    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective. With Palgrave, he previously published Electronic Monitoring: Tagging Offenders in a Culture of Surveillance (2020) and Europe in Prisons: Assessing the Impact of European Institutions on National Prison Systems (2017, co-edited with Luc Robert). .

    Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

Increasing life expectancy in Europe entails a remodelling of career development and life course, marked by discontinuities and changing professional activities.     Abstract: Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.     Abstract: This book provides a comparative perspective on one of the most intriguing developments in law: the influence of basic rights and human rights in private law. It analyzes the application of basic rights and human rights, which are traditionally understood as public law rights, in private law, and discusses the related spillover effects and changing perspectives in legal doctrine and practice. It provides examples where basic rights and human rights influence judicial reasoning and lead to changes of legislation in contract law, tort law, property law, family law, and copyright law.     Abstract: This work deals with the temporal effect of judicial decisions, and more specifically, with the hardship caused by the retroactive operation of overruling decisions. By means of a jurisprudential and comparative analysis, the book explores several issues created by the overruling of earlier decisions. Overruling of earlier decisions, when it occurs, operates retrospectively with the effect that it infringes the principle of legal certainty through upsetting any previous arrangements made by a party to a case under long standing precedents established previously by the courts. On this account, in the recent past, a number of jurisdictions have had to deal with the prospect of introducing in their own systems the well-established US practice of prospective overruling whereby the court may announce in advance that it will change the relevant rule or interpretation of the rule but only for future cases. However, adopting prospective overruling raises a series of issues mainly related to the constitutional limits of the judicial function coupled with the practical difficulties attendant upon such a practice. This book answers a number of the questions raised by this practice. It makes use of the great reservoir of foreign legal experience that furnishes theoretical and practical ideas from which national judges may draw their knowledge and inspiration in order to be able to advise a rational method of dealing with time when they give their decisions

    Abstract: Is there universalism of human rights? If so, what are its scope and limits? This book is a doctrinal attempt to define universalism of human rights, as well as its scope and limits. The book presents tests of universalism on international, regional and national constitutional levels. It is maintained that universalism of human rights is both a concept and a normative reality. The normative character of human rights is scrutinized through the study of international and regional agreements as well as national constitutions. As a consequence, limitations of normativity are identified, usually on the international level, and take the form of exceptions, reservations, and interpretations. The book is based on the General and National Reports which were originally presented at the 18th International Congress of the International Academy of Comparative Law in Washington D.C. 2010.

    Abstract: This book is a comparative study of the exclusion of illegally gathered evidence in the criminal trial , which includes 15 country studies, a chapter on the European Court of Human Rights, and a comparative synthetic conclusion. No other book has undertaken such a broad comparative study of exclusionary rules, which have now become a world-wide phenomenon. The topic is one of the most controversial in criminal procedure law, because it reveals a constant tension between the criminal court’s duty to ascertain the truth, on the one hand, and its duty to uphold important constitutional rights on the other, most importantly, the privilege against self-incrimination and the right to privacy in one's home and one's private communications. The chapters were contributed by noted world experts on the subject for the XVIII Congress of the International Academy of Comparative Law in Washington in July 2010.

    Abstract: This compilation of original essays by an international cast of economists, regulators and industry practitioners analyzes some of the major issues now facing postal and delivery services throughout the world as competition from information and communication technologies (ICT) has increased. Competition has become increasingly important in the postal sector for some time in the form of alternative entrants providing mail delivery. However, the competition from ICT in the form of email and instant messaging, the Internet, Facebook and other forms of social networking and portable wireless devices such as the iPad and Kindle may be even more significant. Mail volumes are falling and the economies of scale that have made possible daily deliveries to every address are being eroded. This book assesses volume these declines resulting from this so-called ‘eSubstituion’ and looks at the ways the postal sector can adapt to the rapid changes resulting from ICT. The impact of electronic invoicing on transactions mail, and the impact on bulk mail of electronic forms of advertising are examined. Strategies, including pricing and access policies, are discussed in the context of the increasing impact of ICT. A rethinking of the role of mail in an electronic age is taking place and this book provides the cutting-edge of this rethinking and the attempts of POs to reinvent themselves while continuing to meet the public’s expectation of continuing ubiquitous daily deliveries of traditional mail products.

    Abstract: Since the turn of the Millennium, world-wide initiatives from the private sector have turned the regulatory environment for food businesses upside down. For the first time in legal literature this book analyses private law initiatives relating to the food chain, often referred to as private (voluntary) standards or schemes.Private standards are used to remedy flaws in legislation in order to reach higher levels of consumer protection than the ones chosen by the EU legislature and to manage risks and liability beyond the traditional limits of food businesses. We see that litigation is no longer solely framed by legislative requirements, but ever more by private standards such as GlobalGAP, BRC, IFS, SQF and ISO. These private standards incorporate public law requirements thus embedding them in contractual relations and exporting them beyond the jurisdiction of public legislators. This book also addresses how private standards play a role in defining specific markets of growing importance. It is noted that organic standards have found an interesting symbioses with public law.Another development on this topic is that food businesses are inspected more often by private auditors than by public inspectors. Effects in terms of receiving or being denied certification far outweigh public law sanctions. In short private law has changed an entire legal infrastructure for the food sector. It emerges as competing with the public law regulatory infrastructure.This book is of interest to all who concern themselves with food law legislation and litigation and the evolving role of private standards on changing the landscape of food chains and innovation

Die Beiträge dieses Bandes stellen mögliche Ursachen, den unterschiedlichen Verlauf, die verschiedenen Folgen sowie die Behandlungsmöglichkeiten für die weiblichen oder männlichen Jugendlichen dar.     Abstract: The international carriage of goods by sea has been regulated by international conventions. These include the "International Convention for the Unification of Certain Rules of Law relating to Bills of Lading" ("Hague Rules"); the "Protocol to Amend the International Convention for the Unification of Certain Rules of Law Relating to Bills of Lading" ("Visby Rules"); and the "UN Convention on the Carriage of Goods by Sea." They were adopted in 1924, 1968 and 1978 respectively and the transport industry's commercial needs have since substantially changed. Furthermore the advent of subsequent regimes has resulted in the uniformity in the carriage of goods by sea once provided by the Hague Rules being lost. In order to update and modernize existing regimes the "UN Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea" ("Rotterdam Rules") was adopted on December 11, 2008 by the UN General Assembly and opened for signature on September 23, 2009. Since then drafters of the Rotterdam Rules, academics and practitioners have been publicizing, discussing, and evaluating the Rules. This book is an effort to further explore those same goals.

    Abstract: The introduction of the 'Common Consolidated Corporate Tax Base' as a means for an efficient and equitable taxation of multinational enterprises in Europe represents the most important issue of European business taxation. Starting in 2001, the Commission and the Member States have cooperated in order to develop an innovative technique for the measurement and the allocation of business profits within the European Union. This venture is not only the most ambitious political project of the current European Commission, it also challenges traditional legal and economic concepts of business taxation. This book contains the proceedings of an International Tax Conference, organised under the auspices of the German Presidency in the European Union and designed in cooperation with the Centre for European Economic Research (Mannheim) and the Max Planck Institute for Intellectual Property, Competition and Tax Law (Munich) including presentations from European and American academics and tax practitioners.

    Abstract: The book explores recent developments in the international and national prosecution of persons accused of committing war crimes and crimes against humanity. It considers the relationship between national and international law, science and practice, with emphasis on the emerging principle of universial jurisdiction and the effect of 'the war on terror' on legal norms.
    Abstract: The demand for accountability for human rights violations is heard throughout the world as never before. This volume explores current developments in the prosecution of human rights crimes on the national and international level. Experts from several countries discuss relevant topics from the academic debate, describe the practice in different countries, and analyze problems which have arisen in this new and exciting field of law. They strike a balance after the first years of the International Criminal Court and a growing universal jurisdiction practice and give the reader a present-day overview of attempts to bring to justice major figures like Augusto Pinochet and Donald Rumsfeld as well as lesser known ones. Emphasis is put on the emerging principle of universal jurisdiction and the effect of the `war on terror` on legal norms. While the latter threatens to weaken and, in some respect, destroy long standing principles of international law, the developing practice of universal jurisdiction offers new resources for dealing with international crimes. The book examines the tension between these two phenomena and its meaning for international criminal law and the implementation of human rights. The contributors include Kai Ambos, Jörg Arnold, Christopher Keith Hall, Scott Horton, Florian Jessberger, Lorna McGregor, Michael Ratner, Nigel S. Rodley and Naomi Roht-Arriaza.

    Abstract: An International Expert Workshop on the Right to Social Security was held in April 2005 at the German Institute for Human Rights, whose purpose was to highlight specific issues of the right to social security which should be addressed by the Committee when drafting a General Comment on article 9. The results of this workshop are published in this volume providing an insight into the current challenges on social security as a human right.
    Abstract: Article 9 of the International Covenant on Economic Social and Cultural Rights on the right to social security is the shortest article in the entire Covenant and for that reason alone highly abstract and vague. A comprehensive analysis of the article 9 is still lacking, not least because it is widely regarded as a Pandora's box better not to be opened. Experience has shown that the quality of the state reporting procedure is greatly improved once the Committee on Economic Social and Cultural Rights has adopted a General Comment. Thus, it seems very desirable to close this gap. For the reason, an International Expert Workshop on the Right to Social Security was held in April 2005 at the German Institute for Human Rights, whose purpose was to highlight specific issues of the right to social security which should be addressed by the Committee when drafting a General Comment on article 9. The results of this workshop are published in this volume providing an insight into the current challenges on social security as a human right.

    Abstract: Tort law interacts strongly with public regulation. Is the breach of a statutory duty in itself a sufficient basis for liability? In some fishing communities, almost sixty percent of jobs are linked to fishing and in many coastal areas there are few alternative employment opportunities for fishers. This conference proceedings analyses the social issues and policy challenges that arise from fisheries adjustment policies, and how OECD member countries are meeting those challenges.

    Abstract: These workshop proceedings assess the third party liability and compensation mechanisms that would be implemented by participating countries in the event of a nuclear accident taking place within or near their borders. To do so, two fictitious accident scenarios were developed: one involving a fire in a nuclear installation located in the Slovak Republic and resulting in the release of significant amounts of radioactive materials off-site, and the other a fire on board a ship transporting enriched uranium hexafluoride along the Danube River. The first scenario was designed to involve the greatest possible number of countries, with the second being restricted to countries with a geographical proximity to the Danube. These proceedings contain the papers presented at the workshop, as well as reports on the discussion sessions held.

    Abstract: Limiting Institutions examines the security threats in Eurasia and the role of institutions in the post-Cold War international environment. It looks at both the crucial aspect of foreign policy as well as a theoretical area of security studies and its impact in the former Soviet States including Russia, Belarus, Armenia, the Ukraine and Moldova. The first section addresses the important and varied range of security threats to this area of the world, and examines the range of responses open to European countries and to the United States. Threats such as ethnic conflict, transnational crime, and environmental and energy security issues are examined in depth. The second section addresses an important theoretical issue, namely the role that international institutions can perhaps play as arbiters of conflict and facilitators of cooperation in a region abutting the European political space. The role of the OSCE, NATO, the European Union, the Commonwealth of Independent States and the Black Sea Economic Cooperation Council are consequently examined closely. The contributors are scholars with solid international reputations, and the book will be of benefit to students of international relations and conflict analysis

    Abstract: Until the late 1960s, most Western scholars studying the history, culture, social and political life and economy of Russia and the Soviet Union, paid scant attention to the participation and experience of women. The multifarious ways in which gender roles and perceptions of gender were influenced by and in turn influenced the heterogeneous cultures of the Soviet empire were largely ignored. However, this neglect has slowly been rectified and now the study of women and gender relations has become one of the most productive fields of research into Russian and Soviet society. This volume demonstrates the originality and diversity of this recent research. Written by leading Western scholars, it spans the last decade of tsarist Russia, the 1917 revolutions and the Soviet period.
