Citizenship was once an exceptional status, a kind of aristocracy of the ancient world in which freedom and political voice were not taken for granted. Even as the nation-state emerged as the primary form of human association, citizenship remained an anomalous status, reserved for the few who were privileged as such in republican democracies.     Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: "This book compares the rights and social inclusion of two racialized minority groups: Roma in Central and Southeast Europe ("CSEE") and African Americans in the United States ("U.S."), primarily in the American South. We couch those attempts loosely in the frameworks of Roma rights and civil rights, though we will focus primarily on Roma rights in post-Communist CSEE (from 1991 until the present) and civil rights during the U.S. Civil Rights Movement (roughly 1954-1968). Scholars have made fleeting comparisons between Roma and African Americans for years, and in the last decade, the Roma rights-Civil Rights comparison has recurred with increasing frequency. Despite the burgeoning recognition of the broader similarities between Roma and African Americans, including the systems that facilitate their marginalization and the barriers to their representation, no book-length work has sustained these comparisons"--

    Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Abstract: In der rechtsvergleichenden Studie arbeitet der amerikanische Historiker heraus, in welch starkem Umfang die rassistischen Gesetze des NS-Staates durch die Einwanderungsgesetzgebung der USA und die rassistischen Gesetze der US-Südstaaten beeinflusst wurden. Rezension: Mit dieser sehr gut lesbaren, sorgfältig gearbeiteten rechtsvergleichenden Spezialstudie liefert der amerikanische Rechtshistoriker eine kleine Sensation. In einer sehr differenzierten Argumentation arbeitet Whitman heraus, dass die Rassengesetzgebung des NS-Staats in erheblicher Weise durch amerikanische Vorbilder, die auch einem Zeitgeist entsprachen, beeinflusst wurde. Die gegen die schwarze Bevölkerung gerichtete Gesetzgebung der US-Südstaaten wurde von massgeblichen NS-Juristen ebenso aufmerksam studiert wie die diskriminierenden Einwanderungsgesetze, die besonders Ost- und Südeuropäer betrafen. Whitman, der sein möglicherweise überraschtes (amerikanisches) Publikum immer wieder direkt anspricht, zieht Parallelen und zeigt Verbindungslinien auf, arbeitet jedoch auch deutlich die Unterschiede heraus: In den USA mündeten die rassistischen Gesetze eben nicht in einen Genozid und der liberale Rechtsstaat setzte ihnen Grenzen.     Abstract: The regulation of civil society provides the framework under which those organisations can most effectively provide services in education, health, social services, housing, development aid and so on. Civil Society in Europe identifies common principles of civil society law in two ways. First, the approaches of the Council of Europe and the European Union are explored. Next civil society regulation in twelve domestic legal systems are investigated on a broad range of substantive areas of law including internal organisation, registration, external supervision, public benefit organisations and international activities. From these, the authors distill a set of minimum norms and optimal conditions under which civil society can deliver its aims most effectively. This book is essential reading for policymakers and legislators across Europe and beyond

Approaching contemporary legal debates with fresh insights, this original and powerful critique sheds new light on issues of overriding social importance, including false confessions, sexual consent, threats of violence, and criminal responsibility. By challenging basic legal assumptions with a nuanced and humane perspective, Dailey shows how psychoanalysis can further our legal system's highest ideals of individual fairness and systemic justice

    Abstract: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.
