Abstract: This open access volume of LIDC contributions focuses on how competition and intellectual property laws incorporate sustainability objectives. Businesses are increasingly embracing sustainability objectives, driven by the international community. Although competition and intellectual property law are certainly not the only tools for addressing sustainability issues, they can play a role in moving toward a more sustainable society. Sustainability has gained prominence in competition law in all jurisdictions covered in this volume. The contributions focus on classic questions such as whether sustainability agreements restrict competition and, if so, to what extent businesses can be exempted on efficiency grounds. The papers also raise a number of questions, in particular concerning the treatment of non-market efficiencies. The soft law and case law produced by competition authorities are examined, and the leadership role of some competition authorities in the field – from advocacy to policy papers and sustainability guidelines – is highlighted. The authors call for more individual guidance to provide enhanced transparency and clarity to industry, advisors and society at large on sustainability issues, with guidelines or sustainability-related block exemptions providing even greater legal certainty. With regard to intellectual property, the contributions examine various important issues, such as the need for intellectual property rights to remain technology-neutral, ways to promote the use of sustainable technologies and incentives for licensing, and ways to promote the dissemination of sustainable technologies, including compulsory licensing, cross-licensing, open source or FRAND licensing, and replacing the destruction of counterfeit goods with recycling. The papers also discuss greenwashing and how it can be addressed through revisions to trademarks and related rights

Abstract: This open access book studies how foreign models of economic development can be effectively learned by and applied to today’s latecomer countries. Policy capacity and societal learning are increasingly stressed as pre-conditions for successful catch-up. However, how such learning should be initiated by individual societies with different features needs to be explained. The book answers this pragmatic question from the perspective of Japan’s past experience and its extensive development cooperation in Asia, Africa, and Latin America. Since the late nineteenth century, Japan has developed a unique philosophy and method for adopting advanced technologies and systems from the West; the same philosophy and method govern its current cooperation with the developing world. The key concepts are local learning and translative adaptation. Local learning says that development requires the learner to adopt a proactive mindset and the goal of graduating from receiving aid. Meanwhile, translative adaptation requires foreign models be modified to fit local realities given the different structures of the home and foreign society. The development process must be wholly owned by the domestic society in rejection of copy-and-paste acceptance. These ideas not only informed Japan but are key to successful development for all. The book also asks how this learning method should—or should not—be revised in the age of SDGs and digitalization. Following the overview section that lays out the general principles, the book offers many real cases from Japan and other countries. The concrete actions outlined in these cases, with close attention to individual growth “ingredients” as opposed to general theories, are crucial to successful policy making. The book contains materials that are highly useful for national leaders and practitioners within developing countries as well as students of development studies

Abstract: Seit dem Mord an George Floyd durch den Polizeieingriff in den Vereinigten Staaten im Mai 2020 und der daraus erwachsenen (Social Media-)Bewegung #blacklivesmatter hat auch die Beschäftigung mit den verschiedenen Formen von Rassismus in Deutschland zugenommen. Konnte der Begriff vor wenigen Jahren in wissenschaftlichen wie öffentlichen Diskursen weitgehend nur schwierig oder selten genutzt werden, hat er sich inzwischen hierzulande auch als Gegenbegriff zur globalen Wirkmächtigkeit rechter Ideologien, die besonders Identitätskategorien zur Legitimation mörderischer Gewalt heranziehen, sowie im Kontext globaler Diversifizierungsmaßnahmen im Diskursmainstream durchgesetzt. Dieser Erfolg des Begriffs lässt auch die filmischen Produktionen zu Themen von Menschenfeindlichkeit, die auf Repräsentationskategorien basieren, in einem neuen Licht erscheinen. Filme zu Themen des Rassismus versuchen, Aufklärungsarbeit im Sinne anti-rassistischer Praxis zu leisten, während beispielsweise propagandistische Videos rechter und dschihadistischer Kreise zur (re-)produktiven Verhandlung von Rassismus beitragen. Andererseits lassen sich Filme, die scheinbar nichts mit Rassismus zu tun haben, bei einem genaueren analytischen Blick sehr wohl als Verstärkungs-, Reproduktions- oder Verschleierungsakteure von Rassismen verstehen. So sind Filme immer schon im Sinne von (Un-)Sichtbarkeitsmaschinen dazu geeignet, soziale Verhältnisse zu veräußerlichen und so ungedachte Zusammenhänge zu denken. In dieser argumentativen Bi-Perspektivität – Sichtbarwerden der Rassismusdiskurse und Filme als Sichtbarkeitsmedien sozialer Verhältnisse – geht der vorliegende Sammelband Diskursformen des Rassismus, seiner Filmkulturen und Möglichkeiten des (anti-rassistischen) Widerstands besonders/aber nicht nur im deutschsprachigen Kontext nach. Daran schließen sich folgende Fragen an: Wie sieht der Zusammenhang von (fiktionalen) Filmen und Formen des Rassismus in Film-kulturen aus? Wie gehen fiktionale Formate mit Antisemitismus, Rechtsradikalismus, antimuslimischem Rassismus, Antiziganismus und whiteness um? Und wie versuchen aktuelle (auch experimentelle) filmische Formate, Rassismus entgegenzutreten? Im Zentrum des Sammelbandes stehen die Filme und ihre Geschichten selbst. Ziel ist es, das Erkenntnispotential von Filmen in der Auseinandersetzung mit Rassismus zu befragen: Was genau am Rassismus machen die Filme sichtbar? Wie lassen sich mögliche historische Entwicklungen narrativer audiovisueller Diskursformen (für den deutschsprachigen Kontext) darstellen? Wie verändern sich in diesen Entwicklungen die Auseinandersetzungen mit jenen rassistischen Formen? Und grundsätzlich: Wie stehen Film und Rassismus zueinander? Welcher Menschentypus folgt dem "homo sovieticus" und wieviel vom Sowjetmenschen besteht noch fort in diesem? Abstract: The present volume aims at exploring the overall patterns of linguistic regionalism throughout Eastern Europe, casting also a comparative glance beyond this specific cultural setting into neighboring Western European regions. A wide array of aspects related to regional language designs are addressed, such as: linguistic rights, conflicting conceptualisations of linguistic regionalism, the role of the internet in identity modelling, the role of linguistics in language planning and research, etc. The volume is also designed to approach linguistic regionalism on a general theoretical level giving a critical assessment of Aleksandr Dulichenko’s microlanguage paradigm. Case studies of individual projects as well as reports by regional language activist will provide the reader with glimpses of how regional language designs are set up and elaborated.

Abstract: Parteien bemühen sich seit geraumer Zeit verstärkt um Menschen mit Migrationshintergrund - als Wähler_innen, Parteimitglieder oder politisches Personal. Wann und warum kam es zu dieser Öffnung? Welche Widerstände gehen damit bis heute einher? Lassen sich vergleichbare Phänomene in unterschiedlichen Migrationsgesellschaften und Städten feststellen - oder dominieren die Unterschiede?Am Beispiel der Sozialdemokratischen Partei in Deutschland und der französischen Parti socialiste geht Daniel Volkert diesen Fragen erstmals nach. Seine Studie legt die Unterschiede und Gemeinsamkeiten in der Art der Inkorporation offen, die durch eine feinteilige Analyse der nationalen, lokalen und parteispezifischen Rahmenbedingungen nachvollziehbar gemacht werden.
