    Abstract: This paper is concerned with a number of conceptual and practical issues associated with the use of vouchers to distribute public services. Section 1 proposes a definition of vouchers and considers the position which voucher distribution occupies in the spectrum of possible mechanisms for the production and distribution of public services; this leads into a discussion of the objectives which voucher distribution might promote. Section 2 classifies the contexts in which vouchers might be applied and types of voucher systems. This permits a preliminary mapping of combinations of policy objectives and characteristics of the public service in question onto alternative forms of voucher distribution. Section 3 provides an illustrative review of the use of vouchers in the distribution of public services. Many of the examples discussed are in the field of education, where discussion of or use of vouchers is most developed, but experience of other public services is included where it is available. Section 4 contains conclusions.

    Abstract: Most OECD Member countries have sought to renew their systems and structures of public management in the last 10-15 years. Some started earlier than others and the emphasis will vary among Member countries according to their historic traditions and institutions. There is no single best model of public management, but what stands out most clearly is the extent to which countries have pursued and are pursuing broadly common approaches to public management reform. This is most probably because countries have been responding to essentially similar pressures to reform.

    Abstract: This paper seeks to outline the thinking behind a proposal contained in a recently released discussion paper by the Business Council of Australia (BCA). The BCA is Australia’s leading business body. It comprises the chief executive officers of most of Australia’s largest companies. The BCA’s paper was entitled Avoiding boom/bust: macroeconomic reform for a globalised economy (1999). A major section of the paper was devoted to exploring the idea of “re-engineering” fiscal policy.

    Abstract: La dette publique du Canada exprimée en proportion du PIB, qui était inférieure à la moyenne des pays Membres de l’OCDE au début des années 80, a augmenté par la suite, culminant à 97.6 % en 1995. Seules l’Italie, à l’intérieur du G- 7, et la Grèce ainsi que la Belgique, dans la communauté de l’OCDE, avaient une dette plus élevée en proportion de leur PIB. Au plan de la gestion budgétaire, le point tournant est survenu en 1994. On a compris alors que la situation financière était en voie de se muer en crise, et que des mesures rigoureuses s’imposaient. Aujourd’hui, le Canada enregistre un excédent budgétaire et rembourse sa dette. Le présent rapport retrace le fil de ces événements.

    Abstract: Canada’s level of indebtedness, as a percentage of GDP, increased from a level lower than the average for OECD Member countries in the early 1980s to a high of 97.6% in 1995. This was a level of debt exceeded only by Italy among G7 nations and Belgium and Greece among the wider OECD community. Fiscal management reached a breaking point in 1994. It was recognised that the fiscal situation had reached crisis proportions and strong corrective measures were needed. Today, Canada is enjoying a budget surplus and is repaying debt. This paper surveys these developments.

Certains ont pris le départ plus tôt que d’autres, et les points forts ont varié selon les traditions historiques et les institutions des pays. Il n’existe pas de modèle idéal de gestion publique, mais il apparaît très clairement que les pays concernés ont suivi et continuent de suivre des approches plus ou moins communes en matière de réforme de la gestion publique. Cela tient probablement au fait que les pressions en faveur de la réforme qui s’exercent sur eux ont été plus ou moins similaires.

    Abstract: Alors qu’elle bénéficiait des plus forts excédents budgétaires de tous les pays Membres de l’OCDE à la fin des années 80, la Suède a enregistré ensuite les déficits budgétaires les plus élevés de tous les pays Membres de l’OCDE. Ces énormes déficits se sont accompagnés d’une hausse massive de la dette publique. En cinq ans à peine, le niveau de la dette brute s’est accru de moitié. Cependant, vers la fin des années 90, l’équilibre budgétaire a été rétabli et maintenant elle bénéficie de nouveau d’excédents importants.

    Abstract: From enjoying the largest budget surpluses of any OECD Member country in the late 1980s, Sweden went into having the largest budget deficits of any OECD Member country in the early 1990s, which were accompanied by a massive increase in government debt. In a span of just five years, the level of debt had nearly doubled. However, by the late 1990s, the budget had been brought back to balance and Sweden is now enjoying significant surpluses again.

Cette réforme – ainsi que d’autres changements structurels favorisant les mécanismes du marché – et la nette amélioration des résultats de l’économie chilienne ont conduit de nombreux observateurs à conclure qu’il existait un lien direct entre tous ces facteurs, compte tenu notamment de l’augmentation de l’épargne intérieure des ménages générée par ce nouveau régime de retraite.

    Abstract: La mission traditionnelle des services centraux du budget est incompatible avec les réformes de la gestion qui touchent plusieurs pays Membres de l’OCDE. Ces réformes partent du principe que les gestionnaires doivent pouvoir gérer sans ingérence excessive. Dans la logique des réformes, les gestionnaires ne peuvent être tenus pour responsables des performances de leurs services que s’ils peuvent disposer à leur guise des ressources administratives, notamment financières, prévues au budget. Dans les pays où souffle l’esprit de réforme, on s’accorde à reconnaître qu’il ne sert à rien de faire les choses à moitié, que les gestionnaires sont libres d’agir ou ne le sont pas. Il ne s’agit pas d’assouplir telle ou telle restriction, mais de transformer le fonctionnement des institutions publiques et l’attitude de ceux qui y travaillent. L’élaboration du budget est l’un des domaines où les rouages de l’administration sont en mutation.

La section 1 propose une définition des chèques-service et examine la place qu’occupe la formule des chèques-service dans l’éventail des mécanismes susceptibles d’assurer la production et la distribution de services collectifs, ce qui conduit à analyser les objectifs auxquels pourrait servir la distribution de chèques-service. La section 2 présente une classification des contextes où les chèques-service pourraient être mis en oeuvre et des systèmes de chèques-service. Elle permet de procéder à un premier croisement entre d’une part des combinaisons d’objectifs publics et de caractéristiques d’un service collectif déterminé, et d’autre part diverses formes de distribution de chèques-service. La section 3 présente à titre d’illustration un tableau de l’utilisation des chèques-service dans la fourniture de services collectifs. Un grand nombre d’exemples commentés ressortent du domaine de l’éducation, domaine où les chèques-service ont été particulièrement débattus ou mis en oeuvre, mais on a fait référence, lorsqu’ils existaient, à d’autres cas de services collectifs. Ajoutons que je m’appuie à titre principal sur les expériences du Royaume-Uni et des États-Unis, puisqu’elles ont été particulièrement bien analysées dans les documents dont je disposais. Les conclusions figurent dans la section 4.

    Abstract: The formal procedures of public expenditure management vary widely within the European Union. They depend especially on the relative status of institutions. In most member states, operations are delegated to spending ministries or other spending units which have considerable freedom (within tough overall budget constraints) to decide how they meet their objectives; but there are wide variations in the degree of delegation and the incentives for efficiency. Public enterprises, similarly, are seen in some countries as an arm of the public sector and in others as essentially commercial bodies. Some member states have federal structures. Nearly all have complex procedures for funding local municipalities or counties. They differ in their relationships between government and Parliament. They also differ in technical procedures such as budgetary timescales, and methods of accounting for expenditure.

    Abstract: The traditional role of the central budget office is incompatible with the management reforms enfolding in various OECD Member countries. These reforms are grounded on the principle that managers must be permitted to run their operations without undue outside interference. The logic of reform is that only when managers are free to use money and other organisational resources within agreed budgets can they be responsible for the organisation’s successes or failures. In countries where a culture of reform has taken hold, there is consensus that halfway measures do not suffice, that managers either are free to act or are not. It is not a matter of relaxing one or another restriction, but of reshaping the operations of public institutions and the behaviour of those who work in them. The budget process is one of the main arenas in which the machinery of government is undergoing fundamental transformation.

    Abstract: OECD's 2001 review of investment policy in the Ukraine. It builds on the 1993 OECD Investment Guide for Ukraine and is primarily intended to further advance the policy dialogue and co-operation between the OECD and Ukrainian decision-makers on investment issues. It is part of OECD’s efforts to help drive the much needed policy reforms in Ukraine. The review attempts to assess the implementation of the legal rules, with an emphasis on their practical enforcement, and identifies gaps in legislation and institutional frameworks, distilling an array of policy recommendations. In addition to the legal and institutional setting specifically dealing with foreign investment issues, the review encompasses salient features of the overall business regime in Ukraine, such as legislation ensuring the rule of law, contract and property protection, corporate legislation, secured lending and financial sector legislation, taxation, public governance, including privatisation, competition and anti-corruption measures.

    Abstract: La paperasserie vue par les entreprises permet, pour la première fois, de comparer systématiquement des données émanant de 11 pays de l’OCDE. Ces données montrent comment les petites et moyennes entreprises perçoivent le coût de l’administration et de la réglementation nationales. La réglementation et les formalités administratives, ce qu'on appelle la "paperasserie", sont d’importants outils dont se servent les autorités publiques pour conduire leur action dans de nombreux domaines, notamment la sécurité, la santé et la protection de l’environnement. Toutefois, si elles sont mal conçues ou mal appliquées, inefficaces ou dépassées, elles peuvent entraver l’innovation, l’accès au marché, l’investissement, et créer des obstacles inutiles aux échanges et à l’efficacité économique. Une réglementation et des formalités administratives de piètre qualité ont un coût pour les économies nationales : la capacité de croissance de ces dernières, leur compétitivité, leur capacité d’adaptation et leur aptitude à créer des emplois peuvent en pâtir. Ce rapport s'appuie sur les résultats d’une enquête menée auprès de 8 000 entreprises, il fait le point sur la qualité, la mise en œuvre et le poids de la réglementation et des formalités administratives dans les domaines de l’emploi, de l’environnement et de la fiscalité. Les résultats sont inquiétants. Un exemple : la « paperasserie » absorbe 4 % du chiffre d’affaires annuel des entreprises (ce sont les plus petites qui sont le plus durement frappées) et ce coût augmente dans la plupart des pays.

    Abstract: Entre 1980 et 1997, le volume de résidus urbains par habitant a augmenté de 22 % tandis qu’il devenait de plus en plus difficile de trouver des sites pour implanter des installations d’élimination des déchets. Si, au cours des dernières décennies, d’importants progrès ont été accomplis en matière de réduction du volume de pollution de l’eau et de l’air produit par habitant, la production de déchets continue d’augmenter. Face à cet accroissement, de nombreux gouvernements ont passé en revue les différents moyens d’action dont ils disposent. Ils en ont conclu qu’imputer au producteur la responsabilité de contribuer ou de pourvoir à l’élimination de ses déchets pouvait permettre d'atténuer certaines des contraintes que ces derniers exercent sur l’environnement (après consommation du produit qu’ils accompagnent). La « responsabilité élargie des producteurs » (REP) est une stratégie en vertu de laquelle les producteurs acceptent d’assumer une responsabilité importante - d’ordre financier et/ou matériel - en ce qui concerne le traitement des déchets d’emballage. La prise en charge de cette responsabilité pourrait inciter à prévenir la production de déchets à la source, promouvoir la conception de produits dans le souci du respect de l’environnement, et contribuer à atteindre les objectifs publics de recyclage et de gestion des matériaux. Au sein de l’OCDE, la tendance est à l’élargissement de la REP à de nouveaux produits, groupes de produits et flux de déchets tels que les appareillages électriques et électroniques. Ce manuel d’orientation constitue un moyen d’informer les gouvernements des avantages et des coûts potentiels liés à la REP.

    Abstract: As we move into the 21st century, the turbulent transformation of economy and society looks set to continue. Growing integration of markets, radical new technologies, the increasing knowledge intensity of human activity, all point to the emergence of an immensely complex world. But how will it be managed? And by whom? What forms of organisation and decision-making will be required at local, national and global levels to meet the challenges of the next decades? One thing seems certain: old forms of governance -- in the public sector, corporations and civil society -- are becoming increasingly ineffective. New forms of governance will be needed over the next few decades which will involve a much broader range of active players. Traditional hierarchical organisations and top-down control will give way more and more to a wider diffusion of responsibility and decision-making that builds on the talents for innovation and creativity of individuals and groups. This book explores some of the opportunities and risks -- economic, social and technological -- that decision-makers will have to address in the coming years, and outlines what needs to be done to foster society 's capacity to manage its future more flexibly and with broader participation of its citizens.

An ambitious mission, which raises the challenge of harmonising public accountability and participatory democracy. Local Partnerships for Better Governance presents the lessons learnt from the most recent experiences in seven countries: Austria, Belgium, Denmark, Finland, Ireland, Italy and the United States. This book proposes a strategy that governments can implement to improve governance through partnerships. Applying this strategy will enforce local capacities in a globalising economy, and contribute to reconcile economic competitiveness, social cohesion and environmental progress.

Better strategies for the development of metropolitan areas are vital if their rate of economic growth is to remain strong, but the governance structures currently in place are often outdated and ill-adapted to the tasks they face, especially given the sprawl of many metropolitan cities across many jurisdictions.Drawing on the lessons from successful and unsuccessful attempts at the reform of metropolitan governance, this book identifies ways by which central and metropolitan governments can work better to optimise the potential of each urban region.

Au moyen de ces réformes, la Corée passe aujourd’hui d'un modèle de développement économique interventionniste et dirigiste à un modèle ouvert, fondé sur le libre jeu des mécanismes de marché et sur des valeurs telles que le choix du consommateur, la démocratie et l’état de droit. Cependant, la tâche est loin d’être achevée. Le système de l’intervention étatique n’est qu’en partie réformé, et de nombreux problèmes importants restent à traiter. Pour plusieurs années encore, la pérennité de la croissance nationale restera tributaire de la continuité des progrès de la réforme de la réglementation. La Corée, comme plusieurs pays Membres, a demandé à l'OCDE de procéder à un examen général de ses pratiques réglementaires nationales et de ses réformes internes de la réglementation. Cet ouvrage présente une évaluation approfondie de la réforme de la réglementation dans des domaines cadres comme la qualité du secteur public, la politique de la concurrence et sa mise en œuvre et l’ouverture des marchés. Il comprend aussi des chapitres sectoriels, portant par exemple sur l’électricité et sur les télécommunications, ainsi qu’une évaluation du contexte macroéconomique de la réforme. Les politiques recommandées offrent un plan d'action équilibré à court et à long terme, fondé sur les meilleures pratiques réglementaires à l’échelon international.     Abstract: Businesses’ Views on Red Tape provides the first opportunity to systematically compare data across 11 OECD countries. The data show how small and medium-sized enterprises perceive national administrative and regulatory costs. Regulations and government formalities, so-called "red tape", are important tools used by governments to carry out public policies in many policy areas, including safety, health, and environmental protection. However, if they are poorly designed or applied, inefficient, or outdated, they can impede innovation, entry, investment, and create unnecessary barriers to trade, investment, and economic efficiency. The result of poor regulation and formalities is that national economies become less able to grow, compete, adjust, and create jobs. Based on a survey of almost 8 000 businesses, this report assesses the quality, application and burdens of employment, environment and tax regulations and formalities. The results are dramatic: for example, red tape accounts for 4% of the annual turnover of companies, while the hardest hit are the smallest companies, and these costs are growing in most countries.

    Abstract: Municipal waste has increased 22 % per capita from 1980 to 1997. At the same time, the difficulty of siting new waste disposal facilities has increased. While major progress has been made to lessen the per capita generation of air and water pollution over the past decades, waste generation is still on the rise. Faced with the increase of waste, many governments have reviewed available policy options and concluded that placing the responsibility for the post-consumer phase of certain goods on producers could provide a means to relieve certain environmental pressures, arising from post-consumer waste. Extended Producer Responsibility (EPR) is a policy approach under which producers accept significant responsibility - financial and/or physical - for the treatment or disposal of post-consumer products. Assigning such responsibility could provide incentives to prevent wastes at the source, promote product design for the environment and support the achievement of public recycling and materials management goals. Within the OECD the trend is towards the extension of EPR to new products, product groups and waste streams such as electrical appliances and electronics. This guidance manual represents one means to inform national governments about the potential benefits and costs associated with EPR.

    Abstract: This landmark study of the material well-being of older people in nine OECD countries -- Canada, Finland, Germany, Italy, Japan, the Netherlands, Sweden, the United Kingdom and the United States -- uses a wealth of new data to shed light on the challenges that face policy-makers as they anticipate the coming retirement of the baby-boom generation. The findings are often surprising. In all the countries surveyed, policies have been fundamentally successful: older people at all income levels tend to maintain or even increase their material standards of living once they stop working. This happens despite large differences in approaches to public policy, including the size of public pensions. The systems that provide resources to older people are considerably more complex than is usually taken into account in policy-making, and the effects of policy, while large, are less direct than often thought. Demography and changing labour market patterns make reforms to these systems imperative. The challenge is to make needed changes without undermining past success. This is difficult, but entirely possible; the payoffs from relatively small changes in the balance between work and retirement could be particularly large. The study examines the many diverse ways in which the nine countries are tackling this challenge and the lessons that have been learned from their experiences. It provides invaluable evidence for policy-makers, researchers and citizens concerned about the challenges posed for societies by ageing populations.

By setting out the core characteristics of effective consumer protection for online business-to-consumer transactions, the Guidelines are intended to help eliminate some of the uncertainties that both consumers and businesses encounter when buying and selling on line. The Guidelines reflect existing legal protections available to consumers in more traditional forms of commerce. Their aim is to encourage: - fair business, advertising and marketing practices; - clear information about an online business’s identity, the goods or services it offers and the terms and conditions of any transaction; - a transparent process for the confirmation of transactions; - secure payment mechanisms; - fair, timely and affordable dispute resolution and redress; - privacy protection; and - consumer and business education.

    Abstract: OECD's territorial review of Hungary. It finds that ater a period of decline Hungary has returned on a satisfactory growth track. However, benefit and cost have not been evenly distributed during the transition. This report points to the persisting disparities between the West and the East, the capital and the periphery and urban and rural areas. It analyses numerous spatial, economic and social issues including transportation priorities, clustering of regional capacities, cross-border co-operation, the links between foreign investment and endogenous activities and social policies decentralisation. The review emphasizes the need to better articulate the territorial policy framework with those of the EU and proposes recommendations in order to streamline the institutional system and reinforce the subnational levels.

Hoy, la corrupción ha pasado a ocupar el lugar principal de la agenda política global conforme su severo impacto en el desarrollo económico y su corrosivo efecto sobre la estabilidad política y las instituciones democráticas se hace cada vez más evidente.En el nuevo milenio, la OCDE y los países asociados, que representan poco más del 75% del comercio y la inversión en el mundo, aplicarán reglas más estrictas. La Convención contra el cohecho de servidores públicos extranjeros en transacciones comerciales internacionales prohibirá la práctica de sobornar a dichos servidores públicos, haciendo que la competencia en los negocios internacionales sea mucho más justa y abierta. El cohecho en las transacciones comerciales internacionales es sólo parte del problema. Actualmente, se ha desarrollado todo un arsenal de instrumentos legales para combatir la corrupción y mejorar las normas de ética en el sector público, al igual que para terminar con la posibilidad de deducir fiscalmente el cohecho; para contrarrestar el lavado de dinero y para sanear las prácticas en las compras gubernamentales. El sector privado y la sociedad civil continuarán desempeñando un papel crucial para lograr que estas nuevas reglas se conviertan en una realidad.Este libro presenta los elementos clave que se requieren para establecer y mantener libres de corrupción a instituciones, sistemas y empresas privadas.

Sustained and consistent reforms over the next few years will do much to bring Greek regulatory practices up to OECD good practices and build credibility for Greek reforms. Greece still suffers from the high costs of poor regulation in some areas and too little pro-market regulation in others, such as the liberalising utility sectors. Long traditions of political intervention and protection of economic actors will be difficult to reverse. The confluence of positive elements - growing consensus for reform, macroeconomic stability, and healthy economic growth - suggest that the next few years will be decisive years of reform in Greece. This Review presents an integrated assessment of regulatory reform in framework areas such as the quality of the public sector, competition policy and enforcement, and market openness. It also contains chapters on sectors such as telecommunications, electricity, domestic ferries and trucking, and an assessment of the macroeconomic context for reform. The policy recommendations present a balanced plan of action for both short and longer term based on best international regulatory practices.

It finds that starting later than many countries, Italy devoted the 1990s to "catching up" with the leading OECD countries in economic and governance reforms. The scope, speed and consistency of structural reforms by multiple governments were remarkable. Accumulated rigidities and practices of decades were re-assessed, and many rejected. Awareness of the excessive role of the state in the economy led to broad policy and institutional changes in favour of transparency, public sector efficiency, and market competition. By 1999, Italy’s privatisation programme was among the largest in the OECD. Reform of Italy’s regulatory state is a formidable task, but early results, such as reduced red tape and stronger accountability of the public service, are appearing. Yet, enhancing the growth potential of the Italian economy -- following years of comparatively slow growth, relatively high inflation, low foreign direct investment, and a declining market share in world trade -- justifies faster and deeper regulatory reform to address the substantial reform agenda still outstanding. Long-standing income gaps between north and south could be narrowed by revitalised domestic markets. Better regulatory practices are particularly needed at regional and local levels, whose decisions increasingly decide Italy’s future. This review presents an integrated assessment of regulatory reform in framework areas such as the quality of the public sector, competition policy and enforcement, and market openness. It also contains chapters on sectors such as telecommunications, electricity, and railways, and an assessment of the macroeconomic context for reform. The policy recommendations present a balanced plan of action for both short and longer term based on best international regulatory practices.

L’Espagne a mis en oeuvre une libéralisation de grande envergure des échanges et de l’investissement, elle a privatisé la quasi-totalité des entreprises publiques, assoupli les contrôles de l’Etat, entrepris l’élaboration de nouvelles réglementations sectorielles et la mise en place d’institutions et renforcé la politique de la concurrence. L’Espagne a retiré des avantages économiques importants de ces mesures : baisse des prix et des taux d’intérêt, accroissement de la flexibilité du côté de l’offre, élargissement des choix offerts aux consommateurs et amélioration de la qualité des services. Avec les réformes du marché du travail, les réformes de la réglementation ont contribué à la baisse importante du chômage. Pourtant, l’Espagne est toujours confrontée à des problèmes imputables à des rigidités du côté de l’offre : taux de chômage élevé et faible taux d’activité, niveau élevé de l’inflation dû essentiellement au secteur des services et à l'absence d’innovation. La poursuite d’une amélioration des régimes de réglementation de l’Espagne, conjuguée à la vigilance des autorités chargées de la concurrence, renforcera encore la compétitivité du secteur des entreprises et réduira au minimum les obstacles internes à la croissance et à la création d’emplois, tout en améliorant l’efficacité de la réglementation pour mener à bien les politiques sociales essentielles. L’Espagne, comme plusieurs pays Membres, a demandé à l’OCDE de procéder à un examen général de ses pratiques réglementaires nationales et de ses réformes internes de la réglementation. Cet ouvrage présente une évaluation approfondie de la réforme de la réglementation dans des domaines cadres comme la qualité du secteur public, la politique de la concurrence et sa mise en oeuvre et l’ouverture des marchés. Il comprend aussi des chapitres sectoriels, portant notamment sur l’électricité et sur les télécommunications, ainsi qu’une évaluation du contexte macro-économique de la réforme. Les mesures recommandées constituent un plan d’action équilibré à court et à long terme, fondé sur les meilleures pratiques réglementaires à l’échelon international. It finds that since 1990, the Czech Republic has carried out a comprehensive transition to a market democracy that required a rapid and broad programme of deregulation, re-regulation, and institution-building. Today, the legal and policy frameworks consistent with a market economy are substantially in place and functioning. Important challenges remain, however, and reform to fill the remaining gaps and further refine regulatory regimes at national and subnational levels will continue to play a central role in economic development in the Czech Republic. Privatisation, restructuring, and building pro-competition regulatory regimes have been delayed in key areas, such as energy, and reform in telecommunications should be completed. Public sector reform should continue. Speed and consistency are essential. If the Czech Republic is to converge with the rest of Europe, it must move faster than the average European country.

    Abstract: Central and eastern European countries have been and still are adapting their legal framework to the requirements of a Western market economy and the body of EU legislation, the acquis communautaire. As the harmonisation of the national legal framework to EU standards is one of the yardsticks for EU accession, most candidate countries have drafted and adopted new legislation under enormous time pressure. Sub-optimal solutions, unforeseen implementation costs and unintended side effects were unavoidable. In many cases new legislation has proved impossible to implement. This experience has led candidate countries and other transition countries to develop an interest in impact assessment. EU Member States introduced impact assessment for legal programmes about two decades ago, based on the experience that new legislation may have a considerable and sometimes unexpected, impact not only on the budget, but also on various parts of the economy and society as a whole. Today, there is an acceptance among EU Member States that some kind of impact assessment exercise should be conducted before legislative changes are introduced. Although the comprehensiveness of a particular impact assessment exercise depends on a variety of factors, e.g. the importance of the policy issue or the commitment of the respective government, the basic aim is to enhance the quality of government decision-making. Establishing or improving the administrative capacity to carry out impact assessments is crucial for both in order to provide the government with the necessary information to take informed decisions on policy options and to improve the quality of new legislation. Even applying only the basic principles of impact assessment can often avoid the necessity for immediate amendments or redrafting. This publication deals with impact assessment in a wide sense, including policy analysis (impact assessment for choosing the instrument), assessment of a policy instrument during the drafting stage and evaluation of existing laws or programmes. Special emphasis is given to impact assessment during drafting.

    Abstract: All Member States of the EU and countries from Central and Eastern Europe use agencies of various shapes and sizes as part of their system of public administration. The legal forms vary widely from country to country depending on the legal tradition and the system of administration. Public agencies, if properly designed and managed, provide an opportunity for decentralising public administration, achieving greater transparency in government operations, and improving the efficiency and effectiveness with which government services are delivered to end users. Agencies can thus be used for economically and socially beneficial reasons, and indeed are sometimes employed as a stepping stone to more radical options, e.g. the privatisation of government services. However, agencies can also be misused for purposes that contravene the tenets of good governance and sound financial management. They can be a source of inefficiency, unregulated and covert expenditures, political favouritism and corruption. This paper originated in a request from the Ministry of Finance of the Czech Republic for SIGMA advice in developing new legal provisions for the financial management of public agencies. However, this subject cannot be addressed without avoiding the broader context. This paper has expanded well beyond the scope of the original mandate. It highlights the practice and experience of five EU Member States with very different legal systems and administrative structures. It focuses on issues relating to the financial management of public agencies but also discusses, in less detail, other issues concerning legal structures and governance. No single good practice "model" exists in this complex field. International best practice is still evolving. Moreover, we recommend a cautious approach by countries that are tempted to transpose elements of the agency models applied in countries such as New Zealand, Sweden and the United Kingdom. Would-be reformers should consider whether the legal and administrative structures are comparable, and the necessary systems of regulation, control and open reporting are in place and can be enforced. Whilst avoiding simplistic solutions, the paper includes recommendations that policy makers in Central and Eastern Europe should take into account before embarking on major reforms in this area.

Outre la description du cadre juridique et institutionnel ayant spécifiquement trait à l'investissement étranger, l'examen couvre les principales caractéristiques du régime des activités d’entreprise en Ukraine : la législation garantissant le respect du droit et des contrats et la protection de la propriété, le droit des sociétés, les garanties de crédit et la législation applicable au secteur financier, la fiscalité, la gestion des affaires publiques, les opérations de privatisation, la concurrence et la lutte contre la corruption. Cette étude s’inscrit dans le cadre des relations de coopération que l’OCDE entretient avec les économies non-membres de diverses régions du monde.

Les partenariats permettent à la société civile et ses ONG, aux entreprises et aux différents niveaux de gouvernement d’élaborer ensemble des stratégies territoriales, d’adapter les politiques au contexte local, et de prendre des initiatives qui vont dans le sens de priorités partagées. Un pari ambitieux, qui pose le défi d’harmoniser responsabilité publique et démocratie participative. Des partenariats locaux pour une meilleure gouvernance tire les leçons des expériences les plus récentes de sept pays : l’Autriche, la Belgique, le Danemark, les États-Unis, la Finlande, l’Irlande et l’Italie. Cet ouvrage propose une stratégie que les gouvernements peuvent mettre en œuvre pour améliorer la gouvernance par le biais du partenariat. Cette stratégie permettra de renforcer les capacités locales au sein d’une économie toujours plus globalisée, contribuant ainsi à réconcilier compétitivité économique, cohésion sociale et progrès environnemental.

    Abstract: L’Italie a commencé à réformer son économie et sa gestion publique plus tard que bon nombre de pays, aussi s’est-elle employée à « rattraper » les principaux pays de l’OCDE pendant les années 1990. L'étendue, le rythme et la cohérence des réformes structurelles opérées par de multiples gouvernements ont été remarquables. Les rigidités accumulées et les pratiques ayant cours depuis des décennies ont fait l'objet d'une réévaluation, et un grand nombre d'entre elles ont été bannies. La prise de conscience du rôle excessif de l'Etat dans l'économie a conduit à des changements radicaux tant au niveau des politiques que des institutions : on a favorisé la transparence, l'efficacité du secteur public, et la concurrence sur le marché. En 1999, le programme de privatisation de l'Italie était d’ores et déjà l'un des plus importants de l'OCDE. La réforme de l'Etat réglementaire italien est une tâche très difficile, mais les premiers résultats, comme la réduction des formalités administratives et une plus grande transparence du service public, se font jour. Pourtant, une réforme de la réglementation plus rapide et plus approfondie sera nécessaire pour mettre en valeur le potentiel de l'économie italienne. Après des années de croissance comparativement faible, d'inflation relativement forte, d'investissements directs étrangers bas et de parts de marché en baisse dans le commerce mondial, un certain nombre de réformes essentielles s'imposent encore. Des marchés intérieurs revitalisés pourraient permettre de réduire les écarts de revenu qui existent depuis longtemps entre le Nord et le Sud. De meilleures pratiques réglementaires sont nécessaires aux échelons régional et local notamment, car les décisions prises à ces niveaux ont un impact croissant sur l’avenir de l’Italie. A l’instar d’autres pays Membres, l’Italie a demandé à l'OCDE de procéder à un examen général de ses pratiques réglementaires nationales et de ses réformes internes de la réglementation. Cet ouvrage présente une évaluation approfondie de la réforme de la réglementation dans des domaines cadres comme la qualité du secteur public, la politique de la concurrence et sa mise en oeuvre et l’ouverture des marchés. Il comprend aussi des chapitres sectoriels, portant par exemple sur l’électricité et sur les télécommunications, ainsi qu’une évaluation du contexte macroéconomique de la réforme. Elle réunit une série de documents de travail que les autorités de la concurrence et des échanges ont examiné durant les deux dernières années.     Abstract: Public utility industries, once regarded as monolithic monopolies, in fact are made up of many separate activities, many of which can sustain effective competition. But owners of bottleneck facilities are often in a position to restrict or limit the growth of competition. There is a growing realisation that fundamental structural changes are often necessary if the full benefits of competition are to be achieved for users and consumers. This publication explores the nature and impact of rules which affect the structure of public utility industries. It covers not only the theory behind different forms of separation but also practical experience in a wide variety of countries and sectors (railways, electricity, postal services, telecommunications, gas, air services, and maritime transport). It also contains the new OECD Recommendation on Structural Separation of Regulated Industries, which urges Member countries to consider separating the monopoly and the competitive parts of regulated industries, especially during the process of privatisation or liberalisation.

    Abstract: As trade barriers at the border have fallen through successive trade negotiations, domestic regulation has emerged as a source of residual but potentially significant trade barriers. Recognising the importance of participating in intensified global competition, countries increasingly see regulatory reform as an inescapable policy to ensure that the expected benefits of globalisation are realised and that differences in national regulatory systems do not become barriers to international trade and investment. In this light, OECD has undertaken a broad-ranging project on regulatory reform, for which market openness is seen as a key objective. The papers collected in this volume were presented at a workshop at OECD that aimed to share national experiences of regulatory reform and trade and to foster consensus-building on best practices. Such practices include enhanced transparency, non-discriminatory due process, independence of regulators and active implementation of competition policy. Other issues raised at the workshop included the challenges for developing countries in pursuing regulatory reform and enhancing market openness, and insights for multilateral trading rule-making emerging from country experiences. The discussions reveal the pervasiveness of the issues raised at the workshop. In examining the recent development of regulatory issues in trade policy making, this volume brings new light to experiences in some parts of Asia and the Western hemisphere as well as to the growing links among trade, regulation and governance.

    Abstract: Poor corporate governance was identified as one of the root causes of the recent Asian financial crisis. The absence of effective disciplines on corporate managers, coupled with complicated and opaque relationships between corporations, their owners and their finance providers, affected severely investors’ confidence in the region’s corporate sectors. Economies that took early steps to improve corporate governance have been recovering from the crisis at a more rapid pace than those who have not addressed this issue. The Asian crisis showed that good corporate governance is important not only for individual corporations to raise capital but also for an economy to achieve sustainable growth. This publication includes papers submitted to the "Conference on Corporate Governance in Asia: A Comparative Perspective" held in Seoul in March 1999. These papers describe vividly the corporate governance practices in the region and the recent changes largely prompted by the crisis. Also included are papers on corporate governance in major OECD countries, which serve as a good source of comparative information on this issue. This review is part of the OECD's ongoing co-operation with non-Member economies around the world.

    Abstract: Corporate entities underpin most commercial and entrepreneurial activities in market-based economies and have contributed immensely to growing prosperity worldwide over recent decades. Increasingly, however, governments and regulatory bodies have realised that corporate entities ranging from corporations and trusts to foundations and partnerships are often misused for money laundering, bribery and corruption, shielding assets from creditors, tax evasion, self-dealing, market fraud, and other illicit activities. Prepared against this background, the OECD report Behind the Corporate Veil: Using Corporate Entities for Illicit Purposes opens ways to prevent and combat the misuse of corporate entities. The report shows that the types of corporate entities misused most frequently are those that provide the greatest degree of anonymity to their beneficial owners. With that in mind, the report offers governments and other relevant authorities a menu of policy options for obtaining information on the beneficial ownership and control of corporate entities in order to combat their misuse for illicit purposes.

    Abstract: Proponents of an active labour market policy are now claiming part of the credit for large falls in structural unemployment rates that have occurred in some OECD countries. Advances in information technology which facilitate matching job-seekers to jobs, modern management methods, and a favourable economic climate in recent years have encouraged innovative approaches and created new opportunities for the Public Employment Service to help the unemployed return to work. This book presents the proceedings of a conference on Labour Market Policies and the Public Employment Service organised jointly by the OECD and the Czech Ministry of Labour and Social Affairs. Among the themes addressed are: front-line employment service operations, one-stop offices and decentralised management; customer service and employer service; the advanced use of information technology; eligibility conditions for unemployment benefits; job guarantees for the long-term unemployed and other strategies of intervention in the unemployment spell; and improving the accountability of the Public Employment Service through external audits, the use of performance indicators, appropriate financing mechanisms, and contestability in the provision of services. The papers reflect the views of key actors -- politicians, senior officials from national labour ministries and employment services, front-line managers, and prominent academic experts -- on these important issues.
