    Abstract: In general, the history of virtue theory is well-documented (Sherman, 1997; O’Neill, 1996). Its relationship to medicine is also recorded in our work and in that of others (Pellegrino and Thomasma, 1993b; 1996; Drane, 1994; Ellos, 1990). General publications stress the importance of training the young in virtuous practices. Still, the popularity of education in virtue is widely viewed as part of a conservative backlash to modern liberal society. Given the authorship of some of these works by professional conservatives like William Bennett (1993; 1995), this concern is authentic. One might correspondingly fear that greater adoption of virtue theory in medicine will be accompanied by a corresponding backward-looking social agenda. Worse yet, does reaffirmation of virtue theory lacquer over the many challenges of the postmodern world view as if these were not serious concerns? After all, recreating the past is the “retro” temptation of our times. Searching for greater certitude than we can now obtain preoccupies most thinkers today. One wishes for the old clarity and certitudes (Engelhardt, 1991). On the other hand, the same thinkers who yearn for the past, like Engelhardt sometimes seems to do, might stress the unyielding gulf between past and present that creates the postmodern reaction to all systems of Enlightenment thought (1996).

    Abstract: At the origin of this volume, a simple question: what to make of that surprisingly monotonous series of statements produced by our societies and our philosophers that all converge in one theme - the importance of difference? To clarify the meaning of the difference at stake here, we have tried to rephrase it in terms of the two major and mutually competing paradigms provided by the history of phenomenology only to find both of them equally unable to accommodate this difference without violence. Neither the ethical nor the ontological approach can account for a subject that insists on playing a part of its own rather than following the script provided for it by either Being or the Good. What appears to be, from a Heideggerian or Levinasian perspective, an unwillingness to open up to what offers to deliver us from the condition of subjectivity is analysed in these pages as a structure in its own right. Far from being the wilful, indifferent and irresponsive being its critics have portrayed it to be, the so-called 'postmodern' subject is essentially finite, not even able to assume the transcendence to which it owes its singularity. This inability is not a lack - it points instead to a certain unthought shared by both Heidegger and Levinas which sets the terms for a discussion no longer our own. Instead of blaming Heidegger for underdeveloping 'being-with', we should rather stress that his account of mineness may be, in the light of contemporary philosophy, what stands most in need of revision. And, instead of hailing Levinas as the critic whose stress on the alterity of the Other corrects Heidegger's existential solipsism, the problems into which Levinas runs in defining that alterity call for a different diagnosis and a corresponding change in the course that phenomenology has taken since. Instead of preoccupying itself with the invisible, we should focus on the structures of visibility that protect us from its terror. The result? An account of difference that is neither ontological nor ethical, but 'mè-ontological', and that can help us understand some of the problems our societies have come to face (racism, sexism, multiculturalism, pluralism). And, in the wake of this, an unexpected defence of what is at stake in postmodernism and in the question it has refused to take lightly: who are we? Finally, an homage to Arendt and Lyotard who, if read through each other's lenses, give an exact articulation to the question with which our age struggles: how to think the 'human condition' once one realizes that there is an 'inhuman' side to it which, instead of being its mere negation, turns out to be that without which it would come to lose its humanity?

    Abstract: Modern liberalism asserts the transcendental, autonomous self's 'natural rights' against others' moralistic and political preferences, and regards the economist's utilitarian social welfare theory as instrumental to the achievement of 'social justice'. Timothy Roth argues that the liberal enterprise ignores Kant's 'two points of view', confuses Kantian autonomy with moral and political license, mistakes utilitarian impersonality for impartiality, and takes no account of the indeterminacy of social welfare theory's fundamental theoretical constructs. In contrast, the author shows that Kant's 'two points of view' inform the conservative's constitutive political position and animate the consequence-detached, explicitly normative work of the conservative, constitutional political economist. He shows that, unlike modern liberalism, conservatism is grounded in Kant's 'two points of view', that utilitarian social welfare theory cannot be instrumental to the achievement of social justice, and that constitutional political economy is conservative economics. Economists interested in political economy, methodological issues, social welfare theory, public choice theory, or the moral foundations of economics will find much of interest in this thought-provoking volume. Political scientists interested in the philosophical foundations of modern liberalism and conservatism will also want to add this title to their library

    Abstract: Aristotle thought of his logic and methodology as applications of the Socratic questioning method. In particular, logic was originally a study of answers necessitated by earlier answers. For Aristotle, thought-experiments were real experiments in the sense that by realizing forms in one's mind, one can read off their properties and interrelations. Treating forms as independent entities, knowable one by one, committed Aristotle to his mode of syllogistic explanation. He did not think of existence, predication and identity as separate senses of estin. Aristotle thus serves as an example of a thinker who did not rely on the distinction between the allegedly different Fregean senses, thereby shedding new light on our own conceptual presuppositions. This collection comprises several striking interpretations that Jaakko Hintikka has put forward over the years, constituting a challenge not only to Aristotelian scholars and historians of ideas, but to everyone interested in logic, epistemology or metaphysics and in their history.

    Abstract: Launch activities performed by private entities deal with a complex legal environment. The Space Treaties provide a general liability framework. Launch participants are subject to regulatory or institutional control, and to domestic liability laws. Specific contractual practice has developed due to insurance limitations, the inter-participants' waivers of liability and claims. This book synthesizes information on the norms of play, to allow the grasp of their relative weight and interactions in the assessment of liability risk for launch activities. It reveals a legal framework presently lacking sufficient predictability for an efficient liability risk management: the waivers of liability suffer weaknesses as do all such clauses, and lack uniformity and reliability; and the Space Treaties contain ambiguous terms preventing predictable determination of the States responsible for authorizing and supervising launch activities and for damage compensation, and do not reflect the liability of launch operators. This book offers suggestions of new approaches for: harmonizing waivers of liability to improve their consistency, validity and flow-down; and improving the Space Treaties for their implementation to non-governmental launch activities. In the launch community, the need for lawmaking is less compelling than in fields such as aviation. Nevertheless, adjustments to the present framework are proposed through model clauses and an international instrument, for further thinking and contribution by those sharing the opinion that creative lawmaking is needed now to prepare for tomorrow's endeavors.

    Abstract: According to Putnam to talk of “facts” without specifying the language to be used is to talk of nothing; “object” itself has many uses and as we creatively invent new uses of words “we find that we can speak of ‘objects’that were not ‘values of any variable’in 1 any language we previously spoke” . The notion of object becomes, then, like the notion of reference, a sort of open land, an unknown territory. The exploration of this land - pears to be constrained by use and invention. But, we may wonder, is it possible to guide invention and control use? In what way, in particular, is it possible, at the level of na- ral language, to link together program expressions and natural evolution? To give an answer to these onerous questions we should immediately point out that cognition (as well as natural language) has to be considered first of all as a peculiar fu- tion of active biosystems and that it results from complex interactions between the - ganism and its surroundings. “In the moment an organism perceives an object of wh- ever kind, it immediately begins to ‘interpret’this object in order to react properly to it . . . It is not necessary for the monkey to perceive the tree in itself. . . What counts is sur- 2 vival” .

    Abstract: Traditionally, logic has been claimed to be 'the science of rational argument', but the relevance to our everyday disputes of the formal logician's results has remained unclear. The abstract character of traditional logic cuts the subject off from practical considerations; Mr Toulmin enquires why this is so, and shows how an alternative conception can be of more general value. Starting from an examination of the actual procedures in different fields of argument - the practice, as opposed to the theory, of logic - he discloses a richer variety than is allowed for by any available system. He argues that jurisprudence rather than mathematics should be the logician's model in analysing rational procedures, and that logic should be a comparative and not a purely formal study. These suggestions lead to conclusions which many will consider controversial; though they will also be widely recognized as interesting and illuminating. This book extends into general philosophy lines of enquiry already sketched by Mr Toulmin in his earlier books on ethics and the philosophy of science. The ordinary reader will find in it the same clarity and intelligibility; and the professional philosopher will acknowledge the same power to break new ground (and circumvent old difficulties) by posing fresh and stimulating questions

    Abstract: The study of information-based actions and processes has been a vibrant - terface between logic and computer science for several decades now. Indeed, several natural perspectives come together here. On the one hand, logical s- tems may be used to describe the dynamics of arbitrary computational p- cesses – as in the many sophisticated process logics available today. But also, key logical notions such as model checking or proof search are themselves informational processes involving agents with goals. The interplay between these descriptive and dynamic aspects shows even in our ordinary language. A word like “proof” hdenotes both a static ‘certificate’ of truth, and an activity which humans or machines engage in. Increasing our understanding of l- ics of this sort tells us something about computer science, and about cognitive actions in general. The individual chapters of this book show the state of the art in current - vestigations of process calculi such as linear logic, and – with mainly two major paradigms at work, namely, linear logic and modal logic. These techniques are applied to the title themes of concurrency and synchronisation, but there are also many repercussions for topics such as the geometry of proofs, categorial semantics, and logics of graphs. Viewed - gether, the chapters also offer exciting glimpses of future integration, as the reader moves back and forth through the book.

    Abstract: Im Forschungsprojekt Georg Lukács und Wien wurde das Verhältnis zwischen der intellektuellen Entwicklung des jungen Georg Lukács und der Kultur der Wiener Jahrhundertwende untersucht. Schwerpunkt war es daher, Lukács' Tätigkeit nach Aspekten zu untersuchen, welche mit der Wiener Kultur um 1900 in Zusammenhang stehen.Als erstes wurde das über das Thema. 'Lukács und Wien' in der bisherigen Forschung Gesagte festgehalten. Es wurde anschließend das methodische Vorgehen der als Standardwerke geltenden Kulturstudien über die Wiener Jahrhundertwende skizziert und die Methode der vorliegenden Arbeit bestimmt. Die relevanten biographischen Fakten wurden in den zwei Kapiteln über Lukács' Leben und über seine Ausbildung mit Schwerpunkt auf der Frage nach der Vermittlung der Probleme der zeitgenössischen österreichischen Philosophie an ihn - festgehalten. Wesentlich erscheint die Wirkung von Rudolf Kassner auf Lukács' Denken um 1910 zu sein. Eine zentrale Stelle nehmen Lukács' literaturkritische Texte über das moderne österreichische Drama und insbesondere über die Literatur von Arthur Schnitzler und Richard Beer-Hofmann ein. Die in diesen Texten entwickelten Theorien wurden von Lukács in einer Diskussion mit Mihály Babits bzw. im Text Ästhetische Kultur präzisiert. Anschliegend wurden die für die Fragestellung des Projekts relevanten Thesen von Lukács' Heidelberger ästhetischen Schriften analysiert. Die Einsicht in die in Lukács-Texten erscheinenden Theorien, welche im Forschungsprojekt mit den soeben aufgezählten Schritten gewonnen worden ist, wurde mit Überlegungen zur 'jüdischen Frage' bzw. mit der Analyse der Begriffe 'Liberalismus', 'Kultur' und 'Moderne' vertieft. Gleichzeitig wurde Lukács' Tätigkeit in den Kontext von 'Mitteleuropa' gesetzt.     Abstract: In the second half of the eighteenth century, German philosophy came for a while to dominate European philosophy. It changed the way in which not only Europeans, but people all over the world, conceived of themselves and thought about nature, religion, human history, politics, and the structure of the human mind. In this wide-ranging book, Terry Pinkard interweaves the story of 'Germany' - changing during this period from a loose collection of principalities into a newly-emerged nation with a distinctive culture-with an examination of the currents and complexities of its developing philosophical thought. He examines the dominant influence of Kant, with his revolutionary emphasis on 'self-determination', and traces this influence through the development of romanticism and idealism to the critiques of post-Kantian thinkers such as Schopenhauer and Kierkegaard. To fully understand and appreciate its meaning, she argues, we must attend to what its original language discloses. Through a close reading of the Greek text, attentive to the pervasiveness of story and myth, Baracchi investigates the dialogue's major themes. The first part of the book addresses issues of generation, reproduction, and decay as they apply to the founding of Socrates' just city.     Abstract: Ferdinand Ebner is next to Ludwig Wittgenstein the most important Austrian philosopher of language in the 20th century. In his main work Das Wort und die geistigen Realitäten. Pneumatologische Fragmente Ebner produces a new form of anthropology, which is based on a dialogic orientated understanding of human beings. Beside his philosophical works Ebner wrote many letters and diaries. One of the 14 existing diaries is the so-called "Mohlauer Tagebuch" from the 23rd of July to the 28 th of August 1920, which is kept on the "Brenner Archiv" in Innsbruck together with the philosophical texts and the letters. In this diary Ebner writes about his stay in Mühlau, a village near Innsbruck, where he was a guest of Ludwig von Ficker for one month and which was the beginning of a long friendship with the publisher of the Brenner. Ficker, who had already published some articles of Ebner in the Brenner, printed the Fragmente 1921, two years after Ebner wrote them. In this way Ficker became the publisher, promoter and friend of Ebner. According to some passages of the diary, Ebner experienced in Ficker a kind of acceptance and security, which he did not know before. This feeling of well-being is also a part of the deep impressions of nature, which Ebner got on many walks through the surrounding of Innsbruck. Although he was a thinker, who always emphasized the meaning of the word, these impressions showed him the limits of language. Ebner's basic opinions are presentated very clearly in his meetings with different members of the Brenner-circle and in the confrontation with the intellectual movements of the time. An example are his talks with Paul Bargehr about Buddhism, who was newly rediscovered in Europe in those days. Ebner understood the good will of Bargehr, but he cannot accept Buddhism as a solution for the big problems of the Europeans. In spite of Ebners turn to Christianity some years before the diary also shows the difficulties in the relation between Ebner and the Catholic church. Of special interest is Ebner's meeting with the painter Erich Lechleitner. In front of Lechleitner's pictures he has doubts about his radical pessimism concerning art and culture.The text of the diary is followed by a commentary, which explains the biographical, literary, philosophical, historical, etc. connections of passages in the diary. Pneumatologische Fragmente entwickelt Ebner eine neue Form von Anthropologie, die auf einem dialogisch geprägten Verständnis des Menschen basiert. Neben seinen philosophischen Schriften verfaßte Ebner aber auch unzählige Briefe und war zudem ein intensiver Tagebuchschreiber. Das sogenannte "Mühlauer Tagebuch" vom 23.7. bis 28.8.1920 ist eines von insgesamt 14 erhaltenen Tagebüchern Ebners, welche neben dem philosophischem Nachlaß und den Briefen am Brenner-Archiv aufbewahrt werden. In diesem Tagebuch schildert Ebner seinen einmonatigen Aufenthalt bei Ludwig von Ficker in Mühlau bei Innsbruck, der der Beginn einer jahrelangen Freundschaft ist. Ficker, der bereits einige Aufsätze Ebners in seiner Zeitschrift Der Brenner publiziert hat, läßt 1921 auch Ebners bereits 1919 fertiggestellte Fragmente im Brenner-Verlag erscheinen. So wird Ficker Ebners Verleger, Förderer und Freund. Aus mehreren Tagebucheintragungen geht hervor, daß Ebner bei Ficker eine Akzeptanz und Freundlichkeit erfährt, die ihm bisher fremd waren. Dieses für Ebner so seltene Gefühl des Wohlbefindens erfährt er auch bei seinen zahlreichen Spaziergängen mit Ficker, die zu intensiven Naturerlebnissen führen, sodaß Ebner, der die Bedeutung des Wortes immer wieder betont, auch Grenzen der sprachlichen Möglichkeiten wahrnimmt. Ebners geistige Einstellung tritt ganz klar und markant in der Begegnung mit verschiedenen Persönlichkeiten aus dem Brenner-Kreis und in der Auseinandersetzung mit den verschiedenen geistigen Strömungen zu dieser Zeit hervor. So wird er z.B. in der Person von Paul Bargehr mit dem Buddhismus konfrontiert, dem gegenüber er sich wenn auch nicht verständnislos so doch skeptisch äußert. Immer wieder zeigt sich auch seine Ablehnung der katholischen Amtskirche trotz seiner erst einige Jahre zuvor erfolgten Hinwendung zum Christenturn. Besonders interessant ist Ebners Begegnung mit dem Maler Erich Lechleitner.     Abstract: Privatisierung ist ein Zeichen tiefreichender Wandlungsprozesse im Verhältnis von Staat und Gesellschaft sowie in den Bereichen des öffentlichen und des Privatrechts. Verbreitet ist die Hoffnung, der unter seinen Kompetenz- und Finanzlasten schwerfällig gewordene Staatskoloß könne wieder 'schlank' werden, wenn er sich zugunsten gesellschaftlicher Kräfte aus Tätigkeitsbereichen zurückziehe. Wichtige Privatisierungsimpulse gehen nach wie vor von den Wettbewerbsbestimmungen des Europäischen Gemeinschaftsrechts aus. Auf kommunaler Ebene ist die 'Organisationsprivatisierung' verbreitet. Mit der Novellierung der Kommunalverfassungen versuchen die Landesgesetzgeber, dem Trend zur kommunalen Eigengesellschaft Einhalt zu gebieten, verletzen jedoch mitunter die Vorgaben des Gesellschaftsrechts. Jörn Axel Kämmerer weist nach, daß sich der Staat im Zuge des Privatisierungsprozesses keineswegs ganz zurückzieht. Vielmehr nimmt der Staat seine grundlegenden verfassungsrechtlichen Aufgaben auch in der 'Privatisierungsfolgenphase' weiterhin wahr – wenn auch nicht mehr durch eigene Leistungen, sondern als Garant und Regulator. Dabei wächst der Spielraum für 'private Grundrechtseingriffe', und die Grundrechte selbst wandeln sich zu Schutzpflichten. Zugleich bringt 'Organisationsprivatisierung', die Begründung privatrechtlich organisierter Wirtschaftsunternehmen der öffentlichen Hand ohne öffentlich-rechtliche Befugnisse, die Grenzen zwischen Staat und Gesellschaft zum Verschwimmen. Letztlich hat der Staat eine Gratwanderung vor sich, bei der er weiterhin als ausgleichende Instanz für eine komplexe, zur Selbstregulierung unfähige, aber in den transnationalen Bereich ausgreifende Gesellschaft agieren können muß, ohne in ihr aufzugehen.

    Abstract: The book investigates various strategies to provide countries with an incentive to accede, agree and comply to an international environmental agreement (IEA). Finus shows that by integrating real world restrictions into a model, game theory is a powerful tool for explaining the divergence between "first-best" policy recommendations and "second-best" designs of actual IEAs. For instance he explains why (inefficient) uniform emission reduction quotas have played such a prominent role in past IEAs despite economists' recommendations for the use of (efficient) market-based instruments as for example emission targets and permits. Moreover, it is stated, that a single, global IEA on climate is not necessarily the best strategy and small coalitions may enjoy a higher stability and may achieve more

    Abstract: Voluntary approaches are schemes whereby firms make commitments to improve their environmental performance.They cover arrangements such as public voluntary programmes, negotiated agreements or unilateral commitments. Until recently, voluntary approaches have not been subject to systematic analysis, inasmuch as, unlike taxes and tradable permits, they have not been prescribed by economic theory. Voluntary approaches were "invented" by those who devise and implement them: policy-makers, business associations, individual firms, non-governmental associations, etc. The use of voluntary approaches in environmental policy (e.g.negotiated agreements between Government and industry) is spreading and attracting growing interest in OECD countries. This book provides a systematic analysis of the different types of voluntary approaches, their economic characteristics, their role and effectiveness.

    Abstract: In der andauernden Auseinandersetzung um die Bedingungen des Ausstiegs aus der Nutzung der Kernenergie zur Stromerzeugung sind auch die verfassungsrechtlichen und europarechtlichen Rahmendaten umstritten. Auf Seiten der Kernkraftwerks-Betreiber wird die geplante Stillegung der Anlagen als eine grundsätzlich entschädigungspflichtige Enteignung angesehen. Demgegenüber kommt Erhard Denninger in seiner Studie zu dem Ergebnis, daß ein »Ausstiegsgesetz«, das die gewerbliche Nutzung der Atomenergie für die Zukunft überhaupt untersagt, eine verfassungsrechtlich zulässige Inhalts- und Schrankenbestimmung des Eigentums darstellt. Allerdings muß das schutzwürdige Vertrauen der bisherigen Kraftwerksbetreiber nach dem Grundsatz der Verhältnismäßigkeit berücksichtigt werden. Dies kann durch entsprechende Gestaltung der »Restlaufzeiten« geschehen. Die Arbeit beruht auf einem Rechtsgutachten für das Bundesumweltministerium. Der Verfasser ist mehrfach mit Arbeiten zu Verfassungsrechtsfragen im Technikrecht hervorgetreten

    Abstract: China's 1911-12 Revolution, which overthrew a two-thousand-year succession of dynasties, is thought of primarily as a change in governmental style, from imperial to republican, traditional to modern. But given that the dynasty that was overthrown - the Qing - was that of a minority ethnic group that had ruled China's Han majority for nearly three centuries, and that the revolutionaries were overwhelmingly Han, to what extent was the revolution not only anti-monarchical, but also anti-Manchu?Edward Rhoads explores this provocative and complicated question in Manchus and Han, analysing the evolution of the Manchus from a hereditary military caste (the "banner people") to a distinct ethnic group and then detailing the interplay and dialogue between the Manchu court and Han reformers that culminated in the dramatic changes of the early twentieth century.     Abstract: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them

    Abstract: In January 1998 leading scholars from Europe, the United States, and Israel in the fields of medieval encyclopedias (Arabic, Latin and Hebrew) and medieval Jewish philosophy and science gathered together at Bar-Ilan University in Ramat-Gan, Israel, for an international conference on medieval Hebrew encyclopedias of science and philosophy. The primary purpose of the conference was to explore and define the structure, sources, nature, and characteristics of the medieval Hebrew encyclopedias of science and philosophy. This book, the first to devote itself to the medieval Hebrew encyclopedias of science and philosophy, contains revised versions of the papers that were prepared for this conference.
