    Abstract: Ce rapport aborde une question qui se pose dans pratiquement tous les secteurs de services aux collectivités, à savoir la réglementation de l’accès à des installations essentielles. Les régulateurs des industries d’équipements collectifs publics se heurtent à un problème crucial : la réglementation des termes et conditions dans lesquels des entreprises en concurrence ont accès à des intrants clés fournis par des concurrents. Le développement de la concurrence et le succès de la libéralisation dépendent souvent des termes de l’accès et des conditions choisies, aussi les pouvoirs publics sont-ils soucieux de faire le bon choix. Préparé par le comité de la concurrence de l’OCDE, ce rapport traite du secteur des télécommunications et cherche à approfondir la compréhension de la réglementation de l’accès. Les problèmes d’accès ne sont pas des plus faciles pour les autorités de tutelle et les responsables de la politique de la concurrence : ils peuvent en effet être techniquement délicats et donner lieu à des polémiques retentissantes sur le plan pratique. En abordant la question sous ces deux angles, ce rapport cherche à aider les autorités de tutelle et les pouvoirs publics à tirer les leçons de l’expérience de l’OCDE pour obtenir des résultats efficients et compétitifs.

    Abstract: Hydrogen has the potential to play an important role as a sustainable and environmentally acceptable source of energy in the 21st century. Present methods for producing hydrogen are mainly based on the reforming of fossil fuels with subsequent release of greenhouse gases. To avoid producing greenhouse gases, the possibility to use heat and surplus electricity from nuclear power plants to produce hydrogen by water cracking is being investigated. This report presents the state of the art in the nuclear production of hydrogen and describes the scientific and technical challenges associated with it.

Buena parte del interés de política por fomentar la iniciativa empresarial se refleja en la convicción de que la creación de nuevas empresas contribuirá a facilitar el logro de importantes objetivos económicos y sociales. El aumento en el ritmo de creación de empresas es hoy una inquietud casi universal para las autoridades locales, al igual que para los gobiernos centrales que desean combatir la marginación económica local. Sin embargo, a pesar del amplio interés de política, pocos estudios han analizado sistemáticamente la relación entre la creación de nuevas empresas y el desarrollo económico local. Esta publicación analiza las principales rutas a través de las cuales la creación de empresas y su desarrollo puede tener un impacto sobre las economías locales. Así, se analiza la evidencia empírica acerca de la relación entre la iniciativa empresarial y las economías locales. Asimismo, se demuestra que aunque la creación de empresas puede resultar un componente crucial para el desarrollo económico local, el fomento de la iniciativa empresarial no constituye una panacea para el desarrollo. Por ello, se discuten a profundidad una serie de limitaciones potenciales de las estrategias orientadas hacia la iniciativa empresarial y cómo estas limitaciones pueden contrarrestarse. Este libro presenta detalladas recomendaciones de política tanto en el ámbito gubernamental local como nacional. Las recomendaciones se relacionan con tres ámbitos temáticos: estrategia, financiamiento y diseño de programas. Se espera que estos lineamientos sean de utilidad para los gobiernos centrales y locales en el diseño y la puesta en marcha de programas y estrategias eficaces en términos de costos. En este sentido, la presente publicación describe los tipos de investigación que deben llevarse a cabo para lograr un mejor entendimiento de los temas clave de política.

    Abstract: Partnership Forums are the means by which the OECD Development Assistance Committee provides a venue for non-governmental actors to express their points of view and to offer their own contributions to development policy and strategy. In December 2000, the DAC and the Development Centre held a Forum on ways of integrating civil society into policy formation in developing countries, and to identify obstacles to such involvement. Participants agreed that civil society's role in poverty-reduction strategies had been an important element in succesful implementation. This book contains 8 papers presented at the Forum, covering experience in a variety of countries with a variety of stakeholders. The wide-ranging discussion concluded that civil-society participation in policy making not only enhances efficiency in implementation, but also contributes to the creation of more pluralistic and democratic political systems.

    Abstract: Corporate governance matters for national development. Studies of Brazil, Chile, India, and South Africa show that corporate governance has an important role to play in helping both to increase financial capital to firms in developing countries and to enhance those countries’ financial development as a whole. They further show that corporate governance matters can contribute greatly to achieving sustained productivity growth in developing countries’ real economies. The value of improved corporate governance for development cannot, however, be considered in isolation. In the financial sector, attention must also be given to measures to strengthen the banking sector and a country’s financial institutions as a whole. To gain most from improved corporate governance in the real economy, close attention must also be given to competition policy and to reforms of sector-specific regulatory practices.     Abstract: Governments are significant purchasers of goods and services and these markets represent huge opportunities for international trade. This document presents a synthesis of the analytical studies on the quantification of the size of government procurement markets and proposes a series of estimates of procurement markets for over 130 individual countries. The world total government procurement is estimated to amount to $5550 billion in 1998, which is equivalent to 82.3% of the world merchandise and commercial services exports in 1998. The world value of government procurement that is potentially opened up to international trade is estimated at $2083 billion, which is equivalent to 7.1% of the world Gross Domestic Product (GDP) or 30.1% of the world merchandise and commercial services exports. Detailed estimates of government procurement markets are proposed for OECD countries, including estimates of procurement broken down by government levels, types of expenditure (consumption versus investment) and contestable shares. Informed knowledge about the size of government procurement markets and in particular the shares of national markets that are potentially opened up to intenational competition is relevant for the business community, government and trade negotiators.

Ils en ont conclu qu’imputer au producteur la responsabilité de contribuer ou de pourvoir à l’élimination de ses déchets pouvait permettre d'atténuer certaines des contraintes que ces derniers exercent sur l’environnement (après consommation du produit qu’ils accompagnent). La « responsabilité élargie des producteurs » (REP) est une stratégie en vertu de laquelle les producteurs acceptent d’assumer une responsabilité importante - d’ordre financier et/ou matériel - en ce qui concerne le traitement des déchets d’emballage. La prise en charge de cette responsabilité pourrait inciter à prévenir la production de déchets à la source, promouvoir la conception de produits dans le souci du respect de l’environnement, et contribuer à atteindre les objectifs publics de recyclage et de gestion des matériaux. Au sein de l’OCDE, la tendance est à l’élargissement de la REP à de nouveaux produits, groupes de produits et flux de déchets tels que les appareillages électriques et électroniques. Ce manuel d’orientation constitue un moyen d’informer les gouvernements des avantages et des coûts potentiels liés à la REP.

    Abstract: The term multifunctionality is increasingly used, but is prone to different interpretations concerning its definition, its utility and its implications for policy at domestic and international level. The OECD undertook this analysis to clarify the concept of multifunctionality and to try to establish a common analytical framework and terminology. Examining production, externality and public good aspects of multifunctionality, the analysis contained in this report leads to a series of questions, the answers to which determine if and when policy intervention is warranted and what the nature of that intervention should be. The framework encompasses both negative and positive externalities of agriculture. The first question relates to the degree of jointness in production between the multiple outputs. The second question identifies the circumstances in which market failure arises. A third question leads to an investigation of the public good characteristics of the outputs in question and helps to define the optimal type of intervention. These may range from market creation, to the imposition of user fees, the formation of clubs or public provision financed at local, regional or national level. The most efficient policy option is defined by the nature of jointness on the supply side and by the characteristics of the output on the demand side, all costs and benefits being taken into account.

The initiatives include issuance of codes of business conduct, implementation of management systems and broader efforts to improve business accountability. Yet, there is little agreement about what these initiatives mean or how effective they are. OECD research on private initiatives sheds light on various aspects of the corporate responsibility movement: what are firms and business associations doing? How have governments influenced the initiatives? What contributions, if any, have these initiatives made to improving the business sector’s ability to comply with law and regulation and to respond to broader societal expectations?

    Abstract: The 2001 edition of Transfer Pricing Guidelines was substantially revised in July 2010. See the current edition . This compact version of Transfer Pricing Guidelines provides the complete and current text of the OECD pricing guidelines accepted by member countries and to be used by multinational enterprises when transferring goods and services across boundaries and within the same group of companies. They maintain the arm's length principle of treating related entreprises within a multinational group and affirm traditional transaction methods as the prefered way of implementing the principle. These controversial issues are not just of interest to tax experts. National tax administrations, taxpayers, and businessmen alike all have a share in avoiding conflicting tax rules which might seriously hamper the development of world trade. These guidelines have also been published in a loose leaf version.

    Abstract: Municipal waste has increased 22 % per capita from 1980 to 1997. At the same time, the difficulty of siting new waste disposal facilities has increased. While major progress has been made to lessen the per capita generation of air and water pollution over the past decades, waste generation is still on the rise. Faced with the increase of waste, many governments have reviewed available policy options and concluded that placing the responsibility for the post-consumer phase of certain goods on producers could provide a means to relieve certain environmental pressures, arising from post-consumer waste. Extended Producer Responsibility (EPR) is a policy approach under which producers accept significant responsibility - financial and/or physical - for the treatment or disposal of post-consumer products. Assigning such responsibility could provide incentives to prevent wastes at the source, promote product design for the environment and support the achievement of public recycling and materials management goals. Within the OECD the trend is towards the extension of EPR to new products, product groups and waste streams such as electrical appliances and electronics. This guidance manual represents one means to inform national governments about the potential benefits and costs associated with EPR.

Since that time, women’s entrepreneurship has been burgeoning.     Abstract: Businesses’ Views on Red Tape provides the first opportunity to systematically compare data across 11 OECD countries. The data show how small and medium-sized enterprises perceive national administrative and regulatory costs. Regulations and government formalities, so-called "red tape", are important tools used by governments to carry out public policies in many policy areas, including safety, health, and environmental protection. However, if they are poorly designed or applied, inefficient, or outdated, they can impede innovation, entry, investment, and create unnecessary barriers to trade, investment, and economic efficiency. The result of poor regulation and formalities is that national economies become less able to grow, compete, adjust, and create jobs. Based on a survey of almost 8 000 businesses, this report assesses the quality, application and burdens of employment, environment and tax regulations and formalities. The results are dramatic: for example, red tape accounts for 4% of the annual turnover of companies, while the hardest hit are the smallest companies, and these costs are growing in most countries.

    Abstract: This report examines the form regulation should take in rail freight markets to promote efficiency in railways and the wider economy. It analyses issues of monopoly, scale economies, competition, mergers, ownership and the structure of the rail industry. Experience in North America, Australia, Japan, the European Union and countries from eastern and western Europe is reviewed. The need for regulation differs by market and, together with political constraints, this means that regulatory models can not be transferred wholesale from one continent to another. However, each region provides important lessons for reforms currently under consideration in all ECMT and OECD countries.

    Abstract: Le terme de multifonctionnalité est de plus en plus utilisé mais différentes interprétations sont attachées à sa définition, son utilité et ses implications pour la politique au niveau national et international. L’OCDE a entrepris cette analyse pour clarifier le concept de multifonctionnalité et pour essayer d’établir un cadre analytique et une terminologie communs. Cette étude examine les aspects de production, d’externalité et de bien d’intérêt public de la multifonctionnalité. Elle présente une série de questions dont les réponses déterminent quand une intervention publique est appropriée et quelle forme elle doit prendre. Le cadre développé prend en compte toutes les externalités de l’agriculture, qu’elles soient négatives ou positives. La première question est relative à l’intensité du caractère conjoint des produits multiples au niveau de la production. La seconde identifie les circonstances dans lesquelles intervient une défaillance du marché. Une troisième question conduit à examiner les caractéristiques des produits en question en tant que biens d’intérêt public et permet de mieux définir le type d’intervention le plus approprié. Ces interventions peuvent aller de la création d’un marché à l’imposition de charges d’utilisation, en passant par la constitution de clubs ou l’approvisionnement public financé au niveau local, régional ou national. La politique la plus efficace est définie par l’intensité du caractère conjoint des produits du côté de l’offre et par leurs caractéristiques du côté de la demande, l’ensemble des coûts et bénéfices étant considérés.

Ils réaffirment qu’un traitement de pleine concurrence doit être appliqué aux entreprises faisant partie d’un groupe multinational et que pour ce faire, les méthodes transactionnelles traditionnelles doivent être privilégiées. Ces questions controversées n’intéressent pas uniquement les spécialistes de la fiscalité. De fait, les administrations fiscales, les contribuables et les chefs d’entreprises ont tous un rôle à jouer pour éviter la coexistence de règles fiscales contradictoires qui risqueraient d’entraver sérieusement le développement des échanges mondiaux.     Abstract: A general consensus has been reached among technical experts that high-level radioactive waste can safely be disposed of in deep geological repositories. Safety studies are carried out to evaluate the overall capacity of a particular disposal site to confine waste and minimise radioactive releases. Since the principal way in which radioactive elements might eventually reach the biosphere is by transport of dissolved radionuclides in groundwater, the safety study calculations must be able to estimate their rate of transfer through each of the barriers surrounding the repository. It is well known that, for many radioelements, sorption reactions can lead to a reduction of the amount of radionuclides present in the solution phase. How best to take radionuclide sorption reactions into account in repository performance assessment models is the subject of this book.

    Abstract: In the former Soviet Union, extensive networks were constructed to supply urban populations with clean, safe water. However, the networks were not well designed and this resulted in low quality water services and high operation and maintenance costs. With the dissolution of the Soviet Union in 1991, the condition of water infrastructure deteriorated more dramatically following sharp decreases in public budgets and the continued tradition of providing water services virtually free of charge. Without urgent action, the quality of services will continue to worsen and, in some of the New Independent States (NIS) of the former Soviet Union, may even collapse, with serious consequences for human health and economic activity. This volume analyses the causes underlying this dire situation and presents recommendations for addressing it which were adopted at a meeting of Economic/Finance and Environment Ministers held in Almaty, Kazakhstan, in October 2000. The meeting was organized within the framework of the EAP Task Force, with its Secretariat at OECD, and involved key stakeholders from the governmental and non-governmental sectors. The EAP Task Force will implement a focused programme of work guided by the main recommendations agreed by participants.

    Abstract: Services are the driving force in OECD economies, accounting for at least 70% of GNP in many countries. However, their potential contribution is hampered by government policies that were designed for manufacturing industries. This report shows that policies can be adapted to stimulate innovation and boost productivity in service sectors, with economy-wide benefits for employment and growth. Crucial in this regard are policies aimed at promoting the development of human capital/resources and stimulating competition in services within and between countries. Further regulatory reform is essential to achieve these goals. Governments must explore ways to strengthen the interface between innovative services and traditional industry sectors.

Une réglementation et des formalités administratives de piètre qualité ont un coût pour les économies nationales : la capacité de croissance de ces dernières, leur compétitivité, leur capacité d’adaptation et leur aptitude à créer des emplois peuvent en pâtir. Ce rapport s'appuie sur les résultats d’une enquête menée auprès de 8 000 entreprises, il fait le point sur la qualité, la mise en œuvre et le poids de la réglementation et des formalités administratives dans les domaines de l’emploi, de l’environnement et de la fiscalité. Les résultats sont inquiétants. Un exemple : la « paperasserie » absorbe 4 % du chiffre d’affaires annuel des entreprises (ce sont les plus petites qui sont le plus durement frappées) et ce coût augmente dans la plupart des pays.

    Abstract: Ten years into the transition, newly emerging private enterprises in transition economies, usually described as small and medium-sized enterprises (SMEs) in the international context, have come to play an increasingly important role as the driving engines of economic growth and employment creation. Accordingly, the policy considerations for developing SMEs are becoming very urgent and important for transition economies, especially through facilitating financial mechanisms for them, as limited availability of financial resources is the largest hindrance to their development. This publication gathers the proceedings of the Second Workshop on "Financing Newly Emerging Private Enterprises in Transition Economies" which was organised in Paris under the aegis of the OECD’s Centre for Co-operation with Non-Members with the sponsorship of the Japanese Government. This volume contains in-depth studies on various schemes for financing these enterprises, including credit guarantees, leasing, venture capital and capital market operations, as well as public schemes. In addition, it provides detailed and comparative information on the situation of SME development and the policy measures towards it.

    Abstract: Services are transforming OECD economies on a massive scale, but are still impeded by regulations and policies that stifle innovation and competition. Comprehensive reforms need to be pursued internationally as well as in individual OECD countries. These are the principal conclusions reached by participants in a Business and Industry Policy Forum organised by the OECD on 28 September 1999. The Forum was organised by the Industry Committee, partly to address the mandate of the OECD Ministerial to explain the differences which have emerged in growth performance among OECD countries. It brought together senior government officials, experts, and business and trade union leaders from 30 countries to address issues related to “Realising the Potential of the Service Economy: Facilitating Growth, Innovation and Competition”.

    Abstract: The taxation of professional services and other activities of an independent character under Article 14 of the OECD Model Tax Convention is problematic. For example, what activities and entities fall within Article 14 as opposed to the business profits Article (Article 7)? Is the distinction between those activities and entities satisfactory and easy to apply? What are the practical differences between taxation under Article 7 and 14? This report analyses those questions in detail and concludes that there is no practical difference between the two Articles or if any differences did in fact exist, there is no valid policy justification for them. It recommends that Article 14 be eliminated from the Model and describes the changes that would need to be made to the Articles and Commentary of the Model as a consequence.

    Abstract: L'imposition des professions libérales et des autres activités de caractère indépendant dans le cadre de l'article 14 du Modèle de Convention fiscale de l'OCDE pose certains problèmes. Par exemple, quelles sont les activités et entités qui relèvent de l'article 14 par opposition à l'article 7 sur les bénéfices des entreprises ? La distinction entre ces activités et entités est-elle satisfaisante et facile à appliquer ? Quelles sont les différences pratiques qui existent entre l'imposition sous l'article 7 et l'imposition sous l'article 14 ? Cet ouvrage examine ces questions de manière détaillée et conclut qu'il n'y a pas de différences pratiques entre les deux articles et que, dans le cas où des différences apparaîtraient, elles ne pourraient être justifiées sur le plan de la politique fiscale. En conséquence, il recommande que l'article 14 soit supprimé du Modèle et décrit les modifications à apporter aux articles et aux commentaires du Modèle.

    Abstract: How can the environmental effects of trade liberalisation agreements be assessed ? Are available methodologies sufficiently tuned to current concerns? In order to take stock of the state of the art in assessment methodologies, the OECD organised a two-day technical workshop to focus on past practice and new tools for assessing the environmental effects of trade agreements. Some two dozen experts from governments, international organisations, universities international organisations, universities and NGOs active in this area presented lessons from past practice and results of the considerable advances made in recent years. This volume brings together the papers presented during the two-day workshop by the invited experts and the comments from a range of governmental and international organisation practitioners and representatives of civil society who participated in the workshop. In addition to the presentations on methodologies, this book includes the workshop rapporteur's summary of the gaps in the existing research in this field.
