    Abstract: Das 20. Jahrhundert ist oft als das Jahrhundert der Gewalt bezeichnet worden. Daher mangelt es nicht an Gewaltphänomenen, die es genauer zu untersuchen gilt, als dies bislang geschehen ist. In diesem Band werden deswegen Gewalttaten aus neuen Perspektiven untersucht, neue Interpretationen ihrer Entstehung vorgestellt und neue Herausforderungen der sozialwissenschaftlichen Gewaltforschung debattiert. Folgende Fragen werden unter anderem in diesem gesellschaftspolitisch folgenreichen Buch behandelt: Kann der lange dominierende Begriff der physischen Gewalt überhaupt noch leitend sein, und muß die Gewaltanalyse sich nicht wieder stärker der strukturellen Gewalt zuwenden, da zunehmend eine »Gewalt ohne Gesicht« auftritt? Stecken die Ursachen im Gewalthandeln selbst, so daß Hinweise auf soziale Hintergründe etwa in die Irre führen? Verlieren sozialwissenschaftliche Forschungen aufgrund neuer biologischer Ansätze völlig an Relevanz? Biographische Informationen Wilhelm Heitmeyer, geboren 1945, war von 1996 bis 2013 Direktor des Instituts für interdisziplinäre Konflikt- und Gewaltforschung der Universität Bielefeld und arbeitet dort jetzt als Forschungsprofessor. In der edition suhrkamp gab er u. a. die Reihe Deutsche Zustände heraus.     Abstract: Arnd Uhle untersucht das Verhältnis von freiheitlichem Verfassungsstaat und kultureller Identität, das bislang kaum – wenn, dann lediglich partiell – erforscht wurde. Der Autor beleuchtet die Relevanz der kulturellen Identität für Entstehung, Gestalt und Fortbestand des freiheitlichen Verfassungsstaates aus verfassungstheoretischer, aus verfassungsrechtlicher und schließlich aus europarechtlicher Perspektive.Bereits aus verfassungstheoretischer Sicht ergibt sich dabei, daß die kulturelle Identität gleichermaßen Entstehungs- wie auch Geltungsbedingung freiheitlicher Verfassungsstaatlichkeit ist, weil der freiheitliche Staat in vielfältiger Weise an die kulturelle Identität anknüpft. Eine Betrachtung aus verfassungsrechtlicher Perspektive unterstreicht diesen Befund und belegt, daß namentlich das deutsche Grundgesetz in einer prima facie zwar komplex und unüberschaubar erscheinenden, letztlich aber systematisch geordneten und differenzierenden Weise an die kulturelle Identität anknüpft – und diese angesichts ihrer Bedeutung für den dauerhaften Fortbestand des freiheitlichen Verfassungsstaates überdies durch das in der Habilitationsschrift erstmals entfaltete grundgesetzliche Staatsziel der Vitalität und Dauerhaftigkeit der freiheitlichen Verfassungsordnung mit verfassungsrechtlichem Schutz umhegt. In der Konsequenz dieses Staatsziels ist der grundgesetzgebundene Staat zur Pflege und zum Schutz der kulturellen Identität verpflichtet. Eine abschließende europarechtliche Betrachtung verdeutlicht, daß die grundgesetzliche Anknüpfung an die kulturelle Identität wie auch deren verfassungsrechtliche Sicherung den Schutz des Art. 6 Abs.3 EUV genießen, der die Achtung der nationalen Identität anordnet.

    Abstract: Much of the discussion about new technologies and social equality has focused on the oversimplified notion of a "digital divide." Technology and Social Inclusion moves beyond the limited view of haves and have-nots to analyze the different forms of access to information and communication technologies. Drawing on theory from political science, economics, sociology, psychology, communications, education, and linguistics, the book examines the ways in which differing access to technology contributes to social and economic stratification or inclusion. The book takes a global perspective, presenting case studies from developed and developing countries, including Brazil, China, Egypt, India, and the United States. A central premise is that, in today's society, the ability to access, adapt, and create knowledge using information and communication technologies is critical to social inclusion. This focus on social inclusion shifts the discussion of the "digital divide" from gaps to be overcome by providing equipment to social development challenges to be addressed through the effective integration of technology into communities, institutions, and societies. What is most important is not so much the physical availability of computers and the Internet but rather people's ability to make use of those technologies to engage in meaningful social practices.

    Abstract: This volume represents the first attempt to systematically compare organised crime concepts, as well as historical and contemporary patterns and control policies in thirteen European countries. These include seven ‘old’ EU Member States (Denmark, France, Germany, Italy, The Netherlands, Spain and the United Kingdom), two ‘new’ members (the Czech Republic and Poland), a candidate country (Turkey), and three non-EU countries (Albania, Russia and Switzerland).     Abstract: Launch activities performed by private entities deal with a complex legal environment. The Space Treaties provide a general liability framework. Launch participants are subject to regulatory or institutional control, and to domestic liability laws. Specific contractual practice has developed due to insurance limitations, the inter-participants' waivers of liability and claims. This book synthesizes information on the norms of play, to allow the grasp of their relative weight and interactions in the assessment of liability risk for launch activities. It reveals a legal framework presently lacking sufficient predictability for an efficient liability risk management: the waivers of liability suffer weaknesses as do all such clauses, and lack uniformity and reliability; and the Space Treaties contain ambiguous terms preventing predictable determination of the States responsible for authorizing and supervising launch activities and for damage compensation, and do not reflect the liability of launch operators. This book offers suggestions of new approaches for: harmonizing waivers of liability to improve their consistency, validity and flow-down; and improving the Space Treaties for their implementation to non-governmental launch activities. In the launch community, the need for lawmaking is less compelling than in fields such as aviation. Nevertheless, adjustments to the present framework are proposed through model clauses and an international instrument, for further thinking and contribution by those sharing the opinion that creative lawmaking is needed now to prepare for tomorrow's endeavors.

    Note: Die Forschung zur Gewalt in modernen westlichen Gesellschaften hat in den letzten Jahren zugenommen. Die Erklärungen dafür sind zahlreich: tatsächlicher Anstieg bei bestimmten Gewaltvarianten, neue Sensibilitäten, Rückkehr alter Gewaltformen, Verlagerung von Gewalt in andere gesellschaftliche Bereiche etc. Bisher fehlte jedoch ein systematischer Überblick über die tatsächlichen Befunde. Das "Internationale Handbuch der Gewaltforschung" füllt diese Lücke. Es stellt die langfristigen Entwicklungen umfassend dar, berücksichtigt aber auch ganz aktuelle Ereignisse. Insgesamt dominiert dabei der soziologische Schwerpunkt: Gewalt als soziales Phänomen. Entsprechend sind die Artikel gruppiert nach sozialstrukturellen Verhältnissen und Gewalt, Sozialisation und Lernen von Gewalt, Gewalterfahrungen und Gewalttätigkeiten etc. Ge-waltopfer werden ebenso thematisiert wie die Gewalt in gesellschaftlichen Institutionen, im öffentlichen Raum, durch politische Gruppen oder in bezie-hungsweise durch staatliche Institutionen. Thematisiert werden auch die jeweiligen Gewaltdiskurse, Rechtfertigungen und Verarbeitungen, mithin die ganze Prozessdynamik. Die 62 Artikel von Autorinnen und Autoren aus zehn Ländern liefern aber auch Analysen mit sozialpsychologischen, kulturwis-senschaftlichen, rechtswissenschaftlichen, politikwissenschaftlichen und historischen Hintergründen sowie soziobiologischer und psychologischer Herkunft. Auf diese Weise entsteht ein komplexes, mehrperspektivisches Bild eines schwierigen Forschungsfeldes zwischen Ordnung, Zerstörung und Macht

In this book she gives an overview of the history of legal anthropology and at the same time urges anthropologists, lawyers, and activists to recognize the centrality of law in social change. Nader traces the evolution of the plaintiff's role in the United States in the second half of the twentieth century and argues that the atrophy of the plaintiff's power during this period represents a profound challenge to justice and democracy. Taking into account the vast changes wrought in both anthropology and the law by globalization, Nader speaks to the increasing dominance of large business corporations and the prominence of neoliberal ideology and practice today. In her discussion of these trends, she considers the rise of the alternative dispute resolution movement, which since the 1960s has been part of a major overhaul of the U.S. judicial system. Nader links the increasing popularity of this movement with the erosion of the plaintiff's power and suggests that mediation as an approach to conflict resolution is structured to favor powerful--often corporate --interests

    Abstract: Das Konzept einer redistributiven Sozialpolitik scheint schon seit längerem in Deutschland an seine Grenzen gestoßen zu sein: Die durchgehend mit einer erheblichen Umverteilungskomponente versehenen sozialen Sicherungssysteme haben einerseits zu unerträglichen Belastungen insbesondere der laufenden Arbeitseinkommen geführt, ohne jedoch andererseits den Wunsch nach sozialer Gerechtigkeit nachhaltig erfüllen zu können. Ironischerweise scheint es sogar so zu sein, daß die Unzufriedenheit mit dem Sozialstaat aus einer wie auch immer definierten "Gerechtigkeitsperspektive" mit dem Ausmaß der Umverteilung wächst. Dieses ernüchternde Ergebnis hat in der Vergangenheit immer wieder zu wirtschaftswissenschaftlichen und -politischen Diskussionen darüber geführt, ob die traditionelle Umverteilungspolitik mit laufenden Einkommen als Zielgröße und Aktionsparameter redistributiver Maßnahmen nicht schon vom Ansatz her verfehlt ist. --
    Abstract: In diese Diskussion reiht sich die Dissertation von Thomas Wilke ein. Der Autor geht von der in einem theoretischen Teil abgeleiteten Hypothese aus, daß nicht das Arbeitseinkommen als Ergebnis der individuellen Leistungsfähigkeit und Leistungswilligkeit Gegenstand der Umverteilung sein darf, sondern vielmehr die individuellen Einkommenserzielungschancen, die durch das beim einzelnen gebildete Humankapital und gegebenenfalls geerbte oder geschenkte Vermögen maßgeblich beeinflußt werden. Chancengleichheit und nicht Egalität von Arbeitseinkommen ist folglich das durch eine Redistributionspolitik zu verfolgende Ziel. Damit aber rücken intergenerative Transfers und ihre umverteilende Besteuerung als Alternative zur Einkommensumverteilung in den Blickpunkt. --
    Abstract: Thomas Wilke beschäftigt sich intensiv mit einer theoretischen Diskussion unterschiedlicher Motive bezüglich intergenerativer Transfers. Durch eine sich auf Daten des Sozio-ökonomischen Panels und des Europäischen Haushaltspanels stützende empirische Untersuchung wird daran anschließend der Frage nachgegangen, ob und inwieweit man mit einer Erbschaft- und Schenkungsteuer die vom Staat wahrzunehmende Umverteilungsfunktion effizienter und gerechter ausfüllen kann. Der Autor kommt zu dem Ergebnis, daß dies nur dann gelingt, wenn ausschließlich Erbschaften, nicht aber Schenkungen zwischen Generationen besteuert werden

    Abstract: "International business transactions are heavily influenced by culture,practice and rule. The pursuit of business relationships within nation-states can be subject to differences in the generation of norms and the processing of disputes, but these conflicts are magnified many times over in cross-border transactions where nation-state control and support is weak or absent. This book seeks different explanations of the ways in which business people and their legal advisers try to minimise the effect of these magnified difficulties. At the outset the editors suggest four sources through which the international business community might be considered to have supplemented nation-state conflict prevention and dispute resolution institutions - an international legal order; the development of a private normative order based on common business practices (denominated the lex mercatoria); through the efforts and work product of internationalised law firms, and by means of extensive, thick personal relationships often referred to by their Chinese term guanxi. Since most explanations are dominated by North American and European legal scholarship and practice, a second concern of this book is to open up the discussion to competing explanatory frameworks. Specifically, it develops the notion that global legal convergence may not be the immediate, inevitable result of increased global economic interaction. Rather, less formal mechanisms for achieving normative understanding and predictability in business dealings may also flourish."--Bloomsbury Publishing

    Abstract: We live in a world where social interaction is increasingly mediated by technological devices. In this book, Ian Hutchby explores the impact these technologies have on our attempts to communicate. Focusing on four examples - telephones, computerized expert systems at work, speech-based systems dealing with enquiries from the public, and multi-user spaces on the Internet - Hutchby asks: are we increasingly technologized conversationalists, or is technology increasingly conversationalized? Conversation and Technology draws on recent theory and empirical research in conversation analysis, ethnomethodology and the social construction of technology. In novel contributions to each of these areas, Hutchby argues that the ways in which we interact can be profoundly shaped by technological media, while at the same time we ourselves are shapers of both the cultural and interactional properties of these technologies. The book begins by examining a variety of theoretical perspectives on this issue. Hutchby offers a critical appraisal of recent sociological thinking, which has tended to over-estimate society's influence on technological development. Instead he calls for a new appreciation of the relationship between human communication and technology. Using a range of case studies to illustrate his argument, Hutchby explores the multiplicity of ways in which technology affects our ordinary conversational practices. Readers in areas as diverse as sociology, communication studies, psychology, computer science and management studies will find much of interest in this account of the human and communicative properties of various forms of modern communication technology. Ian Hutchbyis Senior Lecturer in Sociology and Communication at Brunel University and Honorary Research Fellow in the School of Social Sciences at Cardiff University.     Abstract: Main description: Between 1750 and 1850, the methods and function of imprisonment went through a transformation. Prisons became the centre of public disciplination. Their function was to transform delinquents into useful citizens. But how should the buildings be designed to achieve that aim? Which new technologies could be used? The birth of modern prisons was long-lasting, covering three generations. The author outlines this process and shows parallels to the developments in England and the United States.
    Abstract: Main description: Der fundamentale Transformationsprozess des Strafsystems zwischen 1750 und 1850 machte die Strafanstalt zum Zentrum des staatlichen Strafvollzugs. Mit ihrer Hilfe hofften die Zeitgenossen, den Delinquenten in einen nützlichen Staatsbürger umschaffen zu können. Doch welches Design mußte diese Institution haben? Mit welchen Techniken war die Besserung des Delinquenten zu erreichen? Und wie sollte diese neue Straftechnologie in das bestehende Anstaltssystem implementiert werden? Die Geburt des Gefängnisses war ein langwieriger Erfindungsprozeß, der sich über drei Generationen hinzog. Thomas Nutz zeichnet nach, wie sich im ausgehenden 18. Jahrhundert ein spezifischer Diskurs über die Reform der Haftanstalten formierte und ein internationales Fachwissen herausbildete. Eine Entwicklung, die schließlich Mitte des 19. Jahrhunderts in der Entstehung einer eigenständigen Disziplin der "Gefängniskunde" mündete. Am Beispiel Preußens demonstriert der Autor, wie eng die staatlichen Bürokratien bei der Durchführung der Reformen des Vollzugswesens mit den gefängniskundlichen Experten zusammenarbeiteten.

    Abstract: Netwar-like cyberwar-describes a new spectrum of conflict that is emerging in the wake of the information revolution. Netwar includes conflicts waged, on the one hand, by terrorists, criminals, gangs, and ethnic extremists; and by civil-society activists (such as cyber activists or WTO protestors) on the other. What distinguishes netwar is the networked organizational structure of its practitioners-with many groups actually being leaderless-and their quickness in coming together in swarming attacks. To confront this new type of conflict, it is crucial for governments, military, and law enforcement to begin networking themselves.

    Abstract: Zur "politischen Klasse" zählt eine neue Forschungsrichtung Politiker, die - in der Terminologie von Max Weber - nicht (nur) für die Politik, sondern von der Politik leben, also Berufspolitiker mit eigenen, sozusagen klassenspezifischen Interessen. Der Begriff "Verfassung" wird in einem weiten, dreifachen Sinne verstanden: Er umfaßt a] die Summe der in der Verfassungsurkunde niedergelegten Normen (Verfassung im formellen Sinne), b] bestimmte grundlegende einfachgesetzliche Normen zum Beispiel über Wahlrecht und Politikfinanzierung (Verfassung im materiellen Sinne) sowie c] die realen Macht- und Interessenverhältnisse, die sich in Konventionen und politischen Handlungsmustern niederschlagen (Verfassung im soziologischen Sinne). Die Beziehungen zwischen politischer Klasse und Verfassung sind ambivalent: Die Verfassung soll die politische Klasse eigentlich begrenzen, diese kann die Verfassung aber umgekehrt auch nach ihren Bedürfnissen gestalten oder Anpassungen an neue Gegebenheiten verhindern - mit gefährlichen Folgen für elementare Prinzipien der Demokratie. -- Der vorliegende Band enthält die Referate, die auf der 4. Speyerer Demokratietagung Ende Oktober 2000 gehalten wurden. Ziel dieser Tagung war es, das spannungsreiche Verhältnis von politischer Klasse und Verfassung, das in Forschung und öffentlicher Diskussion bisher stark unterbelichtet ist, am Beispiel charakteristischer Bereiche auszuleuchten und mögliche Wege zu Reformen zu weisen.

    Abstract: There is widespread concern that the growth of the Internet is exacerbating inequalities between the information rich and poor. Digital Divide examines access and use of the Internet in 179 nations world-wide. A global divide is evident between industrialized and developing societies. A social divide is apparent between rich and poor within each nation. Within the online community, evidence for a democratic divide is emerging between those who do and do not use Internet resources to engage and participate in public life. Part I outlines the theoretical debate between cyber-optimists who see the Internet as the great leveler. Part II examines the virtual political system and the way that representative institutions have responded to new opportunities on the Internet. Part III analyzes how the public has responded to these opportunities in Europe and the United States and develops the civic engagement model to explain patterns of participation via the Internet.

    Abstract: China's 1911-12 Revolution, which overthrew a two-thousand-year succession of dynasties, is thought of primarily as a change in governmental style, from imperial to republican, traditional to modern. But given that the dynasty that was overthrown - the Qing - was that of a minority ethnic group that had ruled China's Han majority for nearly three centuries, and that the revolutionaries were overwhelmingly Han, to what extent was the revolution not only anti-monarchical, but also anti-Manchu?Edward Rhoads explores this provocative and complicated question in Manchus and Han, analysing the evolution of the Manchus from a hereditary military caste (the "banner people") to a distinct ethnic group and then detailing the interplay and dialogue between the Manchu court and Han reformers that culminated in the dramatic changes of the early twentieth century. Manchus and Han is a pathbreaking study that will forever change the way historians of China view the events leading to the fall of the Qing dynasty.     Abstract: In this book, Thomas Buoye examines the impact of large-scale economic change on social conflict in eighteenth-century China. He draws upon a large body of actual, documented homicide cases originating in property disputes to recreate the social tensions of rural China during the Qianlong reign (1736–1795). The development of property rights, a process that had begun in the Ming dynasty, was accompanied by other changes that fostered disruption and conflict, including an explosion in the population growth and the increasing strain on land and resources, and increasing commercialization in agriculture. Buoye challenges the 'markets' and 'moral economy' theories of economic behaviour. Applying the theories of Douglass North for the first time to this subject, he uses an institutional framework to explain seemingly irrational economic choices. Buoye examines demographic and technological factors, ideology, and political and economic institutions in rural China to understand the link between economic and social change

    Abstract: New Profession, Old Order explores the creative tension between modern technology and preindustrial Germany. It offers an explanation of why the engineering profession is so successful in transforming the physical world, did not achieve the professional power, cohesion, and prestige that its technological accomplishments would seem to have warranted. On the one hand, engineers were agents of modern instrumental rationality, specialization, practical knowledge, and entrepreneurial capitalism - forces antiasthetical to the quasi-aristocratic world of Bildung and bureaucracy that was the life blood of the preindustrial social hierarchy. On the other hand, it was this latter universe in which engineers had to survive and by whose standards they were judged for membership in the educated middle class or for access to prestigious careers. The result was an orientation that combined the old and the new in ways that were at once uniquely German and paradigmatic for modern industrial society

    Abstract: Umfang und Niveau der informationellen Automatisierung unterschiedlicher Behörden weichen in erheblichem Maße voneinander ab. Der direkte Vergleich von Finanzämtern, Staatsanwaltschaften und Kriminalpolizei in dieser Studie macht dies deutlich. Solche Unterschiede lassen sich nicht hinreichend auf technische Möglichkeiten oder Sachgesetzlichkeiten der jeweiligen Aufgabenstellung zurückführen. Das Forschungsergebnis der hier vorgelegten Dissertation hebt vielmehr die Bedeutung sozialer Selektionsmechanismen hervor.
