    Abstract: Dr Peng He in her book addresses various issues, drawing on Western and Chinese sources for her argument for a ‘communicative’ theory of law making. This book is both timely and important in the Chinese context. Her argument depends upon the insight that what is important in societies is not just representative democracy but ‘voice’ - the opportunity for individuals to be heard and bring their input into official systems. More than that, she argues that this can also take further the idea of living by the rules as something that is not to be seen as narrow Legalism but as something more akin to living ‘righteously’ - a view which is resonant with parts of Chinese legal thought. This book is also important in the present Chinese context in another way. The developing economy necessitates substantial legal reform. But applying Western models to China can often be naïve and not fully fulfil their intended purpose. Peng He’s work addresses this by looking at the process of legislation in connection with legal reform. It is grounded in a sound theoretical reflection of both the process of legal transplantation and the process of law making, and looks both at Western and Chinese sources. Such an approach needs to draw from several intellectual traditions and it is this interdisciplinary, foundational research that is the task Dr He has set herself in her project. Her theory will provide an abstract theoretical framework that is sensitive to local conditions, while at the same time incorporating insights on law reform from a broad range of disciplines.     Abstract: This volume addresses the role of the judge and the parties in civil litigation in mainland China, Hong Kong and various European jurisdictions. It provides an overview and an analysis of how these respective roles have been changed in order to cope with growing caseloads and quality demands. It also shows the different approaches chosen in the jurisdictions covered. Mainland China is introducing far-reaching reforms in its system of civil litigation. From an inquisitorial procedure, in which the parties play a relatively minor role, the country is changing to a more adversarial system with increased powers for the parties. At the same time, case management and the role of the judge as it is understood in mainland China remains different from case management and the role of the judge in Western countries, mainly as regards the limited powers of individual Chinese judges in this respect. Changes in China are justified by the ever-increasing case load of the Chinese courts and the consequent inability to deal with cases in an adequate manner, even though generally speaking Chinese courts still adjudicate civil cases within a relatively short time frame (this may, however, be problematic when viewed from the perspective of the quality of adjudication). Growing caseloads and quality concerns may also be observed in various European states and Hong Kong. In these jurisdictions the civil procedural systems have a relatively adversarial character and it is some of the adversarial features of the existing systems of procedure which are felt to be problematic. Therefore, the lawmakers have opted for increasing the powers of the judge, often making the judge and the parties mutually responsible for the proper conduct of civil cases. Starting from opposite directions, mainland China and the various European states and Hong Kong could meet half way in their reform attempts. This is, however, only possible if a proper understanding is fostered of the developments in these different parts of the World. Even though in both China and Europe the academic community and lawmakers are showing a keen interest in the relevant developments abroad, a study addressing the role of the judge and the parties in civil litigation in both China and Europe is still missing.     Abstract: This book is designed to introduce law students, legal actors and human rights activists, particularly participants in human rights dialogues with China, to the process and reality of a newly confident China’s participation in the international human rights system, albeit with inherent challenges. From an international and comparative perspective, one of the key findings of the author's research is that progress towards human rights depends more on judges than on legislators. Chinese legislators have enacted a series of reforms in order to better protect human rights. Unfortunately, these reforms have not led to greater adherence to China’s international human rights obligations in practice. The reforms failed because they have generally been misunderstood by Chinese judges, who often have a limited understanding of international human rights norms. Specifically, this book will examine how judicial misunderstandings have blocked reforms in one specific area, the use of severe punishments, based on international human rights theory and case studies and data analyses. This examination has several purposes. The first is to suggest that China ratify the ICCPR as the next step for its substantive progress in human rights and as a good preparation for its re-applying to be a member of the UN Human Right Council in the future. The second is to explain how judges could be better educated in international human rights norms so as to greatly reduce the use of severe punishments and better comply with China's human rights obligations. The third is to demonstrate how the international community could better engage with China in a manner that is more conducive to human rights improvements. The author's ultimate goal is to enhance dialogue on human rights in China between judges and the Chinese government, between Chinese judges and their foreign counterparts and between China's government and the international community. Another significant aim of this book is to clarify the controversial question of what obligations China should undertake before its ratification of the ICCPR and to re-examine trends in its developing human rights policy after standing down from the Council in late 2012.     Abstract: This work investigates the development of English as a Foreign Language (EFL) learners’ generic competence in reading, writing and translation within the particular Chinese classroom context. It provides a new perspective for the current teaching and research in reading, writing, translation within the EFL contexts and offers an insightful framework for pedagogical applications in language learning and teaching. Its findings will be extremely valuable not only in local situations, but also more generally in a wider regional and global context as well. The book employs a series of research tools, including pre-research and post-research questionnaires, pre-test and post-test of reading/writing/translation, multi-faceted writing portfolios (including reflection reports), textual analysis and in-depth interviews. It involves 209 participants from a primary university in Wuhan, among whom 171 are undergraduates and 38 are postgraduates. And it draws on the analysis of such varied multi-sourced data both qualitatively and quantitatively. Genre-based teaching is playing a critical role in initiating EFL learners into the discourse community of the target language. Developing EFL learners’ generic competence is viewed as the ultimate goal in the process of teaching and learning. This monograph effectively demonstrates that like genre-based English for Specific Purposes (ESP) pedagogies, it is also possible to take advantage of already acquired genre knowledge for use in EFL learning contexts. It offers an impressive view of the direction in which genre-based applications are likely to take in the coming years

    Abstract: This book provides a unique empirical study of criminal trials in China. Western observers such as the media, politicians and the legal scholars alike, have rarely had the exposure to the vast majority of the ordinary criminal trials in China. A number of legal reforms have been implemented in Chinese criminal courts in recent years, but there has been little research on whether these reforms have been effective. This book fills that gap, by unveiling the day-to-day reality of criminal cases tried by the lowest level courts in China. The data used in this study include hundreds of criminal trial observations, complete criminal case dossiers, and a comprehensive questionnaire survey of criminal justice practitioners from one large province located in China’s Southeast coast. These data were collected over a two-year period, with a generous research grant from the John D. and Catherine T. MacArthur Foundation, by scholars already working in the Chinese legal system. The work opens with a historical framework of the Chinese criminal justice system, both Western and Chinese interpretations, and an overview of the current state of the system. It will provide unique analysis of how criminal trials are being carried out in China, with a useful context for scholars with varying levels of familiarity with the current system. The research framework for gathering data discussed in this book will also provide a useful basis for studying the criminal justice system in other regions

    Abstract: This book makes both empirical and conceptual contributions to the debate on privatization of higher education in China. Empirically, it aims to fill a gap in our knowledge of privatization of higher education in North China. To this end, Beijing was chosen as a case for analysis, and nine local higher educational institutions were visited. The case study strategy is also complemented by an extensive review of national policies to reveal problems beyond the specific case of Beijing and of national concern. The effects of the cultural and socioeconomic background and the unique state-party controlling system on higher education management are stressed. Conceptually, most existing studies on privatization of higher education in China adopt a policy analysis approach, while research on privatization of other public sectors or in other countries is frequently guided by economic theories. This book thus seeks to combine both social policy and econometric approaches to provide a systematic and detailed investigation of the privatization process in the context of higher education. It also improves examines the applicability of western theories in the Chinese context

    Abstract: Known internationally as ‘Mr. Shareholding’ economist, Li Yining has had a transformative impact on China's economic transition, most notably as an early advocate of ownership reform and in his promotion of shareholding theory. By examining the interrelationship between the government, enterprises and the market, Chinese Economy in Disequilibrium presents an in-depth discussion on the issues of resource allocation, industrial structure, institutional innovation and economic fluctuation in the current Chinese economy under the condition of disequilibrium. Credited with developing the theory of economic disequilibrium, Professor Li distinguishes two types of disequilibrium on the basis of whether or not the majority of firms in the economy are viable profit-makers. In Chinese Economy in Disequilibrium, Professor Li points out that not only has China’s economy been in a state of disequilibrium, but it also has issues with enterprises not being under budget constraint. Given the limitations of market regulation under economic disequilibrium, Professor Li advocates the reform of the enterprise system and upholds the government’s leading role in the establishment of order in the socialist commodity economy. A number of measures are also proposed with the aim of facilitating the transition of China’s economy from disequilibrium to equilibrium. The central theme is that the reform and transition are means to serve economic growth and social development, which would eventually benefit the ordinary citizens in society. Yining Li is a Professor of Economics and Emeritus Dean of Peking University’s Guanghua School of Management. He is one of China’s foremost economists, and the author of twenty books and numerous articles on a wide range of economic subjects including reform and development in China. He has received a number of prestigious awards and honours for his research. As the leading proponent of a market economy in China, Professor Li has had a tremendous influence on China’s economic reform policy over the last three decades. He has served on the Standing Committee of the National People’s Congress of China and is currently Vice-Chairman of the Economic Committee of the Chinese People’s Political Consultative Conference.

    Abstract: Against the backdrop of China’s increasingly influential role in the international financial architecture, this book seeks to characterize and evaluate China’s financial power potential. It does so by analyzing the relationship between domestic financial repression and international financial power in the context of the political economy of the developmental state. On the basis of a novel theoretical framework for the analysis of the financial power potential of developmental states, the book provides an in-depth analysis of China’s approach to currency internationalization, its creditor status and its policies towards the Bretton Woods institutions while contrasting the country’s present role in global finance with the position of the Japanese developmental state in the 1980s and 1990s.

    Abstract: This book discusses the recently introduced concession policy, which is also known as PPP worldwide, on municipal utilities policy in China. In this context, critics have claimed that there is a gap in accountability with regard to concessions. The author utilizes interdisciplinary methods and comparative studies, taking into account the situation in the EU and US to analyze the accountability gap some feel will be created when the policy is implemented. Taking water sector concessions as the subject of discussion, the author distinguishes between three types of accountability: traditional bureaucratic accountability, legal accountability and public accountability. By systematically analyzing the essential problems involved, the book attempts to achieve a better understanding of concession and its application in the context of public utilities, and finds that the alleged accountability gap is attributed to traditional bureaucratic accountability in China and the concession system per se.

    Abstract: Long before the Europeans reached the east, the ancient Chinese had advanced their perspectives of the west. In this groundbreaking book, Wang explores a fascinating perspective of the Other. He locates the Other in the alternating directionologies of classical and imperial China, leading the reader into a long history of Chinese geo-cosmologies and world-scapes. In his analysis, Wang also delves into the historical records of Chinese "world activities," or the journeys from being the Central Kingdom to reaching to the "outer regions," separating the construction of illusory from realistic geographies while drawing attention to their interconnected natures.     Abstract: De-politicizing issues of ethnicity is a new theoretical approach to study ethnic questions actively propounded and elaborated by Professor Ma Rong of Sociology Department of Peking University in the past ten years. In the recent years, this theoretical approach has aroused biggish responses from the academic community in Mainland China, the relevant government departments, and the general public. It is likely to elicit vigorous discussions in the years ahead. The book contains eight selected chapters which represent the main contributions to the debate. The first chapter by Ma Rong is the key paper where in he lays out his main ideas and arguments. The remaining chapters deal with both positive and negative responses to the first chapter, and his replies to them

    Abstract: "How does China maintain authoritarian rule while it is committed to market-oriented economic reforms? This book analyzes this puzzle by offering a systematic analysis of the central-local governmental relationship in rural China, focusing on rural taxation and political participation. Drawing on in-depth interviews with Chinese local officials and villagers, and combining them with game-theoretic analyses, it argues that the central government uses local governments as a target of blame for the problems that the central government has actually created. The most recent rural tax reforms, which began in 2000, were a conscious trade-off between fiscal crises and rural instability. For the central government, local fiscal crises and the lack of public goods in agricultural areas were less serious concerns than the heavy financial burdens imposed on farmers and the rural unrest that the predatory extractive behavior of local governments had generated in the 1990s, which threatened both economic reforms and authoritarian rule"--

    Abstract: China's economic transformation has brought with it much social dislocation, which in turn has led to much social protest. This book presents a comprehensive analysis of the large-scale mass incidents which have taken place in the last decade. The book analyses these incidents systematically, discussing their nature, causes and outcomes. It shows the wide range of protests - tax riots, land and labour disputes, disputes within companies, including private and foreign companies, environmental protests and ethnic clashes - and shows how the nature of protests has changed over time. The book argues that the protests have been prompted by the socioeconomic transformations of the last decade, which have dislocated many individuals and groups, whilst also giving society increased autonomy and social freedom, enabling many people to become more vocal and active in their confrontations with the state. It suggests that many protests are related to corruption, that is failures by officials to adhere to the high standards which should be expected from benevolent government; it demonstrates how the Chinese state, far from being rigid, bureaucratic and authoritarian, is often sensitive and flexible in its response to protest, frequently addressing grievances and learning from its own mistakes; and it shows how the multilevel responsibility structure of the Chinese regime has enabled the central government to absorb the shock waves of social protest and continue to enjoy legitimacy.

However, can the same be said of the ethnic Chinese middle classes in Taiwan, China, Hong Kong, and Macao? Given the divergent political and economic experiences under which the respective middle classes were created, established, shaped, and reshaped, can they still be characterized as a homogenous group of 'Chinese middle classes', or are they more unique within each country? Using systematic survey data analysis and case studies to examine and compare the emerging middle classes in Taiwan, Hong Kong, Macao and Urban China, this book explores whether the middle classes in these countries possess any uniquely 'Chinese' features, or if these are shared attributes that can be found in other non-Chinese middle classes in the Asia-Pacific region.     Abstract: This book offers the first comprehensive analysis of China’s information society. It explores the key practical challenges facing Chinese politicians as they try to marry the development of modern information and communications technology with old ways of governing their people and conducting international relations. Fundamental realities of the information age, not least its globalizing character, are forcing the pace of technological change in China and are not fully compatible with the old PRC ethics of stability, national industrial strength and sovereignty. What happens to China in future decades will depend on the ethical choices its leaders are willing to make today. The stakes are high. But if China’s ruling party does not adapt more aggressively to the defining realities of power and social organization in the information age, the ‘China dream’ looks unlikely to become a reality.

    Abstract: A series of high-ranking international meetings in 2013 drew global public attention to the dramatic collapse of elephant and rhinoceros populations in Africa, and to the connections between wildlife crime, terrorist networks and organised crime. On 12 February 2014 an international conference in London again took up the question of how to combat poaching and the illegal wildlife trade. Successful action against wildlife crime is a cross-cutting global task encompassing wildlife conservation, fighting organised crime, promotion of rule of law, and economic cooperation, as well as resolute anti-corruption and involvement of local populations along the entire supply chain. Countermeasures will function only if people in Africa enjoy economically viable livelihoods and benefit from wildlife protection. In Asia, renouncing ivory as a status symbol and dropping superstitions about the medical value of rhinoceros products demands a change of mindset. (author's abstract)

    Abstract: Research findings has shown that there are developmental issues and concerns regarding the development of university students in Hong Kong. First, there were behavioral and lifestyle problems of university students, including alcohol consumption, internet addiction, cyber-pornography, irregular sleep patterns, and interpersonal violence.     Abstract: "Empire and Identity in Guizhou is a study of stormy ethnic relations in eighteenth-century Guizhou Province between the Qing state and the Zhongjia ethnic group, which culminated in the Nanlong Uprising in 1797. As the imperial state extended its control into frontier areas such as Mongolia, Tibet, and the southwest, it encountered difficulty incorporating non-Han people into the empire. The Zhongjia in particular were difficult to control, because the state could not employ religion as a political tool, as it did with ethnic minorities who were Buddhist; nor were literary tactics useful with the nonliterate Zhongjia. Weinstein shows how the Zhongjia maintained autonomy through livelihood choices, and how their "creative resistance" ranged from subterfuge to outright rebellion. This engagingly written and dramatic case study demonstrates how the Qing empire really worked and contributes toward a broader understanding of imperialism and colonialism"--

Using archival materials, indigenous folk narratives, and ethnographic research, Jodi L. Weinstein shows how these seemingly subordinate populations challenged state power.Jodi L.
