    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out. Across the chapters, contributors from different countries examine the data, press coverage, and provide professional observations on how policing, law enforcement, police powers and community relations were managed. They focus on how security and governmental actors often failed to align with the formal scripts that were specifically designed for crisis-management, resulting in the wavering application of professional discretion and coercive powers. Their different approaches were evident: in some regions police were less dominantly visible compared to other regions, where the police used a top-down visible and repressive stance vis-à-vis public alignment with COVID rules, including the imposition of lockdown and curfews. Some contributors draw on data from the COROPOL (Corona Policing) Monitor which collated data on crime, plural policing and public order in Europe and around the world during the early phases of the COVID crisis. Overall, this book seeks to provide comparative critical insights and commentary as well as a practical and operational understanding of security governance during the COVID-19 crisis and the lessons learned to improve future preparedness. Monica den Boer is Professor of Military Policing Operations at the Netherlands Defence Academy. Her primary research focus is on the evolution of military policing, as well as border policing, international policing, urban policing and the policing of organised crime and terrorism. She served as member of the Dutch national parliament from 2017 to 2020. Prior to this she worked in several academic and professional environments, including the Police Academy of the Netherlands and the VU University Amsterdam. Eric Bervoets is a police scientist and criminologist. He has been active as a researcher since 1997. After a master's degree in public administration at Rotterdam Erasmus University, the Netherlands, Bervoets obtained his PhD in 2006 with a dissertation on policing troubled neighbourhoods. In 2020, he was appointed Research Fellow at the Netherlands Defence Academy. Linda Hak obtained her BSc in Criminology at Erasmus University and a master’s degree in Legal Psychology at Maastricht University, the Netherlands. She served as a research intern at Bureau Bervoets and is employed as a detective assistant for the National Police of the Netherlands.

In this regard, this volume fills a need in scholarship by presenting critical analyses of the constitutional identities of selected Member States. Leading and well-placed experts contribute country studies on a range of states, which are compared using a framework that can be applied to other Member States as well.     Abstract: »Schuld« ist ein Basisbegriff in vielen Wissenschaftszweigen. Offensichtlich ist die Funktion von Schuld in der Rechtswissenschaft, wo sie einerseits im Strafrecht und andererseits im Zivilrecht das Fundament für die Rechtsmaterie bildet. In der Philosophie befasst sich vor allem die Ethik mit der wie auch immer definierten Schuld. Die antiken Tragödien drehen sich um verschuldetes wie unverschuldetes Unheil. In der Geschichtswissenschaft wird etwa die Frage nach der Kriegsschuld seit jeher intensiv erörtert. In der Wissenschaftsgeschichte wird über die mit wissenschaftlichen Entdeckungen einhergehende Schuld disputiert. Soziologie, Kunst- und Kulturwissenschaften befassen sich mit in den heutigen pluralistischen Gesellschaften medial und diskursiv präsenten Formen von Schuld. In der Medizin und in den Naturwissenschaften wird die Quantifizierung und Messbarkeit von Schuld sowie ihr eventueller evolutionärer Vorteil erforscht. Und in der Theologie ist die persönliche Schuld Maßstab für die Beurteilung des Menschen am dies irae. Diese Wissensfelder werden in dem vorliegenden Band miteinander in Beziehung und somit ein fruchtbarer interdisziplinärer Diskurs ins Werk gesetzt.

    Abstract: "This book has been brought to life in a period where transnational solidarity and cooperation seemed to be moving backwards rather than forwards. This was among others reflected in the so called refugee crisis in Europe in 2015. After the Brexit referendum in the United Kingdom in June 2016, and presidential elections in the US later the same year, the political agenda took a turn towards focusing primarily on the internal national perspective in relation to areas such as environmental protection, aid to countries in the Third World and trade with the outside world. It still remains to be seen when and how the United Kingdom will be leaving the European Union. In general, the EU has experienced a number of crises, among others an economic and financial crisis and later the refugee crisis, during the past years. These crises have challenged transnational solidarity in Europe. This development in Europe and the World stresses the question, whether and how transnational solidarity is possible. This book is motivated by these developments and discusses and attempts to answer this question. Our main presumption is that solidarity can create stability and sustainability (social, economic, environmental, peace etc.), within states, regions and globally, why it is crucial to gain more knowledge about it. Realization of the UN Sustainability Goals 2017 and 2030 go hand in hand with solidarity at both local, regional and global levels. In this work, we do of course build on earlier discussions and investigations of solidarity"--

Solange Mouthaan is Associate Professor of Law at the University of Warwick. Her research interests focus on the gendered experiences of children affected by armed conflict and the restrictive interpretation of international criminal law in this area. Olga Jurasz is a Senior Lecturer in the Law School at the Open University and works in the fields of international law, human rights, gender-based violence and gender and post-conflict reconstruction.

    Abstract: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Abstract: Distinguishing between civilians and combatants is a central aspect of modern conflicts. Yet such distinctions are rarely upheld in practice. The Civilianization of War offers new ways of understanding civilians' exposure to violence in war. Each chapter explores a particular approach to the political, legal, or cultural distinctions between civilians and combatants during twentieth-century and contemporary conflicts. The volume as a whole suggests that the distinction between combatants and non-combatants is dynamic and oft-times unpredictable, rather than fixed and reciprocally understood. Contributors offer new insights into why civilian targeting has become a strategy for some, and how in practice its avoidance can be so difficult to achieve. Several discuss distinct population groups that have been particularly exposed to wartime violence, including urban populations facing aerial bombing, child soldiers, captives, and victims of sexual violence. The book thus offers multiple perspectives on the civil-military divide within modern conflicts, an issue whose powerful contemporary resonance is all too apparent

Canada, perceived as a nation of immigrants and touted as one of the most generous countries in the world today for its reception of refugees, has not been immune from these practices. This book examines the "crimmigration" -- the criminalization of migration -- from national and comparative perspectives, drawing attention to the increasing use of criminal law measures, public policies, and practices that stigmatize or diminish the rights of forced migrants and regugees within a dominant public discourse that not only steoreotypes and criminalizes but marginalized forced migrants.

    Abstract: The regulation of civil society provides the framework under which those organisations can most effectively provide services in education, health, social services, housing, development aid and so on. Civil Society in Europe identifies common principles of civil society law in two ways. First, the approaches of the Council of Europe and the European Union are explored. Next civil society regulation in twelve domestic legal systems are investigated on a broad range of substantive areas of law including internal organisation, registration, external supervision, public benefit organisations and international activities. From these, the authors distill a set of minimum norms and optimal conditions under which civil society can deliver its aims most effectively.     Abstract: Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.     Abstract: This book examines the two most populous nations on earth – India and China – in an effort to demystify the interaction between intellectual property rights (IPR) regimes, innovation and economic growth by critically looking at the economic and legal realities. In addition, it analyzes the question of how innovation can best be transformed into IPR, and how IPR can best be exploited to encourage innovation. Comparing and contrasting these two giant nations can be highly beneficial as China and India were the two fastest-growing economies in the last three decades, and together their populations make up one third of the world’s total population; as such, exploring how to sustain their growth via innovation and commercialization of IPR could have a tremendous positive impact on global well-being. While a study of these two mega countries with such diverse dimensions and magnitudes can never be truly comprehensive, this joint effort by scholars from law, business management and economics disciplines that pursues an empirical approach makes a valuable contribution. Divided into three parts, the first offers an in-depth doctrinal and empirical analysis. The second part exclusively focuses on India, while the last is dedicated to China.
