    Abstract: "This book examines the everyday judicial experience in four multicultural jurisdictions as a means of exploring the relationship between legal systems and cultural identities. Increasing social heterogeneity has deeply affected legal systems as courts and parliaments must now deal with a growing rate of cases concerning cultural pluralism. Headline grabbing disputes usually concern challenges to fundamental rights and principles which may be put at risk by some religious or cultural practices. These are difficult issues questioning the compatibility between some cultural and religious practices and constitutional values. However, much of the interaction between law and cultural pluralism also concerns daily life activities, which do not necessarily challenge fundamental rights. This book deals with food, clothing and days of rest: three expressions of both human needs and identity, which are based on ethnic origin, tradition, culture, religion or, simply, taste. The volume looks at the intersection between these choices and constitutional rights such as religious liberty, or freedom of expression. It aims to understand how the state legal system deals with them and when non-mainstreaming behaviours are accommodated.     Abstract: "This book focuses on the testimonial evidence of traumatised witnesses in trials of international crimes, which deal with acts of genocide, war crimes and crimes against humanity. Such trials often involve the testimonies of those who experienced or witnessed extremely traumatic events, which can make it hard for these witnesses to recall specific details. Testifying during trial may in itself also pose challenges to their well-being. Yet the legal process of determining whether someone can be held criminally responsible for the alleged crimes needs to be fair, in accordance with the right to a fair trial of the accused, and the facts need to be determined as accurately as possible. This book argues that to ensure fair and accurate fact-finding when in particular traumatised witnesses testify, a balance needs to be struck between the needs of witnesses who testify about traumatic experiences, the fair trial rights of the accused, and the objective of the court to establish as accurately as possible the responsibility of the accused. This is crucial throughout the stages of selecting, preparing, presenting and assessing the testimonial evidence of traumatised witnesses. The methodology involves an analysis of transcripts of proceedings and case law of the International Criminal Tribunal for the former Yugoslavia, the International Criminal Court, and Dutch courts prosecuting international crimes. The research demonstrates that it is often difficult to strike a balance between the competing objectives during proceedings when traumatised witnesses testify due to the current lack of regulations and guidelines applicable during investigations and prosecutions. This book shows that this balance can, and should, be achieved when traumatised witnesses testify during criminal proceedings for international crimes. The work is an invaluable resource for researchers, academics and practitioners in criminal law, criminology, legal-psychology, legal-psychiatry, social anthropology and forensic sciences"--

The book illuminates how sexual orientation, gender, race, and other social locations impact the treatment of queer people in the criminal legal system as well as the mass media. Each chapter describes one or more high-profile criminal cases involving queer people (e.g., the murders of Brandon Teena and Kitty Genovese; serial killer Aileen Wuornos; the Pulse nightclub mass shooting). The authors examine how the case(s) are portrayed in the media via news, film, podcasts, documentaries, books, social media, and more. Each chapter discusses not only what is visible or emphasized by the media, but also what is invisible in the accounting or societal focus surrounding the case. Lesser known (but similar) cases are used in the book to call attention to how race, gender, sexuality, sexual orientation, social class, and/or other features influence the dominant narrative surrounding these cases. Each chapter addresses "teachable moments" from each case and its coverage, leaving readers with several considerations to take with them into the future. At present, the battle for scarce land is intense and bitter, with a strong clash between developers who want to build houses, farmers who do not want to give up farming and conservationists who increasingly find support in the courts for insufficiently caring for the natural environment. While diversification is often met with simplifying stereotypes, threat narratives, and expressions of antagonism, superdiversity encourages a perspective on difference as comprising multiple social processes, flexible collective meanings, and overlapping personal and group identities. A superdiversity approach encourages the re-evaluation and recognition of social categories as multidimensional, unfixed and porous as opposed to views based on hardened, one-dimensional thinking about groups. Diversification and increasing social complexity are bound to continue, if not intensify, in light of climate change. This will have profound impacts on the nature of global migration, social relations and inequalities. Superdiversity presents a convincing case for recognizing new social formations created by changing migration patterns and calls for a re-thinking of public policy and social scientific approaches to social difference.     Abstract: "Globalizations from Below uses a Constructivist International Relations approach that emphasizes the centrality of normative power to analyze and compare the four globalizations 'from below'. These are: (1) the counter-hegemonic globalization represented by the 'movement of movements' of alter-globalization transnational social activists, who try to put an end to the Neoliberal nature of the Western-centered globalization 'from above;' (2) the non-hegemonic globalization enacted by 'ant traders' that are part of the transnational informal economy; (3) the partially similar Chinese-centered globalization, whose entrepreneurial migrants are strongly influenced and instrumentalized by the Chinese state; and (4) the first wave globalization 'from below' that paralleled (and outlived) the 1870-1914 globalization 'from above.' This book identifies their common features and uses them to define the concept of globalization 'from below' as a set of socio-economic or socio-political processes that involve large transnational flows of people, goods, and/or ideas characterized at least in part by informality. They are enacted by entrepreneurial or activistic individuals who either take advantage of the normative power of the hegemon at the origin of an international order and an associated globalization 'from above,' or - explicitly or implicitly - transgress, contest, and try to redefine dominant economic, legal, political, and socio-cultural norms, thus challenging the existing international order and globalization 'from above.' By constructing a unified theoretical framework, this book attempts to open a new field of interdisciplinary research that should take globalizations 'from below' out of their current scholarly marginality. It studies the writings of colonial ethnographers, orientalist scholars, Christian missionaries, and pre-colonial literary texts like the Mangalkavya to show how the concept of caste emerged and argues that the jati order in Bengal was far from being a rigidly reified structure, but one which had room for spatial and social mobility. The volume highlights the processes through which popular myths and beliefs of the lower caste orders of Bengal were Sanskritised.
