    Abstract: Arnd Uhle untersucht das Verhältnis von freiheitlichem Verfassungsstaat und kultureller Identität, das bislang kaum – wenn, dann lediglich partiell – erforscht wurde. Der Autor beleuchtet die Relevanz der kulturellen Identität für Entstehung, Gestalt und Fortbestand des freiheitlichen Verfassungsstaates aus verfassungstheoretischer, aus verfassungsrechtlicher und schließlich aus europarechtlicher Perspektive.Bereits aus verfassungstheoretischer Sicht ergibt sich dabei, daß die kulturelle Identität gleichermaßen Entstehungs- wie auch Geltungsbedingung freiheitlicher Verfassungsstaatlichkeit ist, weil der freiheitliche Staat in vielfältiger Weise an die kulturelle Identität anknüpft. Eine Betrachtung aus verfassungsrechtlicher Perspektive unterstreicht diesen Befund und belegt, daß namentlich das deutsche Grundgesetz in einer prima facie zwar komplex und unüberschaubar erscheinenden, letztlich aber systematisch geordneten und differenzierenden Weise an die kulturelle Identität anknüpft – und diese angesichts ihrer Bedeutung für den dauerhaften Fortbestand des freiheitlichen Verfassungsstaates überdies durch das in der Habilitationsschrift erstmals entfaltete grundgesetzliche Staatsziel der Vitalität und Dauerhaftigkeit der freiheitlichen Verfassungsordnung mit verfassungsrechtlichem Schutz umhegt. In der Konsequenz dieses Staatsziels ist der grundgesetzgebundene Staat zur Pflege und zum Schutz der kulturellen Identität verpflichtet. Eine abschließende europarechtliche Betrachtung verdeutlicht, daß die grundgesetzliche Anknüpfung an die kulturelle Identität wie auch deren verfassungsrechtliche Sicherung den Schutz des Art. 6 Abs.3 EUV genießen, der die Achtung der nationalen Identität anordnet.

    Abstract: This volume represents the first attempt to systematically compare organised crime concepts, as well as historical and contemporary patterns and control policies in thirteen European countries. These include seven ‘old’ EU Member States (Denmark, France, Germany, Italy, The Netherlands, Spain and the United Kingdom), two ‘new’ members (the Czech Republic and Poland), a candidate country (Turkey), and three non-EU countries (Albania, Russia and Switzerland). Based on a standardised research protocol, thirty-three experts from different legal and social disciplines provide insight through detailed country reports. On this basis, the editors compare organised crime patterns and policies in Europe and assess EU initiatives against organised crime.     Abstract: Launch activities performed by private entities deal with a complex legal environment. The Space Treaties provide a general liability framework. Launch participants are subject to regulatory or institutional control, and to domestic liability laws. Specific contractual practice has developed due to insurance limitations, the inter-participants' waivers of liability and claims. This book synthesizes information on the norms of play, to allow the grasp of their relative weight and interactions in the assessment of liability risk for launch activities. It reveals a legal framework presently lacking sufficient predictability for an efficient liability risk management: the waivers of liability suffer weaknesses as do all such clauses, and lack uniformity and reliability; and the Space Treaties contain ambiguous terms preventing predictable determination of the States responsible for authorizing and supervising launch activities and for damage compensation, and do not reflect the liability of launch operators. This book offers suggestions of new approaches for: harmonizing waivers of liability to improve their consistency, validity and flow-down; and improving the Space Treaties for their implementation to non-governmental launch activities. In the launch community, the need for lawmaking is less compelling than in fields such as aviation. Nevertheless, adjustments to the present framework are proposed through model clauses and an international instrument, for further thinking and contribution by those sharing the opinion that creative lawmaking is needed now to prepare for tomorrow's endeavors.

    Abstract: About the Book Series The idea for the Book Series “Innovation and Change in Professional Education” (ICPE) was born in 1996. While working on another publication in this area, we noticed that professional educators faced similar problems without even knowing from each other. It was this observation that resulted in examining the possibilities for a new publication platform about professional education with input from different professions. We wanted to develop a publication source that would bring together educators and researchers to exchange ideas and knowledge about theory, research and professional practice. But we were not only striving for a book series informing readers about important themes in the professions. A second goal was to focus on processes of change and innovation. We were heavily involved in innovations going on in our institutions, and were convinced that a better understanding was needed in a wide range of issues critically important to the future of professional education. It was our belief that scholarly publications about innovation processes may support fundamental change in professional education. ICPE reflects our view that professional education deserves such a publication platform. It aims to approach critical questions of educational innovations, and to examine dynamics of educational change in various professional domains in the context of innovation processes. The books will include contributions from frontline practitioners, leading researchers, or distinguished scholars in professional education, delivering reports of empirical or theoretical research, reviews, interpretations of evaluation studies, or descriptions of innovative approaches.

    Abstract: How is it that cultures come into existence at all? How do cultures develop particular customs and characteristics rather than others? How do cultures persist and change over time? Most previous attempts to address these questions have been descriptive and historical. The purpose of this book is to provide answers that are explanatory, predictive, and relevant to the emergence and continuing evolution of cultures past, present, and future. Most other investigations into "cultural psychology" have focused on the impact that culture has on the psychology of the individual. The focus of this book is the reverse. The authors show how questions about the origins and evolution of culture can be fruitfully answered through rigorous and creative examination of fundamental characteristics of human cognition, motivation, and social interaction. They review recent theory and research that, in many different ways, points to the influence of basic psychological processes on the collective structures that define cultures. These processes operate in all sorts of different populations, ranging from very small interacting groups to grand-scale masses of people occupying the same demographic or geographic category. The cultural effects--often unintended--of individuals' thoughts and actions are demonstrated in a wide variety of customs, ritualized practices, and shared mythologies: for example, religious beliefs, moral standards, rules for the allocation of resources, norms for the acceptable expression of aggression, gender stereotypes, and scientific values. The Psychological Foundations of Culture reveals that the consequences of psychological processes resonate well beyond the disciplinary constraints of psychology.     Abstract: A goal of mine ever since becoming an educational researcher has been to help construct a sound theory to guide instructional practice. For far too long, educational practice has suffered because we have lacked firm instructional guidelines, which in my view should be based on sound psychological theory, which in turn should be based on sound neurological theory. In other words, teachers need to know how to teach and that "how-to-teach" should be based solidly on how people learn and how their brains function. As you will see in this book, my answer to the question of how people learn is that we all learn by spontaneously generating and testing ideas. Idea generating involves analogies and testing requires comparing predicted consequences with actual consequences. We learn this way because the brain is essentially an idea generating and testing machine. But there is more to it than this. The very process ofgenerating and testing ideas results not only in the construction of ideas that work (i. e. , the learning of useful declarative knowledge), but also in improved skill in learning (i. e. , the development of improved procedural knowledge).

    Abstract: The study of information-based actions and processes has been a vibrant - terface between logic and computer science for several decades now. Indeed, several natural perspectives come together here. On the one hand, logical s- tems may be used to describe the dynamics of arbitrary computational p- cesses – as in the many sophisticated process logics available today. But also, key logical notions such as model checking or proof search are themselves informational processes involving agents with goals. The interplay between these descriptive and dynamic aspects shows even in our ordinary language. A word like “proof” hdenotes both a static ‘certificate’ of truth, and an activity which humans or machines engage in. Increasing our understanding of l- ics of this sort tells us something about computer science, and about cognitive actions in general. The individual chapters of this book show the state of the art in current - vestigations of process calculi such as linear logic, and – with mainly two major paradigms at work, namely, linear logic and modal logic. These techniques are applied to the title themes of concurrency and synchronisation, but there are also many repercussions for topics such as the geometry of proofs, categorial semantics, and logics of graphs. Diese weit verbreitete Stereotype beruht überwiegend auf "Bildern aus zweiter Hand". Im Unterschied dazu rückt die Publikation von Margret Spohn die türkischen Männer der ersten Migrantengeneration explizit in den Mittelpunkt der Analysen, wo sie als "Experten ihrer eigenen Geschichte" ausführlich selbst zu Wort kommen. Das feine Geflecht der hier erzählten und sensibel interpretierten Lebensgeschichten gibt Raum für die Reflexionen der Befragten über ihr Verhältnis zu den eigenen Eltern, zur Ehefrau, zu den Kindern und zu ihrem Leben in "zwei Heimaten". Damit liefert die Arbeit einen Schlüssel zu einem besseren Verständnis der Männer dieser Migrantengeneration, die vor fast einem halben Jahrhundert das Wagnis auf sich genommen haben, sich und ihren Familien in einem fremden Land eine Zukunft aufzubauen

    Abstract: The path adolescents take from childhood to adulthood is a product of social, economic, political, and technological forces. These forces may facilitate youth's preparation to become healthy adults, or they may leave youth unprepared for adulthood. Knowledgeable projections are vital in shaping the agenda for research; for alerting educators, policy makers, and practitioners to new issues; and for formulating thoughtful responses to emerging dilemmas. This book focuses upon the future of adolescence in postindustrial societies. The authors identify some ominous societal changes that will affect youth: unstable job markets, competition for public resources due to an aging population, and widening income gaps between 'information workers' and low-skill workers. But they also observe opportunities created by information technology, innovations in health service delivery and criminal-justice rehabilitation, and the resourcefulness of a new generation. This volume examines these and other macro-structural changes that will impact adolescents' lives and their futures as adults

In this book she gives an overview of the history of legal anthropology and at the same time urges anthropologists, lawyers, and activists to recognize the centrality of law in social change. Nader traces the evolution of the plaintiff's role in the United States in the second half of the twentieth century and argues that the atrophy of the plaintiff's power during this period represents a profound challenge to justice and democracy. Taking into account the vast changes wrought in both anthropology and the law by globalization, Nader speaks to the increasing dominance of large business corporations and the prominence of neoliberal ideology and practice today. In her discussion of these trends, she considers the rise of the alternative dispute resolution movement, which since the 1960s has been part of a major overhaul of the U.S. judicial system. Nader links the increasing popularity of this movement with the erosion of the plaintiff's power and suggests that mediation as an approach to conflict resolution is structured to favor powerful--often corporate --interests

    Abstract: This work presents Sapir's most comprehensive statement on the concepts of culture, on method and theory in anthropology and other social sciences, on personality organization, and on the individual's place in culture and society. Extensive discussions on the role of language and other symbolic systems in culture, ethnographic method, and social interaction are also included. Ethnographic and linguistic examples are drawn from Sapir's fieldwork among native North Americans and from European and American society as well. Edward Sapir (1884-1939), one of this century's leading figures in American anthropology and linguistics, planned to publish a major theoretical state - ment on culture and psychology. He developed his ideas in a course of lectures presented at Yale University in the 1930s, which attracted a wide audience from many social science disciplines. Unfortunately, he died before the book he had contracted to publish could be realized. Like de Saussure's Cours de Linguistique Générale before it, this work has been reconstructed from student notes, in this case twentytwo sets, as well as from Sapir's manuscript materials. Judith Irvine's meticulous reconstruction makes Sapir's compelling ideas - of surprisingly contemporary resonance - available for the first time.

    Abstract: There is widespread concern that the growth of the Internet is exacerbating inequalities between the information rich and poor. Digital Divide examines access and use of the Internet in 179 nations world-wide. A global divide is evident between industrialized and developing societies. A social divide is apparent between rich and poor within each nation. Within the online community, evidence for a democratic divide is emerging between those who do and do not use Internet resources to engage and participate in public life. Part I outlines the theoretical debate between cyber-optimists who see the Internet as the great leveler. Part II examines the virtual political system and the way that representative institutions have responded to new opportunities on the Internet. Part III analyzes how the public has responded to these opportunities in Europe and the United States and develops the civic engagement model to explain patterns of participation via the Internet.

    Abstract: Netwar-like cyberwar-describes a new spectrum of conflict that is emerging in the wake of the information revolution. Netwar includes conflicts waged, on the one hand, by terrorists, criminals, gangs, and ethnic extremists; and by civil-society activists (such as cyber activists or WTO protestors) on the other. What distinguishes netwar is the networked organizational structure of its practitioners-with many groups actually being leaderless-and their quickness in coming together in swarming attacks. To confront this new type of conflict, it is crucial for governments, military, and law enforcement to begin networking themselves.
