    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective.     Abstract: This book provides an in-depth overview of what is currently happening in the field of Law and Artificial Intelligence (AI).     Abstract: The rule of law in cyberspace currently faces serious challenges. From the democratic system to the exercise of fundamental rights, the Internet has raised a host of new issues for classic legal institutions. This book provides a valuable contribution to the fields of international, constitutional and administrative law scholarship as the three interact in cyberspace. The respective chapters cover topics such as the notion of digital states and digital sovereignty, jurisdiction over the Internet, e-government, and artificial intelligence. The authors are eminent scholars and international experts with a profound knowledge of these topics. Particular attention is paid to the areas of digital democracy, digital media and regulation of the digital world. The approach employed is based on a comparative perspective from Germany, the Netherlands, Italy, Portugal and Brazil. One particular focus is on how various legal systems are coping with increasing difficulties in the exercise of democracy with regard to disinformation and hate speech. The roles of legislators, the judicial system and public administrations are analysed in the light of the latest cases, conflicts and technologies.     Abstract: This book explores the history of reggae in modern Britain from the time it emerged as a cultural force in the 1970s. As basslines from Jamaica reverberated across the Atlantic, so they were received and transmitted by the UK's Afro-Caribbean community. From roots to lovers' rock, from deejays harnessing the dancehall crowd to dub poets reporting back from the socio-economic front line, British reggae soundtracked the inner-city experience of black youth. In time, reggae's influence permeated the wider culture, informing the sounds and the language of popular music whilst also retaining a connection to the street-level sound systems, clubs and centres that provided space to create, protest and innovate.     Abstract: What is classical music? This book answers the question in a manner never before attempted, by presenting the history of fifteen parallel traditions, of which Western classical music is just one. Eachmusic is analysed in terms of its modes, scales, and theory; its instruments, forms, and aesthetic goals; its historical development, golden age, and condition today; and the conventions governing its performance. The writers are leading ethnomusicologists, and their approach is based on the belief that music is best understood in the context of the culture which gave rise to it . By including Mande and Uzbek-Tajik music - plus North American jazz - in addition to the better-known styles of the Middle East, the Indian sub-continent, the Far East, and South-East Asia, this book offers challenging new perspectives on the word 'classical'.
    Abstract: It shows the extent to which most classical traditions are underpinned by improvisation, and reveals the cognate origins of seemingly unrelated musics; it reflects the multifarious ways in which colonialism, migration, and new technology have affected musical development, and continue to do today. With specialist language kept to a minimum, it's designed to help both students and general readers to appreciate musical traditions which may be unfamiliar to them, and to encounter the reality which lies behind that lazy adjective 'exotic'. MICHAEL CHURCH has spent much of his career in newspapers as a literary and arts editor; since 2010 he has been the music and opera critic of The Independent. From 1992 to 2005 he reported on traditional musics all over the world for the BBC World Service; in 2004, Topic Records released a CD of his Kazakh field recordings and, in 2007, two further CDs of his recordings in Georgia and Chechnya.

    Abstract: Dieser Open Access Band bietet sowohl deutsch- als auch italienischsprachige Beiträge zu wesentlichen Bereichen des gewerblichen Rechtsschutzes und des Urheberrechts aus der Sicht des deutschen, italienischen und österreichischen Rechts sowie zum TRIPS-Abkommen samt einem Blick auf das vorläufig in Kraft getretene Handelsabkommen zwischen Kanada und der Europäischen Union (CETA). Ein Schwerpunkt ist Schadenersatzansprüchen aus der Verletzung von Immaterialgüterrechten gewidmet, wobei die bei grenzüberschreitenden Sachverhalten auftretenden Fragen der internationalen Gerichtszuständigkeit und des Kollisionsrechts speziell behandelt werden. Darüber hinaus werden Bezüge zum italienischen Verfassungsrecht sowie zum europäischen Wettbewerbsrecht hergestellt und auch wirtschaftsstrafrechtliche Aspekte angesprochen. Schließlich wird ein Ausblick auf die zukünftige Entwicklung des internationalen Immaterialgüterrechts in der Europäischen Union gegeben. Ausgangspunkt für das Buch bildete der vom Internationalen Forum für Wirtschaftsrecht getragene 1. Bozner Wirtschaftsrechtstag, bei dem besonderes Augenmerk auf die Berührung des deutschsprachigen Rechts- und Wirtschaftsraumes mit dem italienischen gelegt wird.

    Abstract: »Schuld« ist ein Basisbegriff in vielen Wissenschaftszweigen. Offensichtlich ist die Funktion von Schuld in der Rechtswissenschaft, wo sie einerseits im Strafrecht und andererseits im Zivilrecht das Fundament für die Rechtsmaterie bildet. In der Philosophie befasst sich vor allem die Ethik mit der wie auch immer definierten Schuld. Die antiken Tragödien drehen sich um verschuldetes wie unverschuldetes Unheil. In der Geschichtswissenschaft wird etwa die Frage nach der Kriegsschuld seit jeher intensiv erörtert. In der Wissenschaftsgeschichte wird über die mit wissenschaftlichen Entdeckungen einhergehende Schuld disputiert. Soziologie, Kunst- und Kulturwissenschaften befassen sich mit in den heutigen pluralistischen Gesellschaften medial und diskursiv präsenten Formen von Schuld. In der Medizin und in den Naturwissenschaften wird die Quantifizierung und Messbarkeit von Schuld sowie ihr eventueller evolutionärer Vorteil erforscht. Und in der Theologie ist die persönliche Schuld Maßstab für die Beurteilung des Menschen am dies irae. Diese Wissensfelder werden in dem vorliegenden Band miteinander in Beziehung und somit ein fruchtbarer interdisziplinärer Diskurs ins Werk gesetzt.

This book explores the intersection of Christians and Hip Hop and the multiple outcomes of this intersection. It lays out the ways in which Christians and Hip Hop overlap and diverge.     Abstract: This book demonstrates the rich and varied ways in which heavy metal music draws on the ancient Greek and Roman world. Contributors examine bands from across the globe, including: Blind Guardian (Germany), Therion (Sweden), Celtic Frost, Eluveitie (Switzerland), Ex Deo (Canada/Italy), Heimdall, Stormlord, Ade (Italy), Kawir (Greece), Theatre of Tragedy (Norway), Iron Maiden, Bal-Sagoth (UK), and Nile (US). These and other bands are shown to draw inspiration from Classical literature and mythology such as the Homeric Hymns, Vergil's Aeneid, and Caesar's Gallic Wars, historical figures from Rome and ancient Egypt, and even pagan and occult aspects of antiquity. These bands' engagements with Classical antiquity also speak to contemporary issues of nationalism, identity, sexuality, gender, and globalization. The contributors show how the genre of heavy metal brings its own perspectives to Classical reception, and demonstrate that this music-often dismissed as lowbrow-engages in sophisticated dialogue with ancient texts, myths, and historical figures. The authors reveal aspects of Classics' continued appeal while also arguing that the engagement with myth and history is a defining characteristic of heavy metal music, especially in countries that were once part of the Roman Empire

    Abstract: The constitutional identity of the Member States is a topic of increasing importance in understanding the interaction between the EU and its Member States. This is because the EU is enjoined to respect the constitutional identities of its Member States in accordance with Article 4(2) TEU. There is also a trend among Member States to articulate their constitutional identities, in particular in relation to European integration. In this regard, this volume fills a need in scholarship by presenting critical analyses of the constitutional identities of selected Member States. Leading and well-placed experts contribute country studies on a range of states, which are compared using a framework that can be applied to other Member States as well. The analyses and comparison of Member States' constitutional identities take place in the context of the EU's multilevel architecture

    Abstract: In the 20th and 21st century, the tradition of singer-poets gained popularity in Eastern Turkey and its neighboring countries. Many of these artists were bi- or multilingual and thus representative of the ethnically diverse region of Eastern Anatolia. The connection to oral traditions of the region is evident in the singer-poets’ songs, music and text. This anthology illustrates the variety of singer-poet traditions from an interdisciplinary perspective by discussing, among other topics, the artists’ employment as national symbol, the role of gender, and the different styles that are grown out of this kind of music

    Abstract: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Abstract: In der aktuellen Berichterstattung werden vor allem die Unterschiede zwischen dem christlichen Westen und dem islamischen Osten betont. Bei einem näheren Blick auf die Geschichte der beiden Kulturräume lässt sich jedoch eine ähnliche Entwicklung ausmachen: Als Renaissance wird sowohl eine Phase im Heiligen Römischen Reich unter den Habsburgern als auch im Herrschaftsgebiet der Timuriden bezeichnet.Diese vermeintliche Ähnlichkeit bildet den Ausgangspunkt für eine Untersuchung der beiden Kulturräume in der Zeit um 900/1500. Damals lenkten die Herrscher Maximilian I. und Babur die Geschicke der beiden Dynastien. Ihre Selbstzeugnisse bilden die Grundlage für eine vergleichende Analyse. Die Fragen, die im Rahmen der Arbeit behandelt werden, lauten: Welche signifikanten Ähnlichkeiten zwischen diesen Texten lassen sich ausmachen und woher rühren sie? Lassen sich Unterschiede feststellen, die Hinweise auf eine Auseinanderentwicklung der beiden Kulturräume geben?Die Analyse lässt zahlreiche Gemeinsamkeiten zutage treten. Es zeigt sich, dass der typologische Vergleich literarischer Texte dazu beitragen kann, aktuelle Entwicklungen, in denen die trennenden Elemente zwischen Westen und Osten stark betont werden, historisch präziser einzuordnen. Doch auch der herausgearbeitete Unterschied kann aufschlussreich sein: Er lässt sich als Vorzeichen auf die Auseinanderentwicklung beider Kulturräume im Bereich der Ambiguitätstoleranz deuten.
    Abstract: The current media coverage emphasizes the differences between “Christian West” and “Islamic East”. However, a similarity in development can be found by having a closer look at the history of the Islamic world. For example, a period during the rule of the Timurid dynasty is also known as ‘Renaissance’. It took place at the same time as the ‘Renaissance’ under the rule of the Habsburgs in the Holy Roman Empire.This apparent similarity is used as a starting point for an analysis of the situation of the two cultural regions around 900/1500. The powerful dominions of the Habsburgs and the Timurids were ruled by the emperors Maximilian the First and Babur during that time. They both wrote self-testimonies which have been used for a comparative analysis. The thesis seeks to provide answers to the following questions: Which kind of important similarities can be found in the texts, and where do they originate? Can significant differences be identified which may reveal the starting point of the diverging development of the cultures?The results of the analysis indicate many similarities in the self-presentations. They show that a typological comparison of literary texts can lead to a more precise and historically correct interpretation than that of current trends, which rather promote differences between the cultures of West and East. Even the detected difference can be insightful: it is seen as an early sign of divergence of the two cultures in the area of intolerance of ambiguities.

    Abstract: Distinguishing between civilians and combatants is a central aspect of modern conflicts. Yet such distinctions are rarely upheld in practice. The Civilianization of War offers new ways of understanding civilians' exposure to violence in war. Each chapter explores a particular approach to the political, legal, or cultural distinctions between civilians and combatants during twentieth-century and contemporary conflicts. The volume as a whole suggests that the distinction between combatants and non-combatants is dynamic and oft-times unpredictable, rather than fixed and reciprocally understood. Contributors offer new insights into why civilian targeting has become a strategy for some, and how in practice its avoidance can be so difficult to achieve. Several discuss distinct population groups that have been particularly exposed to wartime violence, including urban populations facing aerial bombing, child soldiers, captives, and victims of sexual violence.     Abstract: The regulation of civil society provides the framework under which those organisations can most effectively provide services in education, health, social services, housing, development aid and so on. Civil Society in Europe identifies common principles of civil society law in two ways. First, the approaches of the Council of Europe and the European Union are explored. Next civil society regulation in twelve domestic legal systems are investigated on a broad range of substantive areas of law including internal organisation, registration, external supervision, public benefit organisations and international activities. From these, the authors distill a set of minimum norms and optimal conditions under which civil society can deliver its aims most effectively.     Abstract: Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.     Abstract: This book explores the constitutional, legally binding dimension to legisprudence in the light of the German Federal Constitutional Court´s approach to rational lawmaking. Over the last decades this court has been remarkably active in applying legisprudential criteria and standards when reviewing parliamentary laws. It has thus supplied observers with a unique material to analyse the lawmakers’ duty to legislate rationally, and to assess the virtues and drawbacks of this strand of judicial control in a constitutional democracy. By bringing together legislation experts and public law scholars to elaborate on ‘legisprudence under review’, this contributed volume aspires to shed light on the constitutionalisation of rational lawmaking as a controversial trend gaining ground in both national and international jurisdictions. The book is divided into five parts. Part I frames the two key issues pervading the whole collection: the intricate relationship between judicial review and democracy, on the one hand, and the possibility of improving and rationalizing the task of legislation under the current circumstances of politics, on the other. Part II provides an overview of the judicial review of rational lawmaking, laying special emphasis on the duty of legislative justification imposed on lawmakers by the German Constitutional Court. Part III is devoted to the review of the systemic rationality of legislation, in particular to the requirements of legislative consistence and coherence as developed by this court. Contributions in Part IV revolve around the judicial scrutiny of the socio-empirical elements of rational lawmaking, with the control of legislative facts and impacts and the problem of symbolic laws being the central topics. Finally, Part V draws on the German case law to discuss the links between rational lawmaking, balancing and proportionality, and the interdependence between process review and substantive review of legislation.

    Abstract: This book investigates how human rights law can be applied to corporate entities. To date there have been insufficient international legal mechanisms to bring corporations to justice for their misconduct abroad. The book argues that rather than trying to solve the problem locally, an international approach to corporate human rights compliance needs to be sought to prevent future corporate human rights abuses. Implementing effective and enforceable human rights compliance policies at corporate level allows businesses to prevent negative human rights impacts such as loss of revenue, high litigation costs and damage to reputation. By considering human rights to be an inherent part of their business strategy, corporations will be well equipped to meet national and regional business and human rights standards, which will inevitably be implemented in the next few years. This approach, in turn, also furthers the fundamental aim of international human rights law.

    Abstract: This Handbook comprehensively addresses the breadth of law encompassed by the EEA Agreement, which extends the European Union’s Single Market to three EFTA countries: Iceland, Liechtenstein and Norway. The Handbook is first and foremost intended for practitioners and legal scholars, but its approachable style makes it readily accessible for students. The Handbook provides the reader with a thorough grounding in the EEA Agreement, detailing how secondary EU law becomes applicable in the EFTA pillar, and the roles played by the EFTA Surveillance Authority and the EFTA Court.     Abstract: This book offers a legal understanding regarding the core elements of SGEI (Services of General Interest), and of how the post-Lisbon constitutional framework on SGEI affects the application of the EU market rules by the EU Court of Justice, including procurement rules, to public services. It is built up of three parts, namely Part I: No Exit from EU Market Law for Public Services, Part II: SGEI as a Constitutional Voice for Public Services in EU Law, and Part III: The cost of loyalty, the relationship between EU procurement and state aid legislation on social services and the Treaty rules on SGEI, ending with a case study of Swedish systems of choice. Analyses are also provided on how the EU legislator engages in the Europeanisation of social services through EU procurement and state aid rules that have an ambiguous relationship to the Treaty framework on SGEI. Some explanation to this ambiguity is proposed by studying how the application of EU state aid rules could hinder the development of Swedish systems of choice liberalizing publicly-funded elderly care and school education. Included are propositions on crucial but yet unsettled legal questions, in particular what the legal meaning and relevance of the notion of economic activity in EU market law are and which core elements characterize SGEI. This book is therefore mainly aimed at legal academics and practitioners but may also be of interest to political scientists. Caroline Wehlander studied at Umeå University and holds the title of Doctor of Laws. She lives and works in Sweden. .
