    Kurzfassung: This study deals with a constitutional principle of the EU: the rule of law. The EU Treaties leave no doubt that the rule of law is a universal value on which the Union is founded. This value is not bound to remain internal; EU external relations should also be guided by the principle. However, a lack of conceptual and legal clarity on the principle makes it uncertain how it guides external relations. 0The basic question this study poses is therefore what the role of the rule of law is in EU external relations. 0More specifically, this study analyses this role by focussing on the external dimension of EU migration and asylum policy. Over the years the EU has developed this external dimension of an originally internal policy field. Measures such as externalising border control, readmission of migrants to third states or mobility opportunities for third country nationals have been promoted. This relatively new area of EU external relations is characterised by a high degree of operational and human rights sensitive activities. For example, Frontex, the EU border agency, operates beyond Europe`s borders, sometimes on the basis of undisclosed working arrangements with third States

    Kurzfassung: With Faithful Translators Jaime Goodrich offers the first in-depth examination of women’s devotional translations and of religious translations in general within early modern England. Placing female translators such as Queen Elizabeth I and Mary Sidney Herbert, Countess of Pembroke, alongside their male counterparts, such as Sir Thomas More and Sir Philip Sidney, Goodrich argues that both male and female translators constructed authorial poses that allowed their works to serve four distinct cultural functions: creating privacy, spreading propaganda, providing counsel, and representing religious groups. Ultimately, Faithful Translators calls for a reconsideration of the apparent simplicity of "faithful" translations and aims to reconfigure perceptions of early modern authorship, translation, and women writers.

    Kurzfassung: The number of international human rights treaties and monitoring mechanisms has grown considerably over the past decades. States are increasingly confronted with criticism as to their domestic human rights record. What is the effect of all these treaties, monitoring and criticism? Do they lead to changes and improvements? This book addresses such questions. More in particular, it investigates the domestic impact and effectiveness of the process of state reporting under the six main UN human rights treaties in the Netherlands, New Zealand and Finland. The focus is on the effectiveness of the recommendations of the treaty bodies and the extent to which policy or legislation is changed as a result of these recommendations. This question has hardly been addressed before.0This book fills this empirical gap and provides insights into the factors at both the national and international level which contribute to the effectiveness of the treaty bodies recommendations. The book is original and thorough in its approach because it is based on an extensive analysis of a wide variety of documents as well as 175 interviews with various domestic human rights stakeholders in the three countries. This includes government officials, NGO representatives, members of parliament, lawyers and judges, representatives from human rights and Ombudsman institutions and academics.     Kurzfassung: The book addresses one of the most heinous crimes of Saddam Hussein's Baath regime in Iraq, the so-called Anfal Campaign against the Kurdish population in 1988: within a few months, thousands of villages were destroyed; up to 182,000 men and women abducted and murdered; tens of thousands of civilians detained and forcibly reset tled.
    Kurzfassung: Based on longstanding work with women Anfal survivors in the Germyan region of Kurdis tan-Iraq, the author explores their psychosocial situation and coping strategies over more than twenty years. She documents the women's path from victims to survivors, their struggle for truth, justice, and acknowledgement, and their conflicts with both the Kurdish national victimhood discourse and Iraqi national strategies in dealing with the past.
    Kurzfassung: The research gives an exceptional long-term psychological perspective on coping with extreme violence, beyond common discourses of trauma and "healing". It links psycho logical trauma research to memory studies and the debate on socio-political reconstruction in post-conflict societies.

    Kurzfassung: Computer gelten als prägende Faktoren unserer Gesellschaft, ohne dass die ihnen zugesprochene Gestaltungsmacht systematisch hinterfragt würde. Gemeinhin werden sie als Rechenmaschine, Medium oder Notationssystem adressiert. Unklar bleibt, welcher Status Computern als Ding überhaupt zukommt. Mit ihrer kritischen Neulektüre von Vilém Flusser und Mark Weiser legt Suzana Alpsancar zwei symptomatische Computerkonzepte im Diskurs des Digitalen frei. Sie zeigt, dass eine Reflexion der Gestaltungsmacht von Computern neben typischen Gebrauchsweisen gerade auch auf ihre potenzielle Widerständigkeit als Dinge abheben muss, um ihre Medialität angemessen erfassen zu können.

    Kurzfassung: Language and the Right to Fair Hearing in International Criminal Trials explores the influence of the dynamic factor of language on trial fairness in international criminal proceedings. By means of empirical research and jurisprudential analysis, this book explores the implications that conducting a trial in more than one language can have for the right to fair trial. It reveals that the language debate is as old as international criminal justice, but due to misrepresentation of the status of language fair trial rights in international law, the debate has not yielded concrete reforms. Language is the core foundation for justice. It is the means through which the rights of the accused are secured and exercised. Linguistic complexities such as misunderstandings, translation errors and cultural distance among participants in international criminal trials affect courtroom communication, the presentation and the perception of the evidence, hence jeopardizing the foundations of a fair trial. The author concludes that language fair trial rights are priority rights situated in the minimum guarantees of fair criminal trial; the obligation of the court to ensure fair trial or accord the accused person a fair hearing also includes the duty to ensure they can understand and be understood

    Kurzfassung: The book provides in depth studies of two epistemological aspects of Jewish Law (Halakhah) as the?Word of God?? the question of legal reasoning and the problem of knowing and remembering. - How different are the epistemological concerns of religious-law in comparison to other legal systems? - In what ways are jurisprudential attitudes prescribed and dependent on theological presumptions? - What specifies legal reasoning and legal knowledge in a religious framework? The author outlines the rabbinic jurisprudential thought rooted in Talmudic literature which underwent systemization and enhancement by the Babylonian Geonim and the Andalusian Rabbis up until the twelfth century. The book develops a synoptic view on the growth of rabbinic legal thought against the background of Christian theological motifs on the one hand, and Karaite and Islamic systemized jurisprudence on the other hand. It advances a perspective of legal-theology that combines analysis of jurisprudential reflections and theological views within a broad historical and intellectual framework.     Kurzfassung: Trauma has become a hotly contested topic in literary studies. But interest in trauma is not new; its roots extend to the Romantic period, when novelists and the first psychiatrists influenced each others' investigations of the 'wounded mind'. This book looks back to these early attempts to understand trauma, reading a selection of Romantic novels in dialogue with Romantic and contemporary psychiatry. It then carries that dialogue forward to postmodern fiction, examining further how empirical approaches can deepen our theorizations of trauma. Within an interdisciplinary framework, this study reveals fresh insights into the poetics, politics, and ethics of trauma fiction

    Kurzfassung: Die Akkreditierung von Studiengängen bietet auch fast 15 Jahre nach ihrer Einführung politisch wie juristisch beträchtlichen Anlass zur Diskussion. Die stetige Fortentwicklung des Akkreditierungsverfahrens, die zunehmende Bedeutung von Qualitätssicherung sowie die immer wieder aufflammende Debatte um den Bologna-Prozess sorgen dafür, dass das Thema aktuell und lebendig bleibt. Die vorliegende Dissertation widmet sich neben der hochschulpolitischen Entwicklung den vielfältigen verwaltungs- und verfassungsrechtlichen Problemen des Akkreditierungswesens an deutschen Hochschulen. Dabei kommen zum einen altbekannte Fragen zur Rechtsnatur der Akkreditierung oder dem Grundrechtseingriff durch die Akkreditierungspflicht zur Sprache. Des Weiteren geht es aber auch um neue Herausforderungen wie die Systemakkreditierung und um bisher nur wenig erörterte Themen wie die Vertragsverhältnisse der Beteiligten, die demokratische Legitimation der Akkreditierungsverwaltung sowie die Rechtsnatur ihrer Beschlüsse. Außerdem zieht die Arbeit systematische Vergleiche zu Rechtsgebieten mit ähnlichen Strukturen; dabei nimmt sie u.a. Stellung zu weiteren Fragen der Hochschulmodernisierung, der Privatisierungsdebatte und des Verwaltungsorganisationsrechts.

    Kurzfassung: The present dissertation addresses the manifold legal aspects of the administrative and constitutional problems of accreditation in german institutions of higher education. Issues are raised in respect to well-known questions concerning the legal nature of accreditation, as well as to the related encroachment upon fundamental rights. Furthermore, new challenges such as system accreditation and the seldom debated issues concerning the contractual relationships of the involved parties, or the democratic legitimation of the accreditation administration and the legal nature of its decisions are discussed. The study also draws comparisons to similarly structured areas of law - in so doing, further questions of modernisation in higher education, the debate surrounding privatisation and legal aspects of the administrative organisation are commented on

    Kurzfassung: This descriptive and comprehensive study on the discursive struggle over interpersonal relations in online message boards is located at the fascinating interface of pragmatics and computer-mediated discourse - a research area which has so far not attracted much scientific interest. It sets out to shed light on the question how interpersonal relations are established, managed and negotiated in online message boards by giving a valid overview of the entire panoply of interpersonal relations (and their interrelations), including both positively and negatively marked behavior. With the first part of the book providing an in-depth discussion and refinement of the pivotal theoretical positions of both fields of research, students as well as professionals are (re-)acquainted with the subject at hand. Thus supplying a framework for the ensuing case study, the empirical part displays the results of the analysis of 50 threads (ca. 300,000 words) of a popular British message board

    Kurzfassung: Verse and transmutation: a corpus of Middle English alchemical poetry' identifies and investigates a corpus of twenty-one anonymous recipes for the philosophers' stone dating from the fifteenth century. These were circulated and received in association with each other until the mid-seventeenth century, when a number of them appeared in Elias Ashmole's 'Theatrum Chemicum Britannicum'. These editions are the first to make this previously unidentified corpus available to researchers. The accompanying studies discover the complex histories of these "alchemica", in plain and illuminated manuscripts, "asanonyma" and in attribution to famous authors, and in private and institutional, medical and academic book collections. Together, they offer novel insights into the role of alchemy and poetry in late medieval and early modern England. Also part of series Medieval and Early Modern Science

    Kurzfassung: This book discusses all critical privacy and data protection aspects of biometric systems from a legal perspective. It contains a systematic and complete analysis of the many issues raised by these systems based on examples worldwide and provides several recommendations for a transnational regulatory framework. An appropriate legal framework is in most countries not yet in place. Biometric systems use facial images, fingerprints, iris and/or voice in an automated way to identify or to verify (identity) claims of persons. The treatise which has an interdisciplinary approach starts with explaining the functioning of biometric systems in general terms for non-specialists. It continues with a description of the legal nature of biometric data and makes a comparison with DNA and biological material and the regulation thereof. After describing the risks, the work further reviews the opinions of data protection authorities in relation to biometric systems and current and future (EU) law. A detailed legal comparative analysis is made of the situation in Belgium, France and the Netherlands. The author concludes with an evaluation of the proportionality principle and the application of data protection law to biometric data processing operations, mainly in the private sector. Pleading for more safeguards in legislation, the author makes several suggestions for a regulatory framework aiming at reducing the risks of biometric systems. They include limitations to the collection and storage of biometric data as well as technical measures, which could influence the proportionality of the processing. The text is supported by several figures and tables providing a summary of particular points of the discussion. The book also uses the 2012 biometric vocabulary adopted by ISO and contains an extensive bibliography and literature sources
