    Abstract: This open-access book explores the security dynamics amid the polarization, shifting borders, and liquid governance that define the Zeitenwende era in Europe's eastern neighbourhood and Central Asia. Presenting various case studies, the volume unveils the intricate web of border dynamics and practices, including the nuanced interplay of border disputes within the Organization for Security and Cooperation in Europe (OSCE) member states. The contributions shed new light on how contested borders and liquid modes of governance have impacted the engagement of international organizations such as the European Union (EU), North Atlantic Treaty Organization (NATO), and OSCE in security crises and conflict prevention.     Abstract: Robotic research and developments in computing technologies including artificial intelligence have led to significant improvements in autonomous capabilities of robots. Yet, human supervision is advisable and, in many cases, necessary when robots interact with real-world, outside-lab environments. This is due to the fact that complete autonomy in robots has not yet been achieved. When robots encounter challenges beyond their capabilities, a viable solution is to include human operators in the loop, who can support robots through teleoperation, taking complete control or shared control. This monograph focuses on a special form of shared control, namely mixed-initiative, where the final command to the robot is a weighted sum of the commands from the operator and the autonomous controller. The weights (fixed or adaptive), called authority allocation (AA) factors, decide who has more control authority over the robot. Several research groups use different methods to adapt the AA factors online and the benefits of adaptive mixed-initiative shared control have been well established in terms of task completion success and operator usability. However, stability of the overall shared control framework, with communication time-delays between the operator and the robot, is a field that has not been examined extensively. This monograph presents methods to improve performance and stability in shared control so that the possibilities of its applications can be widened. Firstly, methods to improve the haptic feedback performance of teleoperation are developed. Secondly, methods to stabilize adaptive shared control systems, while still ensuring high teleoperation performance, are proposed. The methods are validated on multiple robotic systems and they were applied in several projects, both in space and terrestrial domains. With the aforementioned contributions, this monograph provides an overarching framework to improve synergy between humans and robots. The flexibility of the framework allows integration of existent teleoperation and shared control approaches, which further promotes synergy within the robotics community.

    Abstract: This book offers a novel perspective on consultation with indigenous peoples in projects of natural resource exploitation. Engaging with current debates in international law, the study introduces a multi-dimensional perspective on consultation understood to include self-determination and cultural rights. It analyzes evidence from several countries across the Americas and Africa and presents an original and in-depth case study of Brazil. The book assesses judicial and legislative cases, drawing on relevant literature, international treaties and supplementary information gained from expert interviews. This supports the work’s broader objective to explore legal facts as well as to evaluate the empirical evidence in light of theoretical considerations. It thereby expands the understanding of consultation as a right under national legal systems and considers practical ways on how to enforce domestic redress for avoiding legal indeterminacy. The conclusions of the analysis contribute to not only a better understanding of the subject matter but also showcase ways of how to improve the realities on the ground. The book puts forward a range of recommendations directed at national authorities, international organizations, development lenders and civil society to help improve the unsatisfactory present circumstances.     Abstract: This book seeks to explore the potential and actual value of parliamentary debates as a source of legislative justification. Drawing on a sample of recent Spanish legislation, the papers collected here analyse (critically) the rationale of several laws or legislative measures as it can be reconstructed from the respective parliamentary discussions. All issues covered have given rise to intense political, legal and social controversy: they range from the combat against gender violence, the legal status of bullfighting, the protection of crime victims and the so-called ‘push-backs’ at the border, to the regulation of euthanasia, the minimum living income, underage girls’ access to abortion, and joint child custody. The volume is organised into two main parts. The first group of case studies adopt a legisprudential perspective and examine parliamentary deliberations in the light of the theory and methodology of legislative justification; the contributions in the second part follow approaches that fall outside – but are largely compatible with –legisprudence, and deal with aspects such as the rhetorical strategies employed by MPs when debating bills, and the role of elected legislators as constitutional interpreters.

    Abstract: This book presents many valuable tips for making decisions related to road traffic in transport networks. The knowledge base in practical examples, as well as the decision support systems described in this volume, finds interest among people who face the daily challenge of searching for advanced solutions and practical applications in road traffic engineering. The publication is therefore addressed to local authorities related to the planning and development of development strategies for selected areas with regard to transport (both in the urban and regional dimension) and to representatives of business and industry, as people directly involved in the implementation of traffic engineering solutions. The tips contained in individual sections of the publication allow to look at a given problem in an advanced way and facilitate the selection of the appropriate strategy (among others, in relation to the heuristic approach to assessing the performance efficiency of road intersections in urban environments from the resilience perspective, modeling the distribution of transport pollutants in a naturally ventilated road tunnel, development of a camera-based parking monitoring system with an automatic parking spot identification).     Abstract: This book focuses on OLAF, the European Union’s anti-fraud office, and examines the role of and challenges concerning fundamental rights in OLAF’s composite enforcement procedure. The mission of OLAF (Office Européen de Lutte Antifraude) is to fight fraud, corruption and any other illegal activities that affect the financial interests of the European Union. To this end, OLAF carries out administrative investigations, in which it gathers evidence itself, and coordination cases, in which it coordinates the Member States’ investigations. OLAF’s investigation and coordination efforts are conceived of as mere derivatives of other more traditional forms of law enforcement cooperation in which authorities enter into obligations to cooperate with one another, but in which each acts to fulfill these obligations within its own separately identifiable legal order and on the basis of its own law. This system, in its most conventional form, is founded on the notion of territorial sovereignty. If we extend the logic of this approach from enforcement (the ‘sword’) to fundamental rights (the ‘shield’), issues in relation to the latter – and the accompanying responsibility to prevent and/or remedy them – can arise only in individual (sovereign) legal orders. The way in which we view OLAF, as an evolved cognate of traditional forms of law enforcement cooperation, therefore directly dictates which fundamental rights issues enter into the equation, and in which manner. This book proposes an innovative way of looking at OLAF, which we refer to as ‘composite enforcement procedures.’ In this type of procedure, responsibilities for the entirety of enforcement are attributed to inextricably interlinked European Union and Member State legal orders. If we observe OLAF through this new lens, fundamental rights issues that would otherwise go unnoticed come to the forefront. These are issues that arise not in individual legal orders, but rather between or among the European Union and the Member States. This book addresses these fundamental rights challenges and makes concrete recommendations on how they can be addressed and resolved.

    Abstract: This volume considers the most appropriate criminal jurisdiction to prosecute aggravated sex trafficking of the kind associated with northern Albanian crime groups. Watershed jurisprudence from the Yugoslav war crimes tribunal could prove pivotal to achieving the legislative changes for prosecuting Albanian sex trafficking in peacetime that this book advocates. This book revisits this relevant history to challenge the current transnational status of trafficking as a mischaracterisation. It is maintained that the Albanian sex trafficker has become, like the wartime rapist before him, the perpetrator of an offence that warrants recognition by the international criminal justice regime. The book considers the historico-cultural legacies of present-day root-causes of Albanian sex trafficking to understand how the same dehumanising ideology and sexual violence aimed at women during the Yugoslav Wars persisted post-conflict and continues to underscore contemporary Albanian sex trafficking and what these similarities in assailant attitudes and actions might mean for potentially prosecuting human trafficking within the international criminal justice system. Through the prism of neutralisation theory rooted in forensic cultural anthropology, in the form of a novel hypothetical model, a conceptual framework to consider the true nature of trafficking is offered. The model offers a précised interpretation of the key factors that establish certain criminal conduct as suitable for international criminal justice and how those factors relate to Albanian sex trafficking. The model distils the characteristics of Albanian sex trafficking; it extracts the essential elements and most important aspects of this type of criminality so we can recognise their presence in real-world cases. A case study featuring interviews with the traffickers themselves and individuals who have encountered them firsthand then describes how the model holds for the real-world experience of Albanian sex trafficking. Approached from the trafficker angle, the purpose of the case study is to support the theoretical model by showing how each element manifests in Albanian sex trafficking. For a richer understanding, each of the elements is explained and explored within a historico-cultural context. The chapters in this book feature key topics and supporting material, including: The backstory, purpose, and structure of the international criminal justice system followed by how the regime could and should be extended to encompass aggravated sex trafficking.     Abstract: The book contains the results of the best research developments obtained during the implementation of major scientific events organized and carried out with the financial support of the Russian Science Foundation and the President of the Russian Federation. The scientific novelty of the work lies in the fact that for the first time at the level of Russian and international interdisciplinary social and humanitarian sciences, primarily economic and legal, firstly, philosophical concepts and regulatory legal approaches to the regulation of remote investment transactions have been studied; secondly, a set of economic and legal conditions and means of harmonizing and observing the mutual interests of participants in remote investment transactions has been developed and proposed in order to prevent and minimize potential conflicts between the parties; thirdly, the current state and international regulation of investment transactions concluded and executed on Internet platforms was critically assessed; fourthly, a system of guarantees and protection of the rights of participants in remote investment transactions is proposed, including special contractual structures and an economic and legal model for the proper fulfillment of obligations. Measures are substantiated to expand and increase the intensity of the national investment turnover based on the improvement of the current legislation regulating investments through remote digital technologies in the Internet space, which provided a solution to the world scientific problem of great socioeconomic and economic importance. The book is designed for a wide target audience—scientists of different generations, different disciplinary and industry affiliations. Among them are young researchers, as well as scientists who have received recognition from the world scientific community, studying the socioeconomic, managerial, and legal consequences of the emergence and spread of digital technologies in the field of investment. Readers can be all individuals and legal entities interested in the development of digital technologies in the field of investment.

    Abstract: Based on a deliberative democracy, this book uses a hermeneutic-critical methodology to study bibliographical sources and practical issues in order to analyse the possibilities, limits and consequences of the digital transformation of democracy.     Abstract: It is wrong when someone cannot exercise their rights in a court of law because they have no money to pay for a good lawyer, because they are too scared of the possible consequences, or because they simply don’t know that the law protects them. But does that mean governments have an obligation to intervene? And if so, how? This book provides the first systematic philosophical theory of equal access to justice. It begins by identifying the content of claims to equal access to justice. Then, it reviews traditional political and legal arguments on the right of access to justice, which it argues are both illuminating and insufficient. The best comparative way to approach equal access to justice, the book argues, is to think through the requirements of a moral, pre-political, duty to – at times and provisionally – pause, cool down and listen: in other words, we ought to demand that governments step in and protect access rights, because we have a moral and pre-political interest in cultivating our ability to comply with this duty. It is the recognition of this duty which best explains both law’s potential for promoting, as well as its potential for endangering, equal justice. In closing, the book tests this novel theory of equal access to justice against contemporary trends and reforms in procedural law. .

    Abstract: This book critically analyzes both the negative and positive impacts of the Coronavirus pandemic, focusing on changes in families, gender developments, and the evolution of social inequality structures. The Corona pandemic, with its unprecedented restrictions on contact, has meant that families have been challenged in their functioning in a very special way. International studies show that socioeconomic factors such as education, income, but also the geographic center of life of families and women in particular, had an important influence on the management of the pandemic. Despite all negative side effects of the Corona pandemic, there were nevertheless also innovative impulses, especially in the field of social work, particularly work with families. The book's 18 chapters, organized in six sections, highlight not only short-term changes but also longer-term developments that either require a corresponding concept of measures or action or can be evaluated as drivers of innovation in the pandemic. Rather, it leaves it up to readers to compare the developments in the respective countries with their own country of origin from a comparative cultural perspective. As such, the book is addressed to social scientists and historians and all those who are interested in numerical productions. This book is a translation of an original French edition.     Abstract: The book brings to light how Latin American states have traditionally stood before the field of International Investment Law and Arbitration. It delves into their posture of resistance to critically examine how their perspective has gradually changed and how they have adapted and molded their investment agreements so as not to leave their position as players in the field of International Investment Law. Many Latin American states have appeared as defendants before international investment tribunals and some of these, like Venezuela, Bolivia or Ecuador, have denounced their international investment agreements. Deeming the law field as imbalanced, they have looked for alternatives to continue providing legal protection to foreign investors while protecting their right to regulate in the name of public interest. Some interesting investment agreements models, sometimes of a different ilk, have consequently flourished and have arrested the attention of those studying or working with international investment law. The main objective of this book is to critically discuss how Latin American states have accepted, resisted, or adapted themselves to international investment law and arbitration. Accordingly, the general connection between these states and international investment law are explained in an introduction which examines the general trends as per which Latin American states have offered a legal protection to foreign investments. The first part enters the merits of where international investment law and arbitration stand in some Latin American states whereby the experience of Brazil, Chile, Argentina, Venezuela, and Uruguay are discussed. The following parts explain the trends in international investment law and arbitration in Latin America.     Abstract: This book provides philosophers and logicians with a broad spectrum of views on contemporary research on the problem of deduction, its justification and explanation. The variety of distinct approaches exemplified by the single chapters allows for a dialogue between perspectives that, usually, barely communicate with each other. The contributions concern (in a possibly intertwined way) three major perspectives in logic: philosophical, historical, formal. The philosophical perspective has to do with the relationship between deductive validity and truth, and questions the alleged conclusiveness of deduction and its epistemic contribution. It also discusses the role of linguistic acts in deductive practice, and provides a cognitive-didactic contribution on how we may learn through deduction. In the historical perspective, the contributions discuss the ideas of some major historical figures, such as Bolzano, Girard, Gödel, and Peano. Finally, in the formal perspective, the mathematics of deduction is dealt with mainly from an intuitionistic-constructivist or proof-theoretic point of view, with focus on “ecumenic” or internalistic approaches to logical validity, on the nature and identity of proofs, and on dialogical setups.     Abstract: This book provides a unique scientific contribution to the debate on Marx's legacy in proposing to critically articulate two “lines of discussion” which are most often kept apart. On the one hand, it reassesses the place of Marxian thought in the construction of Europe, seeking to revitalize the European political debate.     Abstract: This textbook is a second edition of the successful, Mathematical Logic: On Numbers, Sets, Structures, and Symmetry. It retains the original two parts found in the first edition, while presenting new material in the form of an added third part to the textbook. The textbook offers a slow introduction to mathematical logic, and several basic concepts of model theory, such as first-order definability, types, symmetries, and elementary extensions. Part I, Logic Sets, and Numbers, shows how mathematical logic is used to develop the number structures of classical mathematics. All necessary concepts are introduced exactly as they would be in a course in mathematical logic; but are accompanied by more extensive introductory remarks and examples to motivate formal developments. The second part, Relations, Structures, Geometry, introduces several basic concepts of model theory, such as first-order definability, types, symmetries, and elementary extensions, and shows how they are used to study and classify mathematical structures. The added Part III to the book is closer to what one finds in standard introductory mathematical textbooks.     Abstract: The sometimes complex and controversial relation between the fundamental rights of the European Union, as enshrined in the EU Charter of Fundamental Rights (CFR), and national fundamental rights in the context of constitutional review is reflected in a series of landmark decisions in the multilateral cooperation of European courts, which have reshaped the fundamental rights architecture in the multilevel system in recent decades. This book aims to contribute to a systematic and comprehensive analysis of the EU and constitutional law issues involved, thus serving as a reference point for scholars and practitioners dealing with this emerging topic in depth. Following this approach, it sheds light on the broader Union legal context of these developments, examines the role of the CFR for Constitutional Courts, the relationship between constitutional and ordinary courts, and assesses the key decisions concerning the application of the CFR as a standard of constitutional review. It also draws some initial conclusions on the development of the European fundamental rights architecture, its prospects and possible implications for the Union’s legal order. The book contains several contributions by European legal experts from academia and the judiciary, who examine the different methods of constitutional application of the CFR from a comparative law perspective.     Abstract: While previous volumes have examined specific issues and developments such as the coronavirus crisis or digital transformation from a law and economics perspective, the anniversary edition returns to the methodological and philosophical fundament of the discipline of law and economics. The present book aims to examine these foundations in general and, in particular, efficiency, reciprocity and meritocracy, and their relation to law and justice from an interdisciplinary perspective. Efficiency: Traditionally, the economic analysis of law has been guided by the goal of efficiency. Economists usually define efficiency as Pareto or Kaldor–Hicks efficiency. Any change that makes one member of society better off without anyone else being worse off is a Pareto improvement. A change is a Kaldor–Hicks improvement if the gainers value their gains more than the losers value their losses, with only hypothetical compensation required. Reciprocity: Economists have traditionally based their models on the self-interest hypothesis of homo oeconomicus. In this model, an individual maximises his own utility without being altruistic or jealous. Behavioural economics challenges the self-interest hypothesis. In fact, many people deviate from purely self-interested behaviour. There are also signs that considerations of fairness and mutual benefit are important in bilateral negotiations and in the functioning of markets. Meritocracy: The concept of meritocracy refers to a system, organisation, or society in which people are selected and promoted to positions of success, power, and influence on the basis of their abilities and merits. This means that an individual is able to climb the social ladder through hard work. Moreover, meritocracy directs the most talented people into the most functionally important positions, thereby increasing a society's efficiency. However, the equalising function of meritocracy has been criticised. Rather than reducing inequality, meritocracy is seen as the cause of racial, economic and social inequality.

    Abstract: This book offers a selection of 13 case studies on how the notion of grounding helps illuminate philosophical discussions of our past with a special focus on debates of the Middle Ages. It thereby makes not only the case that the notion of grounding, which has become so widely debated in analytic metaphysics, has a long and venerable tradition, but also shows that this tradition has a lot to teach to contemporary philosophers of grounding. This is because the historical authors discussed in this volume – that is, Aristotle, Fazang, Boethius, Avicenna, Abelard, Aquinas, Scotus, Ockham, Buridan, Suárez, Leibniz, and others – suggested different types of non-efficient-causal explanations which are to be carefully distinguished. This volume illustrates how philosophy and history of philosophy can be mutually illuminating by showing that the terminology developed in the contemporary debate about grounding can help reconstruct philosophical discussions from Antiquity up to the Early Modern Period, and that these very discussions enrich, and in part challenge the contemporary debate about grounding.     Abstract: This book extends Alfred Schutz’s “On Multiple Realities” by describing the provinces of meaning of play, music, religious ritual, and African-American folkloric humor. Throughout these provinces, the author traces two themes: resilience and responsiveness. In resilience, individuals or communities run up against obstacles, imposed relevances, which they come to terms with, or give meaning to (in phenomenological parlance), by modifying, evading, overcoming, or accepting them. Responsiveness emerges from Schutz’s idea of making music together, which the author takes further by analyzing the mimetic encounter with the other and the asymmetries in listening to music, and, especially, by showing how the features of the cognitive style of music as a province of meaning affect sociality, disposing us to be more vulnerable and attentive to each other’s non-conceptual, musical meanings. This text appeals to upper-level undergraduate students and graduate students as well as to faculty in philosophy.

    Abstract: Sustainable (public and private) finance is closely interlinked with the Sustainable Development Goals (SDGs). The latter focus on enhancing the protection of both social and environmental assets at the local and global level, from the real economy and everyday life to financial markets and public policies, thereby laying the groundwork for a transition. Global sustainability challenges – including climate change, natural resource depletion, and rising inequality – are affecting the commercial environment and real economy in a way that presents both risks and opportunities for the private and public financial sectors. On the one hand, policymakers and investors (including banks and pensions funds) are increasingly recognizing the environment’s implications for the financial sector through both physical and transitional risks, producing impacts on financial services and products, not to mention corporate governance. On the other hand, governments and European and international institutions are aware of their sustainability-related responsibilities and the consequences of their actions. Both regulate and supervise financial markets but also use their budgetary and tax policies (e.g. carbon tax) and their participation in financial markets (e.g. green bonds and development banks) to overcome sustainability challenges. In turn, it addresses three key areas of state responsibility. First, it explores how mistakes of fact can influence the analysis of attribution in international practice. Second, it addresses the implications of mistakes of fact in identifying “breaches” of international law.     Abstract: The book shows that the Regulation pursues its objective of ensuring greater equality of competitive conditions on the EU´s Internal Market only by accepting new bureaucracy, establishing the need for complex and extensive assessments and raising considerable legal uncertainties as a result of undefined legal terms and comprehensive Commission discretion. The EU legislators, the Council and the European Parliament, in June 2022 adopted a new regulation that entered into force 12 January 2023: Regulation 2022/2560 on foreign subsidies distorting the internal market. This book analyses the regulation in more detail. To this end, after the brief introduction, its rationale and core contents are first presented. Then, its scope of application is to be explored in more detail, as the Regulation was criticised early on with regard to its compatibility with international law, which has an intense bearing on the substantive and personal scope of application of the Regulation. Subsequently the central regulatory concepts of the Regulation will be presented and then the specific rules for concentrations and public procurement procedures analysed. The conclusion will summarise the findings. In view of the likely backlash from powerful third countries, there is a risk of new distortions to the detriment of EU companies´ activities in third country markets.

    Abstract: Open access. This open-access book discusses vulnerability and the protection-inclusion dilemma of including those who suffer from serious poverty, severe stigma, and structural violence in research. Co-written with representatives from indigenous peoples in South Africa and sex workers in Nairobi, the authors come down firmly on the side of inclusion. In the spirit of leaving no one behind in research, the team experimented with data collection methods that prioritize research participant needs over researcher needs. This involved foregoing the collection of personal data and community researchers being involved in all stages of the research. In the process, the term ‘vulnerability’ was illuminated across significant language barriers as it was defined by indigenous peoples and sex workers themselves. The book describes a potential alternative to exclusion from research that moves away from traditional research methods. By ensuring that the research is led by vulnerable groups for vulnerable groups, it offers an approach that fosters trust and collaboration with benefits for the community researchers, the wider community as well as research academics. Those living in low-income settings, in dire situations that are summarized with the term ‘vulnerability’ know best what their problems are and which priorities they have. To exclude them from research for their own protection is a patronizing approach which insinuates that researchers and research ethics committees know best. The team from this book have shown that minimally risky and minimally burdensome research tailored towards the needs of highly marginalized and stigmatized communities can be scientifically valuable as well as inclusive and equitable. The sporting environment is not disconnected from major contemporary social issues: it constitutes a public space in which injustices can be denounced, but also the theater in which prejudices are perpetuated against various parties, such as athletes or workers. IHRL commonly addresses attacks on individual dignity and social justice issues by guaranteeing rights to individuals and offering them protection mechanisms.     Abstract: This book presents a new framework to improve the integration of exoskeletons in hemiparetic patients. The idea is to reduce potentially damaging compensatory strategies in the non-paretic leg, by ensuring a proper technology embodiment of the robotic exoskeletons in the nervous system. Upon reviewing control strategies for partial robotic exoskeletons applied to human gait, the book introduces robotic exoskeletons control algorithms, which were developed with the intention to promote gait symmetry by assisting the affected limb of hemiparetic patients according to the movement of the non-paretic leg. This new paradigm aimed at promoting the device's embodiment was expected to counteract the compensation mechanisms, which would become unnecessary and thus disappear. The control strategy relies on the gait phase estimation of the sound leg calculated using an adaptive frequency oscillator and was evaluated on post-stroke patients affected by hemiparetic gait, and the results are described in this book. All in all, this book offers a timely snapshot on control strategies for post-stroke robotic gait assistance. It also presents new findings concerning the role of robotic controllers in the embodiment of such devices, and their implications for new assistance paradigms for people with neurological gait disorders.

    Abstract: This book celebrates and explores some philosophical issues raised by the work of Alan Weir, who is Professor Emeritus at the University of Glasgow, having previously held positions at the Universities of Oxford, Edinburgh and Queen’s, Belfast. In a number of areas, Weir has elaborated strikingly original views which involve a radical departure from the mainstream. These include formalism in the philosophy of mathematics, and as well as naïve set theory, with a universal set, and a naïve theory of truth. In contrast to other contemporary defenders of the latter two theories, Weir rejects dialetheism and accepts classical rules for the logical connectives. He avoids contradictions by restricting certain structural inference rules, specifically some generalized versions of transitivity. In addition, Weir has developed radical versions of naturalism and physicalism (partly informed by his work on Quine) and perceptual realism. This collection includes contributions by a distinguished group of philosophers on Weir’s philosophy, as well as a memoir and a new essay on the philosophy of mathematics by Weir himself.

    Abstract: The aesthetics of law deals with the relationship between law and beauty by searching for aesthetic values in the law itself (an internal perspective), by finding material related to law in art and culture (an external perspective), and, lastly, by demonstrating the impact of legal norms on what can be broadly understood as beauty (law as a tool of aestheticization). Regarding all these phenomena, the aesthetics of law ultimately allows us to see the law more clearly and more profoundly. What is more, the law does not function, nor has it ever functioned, separately from its means of expression, which are incontrovertibly subject to aesthetic interpretation. If we think about law in this way, perceiving not only the message, but also the manner in which it is conveyed, the whole set of means and tools used, the perfection and beauty of the form, then we will see art in it. After all, the widely known and still applicable ancient maxim ius est ars boni et aequi equates law and art. This alone should be an argument for aesthetic reflection on the law, a field of endeavour that should never have been abandoned. The book’s twenty-three chapters, written by scholars from various countries and three continents, are thematically diverse. In them we present the manifestations of the aesthetics of law from an external perspective. If we accept a definition of the concept of law that is as broad as possible, not only as a synonym of a certain formalized normative system, but also including the process of its creation (legislation), its application and interpretation (jurisprudence), and even teaching on and research into it (doctrine), we can identify a wealth of aesthetic references in the law. A broadly understood aesthetics of law, approached solely from an external perspective, covers such disciplines as law and literature, the aesthetics of legal rhetoric, the trial as performance, the aesthetics of courthouse architecture, law in the fine arts, law in film, law and music, pictorial law, symbols of the law and legal symbols, symbols of the state and power, legal archaeology etc. The field of research is, therefore, wide. In addition to topics traditionally and obviously associated with the aesthetics of law, such as law and literature, law in the fine arts, and court rhetoric, there are chapters on e.g. legal ethics and trademarks. All authors share the belief that beauty in law is important, even when it is hidden in a caricature. Further, they argue for restoring the aesthetics of law to its proper place in philosophical and legal discourse, as doing so would yield a host of benefits for the addressees of law.

Among these issues is the one concerning the nature of the perceptual state itself – e. g. on the issue of whether the perceptual state, like its distal objects, is structured, for instance by possessing a spatial character. Other issues include those of whether at least aspects of the distal object are presented immediately to us visually, whether representation plays any (interesting) role in disjunctivist and naïve realist accounts of visual experience and the relationship among visual perception, attention and representation. The anthology includes a wide variety of positions on the subject of the roles of representations in visual perception, which would help to close the literature gap and will be of interest to scholars from all schools and trends of philosophy of mind.

    Abstract: It is a book made up of questions, some without certain answers, that attempts to open the reader's mind to new and, perhaps, futuristic scenarios. There are two diametrically opposed approaches to artificial intelligence today. On the one hand, there are the techno-pessimists who see only dystopian scenarios and experience technological progress with apprehension, emphasising the dangers, and on the other hand, there are the techno-optimists who, on the other hand, tend to overestimate the positive effects, going so far as to attribute almost thaumaturgic virtues to technological progress. Our approach is meant to be secular and scientific; the risks must not be concealed, nor must they be overestimated, just as the positive aspects must not be emphasised. And, in any case, as in any social phenomenon, the governance of processes and the definition of a system of rules and policies are the aspects that can create advantages or disadvantages and, above all, can determine who are the beneficiaries of the advantages and who have to bear the disadvantages. Like any new technology, this too can be dehumanising, but technology is a tool that depends on how it is used and by whom it is used. that of ethics is, therefore, a fundamental aspect. Therefore, one should neither be a techno-optimist nor a techno-pessimist, but should be aware that governing the economic and social structural changes that the advent of artificial intelligence will cause will be crucial to ensure prosperity for future generations and to avoid negative and even apocalyptic scenarios. So no futurist dystopias! Humanity has so far always been able to govern technological progress, it certainly has the potential to govern what some have called 'the Final Invention', but it will only succeed if it is able to understand the peculiarities of this new process of technological development and give it ethical content.The book provides a thoughtful review of the relationship between artificial intelligence and ethics, approaching the issue from different perspectives: philosophical, technological, economic and legal. It then reviews quantitative research on predictors of recidivism versus desistance of young offenders in Buenos Aires, Argentina, based on following up over 100 young offenders during a two-year statutory monitoring period. Numerous factors are identified that predict recidivism: family, educational, social, community, demographic, offence history, substance use history. It then presents qualitative research based on offenders’ narratives, using extensive verbatim quotations, that explain their recidivism versus desistance. Finally, it reviews research on the prevention of recidivism of young offenders and makes recommendations based on the quantitative and qualitative analyses.
