Kurzfassung: Undeniably widespread and powerful as it is, the Internet is not beyond control: it can reach as high as the sky (cloud computing), but it cannot escape competition. Yet, protecting competition in the “network of networks” is not without challenges: not only are competitive processes in platform-based industries complex, so is competition law analysis. The latter is often confronted with the difficulties in predicting the outcome of competition, in particular in terms of innovation. Do the specific competition law issues in a digital environment presuppose a reconsideration of competition law concepts and their application? Can current competition law tools be adjusted to the rush pace of dynamic industries? To what extent could and should competition law be supplemented by regulation? This book provides an analysis of recent developments in the most relevant competition law cases in a digital environment on both sides of the Atlantic (the EU and the US) and assesses platform competition issues from a legal as well as an economic point of view

Kurzfassung: This book is highly topical. The shift from the multilateral WTO negotiations to bilateral and regional Free Trade Agreements has been going on for some time, but it is bound to accelerate after the WTO Doha round of negotiations is now widely regarded as a failure. However, there is a particular regional angle to this topic as well. After concluding that further progress in the Doha round was unlikely, Pacific Rim nations recently have progressed with the negotiations of a greatly expanded Trans-Pacific Partnership Agreement that includes industrialised economies and developed countries such as the United States, Japan, Australia and New Zealand, recently emerged economies such as Singapore, but also several developing countries in Asia and Latin America such as Malaysia and Vietnam. US and EU led efforts to conclude FTAs with Asia-Pacific nations are also bound to accelerate again, after a temporary slowdown in the negotiations following the change of government in the United States and the expiry of the US President’s fast-track negotiation authority. The book will provide an assessment of these dynamics in the world’s fastest growing region. It will look at the IP chapters from a legal perspective, but also put the developments into a socio-economic and political context. Many agreements in fact are concluded because of this context rather than for purely economic reasons or to achieve progress in fields like IP law. The structure of the book follows an outline that groups countries into interest alliances according to their respective IP priorities. This ranges from the driving forces of the EU, US and Japan, via Asia-Pacific resource-rich but IP poor economies such as Australia and New Zealand, recently emerged economies with strong IP systems such as Singapore and Korea to leading developing countries such as China and India and ‘second tier industrializing economies’ such as Thailand, Malaysia and Indonesia

    Schlagwort(e): Education, Higher ; Education ; Education ; Education, Higher ; Hochschule ; Privatisierung ; China
Kurzfassung: This book makes both empirical and conceptual contributions to the debate on privatization of higher education in China. Empirically, it aims to fill a gap in our knowledge of privatization of higher education in North China. To this end, Beijing was chosen as a case for analysis, and nine local higher educational institutions were visited. The case study strategy is also complemented by an extensive review of national policies to reveal problems beyond the specific case of Beijing and of national concern. The effects of the cultural and socioeconomic background and the unique state-party controlling system on higher education management are stressed. Conceptually, most existing studies on privatization of higher education in China adopt a policy analysis approach, while research on privatization of other public sectors or in other countries is frequently guided by economic theories. This book thus seeks to combine both social policy and econometric approaches to provide a systematic and detailed investigation of the privatization process in the context of higher education. It also improves examines the applicability of western theories in the Chinese context

For both countries, a university education is seen as key to economic development. While China and the US have two very different political systems, they represent the two largest economies in the world and share beliefs that higher education plays an integral role to economic development. The book will bring together scholars with multiple perspectives on the topic to create dialogue around similarities and differences. This book will appeal to students, scholars, and higher educational administrators in both countries and other countries as well who are seeking to understand the strategic change in higher education in both China and the US

Kurzfassung: This study explores the process of curriculum innovation-the Yuanpei Program, which is intended to provide general education at Peking University and offers key insights in terms of theory and practice. First, it contributes to development of the understanding of curriculum innovation and the enrichment of knowledge on general education, its principles and practice in China. More specifically, it enriches the literature on the curriculum reform in higher education by describing the complexity of the process in the Chinese context. The conflict approach to examining the curriculum change has allowed the author to better understand the difficulty and constraints involved in the innovation. Many studies conducted before tend not to focus on conflicts and constraints in a systematic way, thus leaving many aspects to be investigated. The data on general education reforms practices obtained from the study will expand the understanding of general education reforms in the Mainland context. Second, this study will provide a valuable reference work on reforms in higher education in China. The general education reforms, though conducted at several universities, are still in the trial stage. The lessons learned from the study illustrate what kinds of conflicts and problems might arise, supporting practitioners by addressing sources of conflicts that could be avoided or effectively defused

Kurzfassung: This book provides a comprehensive review of the Measures for Administration of Takeover of Chinese Listed Companies (the Chinese takeover law), with emphasis on the differences between the Chinese takeover law and takeover legislation in the UK, the US and Hong Kong. The Chinese M&A market has been booming at an unprecedented rate in recent years; not only domestic investors, but also foreign funds and multinational companies are actively participating on the market. For both market participants and researchers, it is crucial to understand the emerging and transitional aspects of the Chinese economy and its M&A market, and the impacts of those aspects on relevant laws. While there are ongoing academic discussions on the convergence between the Chinese takeover law and its counterparts in the UK, Hong Kong and the US, this book offers a comprehensive discussion of the divergence and focuses on key differences in the transplanted Chinese takeover law.

Kurzfassung: (Re)Imagining the world: Children's Literature's Response to Changing Times considers how writers of fiction for children imagine 'the world', not one universal world, but different worlds: imaginary, strange, familiar, even monstrous worlds. The chapters in this collection discuss how fiction for children engages with some of the changes brought about by new technologies, information literacy, consumerism, migration, politics, different family structures, cosmopolitanism, new and old monsters. They also invite us to think about how memory shapes our understanding of the past, and how fiction

Kurzfassung: The book pays interest to a small and almost untouched topic: a health practitioner’ s duty to inform about alternatives. It covers both orthodox medicine practitioners and CAM practitioners. The topic is explored in a co mparative way, examining the laws of not only common law jurisdictions, such as the USA, England, Canada, Australia, New Zealand, but also two East Asia jurisdictions ( China and Japan ) . It uses the collective wisdom of several common law jurisdictions, but also differentiates them. It places the issue of “disclosure of alternatives” in a clear and wider context, making a cogent distinction between diagnosis/treatment and information disclosure

Kurzfassung: This book addresses two main questions, namely how to prepare high-quality teachers in the 21st century and how the East and the West can learn from each other. It addresses the different challenges and dilemmas that eastern countries, especially China, and western countries are facing with regard to teacher education. We explore the question by examining teacher education research, practice and policy in different countries, identifying both common problems and country-specific challenges. We then try to find valuable experiences, theories and practice which can solve specific problems in the process of teacher education, also addressing how local and global factors impact it. In this regard, our approach does not strictly separate pre-service teacher education from teachers’ in-service professional development, adopting an integrative perspective. Further, we believe the respective social and cultural contexts must also be taken into account. Lastly, we call for teachers’ knowledge and individual character traits to be accounted for in the education of high-quality teachers
