    Abstract: This note begins by briefly addressing why competition policy is important for developing and transitioning economies. It then discusses some of the critical components of building a competition culture. Ideally, this process should begin by conducting a "needs assessment" in a number of areas. This assessment likely will lead to the identification of a list of steps that should be prioritised and undertaken. The priorities often can be grouped into three broad areas, namely, helping key constituencies to "buy in" to a competition culture, minimizing the extent to which a broad range of institutional mechanisms distort competition, and building an effective competition law enforcement regime to address private anticompetitive conduct. The note then summarizes the valuable perspectives of countries that have been providers or recipients of capacity building and technical assistance. It is based upon the responses to a questionnaire circulated in 2001 to delegates of the OECD’s Competition Committee and non-members who had been invited to participate in the second Global Forum on Competition, held in February 2002. This discussion is followed by a brief discussion of the potentially helpful roles that cooperation and peer review can play in the process of building the institutional capacity of a domestic enforcement authority. After briefly discussing the Doha Declaration, the note summarises the OECD’s capacity building activities in the competition field. Finally, in the conclusion, some suggestions are offered regarding a multi-faceted strategy for future capacity building and technical assistance activities.

    Abstract: The United States has a substantial impact on promoting economic growth and reducing poverty in developing countries due to the large size of its economy, its ability to influence world opinion and action and its weight within the international donor community. In 2001 the United States was the largest donor in the OECD’s Development Assistance Committee (DAC) in volume terms, reporting net official development assistance (ODA) of USD 10.9 billion, more than one-fifth of the DAC total. This represented 0.11% of its gross national income (GNI), the lowest ODA/GNI ratio in the DAC and below the DAC average country effort of 0.40%. President Bush recently announced a bold new proposal, the “Millennium Challenge Account” (MCA) for an additional USD 5 billion annually by 2006. If approved by Congress, the MCA will consolidate the American position as the largest donor, and slightly improve the country’s ODA/GNI performance. The American “checks and balances” system of government has some important ramifications for United States development co-operation. This approach implicates a wide range of stakeholders in budget decision-making, especially through the Congress. Flexible approaches to compromise are standard features of the American system, especially for issues of a short-term nature that respond to national or special interests. Addressing long-term issues related to development co-operation can prove more difficult because they lack urgency or a sufficiently strong and influential domestic constituency. Several of the issues raised in the 1998 DAC Peer Review are being addressed by the current Administration.     Abstract: This article comprises two notes by the Secretariat, one on the Objectives of Competition Law and Policy and the other one on the Optimal Design of a Competition Agency. Both notes were prepared to provide a framework for discussion at the meeting of the Global Forum on Competition (GFC) held on 10-11 February 2003. It was decided to link these topics together in the GFC's agenda after it was recognised that the objectives of competition law and policy can have an important bearing on the optimal design of a competition institution. However, it was agreed that the treatment of objectives should be oriented primarily towards a discussion of how they relate, or may relate, to the design of competition enforcement institutions within the broader government. Accordingly, the note on objectives does not fully explore the pros and cons of specific objectives that may be included in the competition law and policy objectives of one or more jurisdictions, although this topic is discussed to a degree. The principal focus of the two notes is to provide an analysis and synthesis of the responses to two questionnaires that were sent in advance to GFC meeting participants in respect of the respective topics. In addition, the objectives note incorporates some of the additional information provided by participants in their separate written contributions prepared for circulation at the GFC meeting. The most important themes emerging from the questionnaires and written contributions on Objectives were i) among OECD countries, there appears to be a shift away from use of competition laws to promote what might be characterised as broad public interest objectives; ii) there does not appear to be a strong correlation between competition law and policy objectives (broadly defined) and the design of the competition agency; iii) greater independence also was the step/measure most frequently identified as being likely to lead to better promotion/attainment of the articulated objectives. Turning to the note on Optimal Design, the key themes emerging from the responses to the questionnaire were i) there is a broad variety of different models and approaches to the design of competition agencies within the overall apparatus of government (broadly defined); ii) despite the institutional variety, there is a core of common tasks assigned to most competition agencies. Specifically, these agencies normally investigate, take at least certain kinds of decisions on competition cases and engage in competition advocacy; iii) around half the respondents reported having medium influence on their governments, legislative bodies, and other bodies of public administration through advocacy initiatives.

    Abstract: The road transport sector, an essential mode of transport in OECD economies, is conventionally divided into two, largely unrelated, parts – the road freight industry and the road passenger industry. The sectors under discussion – trucking, buses, and taxis – have quite different characteristics and scope for competition, which reflect inter alia differences in the timeliness and economies of scale and scope in operations. Trucking can sustain high level of competition and to some extent buses as well while there is some debate as to how and what form of competition can be introduced in taxis. As in the air transport industry, international trucking is governed by restrictive bilateral treaties. Most countries have liberalised their domestic trucking sector, removing controls on entry and prices. In the bus industry, long-distance bus services are liberalised in some countries while intra-city or local buses are very rarely liberalised. The taxi industry appears at first sight to be competitive with many buyers and many sellers.

    Abstract: Although enhanced price transparency will generally increase competition to the benefit of consumers, this paper argues that it can have the opposite effect in some special situations. A negative impact is especially likely in markets already prone to anti-competitive coordination. In such markets, competition authorities should be suspicious of competitors exchanging price data, or engaging in any other practice that could help focus anti-competitive arrangements or help competitors more than customers to react to price changes. They should also be wary of exchanges of non-binding future prices. The paper identifies a number of key factors to consider in assessing whether increased price transparency might raise the probability of anticompetitive co-ordination. That includes having a look at meeting competition and most favored nation clauses, and the practice of base point pricing. The paper also examines price transparency as regards information exchanges within trade associations, price advertisements, and mandatory price transparency in public procurement markets. It closes with a short list of questions competition authorities might wish to keep in mind when investigating the effects of price transparency. This OECD Competition Roundtable was held in June 2001.

    Abstract: Increased competition in product markets, as well as being good for consumers, can also boost productivity and employment, according to the study Product Market Competition and Economic Performance by the OECD. Competition improves productivity through a more efficient use of resources. At the same time it can encourage innovation and the rapid spread of new technology. Reforms to make product markets more dynamic will also boost real wages as prices are lowered through increased competition. The study argues that reforms undertaken between the late 1970s to the late 1990s, such as the liberalisation of telecommunications industries, increased employment rates in OECD countries by an average of 1.5 percentage points, reaching 2.5 percentage points in economies where pro-competition policies were pursued most vigorously. This study forms a chapter in the OECD Economic Outlook No. 72 published in December 2002.

    Abstract: As with other policies offering lower prices to at least some buyers, loyalty and fidelity discounts are generally pro-competitive and beneficial to consumers even though they may harm certain competitors. Potential problems exist, however, when such discounts are employed in ways that reduce price transparency, exclude or restrict a significant number of actual or potential competitors, or raise the probability of anticompetitive co-ordination. The sometimes complex pro- and anti-competitive effects of loyalty and fidelity discounts are explored in the executive summary, background paper and summary of discussion pertaining to a June 2002 OECD Competition Committee roundtable discussion of the topic. While these documents reveal some interesting policy differences among various members of the Competition Committee, they also point to general agreement that loyalty and fidelity discounts are more likely to raise competition concerns when practised by firms enjoying substantial market power.

    Abstract: Verlagsinfo: In a challenging business environment fraught with new rules, financial executives are clearly assuming a lead role to ensure that both existing and new practices comply with the Sarbanes-Oxley Act of 2002 ("the Act"). Though much of the final rulemaking mandated by the new laws have yet to be finalized, companies have focused attention toward complying with proposed rulemaking with particular attention in two areas: financial statement certification and internal controls. This paper will summarize practices used for implementing the Act of 2002 based on guidance from and interviews with FEI's Committee on Corporate Reporting (CCR), other FEI member companies and from final rules or proposed rulemaking from the Securities and Exchange Commission (SEC).

    Abstract: With the conclusion of the Prague summit, NATO faces a number of new challenges in its Eastern agenda. First, it must ensure that the democratic transitions in Central and Eastern Europe are consolidated and that there is no backsliding. These countries must modernize their military forces and make them interoperable with those of NATO. Second, NATO, must remain engaged in and ensure the security of the Baltic states. The problem of Kaliningrad should be addressed and the enclave stabilized. Third, NATO needs to develop a post-enlargement strategy for Ukraine to support the country's continued democratic evolution and integration into Euro-Atlantic structures. Fourth, Russia must be incorporated into a broader European and Euro-Atlantic security framework. Finally, NATO needs to develop a coherent strategy toward the Caucasus and Central Asia. The Partnership for Peace can provide the framework for developing relations with these countries. Other U.S. and NATO polices can encourage greater openness, reform, and democratic practices. These challenges, moreover, must be addressed in a new strategic context. In the post-Prague period, the key issue is NATO's transformation and its strategic purpose: What should its missions and strategic rationale be?

    Abstract: The National Energy Policy released by the Bush Administration in 2001 calls for continued reductions in U.S. energy intensity, typically defined as energy consumption per dollar of gross economic output. The Department of Energy's Office of Energy Efficiency and Renewable Energy asked RAND to examine changes in energy intensity as part of a larger effort to identify state-level factors that may contribute to efficient energy use nationwide. The authors examined changes in energy intensity from 1977 through 1999 across the 48 contiguous states and in each of the states' residential, commercial, industrial, and transportation energy-consuming sectors. They identified a number of factors that may explain why some states had different patterns of energy intensity than others: energy prices; the mix of industrial and commercial activities; production capacity utilization; capital investment and new construction; population and demographics; climate; technological innovation; and the energy policies of national, state, and local governments. The results from this study suggests that opportunities may exist for the Department of Energy to increase its involvement in helping states to share information and to provide guidance on state-level actions that are effective in reducing energy intensity

    Abstract: The author assesses the military space challenges that face the Air Force and the nation in light of the findings and recommendations of the congressionally mandated Space Commission, released in January 2001. After reviewing the main milestones in the Air Force's involvement in space since its creation as an independent service in 1947, he examines the circumstances that occasioned the Space Commission's creation, as well as the conceptual and organizational roadblocks that have impeded a more rapid growth of U.S. military space capability. He concludes that the Air Force faces five basic challenges with respect to space: continuing the operational integration of space with the three terrestrial warfighting mediums while ensuring the organizational differentiation of space from Air Force air; effectively wielding its newly granted military space executive-agent status; realizing a transparent DoD-wide budget category for space; showing progress toward fielding a meaningful space control capability while decoupling that progress from any perceived taint of force-application involvement; and making further progress toward developing and nurturing a cadre of skilled space professionals within the Air Force

    Abstract: Before the independence of the four other constituent Republics (Slovenia, Croatia, Bosnia and Herzegovina, and Macedonia), Montenegro was a constituent Republic of the Socialist Federal Republic of Yugoslavia. The first multiparty elections in Montenegro took place in 1990 following the period of the one-party system, which had been in force after the Second World War. There were three main principles in the legal system, in relation to the Federal State of Yugoslavia and constituent Republics, as well as in relation to Serbia and Montenegro within the new State. The first was a principle of “double track” in the implementation of laws: (federal authorities execute federal law, and Republican authorities execute the laws of the Republic). The second principle was a presumption of power in favour of the Republics (Serbia and Montenegro). The third principle was the possibility of delegating the power from constituent Republics to the Federal State. These were the main features of the period after dissolution of the former Yugoslavia, and means that the competence of the Federal Administration was limited only to the fields that were explicitly envisaged by the Federal Constitution.

    Abstract: Kosovo and Metohija used to be as an autonomous province an integral part of the Republic of Serbia. In 1989 Serbia revoked unilaterally the autonomy of the province. In the second half of the 1990s, the tensions between Kosovo Albanians and Serb military forces led to fighting. The international community and NATO began a military intervention in March 1999 to stop the violence and the humanitarian crisis. After three months of NATO air strikes against Serbian police and military positions the United Nations Security Council issued, in June 1999, Resolution 1244 which established an interim international administration in Kosovo (United Nations Interim Administration Mission in Kosovo — UNMIK). The main objective of this provisional administration is to work towards creating the conditions necessary to build provisional democratic institutions of governance to ensure a peaceful and normal life for all the inhabitants of Kosovo. The head of UNMIK is the Special Representative of the Secretary-General for Kosovo (SRSG). Bernard Kouchner (France) served as the first head of UNMIK, from July 1999 to January 2001. He was followed by Hans Haekkerup (Denmark) who served from February 2001 to December 2001. Michael Steiner (Germany) served from January 2002 to July 2003. Since July 2003 the Special Representative of the Secretary-General for Kosovo has been Harri Holkeri (Finland). The first municipal elections under the administration of UNMIK, for the establishment of the local institutions of municipal governments, were held in September 2000. The second municipal elections were held in October 2002. The general elections for the establishment of the Provisional Institutions of Self-Government (PISG) were held in November 2001.

    Abstract: The Republic of Croatia ended unilateral formal-legal relations with the Socialist Federal Republic of Yugoslavia with the Declaration on Sovereignty and Independence, on 25 June 1991. Following international recognition in 1992, Croatia became a member of the United Nations on 22 May 1992. The first decade of the independence (1990-2000) of the Republic of Croatia was marked by the war, which ended in 1995, and the nationalistic Centre-right Government of the Croatian Democratic Union (HDZ) under President Franjo Tudjman, in power until the elections in January 2000. During this period the HDZ was in absolute majority in both houses of the Croatian Parliament – the House of Representatives and the House of Counties (a unicameral system was introduced 2000). Franjo Tudjman won both presidential elections (1992 and 1997) in the first round. The new Croat state public administration was built using the existing republican administration. Even though there was an administrative system for most of the functions of a state, certain services had to be developed from the very beginning (for example diplomatic service, defence, finances), as they were centralised in ex-Yugoslavia.

    Abstract: After the parliamentary elections, Viktor Orbán, leader of the FIDESZ-Magyar Polgári Párt (Alliance of Young Democrats-Hungarian Civic Party), received a mandate from the president of the republic to form a government and to submit his government programme to parliament. He was elected by parliament as prime minister in June 1998. The new government is composed of the prime minister and 17 ministers. Of the latter, 12 were nominated by FIDESZ-MPP, four represent the Independent Small-Holders’ Party, and one was proposed by the third coalition partner, the Hungarian Democratic Forum. The new coalition has an absolute majority in parliament (with some 55 per cent of the seats). The next regular parliamentary elections are scheduled for spring 2002. The president of the republic is Árpád Göncz. In 1995, he was re-elected by parliament for a five-year term of office. Parliament has approved the new government programme for the next four years. Its priorities include the development of the social state; the maintenance of citizens’ security in all spheres of life; and the fostering of economic growth.

    Abstract: The Greater Helsinki Region emerged from the 1990s as an internationally competitive economy. This review examines the factors contributing to this success and the new development challenges it has created. One critical policy question is the Finnish dependence on the telecom/mobile industry. The current strategic positioning of the Finnish ICT cluster builds on a high-return/high-risk scenario. Long-term regional competitiveness requires a more focused strategy of diversification, i.e. developing ICT activities beyond the current cluster scope. Social inclusion is another crucial issue. Persistent unemployment among the less educated population and growing income disparities are calling for the restructuring of past policies. The Greater Helsinki Region needs to find ways to promote new opportunities of social cohesion. Rapid population growth has resulted from greater economic competitiveness requiring renewed commitment to managed growth and compact development. All of these challenges create needs for greater metropolitan co-ordination that are examined in turn.

    Abstract: Until 1991, Macedonia was a constituent Republic of the Socialist Federal Republic of Yugoslavia. During the disintegration of the federation in the early 1990s, the Republic of Macedonia elected its first democratic parliamentary assembly (the Sobranie) in November 1990. A referendum on independence was held on 8 September 1991. On the basis of this referendum, the Sobranie declared the independence and sovereignty of the Republic of Macedonia1 on 17 September 1991. The Sobranie adopted a Constitution, establishing the foundations of parliamentary democracy, civil society, the rule of law and a market economy, on 17 November 1991. The Republic of Macedonia was accepted as a member state of the United Nations on 8 April 1993. The Republic of Macedonia is a member of the OSCE (12 October 1995), the Council of Europe (9 November 1995), the NATO Partnership for Peace (15 November 1995), WTO (4 April 2003), and other international organisations and institutions. The Republic of Macedonia signed the Stabilisation and Association Agreement with the EU on 6 April 2001. After the ratification by all 15 EU member states, the SAA entered into force on 1 April 2004. On 22 March 2004 the Republic of Macedonia submitted its application for EU membership. In 2001 armed conflict in the Republic of Macedonia began. The conflict was settled with the signing of the Ohrid Framework Agreement on 13 August 2001 by the four leading political parties (Union of Social-Democrats (SDSM), Internal Macedonian Revolutionary Organisation (VMRO-DPMNE), Party for Democratic Prosperity (PDP) and Democratic Party of the Albanians (DPA)). The Ohrid Agreement stipulates adoption and implementation of constitutional and other reforms which improve the rights of ethnic minorities, in accordance with international standards and principles. After the constitution of the Republic of Macedonia was adopted, the first parliamentary elections were held in 1991. The most recent general elections took place on 15 September 2002 and the coalition called “Together for Macedonia” won.

The constituent regions of Öresund, comprising the island of Zealand in Denmark, home of Copenhagen, and Sweden’s Skåne region which hosts the country’s third biggest city, Malmö are both wealthy areas. It is a “learning region” and has a strong presence in some high technology sectors. As such, the key to future growth is not simply the creation of a fixed link between the two parts of the region or improved flexibility in an expanded labour market. The region must look outward and compete with other metropolitan areas to retain and augment the assets that give it, at present, a strong competitive position in the “new economy”.

    Abstract: This book examines the major rural developments and the issues that policy makers have been dealing with across the OECD over the last two decades. The OECD Conference, held in Siena, Italy, in July 2002, on the Future of Rural Policy, identified the need for rural policies to look beyond agriculture and offer new trajectories of development. It concluded that the major shift necessary to guarantee the future vitality of rural regions is the diversification of their economies. The papers examine key critical issues, including the EU LEADER Community Initiative and the Mexican Micro-region programme and provide a new approach that recognises the importance of the interdependence between rural and urban areas, fostering investment (rather than distributing subsidies). This approach also emphasises governance structures that get the locals involved in grass root initiatives to develop and implement new policies. This book is for practitioners and policy makers involved in grass root policies.
