    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective. With Palgrave, he previously published Electronic Monitoring: Tagging Offenders in a Culture of Surveillance (2020) and Europe in Prisons: Assessing the Impact of European Institutions on National Prison Systems (2017, co-edited with Luc Robert). .

    Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

    Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience.     Abstract: Die Europa-Idee, die in den Nachkriegsjahren wirksam war, ist heute verdunstet. Diese Idee war stark geprägt vom Christentum, dem der alte Kontinent seine geistige Einheit verdankt. Die Institutionen des Christentums sind dabei konkurrierenden Interessen ihrer Mitglieder ausgesetzt, verlieren deren Zustimmung in unterschiedlicher Weise und haben das konfliktträchtige Potential ihrer konfessionellen Vielfalt noch nicht ganz überwunden. Daneben haben sogenannte fundamentalistische Richtungen innerhalb traditioneller Weltreligionen – in Europa außer dem Christentum auch das Judentum und der Islam – regen Zulauf. Der Band hinterfragt die traditionelle Rolle religiöser Werte für die Union, ihre Transformation in der Geschichte und behandelt ihre Gegenwart und Zukunft. Increasing life expectancy in Europe entails a remodelling of career development and life course, marked by discontinuities and changing professional activities. One of the concerns is ensuring that everybody may participate in gainful activities during his or her life course while also guaranteeing social rights through adequate social protection.     Abstract: Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.     Abstract: This book provides a comparative perspective on one of the most intriguing developments in law: the influence of basic rights and human rights in private law. Kirchen und Kommunen sind als Friedhofsträger und Erinnerungsgemeinschaften herausgefordert, diese Bedarfe in eine sinnvolle Gestalt zu überführen. In interdisziplinärer Weite werden aus sozialwissenschaftlicher, kulturwissenschaftlicher und theologischer Perspektive die sepulkral-memorialen Formen diskutiert und ausgelotet.

    Abstract: Modern Chinese history told from a Buddhist perspective restores the vibrant, creative role of religion in postimperial China.     Abstract: This work deals with the temporal effect of judicial decisions, and more specifically, with the hardship caused by the retroactive operation of overruling decisions. By means of a jurisprudential and comparative analysis, the book explores several issues created by the overruling of earlier decisions. Overruling of earlier decisions, when it occurs, operates retrospectively with the effect that it infringes the principle of legal certainty through upsetting any previous arrangements made by a party to a case under long standing precedents established previously by the courts. On this account, in the recent past, a number of jurisdictions have had to deal with the prospect of introducing in their own systems the well-established US practice of prospective overruling whereby the court may announce in advance that it will change the relevant rule or interpretation of the rule but only for future cases. However, adopting prospective overruling raises a series of issues mainly related to the constitutional limits of the judicial function coupled with the practical difficulties attendant upon such a practice. This book answers a number of the questions raised by this practice. It makes use of the great reservoir of foreign legal experience that furnishes theoretical and practical ideas from which national judges may draw their knowledge and inspiration in order to be able to advise a rational method of dealing with time when they give their decisions

    Abstract: This book offers its readers an overview of recent developments in the theory of legal argumentation written by representatives from various disciplines, including argumentation theory, philosophy of law, logic and artificial intelligence.     Abstract: Is there universalism of human rights? If so, what are its scope and limits? This book is a doctrinal attempt to define universalism of human rights, as well as its scope and limits. The book presents tests of universalism on international, regional and national constitutional levels. It is maintained that universalism of human rights is both a concept and a normative reality. The normative character of human rights is scrutinized through the study of international and regional agreements as well as national constitutions. As a consequence, limitations of normativity are identified, usually on the international level, and take the form of exceptions, reservations, and interpretations. The book is based on the General and National Reports which were originally presented at the 18th International Congress of the International Academy of Comparative Law in Washington D.C. 2010.

    Abstract: This book is a comparative study of the exclusion of illegally gathered evidence in the criminal trial , which includes 15 country studies, a chapter on the European Court of Human Rights, and a comparative synthetic conclusion. No other book has undertaken such a broad comparative study of exclusionary rules, which have now become a world-wide phenomenon. The topic is one of the most controversial in criminal procedure law, because it reveals a constant tension between the criminal court’s duty to ascertain the truth, on the one hand, and its duty to uphold important constitutional rights on the other, most importantly, the privilege against self-incrimination and the right to privacy in one's home and one's private communications. The chapters were contributed by noted world experts on the subject for the XVIII Congress of the International Academy of Comparative Law in Washington in July 2010.

    Abstract: Dating back millennia, antisemitism has been called "the longest hatred." Thought to be vanquished after the horrors of the Holocaust, in recent decades it has once again become a disturbing presence in many parts of the world. Resurgent Antisemitism presents original research that elucidates the social, intellectual, and ideological roots of the "new" antisemitism and the place it has come to occupy in the public sphere. By exploring the sources, goals, and consequences of today's antisemitism and its relationship to the past, the book contributes to an understanding of this phenomenon that may help diminish its appeal and mitigate its more harmful effects.

Beginning with the decline of religious institutions during the latter part of the 20th century, Rethinking Media, Religion, and Culture focuses on issues such as the increasing autonomy and individualized practice of religion, the surge of media and media-based icons that are often imbued with religious qualities, and the ensuing effect on cultural practices. Editors Stewart M. Hoover and Knut Lundby examine each of these issues and the implicatiors of major recent findings of religious, media, and cultural studies as they pertain to one another.     Abstract: Vom 19. Jahrhundert als einer Mediengesellschaft zu sprechen, erscheint als ein Anachronismus. Der Begriff sucht den Bedeutungsgewinn und die Diversifizierung der Medien in der Gegenwart zu erfassen und damit nicht zuletzt heutige von früheren Gesellschaften abzugrenzen. Die Annahme, dass Medien in früheren Gesellschaften nicht ebenfalls eine zentrale und spezifische Rolle zukam, wäre jedoch irrig. So war das 19. Jahrhundert nicht nur vom Aufstieg einer Vielzahl einstmals neuer Medien geprägt, sondern auch dadurch, dass sich die Gesellschaft über öffentliche und mediale Kommunikation erst konstituierte und ausdifferenzierte. Der Band macht es sich zur Aufgabe, ineinander greifende zentrale mediale und gesellschaftliche Entwicklungen für Deutschland und für Frankreich in einer übergreifenden wie vergleichenden Perspektive vorzustellen..

    Abstract: Der demographische Wandel und die damit einhergehenden Finanzierungsschwierigkeiten der sozialen Sicherungssysteme haben in den letzten Jahren die Frage nach der Gerechtigkeit zwischen den Generationen in das Zentrum der öffentlichen Diskussion gerückt. Die ausgewogene finanzielle Belastung zwischen jetzt lebenden und künftigen Generationen wie auch die Sorge um die Zukunftschancen unserer Kinder sind dabei die zentralen Grundfragen der Debatte. So sieht sich auch die sozialwissenschaftliche Forschung vor die Herausforderung gestellt, klassische Konzepte intragenerationeller Gerechtigkeit daraufhin zu überprüfen, inwiefern sie Forderungen nach intergenerationeller Gerechtigkeit standhalten. Neben den empirischen und philosophischen Grundfragen analysieren die Beiträger dieses Bandes das Thema Generationengerechtigkeit aus einer ordnungsökonomischen Perspektive. Es geht zum einen um eine Begründung dafür, warum überhaupt heutige Gesellschaftsmitglieder die Interessen zukünftiger Generationen berücksichtigen sollen. Zum anderen werden solche gesellschaftlichen Regeln gesucht, die im besten Falle geeignet sind, die Interessen der kommenden Generationen langfristig zu sichern und dabei zugleich für die heute Lebenden akzeptabel sind. Eine tragfähige ordnungsökonomische Konzeption der Generationengerechtigkeit muss sich dann auch als Leitfaden für einzelne Felder der praktischen Politik bewähren.     Abstract: Recent developments in the European integration process have raised, amongst many other things, the issue of linguistic diversity, for some a stumbling block to the creation of a European democratic polity and its legal and social institutions. The solution to the 'question of language', involves an understanding of the role played by natural languages and the consequent design of policies and institutional mechanisms to facilitate inter-linguistic and intercultural communication. This is not an exclusively European problem, and nor is it entirely new, for it is also the problem of linguistic majorities and minorities within unitary nation-states. However, the effects of globalization and the diffusion of multiculturalism within nation-states have given renewed emphasis to the question of language in diverse societies. Facing the question anew involves reconsidering traditional ideas about social communication and the public sphere, about opinion-formation and diffusion, about the protection of cultural and linguistic minorities, and about the role that language plays in the process of formation of political and legal cultures. This volume is intended as a multidisciplinary contribution towards studying and assessing the range of problems that form the 'language question' in Europe and diverse societies

    Abstract: "International business transactions are heavily influenced by culture,practice and rule. The pursuit of business relationships within nation-states can be subject to differences in the generation of norms and the processing of disputes, but these conflicts are magnified many times over in cross-border transactions where nation-state control and support is weak or absent. This book seeks different explanations of the ways in which business people and their legal advisers try to minimise the effect of these magnified difficulties. At the outset the editors suggest four sources through which the international business community might be considered to have supplemented nation-state conflict prevention and dispute resolution institutions - an international legal order; the development of a private normative order based on common business practices (denominated the lex mercatoria); through the efforts and work product of internationalised law firms, and by means of extensive, thick personal relationships often referred to by their Chinese term guanxi. Since most explanations are dominated by North American and European legal scholarship and practice, a second concern of this book is to open up the discussion to competing explanatory frameworks. Specifically, it develops the notion that global legal convergence may not be the immediate, inevitable result of increased global economic interaction. Rather, less formal mechanisms for achieving normative understanding and predictability in business dealings may also flourish."--Bloomsbury Publishing

    Abstract: During the 1920s much attention was paid to the history of Jews in Germany since the Enlightenment and the subject became popular again, with renewed emphasis, after 1945. Many historians were deeply committed to understanding and explaining the tragic path that led from the emancipation of the Jews to the Holocaust. For a long time, much less work was done on the history of Jews in Germany in earlier periods, particularly the period between the late Middle Ages and the Enlightenment.     Abstract: Until the late 1960s, most Western scholars studying the history, culture, social and political life and economy of Russia and the Soviet Union, paid scant attention to the participation and experience of women. The multifarious ways in which gender roles and perceptions of gender were influenced by and in turn influenced the heterogeneous cultures of the Soviet empire were largely ignored. However, this neglect has slowly been rectified and now the study of women and gender relations has become one of the most productive fields of research into Russian and Soviet society. This volume demonstrates the originality and diversity of this recent research. Written by leading Western scholars, it spans the last decade of tsarist Russia, the 1917 revolutions and the Soviet period. The essays reflect the interdisciplinary nature of women's work, women and politics, women as soldiers, female prostitution, popular images of women and women's experience of perestroika.
