    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

How did we become people who effortlessly present our lives in social media profiles and who are meticulously recorded in state surveillance dossiers and online marketing databases? What is the story behind data coming to matter so much to who we are? In How We Became Our Data, Colin Koopman excavates early moments of our rapidly accelerating data-tracking technologies and their consequences for how we think of and express our selfhood today. Koopman explores the emergence of mass-scale record keeping systems like birth certificates and social security numbers, as well as new data techniques for categorizing personality traits, measuring intelligence, and even racializing subjects. This all culminates in what Koopman calls the “informational person” and the “informational power” we are now subject to. The recent explosion of digital technologies that are turning us into a series of algorithmic data points is shown to have a deeper and more turbulent past than we commonly think. Blending philosophy, history, political theory, and media theory in conversation with thinkers like Michel Foucault, Jürgen Habermas, and Friedrich Kittler, Koopman presents an illuminating perspective on how we have come to think of our personhood—and how we can resist its erosion.

    Abstract: In der rechtsvergleichenden Studie arbeitet der amerikanische Historiker heraus, in welch starkem Umfang die rassistischen Gesetze des NS-Staates durch die Einwanderungsgesetzgebung der USA und die rassistischen Gesetze der US-Südstaaten beeinflusst wurden. Rezension: Mit dieser sehr gut lesbaren, sorgfältig gearbeiteten rechtsvergleichenden Spezialstudie liefert der amerikanische Rechtshistoriker eine kleine Sensation. In einer sehr differenzierten Argumentation arbeitet Whitman heraus, dass die Rassengesetzgebung des NS-Staats in erheblicher Weise durch amerikanische Vorbilder, die auch einem Zeitgeist entsprachen, beeinflusst wurde. Die gegen die schwarze Bevölkerung gerichtete Gesetzgebung der US-Südstaaten wurde von massgeblichen NS-Juristen ebenso aufmerksam studiert wie die diskriminierenden Einwanderungsgesetze, die besonders Ost- und Südeuropäer betrafen. Whitman, der sein möglicherweise überraschtes (amerikanisches) Publikum immer wieder direkt anspricht, zieht Parallelen und zeigt Verbindungslinien auf, arbeitet jedoch auch deutlich die Unterschiede heraus: In den USA mündeten die rassistischen Gesetze eben nicht in einen Genozid und der liberale Rechtsstaat setzte ihnen Grenzen.     Abstract: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.

    Abstract: "Frames of War begins where Butler's Precarious Lives left off: on the idea that we cannot grieve for those lost lives that we never saw as lives to begin with. In this age of CNN-mediated war, the lives of those wretched populations of the earth -- the refugees; the victims of unjust imprisonment and torture; the immigrants virtually enslaved by their starvation and legal disenfranchisement -- are always presented to us as already irretrievable and thereby already lost. We may shake our heads at their wretchedness but then we sacrifice them nonetheless, for they are already forgone. By analyzing the different frames through which we experience war, Butler calls for a reorientation of the Left toward the precarity of those lives.     Abstract: In recent decades, religion's traditional distinctiveness under the First Amendment has been challenged by courts and scholars. As America grows more secular and as religious and nonreligious convictions are increasingly seen as interchangeable, many have questioned whether special treatment is still fair. In its recent decisions, the Supreme Court has made clear that religion will continue to be treated differently, but we lack a persuasive account of religion's uniqueness that can justify this difference. This book aims to develop such an account. Drawing on founding era thought illumined by theology, philosophy of religion, and comparative religion, it describes what is at stake in our tradition of religious freedom in a way that can be appreciated by the religious and nonreligious alike. From this account, it develops a new framework for religion clause decision making and explains the implications of this framework for current controversies regarding protections for religious conscience

Ranging from seventeenth- and eighteenth-century Puritan attempts to theorize God's sovereignty to revolutionary and founding-era debates over popular sovereignty, this book argues that democratic aspiration still has much to learn from Hobbes's Leviathan and from the powerful liberal resistance it has repeatedly provoked"--
