    Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience. On 10 December 2020, the book was officially launched with a webinar which brought together the editors of the book and prof. Stephan Parmentier (KU Leuven) and prof. Sie berühren nicht allein die philosophischen, ethischen, rechtlichen, politischen und sozialen Aspekte der Beziehungen zwischen Menschen und Tieren, sondern auch die methodischen Herausforderungen und theoretischen Grundlagen ihrer Erforschung. Im Zentrum steht dabei die Frage, ob und inwieweit sich die anthropozentrisch geprägte Denkstruktur der Kulturwissenschaften um Perspektiven und Forschungsansätze erweitern lässt, die Tieren sowie ihren Rechten, Bedürfnissen und Interessen stärker gerecht werden. Indem die Human-Animal Studies den Blick für die enge Verflochtenheit menschlicher und tierlicher Existenzweisen öffnen, schaffen sie wichtige Voraussetzungen dafür, unser bisheriges Verhältnis zu ihnen grundsätzlich zu überdenken und zugleich praktisch zu verändern.

    Abstract: Junge und minderjährige Geflüchtete sind spätestens seit 2015 eine nicht mehr aus der Kinder- und Jugendhilfe wegzudenkende Zielgruppe. Im Fokus der Veranstaltung stand deshalb drei Jahre "nach dem Ankommen" die Perspektivplanung in der Arbeit mit jungen Flüchtlingen - dies im Hinblick auf die Hilfeplanung insgesamt, mögliche Hilfeformen auch nach dem 18. Lebensjahr sowie die Zukunftsperspektiven und die Verselbstständigung der jungen Geflüchteten. Ein Schwerpunkt der Veranstaltung lag auf der Frage nach dem Ist-Stand und den Perspektiven der kommunalen Integration junger Geflüchteter in der Praxis. Welches sind in diesem Zusammenhang die dringendsten Aufgaben? Und welche Herausforderungen sind damit fachlich, infrastrukturell und personell für die Kinder- und Jugendhilfe verbunden?

Antworten hierauf geben Expertinnen und Experten aus den Bereichen Menschenrechte, Medizinrecht, Philosophie, Medizinethik, Literaturwissenschaft, aus der Inneren Medizin, der Palliativ- und der Rechtsmedizin sowie den Pflege- und Gesundheitswissenschaften.     Abstract: Taking a critical attitude of dissatisfaction towards rights, the central premise of this book is that rights are technologies of governmentality. They are a regulating discourse that is itself managed through governing tactics and techniques - hence governing (through) rights. Part I examines the 'problem of government' (through) rights. The opening chapter describes governmentality as a methodology that is then used to interrogate the relationship between rights and governance in three contexts: the international, regional and local. How rights regulate certain identities and conceptions of what is good governance is examined through the case study of non-state actors, specifically the NGO, in the international setting; through a case study of rights agencies, and the role of experts, indicators and the rights-based approach in the European Union or regional setting; and, in terms of the local, the challenge that the blossoming language of responsibility and community poses to rights in the name of less government (Big Society) is problematised. In Part II, on resisting government (through) rights, the book also asks what counter-conducts are possible using rights language (questioning rioting as resistance), and whether counter-conduct can be read as an ethos of the political, rights-bearing subject and as a new ethical right. Thus, the book bridges a divide between critical theory (ie Foucauldian understandings of power as governmentality) and human rights law

    Abstract: "Governing refugees examines the themes of community governance, order maintenance and legal pluralism in the context of refugee camps. The nature of a refugee situation is such that multiple actors take a role in camp management, creating a complex governance environment which has a significant impact on the lives of refugees but which also speaks to deeply important questions of law and politics, including the production of order beyond the state, justice as a contested site, and the influence of transnational human rights discourses on local justice practice. Focusing specifically on the refugee camps along the Thai-Burma border, this book sheds light on the reality of life in a refugee camp, through exploring the historical evolution and practice of dispute resolution, and examining the ways in which this 'traditional' practice is altered by the influence of new norms encountered during encampment, particularly international human rights law and the law of the host state. Refugee camps are imbued in the public imagination with assumptions of anarchy, danger, and refugee passivity. Governing Refugees marshalls empirical data and ethnographic detail to challenge such assumptions, arguing that refugee camps should be recognised as spaces where social capital can not only survive, but thrive."--

    Abstract: "Although nomadic peoples are scattered worldwide and have highly heterogeneous lifestyles, they face similar threats to their mobile livelihood and survival. Commonly, nomadic peoples are facing pressure from the predominant sedentary world over mobility, land rights, water resources, access to natural resources, and migration routes. Adding to these traditional problems, rapid growth in the extractive industry and the need for the exploitation of the natural resources are putting new strains on nomadic lifestyles. This book provides an innovative rights-based approach to the issue of nomadism looking at issues including discrimination, segregation, freedom of movement, land rights, cultural and political rights, and effective management of natural resources. Jeremie Gilbert analyses the extent to which human rights law is able to provide protection for nomadic peoples to perpetuate their own way of life and culture, and asks why such protection should be granted. The book questions whether the current human rights regime is able to protect nomadic peoples, and highlights the lacuna that currently exists in international human rights law in relation to nomadic peoples. It goes on to propose avenues for the development of specific rights for nomadic peoples, offering a new reading on freedom of movement in the context of nomadic peoples and their rights to land and natural resources"--

Der verbreiteten Vorstellung, dass diese Kommunikationsprozesse weitgehend von Befehl und Gehorsam bestimmt waren, setzen die in diesem Band versammelten Einzelstudien differenzierte historische Analysen der Konstellationen und Dynamiken des Dreiecksverhältnisses entgegen. Die Beiträge widmen sich den spezifischen Formen und Verfahren der Kommunikation zwischen Landesherrn, Verwaltungen und Untertanen, und befassen sich mit deren sprachlicher Ausgestaltung. Zudem fokussieren mehrere Beiträge den Organisationscharakter von Verwaltungen, um das Verhältnis zwischen herrschaftlichen Initiativen und administrativem Handeln, sowie die Rolle von - nicht selten eigendynamischen - Verwaltungspraktiken zu bestimmen.     Abstract: ‘Crafting humans’ – and its corollary human enhancement – is a contested topic, both in medical sciences and the humanities.     Abstract: Summary: Despite the crucial role played by both law and architecture in Roman culture, the Romans never developed a type of building that was specifically and exclusively reserved for the administration of justice: courthouses did not exist in Roman antiquity. The present volume addresses this paradox by investigating the spatial settings of Roman judicial practices from a variety of perspectives. Scholars of law, topography, architecture, political history, and literature concur in putting Roman judicature back into its concrete physical context, exploring how the exercise of law interacted with the environment in which it took place, and how the spaces that arose from this interaction were perceived by the ancients themselves. The result is a fresh view on a key aspect of Roman culture

    Abstract: Der demographische Wandel und die damit einhergehenden Finanzierungsschwierigkeiten der sozialen Sicherungssysteme haben in den letzten Jahren die Frage nach der Gerechtigkeit zwischen den Generationen in das Zentrum der öffentlichen Diskussion gerückt. Die ausgewogene finanzielle Belastung zwischen jetzt lebenden und künftigen Generationen wie auch die Sorge um die Zukunftschancen unserer Kinder sind dabei die zentralen Grundfragen der Debatte. So sieht sich auch die sozialwissenschaftliche Forschung vor die Herausforderung gestellt, klassische Konzepte intragenerationeller Gerechtigkeit daraufhin zu überprüfen, inwiefern sie Forderungen nach intergenerationeller Gerechtigkeit standhalten. Neben den empirischen und philosophischen Grundfragen analysieren die Beiträger dieses Bandes das Thema Generationengerechtigkeit aus einer ordnungsökonomischen Perspektive. Es geht zum einen um eine Begründung dafür, warum überhaupt heutige Gesellschaftsmitglieder die Interessen zukünftiger Generationen berücksichtigen sollen. Zum anderen werden solche gesellschaftlichen Regeln gesucht, die im besten Falle geeignet sind, die Interessen der kommenden Generationen langfristig zu sichern und dabei zugleich für die heute Lebenden akzeptabel sind. Eine tragfähige ordnungsökonomische Konzeption der Generationengerechtigkeit muss sich dann auch als Leitfaden für einzelne Felder der praktischen Politik bewähren.     Abstract: Vom 19. Jahrhundert als einer Mediengesellschaft zu sprechen, erscheint als ein Anachronismus. Der Begriff sucht den Bedeutungsgewinn und die Diversifizierung der Medien in der Gegenwart zu erfassen und damit nicht zuletzt heutige von früheren Gesellschaften abzugrenzen. Die Annahme, dass Medien in früheren Gesellschaften nicht ebenfalls eine zentrale und spezifische Rolle zukam, wäre jedoch irrig. So war das 19. Jahrhundert nicht nur vom Aufstieg einer Vielzahl einstmals neuer Medien geprägt, sondern auch dadurch, dass sich die Gesellschaft über öffentliche und mediale Kommunikation erst konstituierte und ausdifferenzierte. Der Band macht es sich zur Aufgabe, ineinander greifende zentrale mediale und gesellschaftliche Entwicklungen für Deutschland und für Frankreich in einer übergreifenden wie vergleichenden Perspektive vorzustellen..
