoning. With papers from leading figures such as Mike Oaksford and Ulrike Hahn, the book comprises recent research conducted at the frontiers of Bayesian argumentation and provides a multitude of examples in which these formal tools can be applied to informal argument. It signals new and impending developments in philosophy, which has seen Bayesian models deployed in formal epistemology and philosophy of science, but has yet to explore the full potential of Bayesian models as a framework in argumentation. In doing so, this revealing anthology looks destined to become a standard teaching text in years to come.

    Abstract: In this book, an international group of philosophers, economists and theologians focus on the relationship between justice, luck and responsibility in health care. Together, they offer a thorough reflection on questions such as: How should we understand justice in health care? Why are health care interests so important that they deserve special protection? How should we value health? What are its functions and do these make it different from other goods? Furthermore, how much equality should there be? Which inequalities in health and health care are unfair and which are simply unfortunate? Which matters of health care belong to the domain of justice, and which to the domain of charity? And to what extent should we allow personal responsibility to play a role in allocating health care services and resources, or in distributing the costs? With this book, the editors meet a double objective. First, they provide a comprehensive philosophical framework for understanding the concepts of justice, luck and responsibility in contemporary health care; and secondly, they explore whether these concepts have practical force to guide normative discussions in specific contexts of health care such as prevention of infectious diseases or in matters of reproductive technology. Particular and extensive attention is paid to issues regarding end-of-life care.
