Keywords: Race discrimination Law and legislation ; Africans Legal status, laws, etc ; Customary law ; Civil rights ; Lateinamerika ; Rassismus ; Menschenrecht
Abstract: "There are approximately 150 million people of African descent in Latin America yet Afro-descendants have been consistently marginalized as undesirable elements of the society. Latin America has nevertheless long prided itself on its absence of U.S.-styled state-mandated Jim Crow racial segregation laws. This book disrupts the traditional narrative of Latin America's legally benign racial past by comprehensively examining the existence of customary laws of racial regulation and the historic complicity of Latin American states in erecting and sustaining racial hierarchies. Tanya Katerí Hernández is the first author to consider the salience of the customary law of race regulation for the contemporary development of racial equality laws across the region. Therefore, the book has a particular relevance for the contemporary U.S. racial context in which Jim Crow laws have long been abolished and a "post-racial" rhetoric undermines the commitment to racial equality laws and policies amidst a backdrop of continued inequality"--

Abstract: "What are the origins of nationalism and why is it capable of arousing such intense emotions? In this major study, Azar Gat counters the prevailing fashionable theories according to which nations and nationalism are modern and contrived or 'invented'. He sweeps across history and around the globe to reveal that ethnicity has always been highly political and that nations and national states have existed since the beginning of statehood millennia ago. He traces the deep roots of ethnicity and nationalism in human nature, showing how culture fits into human evolution from as early as our aboriginal condition and, in conjunction with kinship, defines ethnicity and ethnic allegiances. From the rise of states and empires to the present day, this book sheds new light on the explosive nature of ethnicity and nationalism, as well as on their more liberating and altruistic roles in forging identity and solidarity"--

Abstract: "There is huge variation in the nature, scope and institutional forms of legal protection for valuable geographical brands such as Champagne, Colombian coffee and Darjeeling tea. Although regional products are becoming more significant to producers, consumers and policy makers, the international legal regime under the TRIPs Agreement remains unclear. Adopting a historical approach, Dev Gangjee explores the rules regulating these brands within international intellectual property law. He traces the emergence of geographical indications as a distinct category and investigates the link between regional products and their places of origin. The research addresses longstanding puzzles, such as the multiplicity of regimes operating in this area; the recognition of the link between product and place and its current articulation in the TRIPs definition; the varying scope of protection; and the extent to which geographical indications ought to be treated as a category distinct from trade marks"--

Abstract: "The effective implementation of human rights treaty obligations in national law is subject to increasing attention. The main responsibility for the international monitoring of national implementation at the global level is entrusted to the UN human rights treaty bodies. These bodies are established by the respective human rights conventions and are composed of independent experts. This book examines three aspects of these bodies: the legal aspects of their structure, functions and decisions; their effectiveness in ensuring respect for human rights obligations; and the legitimacy of these bodies and their decisions. Containing contributions from a variety of eminent legal experts, including present and former members of the treaty bodies, the analysis should be read in light of the ongoing effort to strengthen treaty bodies under the auspices of the UN High Commissioner for Human Rights and with the involvement of relevant stakeholders"--

Abstract: "The return of religion to the public sphere raises various dilemmas. Rights and values, pluralism and identity, justice and efficacy, autonomy and tradition, and integration and toleration cannot always be balanced without the loss of something valuable. This volume of essays tackles such dilemmas from two perspectives. To begin, major contemporary theorists rethink the place of religion in the public sphere from republican, liberal and critical-theoretical viewpoints. Contributors then bring together theory and practice to better conceptualize and assess the latest developments in European jurisprudence with respect to religion"...

Note: "Theatre of the Rule of Law presents the first sustained critique of global rule of law promotion - an expansive industry at the heart of international development, post-conflict reconstruction and security policy today. While successful in articulating and disseminating an effective global public policy, rule of law promotion has largely failed in its stated objectives of raising countries out of poverty and taming violent conflict. Furthermore, in its execution, this work deviates sharply from 'the rule of law' as commonly conceived. To explain this, Stephen Humphreys draws on the history of the rule of law as a concept, examples of legal export during colonial times, and a spectrum of contemporary interventions by development agencies and international organisations. Rule of law promotion is shown to be a kind of theatre, the staging of a morality tale about the good life, intended for edification and emulation, but blind to its own internal contradictions"-- Provided by publisher

Abstract: "In this evaluation of the international legal standing of the right to reparation and its practical implementation at the national level, Christine Evans outlines State responsibility and examines the jurisprudence of the International Court of Justice, the Articles on State Responsibility of the International Law Commission and the convergence of norms in different branches of international law, notably human rights law, humanitarian law and international criminal law. Case studies of countries in which the United Nations has played a significant role in peace negotiations and post-conflict processes allow her to analyse to what extent transitional justice measures have promoted State responsibility for reparations, interacted with human rights mechanisms and prompted subsequent elaboration of domestic legislation and reparations policies. In conclusion, she argues for an emerging customary right for individuals to receive reparations for serious violations of human rights and a corresponding responsibility of States"--

Abstract: "This volume of essays contributes to the understanding of global law reform by questioning the assumption in law and development theory that laws fail to transfer because of shortcomings in project design and implementation. It brings together leading scholars who demonstrate that a synthesis of law and development, comparative law and regulatory perspectives (disciplines which to date have remained intellectually isolated from each other) can produce a more nuanced understanding about development failures. Arguing for a refocusing of the analysis onto the social demand for legal transfers, and drawing on empirically rich case studies, contributors explore what recipients in developing countries think about global legal reforms. This analytical focus generates insights into how key actors in developing countries understand global law reforms and how to better predict how legal reforms are likely to play out in recipient countries"--

Abstract: "In the years following the Napoleonic Wars, a mysterious manuscript began to circulate among the dissatisfied noble elite of the Russian Empire. Entitled 'The History of the Rus,' it became one of the most influential historical texts of the modern era. Attributed to an eighteenth-century Orthodox archbishop, it described the heroic struggles of the Ukrainian Cossacks. Alexander Pushkin read the book as a manifestation of Russian national spirit, but Taras Shevchenko interpreted it as a quest for Ukrainian national liberation and it would inspire thousands of Ukrainians to fight for the freedom of their homeland. Serhii Plokhy tells the fascinating story of the text's discovery and dissemination unravelling the mystery of its authorship and tracing its subsequent impact on Russian and Ukrainian historical and literary imagination. In so doing he brilliantly illuminates the relationship between history, myth, empire and nationhood from Napoleonic times to the fall of the Soviet Union"--

Abstract: "This book is the first comprehensive analysis of the politics of war crimes trials. It provides a systematic and theoretically rigorous examination of whether these trials are used as tools for political consolidation or whether justice is their primary purpose. The consideration of cases begins with the trial of Charles I of England and goes through the presidency of George W. Bush, including the trials of Saddam Hussein and those arising from the War on Terror. The book concludes that political consolidation is the primary concern of these trials - a point that runs contrary to the popular perception of the trials and their stated justification. Through the consideration of war crimes trials, this book makes a contribution to our understanding of power and conflict resolution and illuminates the developmental path of war crimes tribunals"--Provided by publisher

Abstract: "There is an enormous scholarly literature on law's treatment of religion. Most scholars now recognize that although the U.S. Supreme Court has not offered a consistent interpretation of what 'non-establishment' or religious freedom means, as a general matter it can be said that the First Amendment requires that government not give preference to one religion over another or, although this is more controversial, to religion over non-belief. But these rules raise questions that will be addressed in Legal Responses to Religious Practices in the United States: namely, what practices constitute a 'religious activity' such that it cannot be supported or funded by government? And what is a religion, anyway? How should law understand matters of faith and accommodate religious practices?"--

Abstract: "This book explores the tension between law's need for and dependence on merciful judgments and suspicions that regularly accompany them"--
Abstract: "Merciful Judgments in Contemporary Society: Legal Problems/Legal Possibilities explores the tension between law's need for and dependence on merciful judgments and suspicions that regularly accompany them. Rather than focusing primarily on definitional questions or the longstanding debate about the moral worth and importance of mercy, this book focuses on mercy as a part of, and problem, for law. Whether one starts from a worry about rules and discretion, about the attitudes of citizens and their leaders, or ways to undo the past, merciful judgments challenge and perplex, just as they help to sustain, our legal system. Charting these possibilities and problems is the work that this book seeks to do. Here we ask what challenges merciful judgments pose for law? When and why do those judgments encourage and nurture legal ingenuity and resourcefulness? When and why do they precipitate crises and breakdowns in legal authority? This book is a product of The University of Alabama School of Law symposia series on "Law, Knowledge & Imagination." This series explores the ways law is known and imagined in a diverse array of disciplines, including political science, history, cultural studies, philosophy, and science. In addition, books produced through the Alabama symposia explore various conjunctions of law, knowledge, and imagination as they play out in debates about theory and policy and speak to venerable questions as well as contemporary issues"--

Abstract: "A unique and revealing portrait of Saddam Hussein's Iraq which was every bit as authoritarian and brutal as Stalin's Russia or Mao's China"--
Abstract: "The Ba'th Party came to power in 1968 and remained for thirty-five years, until the 2003 U.S. invasion. Under the leadership of Saddam Hussein, who became president of Iraq in 1979, a powerful authoritarian regime was created based on a system of violence and an extraordinary surveillance network, as well as reward schemes and incentives for supporters of the party. The true horrors of this regime have been exposed for the first time through a massive archive of government documents captured by the United States after the fall of Saddam Hussein. It is these documents that form the basis of this extraordinarily revealing book and that have been translated and analyzed by Joseph Sassoon, an Iraqi-born scholar and seasoned commentator on the Middle East. They uncover the secrets of the innermost workings of Hussein's Revolutionary Command Council, how the party was structured, how it operated via its network of informers, and how the system of rewards functioned. Saddam Hussein's authority was dominant. His decision was final, whether arbitrating the promotion of a junior official or the death of a rival or a member of his family. As this gripping portrayal of Saddam Hussein's Iraq demonstrates, the regime was every bit as authoritarian and brutal as Stalin's Soviet Union or Mao's China and some of the regimes in the Arab world who are witnessing upheavals, are not not dissimilar from the Ba'th regime"--

Abstract: "The centrality of death rituals has in anthropologically informed studies of Buddhism been little documented. The current volume brings together a range of perspectives on Buddhist death rituals including ethnographic, textual, historical and theoretically informed accounts, and presents the diversity of the Buddhist funeral cultures of mainland Southeast Asia and China. It arises out of the University of Bristol's Centre for Buddhist Studies research project Buddhist Death Rituals in Southeast Asia and China, funded by the United Kingdom's Arts and Humanities Research Council. This project involved extensive new research in Thailand, Laos and China. Other items from that project included several public exhibitions, extensive stills photographs, and several video films. The project-team produced two 30 minutes films on the ghost festival in Laos and China, one on urban funerals in Chiang Mai (Thailand) and several shorter clips dealing with funeral cultures in Laos, Thailand and China. Most of this material (and an extensive bibliography on the topic) is available free of charge from the project website located at the webpage of the Department of Theology and Religious Studies (Centre for Buddhist Studies) at the University of Bristol"--

Abstract: "What does it mean to be a citizen in a multicultural society? And what role must patriotism play in defining our relationship with our country and fellow citizens? In The Virtuous Citizen Tim Soutphommasane answers these questions with a critical defence of liberal nationalism. Considering a range of contemporary political debates from Europe, North America and Australia, over issues including multiculturalism, national history, civic education and immigration, Soutphommasane argues that a love of country should be valued alongside tolerance, mutual respect and public reasonableness as a civic virtue. A liberal form of patriotism, grounded in national identity, is if anything essential to a successful polity in a diverse society. This book is required reading not only for political theorists and philosophers but also researchers and professionals in political science, sociology, history and public policy"--

Abstract: "This book brings together contributions from academics and practitioners to explore the implications of legal pluralism for legal development"--
Abstract: "Previous efforts at legal development have focused almost exclusively on state legal systems, many of which have shown little improvement over time. Recently, organizations engaged in legal development activities have begun to pay greater attention to the implications of local, informal, indigenous, religious, and village courts or tribunals, which often are more efficacious than state legal institutions, especially in rural communities. Legal pluralism is the term applied to these situations because these institutions exist alongside official state legal systems, usually in a complex or uncertain relationship. Although academics, especially legal anthropologists and sociologists, have discussed legal pluralism for decades, their work has not been consulted in the development context. Similarly, academics have failed to benefit from the insights of development practitioners. This book brings together, in a single volume, contributions from academics and practitioners to explore the implications of legal pluralism for legal development. All of the practitioners have extensive experience in development projects, the academics come from a variety of backgrounds, and most have written extensively on legal pluralism and on development"--

Abstract: "This volume examines the legal and political efficacy of transitional political power-sharing between democratically constituted governments and the African warlords, rebels, or junta that seek to violently unseat them"--
Abstract: "African states have become testing grounds for Western conflict-resolution experiments, particularly power-sharing agreements, supposedly intended to end deadly conflict, secure peace, and build democracy in divided societies. This volume examines the legal and political efficacy of transitional political power-sharing between democratically constituted governments and the African warlords, rebels, or junta that seek to violently unseat them. What role does law indicate for itself to play in informing, shaping, and regulating peace agreements? This book addresses this question and others through the prism of three West African case studies: Liberia, Sierra Leone, and Guinea-Bissau. It applies the Neo-Kadeshean Model of analysis and offers a framework for a 'Law on Power-sharing.' In a field dominated by political scientists, and drawing from ancient and contemporary international law, this book represents the first substantive legal critique of the law, practice, and politics of power sharing"--

Abstract: "This important new study examines the market trade of medieval England from a new perspective, by providing a wide-ranging critique of the moral and legal imperatives that underpinned retail trade. James Davis shows how market-goers were influenced not only by practical and economic considerations of price, quality, supply and demand, but also by the moral and cultural environment within which such deals were conducted. This book draws on a broad range of cross-disciplinary evidence, from the literary works of William Langland and the sermons of medieval preachers, to state, civic and guild laws, Davis scrutinises everyday market behaviour through case studies of small and large towns, using the evidence of manor and borough courts. From these varied sources, Davis teases out the complex relationship between morality, law and practice and demonstrates that even the influence of contemporary Christian ideology was not necessarily incompatible with efficient and profitable everyday commerce"--

Abstract: "The break-up of the Ottoman empire and the disintegration of the Russian empire were watershed events in modern history. The unraveling of these empires was both cause and consequence of World War I and resulted in the deaths of millions. It irrevocably changed the landscape of the Middle East and Eurasia and reverberates to this day in conflicts throughout the Caucasus and Middle East. Shattering Empires draws on extensive research in the Ottoman and Russian archives to tell the story of the rivalry and collapse of two great empires. Overturning accounts that portray their clash as one of conflicting nationalisms, this pioneering study argues that geopolitical competition and the emergence of a new global interstate order provide the key to understanding the course of history in the Ottoman-Russian borderlands in the twentieth century. It will appeal to anyone interested in Middle Eastern, Russian, and Eurasian history, international relations, ethnic conflict, and World War I"--

Abstract: "Making Rights a Reality? explores the way in which disability activists in the United Kingdom and Canada have transformed their aspirations into legal claims in their quest for equality. It unpacks shifting conceptualizations of the political identity of disability and the role of a rights discourse in these dynamics. In doing so, it delves into the diffusion of disability rights among grassroots organizations and the traditional disability charities. It then shows how the diffusion of this rights model of disability can explain how and why disability activists have deployed legal strategies in pursuit of their goals. The book draws on a wealth of primary sources including court records and campaign documents and encompassing interviews with more than sixty activists and legal experts. While showing that the disability rights movement has had a significant impact on equality jurisprudence in two countries, the book also demonstrates that the act of mobilizing rights can have consequences, both intended and unintended, for social movements themselves"--Provided by publisher

Abstract: A timely analysis of State complicity in international law, which takes an innovative rule-of-law perspective.
Abstract: This systematic analysis of State complicity in international law focuses on the rules of State responsibility. Combining a theoretical perspective on complicity based on the concept of the international rule of law with a thorough analysis of international practice, Helmut Philip Aust establishes what forms of support for wrongful conduct entail responsibility of complicit States and sheds light on the consequences of complicity in terms of reparation and implementation. Furthermore, he highlights how international law provides for varying degrees of responsibility in cases of complicity, depending on whether peremptory norms have been violated or special subject areas such as the law of collective security are involved. The book shows that the concept of State complicity is firmly grounded in international law, and that the international rule of law may serve as a conceptual paradigm for today's international legal order.
Description / Table of Contents: 1. Introduction; 2. Complicity between bilateralism and community interest; 3. Complicity and the international rule of law; 4. Complicity in customary international law; 5. The concept of complicity in Article 16 ASR; 6. The consequences of complicity; 7. Complicity and aggravated responsibility; 8. Abstract: "Is there still a right to seek asylum in a globalised world? Migration control has increasingly moved to the high seas or the territory of transit and origin countries, and is now commonly outsourced to private actors. Under threat of financial penalties airlines today reject any passenger not in possession of a valid visa, and private contractors are used to run detention centres and operate border crossings. In this volume Thomas Gammeltoft-Hansen examines the impact of these new practices on refugees' access to asylum. A systematic analysis is provided of the reach and limits of international refugee law when migration control is carried out extraterritorially or by non-state actors. State practice from around the globe and case law from all the major human rights institutions are discussed. The arguments are further linked to wider debates in the fields of human rights, general international law and political science"--

Abstract: "Although migration and integration have become important concepts today as a result of globalization, migration movements, integration, and multiculturalism have always been part of the history of Europe. Few people realize how many ethnic groups participated in migration within Europe or into Europe and this ignorance has grave consequences for the social and political status of immigrants. Newly available to an English-speaking audience, this encyclopaedia presents a systematic overview of the existing scholarship regarding migration within and into Europe. The first section contains survey studies of the various regions and countries in Europe covering the last centuries. The second section presents information on about 220 individual groups of migrants from the Sephardic Jews emigration from Spain and Portugal in the sixteenth and seventeenth centuries to the present-day migration of old-age pensioners to the holiday villages in the sun. The first resource of its kind, The Encyclopaedia of Migration is a comprehensive and authoritative research tool"--

Abstract: "Now available to an English-speaking audience, this book presents a groundbreaking theoretical analysis of memory, identity, and culture. It investigates how cultures remember, arguing that human memory exists and is communicated in two ways, namely inter-human interaction and in external systems of notation, such as writing, which can span generations. Dr. Assmann defines two theoretical concepts of cultural memory, differentiating between the long-term memory of societies, which can span up to 3,000 years, and communicative memory, which is typically restricted to 80-100 years. He applies this theoretical framework to case studies of four specific cultures, illustrating the function contexts and specific achievements, including the state, international law, religion, and science. Ultimately, his research demonstrates that memory is not simply a means of retaining information, but rather a force that can shape cultural identity and allow cultures to respond creatively to both daily challenges and catastrophic changes"--

Abstract: "As a result of its origins in the International Covenant on Civil and Political Rights, and the amount of work that it has done, the UN Human Rights Committee is considered the most important body in the UN human rights treaty system. Sensitive to the viewpoint of developing countries, and taking into account the interplay of law and politics, this comprehensive study of the Committee's procedure and practice assesses its conceptual, institutional and functional frameworks and analyses a large number of cases with which the Committee has dealt. It is based on the drafting history of the Covenant and the Optional Protocols thereto, in-depth analysis of the relevant documents of the United Nations and other international bodies, observations on the functioning of the Committee and interviews with a number of activists, experts and officials dealing with the work of the Committee"--Provided by publisher

Abstract: "The third volume in the series examines international criminal procedure as set out in the regulatory provisions and jurisprudence of the international criminal tribunals. It reviews in detail the key areas of international criminal procedure, including the relationship between the international tribunals and national jurisdictions, investigations, pre-trial and trial proceedings, the rules of evidence, representation of accused, the role and status of victims, judgments, and the appeals process. Moreover, the volume also considers the legal foundations and sources of this area of the law, the rule-making and amending powers of the international tribunals, and the structure of the administrative decision-making processes that impact upon crucial areas of the substantive law. In providing a thorough and critical overview of the mechanics of investigating and trying international crimes, International Criminal Procedure will complement the first two volumes in the series, and thus complete a comprehensive work on international criminal law"--

Abstract: "Do human rights offer real protection when disadvantaged groups invoke them at the local level in an attempt to improve their living conditions? If so, how can we make sure that the experiences of those invoking human rights at the local level have an impact on the further development of human rights (at national and other levels) so that the local relevance of human rights increases? Since the adoption of the Universal Declaration of Human Rights (UDHR) on 10 December 1948, numerous international documents have reaffirmed human rights as global norms. This book examines what factors determine whether appeals to human rights that emanate from the local level are successful, and whether the UDHR adequately responds to threats as currently defined by relevant groups or whether a revision of some of the ideas included in the UDHR is needed in order to increase its contemporary relevance"--

Abstract: "Through an ambitious and critical revision of Michel Foucault's investigation of ethics, James Faubion develops an original program of empirical inquiry into the ethical domain. From an anthropological perspective, Faubion argues that Foucault's specification of the analytical parameters of this domain is the most productive point of departure in conceptualizing its distinctive features. He further argues that Foucault's framework is in need of substantial revision to be of genuinely anthropological scope. In making this revision, Faubion illustrates his program with two extended case studies: one of a Portuguese marquis and the other of a dual subject made up of the author and a millenarian prophetess. The result is a conceptual apparatus that is able to accommodate ethical pluralism and yield an account of the limits of ethical variation, providing a novel resolution of the problem of relativism that has haunted anthropological inquiry into ethics since its inception"--

Abstract: "In recent years, the Uzbekistan government has been criticized for its brutal suppression of its Muslim population. This book, which is based on the author's intimate acquaintance with the region and several years of ethnographic research, is about how Muslims in this part of the world negotiate their religious practices despite the restraints of a stifling authoritarian regime. Fascinatingly, the book also shows how the restrictive atmosphere has actually helped shape the moral context of peoples' lives, and how understandings of what it means to be a Muslim emerge creatively out of lived experience"--

Abstract: "Competitive authoritarian regimes - in which autocrats submit to meaningful multiparty elections but engage in serious democratic abuse - proliferated in the post-Cold War era. Based on a detailed study of 35 cases in Africa, Asia, Latin America, and post-communist Eurasia, this book explores the fate of competitive authoritarian regimes between 1990 and 2008. It finds that where social, economic, and technocratic ties to the West were extensive, as in Eastern Europe and the Americas, the external cost of abuse led incumbents to cede power rather than crack down, which led to democratization. Where ties to the West were limited, external democratizing pressure was weaker and countries rarely democratized. In these cases, regime outcomes hinged on the character of state and ruling party organizations. Where incumbents possessed developed and cohesive coercive party structures, they could thwart opposition challenges, and competitive authoritarian regimes survived; where incumbents lacked such organizational tools, regimes were unstable but rarely democratized"--

Abstract: "The Slave Trade and Culture in the Bight of Biafra dissects and explains the structure, dramatic expansion, and manifold effects of the slave trade in the Bight of Biafra. By showing that the rise of the Aro merchant group was the key factor in trade expansion, G. Ugo Nwokeji reinterprets why and how such large-scale commerce developed in the absence of large-scale centralized states. The result is the first study to link the structure and trajectory of the slave trade in a major exporting region to the expansion of a specific African merchant group - among other fresh insights into Atlantic Africa's involvement in the trade - and the most comprehensive treatment of Atlantic slave trade in the Bight of Biafra. The fundamental role of culture in the organization of trade is highlighted, transcending the usual economic explanations in a way that complicates traditional generalizations about work, domestic slavery, and gender in pre-colonial Africa"--
