    Abstract: Mai Sato examines public attitudes to the death penalty in Japan, focusing on knowledge and attitudinal factors relating to support for, and opposition to, the death penalty. She uses a mixed-method approach and mounts quantitative and qualitative surveys to assess Japanese death penalty attitudes. The author’s main findings show that death penalty attitudes are not fixed but fluid. Information has a significant impact on reducing support for the death penalty while retributive attitudes are associated with support. This book offers a new conceptual framework in understanding the death penalty without relying on the usual human rights approach, which can be widely applied not just to Japan but to other retentionist countries.     Abstract: "Ten years ago, in the wake of massive crimes in central Africa and the Balkans, the first permanent international criminal court was established in The Hague despite resistance from some of the world's most powerful states. In the past decade, the court has grown from a few staff in an empty building to a bustling institution with more than a thousand lawyers, investigators, and administrators from around the world. Despite its growth and the backing of more than 120 nations, the ICC is still struggling to assert itself in often turbulent political crises. The ICC is generally autonomous in its ability to select cases and investigate crimes, but it is ultimately dependent on sovereign states, and particularly on the world's leading powers. These states can provide the diplomatic, economic, and military clout the court often needs to get cooperation-and to arrest suspects. But states don't expend precious political capital lightly, and the court has often struggled to get the help it needs. When their interests are most affected, moreover, powerful states usually want the court to keep its distance. Directly and indirectly, they make their preferences known in The Hague.     Abstract: This book contains a collection of essays by leading experts linked to the outstanding characteristics of the scholar in honour of whom it is published, Tullio Treves, who combines his academic background with his practical experiences of a negotiator of international treaties and a judge of an international tribunal. It covers international public and private law related to international courts and the development of international law.Under Article 38 of its Statute, the International Court of Justice can apply judicial decisions only as a "subsidiary means for the determination of rules of law. However, there are many reasons to believe that international courts and tribunals do play quite an important role in the progressive development of international law. There are a number of decisions which are inevitably recalled as the first step, or a decisive step, in the process of the formation of a new rule of customary international law. In these cases, can the judge be considered as a subsidiary of others? Are these cases compatible with the common belief that a judge cannot create law? Is this a peculiarity of international law, which is characterized by the existence of several courts but the lack of a legislator? Do decisions by different courts lead to the consequence of a fragmented international law? This volume provides the reader with an elaboration of various questions linked to the legislative role of courts.In their choices of subjects, some contributors have taken into account the general aspects of the development of international rules through court decisions or specific sectors of international law, such as human rights, international crimes, international economic law, environmental law and the law of the sea.     Abstract: The more international law, taken as a global answer to global problems, intrudes into domestic legal systems, the more it takes on the role and function of domestic law. This raises a separation of powers question regarding law-making powers. In this book the author considers that specific issue.In contrast to other studies on domestic courts applying international law, the author’s constitutional orientation focusses on the presumptions concerning the distribution of state power. He collects and examines relevant decisions regarding treaties and customary international law from four leading legal systems, the US, the UK, France, and the Netherlands. Those decisions reveal that institutional and conceptual allegiances to constitutional structures render it difficult for courts to see their mandates and powers in terms other than exclusively national. What follows is a constitutional asymmetry between international law and national law generating an inevitable dualism which cannot necessarily be overcome by express constitutional provisions accommodating international law. The separation of powers thus frames the two principal horizons for any future, practicable attempts at integrating of the two legal orders. Either established concepts of constitutional law and constitutionalism will have to be revised, or what international law may do within a municipal legal system will have to be recalculated. This book offers new insight and new approaches in dealing with international law questions before domestic courts. It is an interesting work of reference and a basis for further debate on this topic among academics and practitioners in the fields of international and constitutional law.     Abstract: Little has been written about the legal position and conditions of detention of persons detained by international criminal tribunals, particularly as regards their internal legal position (their rights and duties inside the remand facility). The primary purpose of this book is to set out the law governing the detention of persons detained under the tribunals jurisdiction. The book provides a detailed account of this area of international criminal law. It sets out the applicable law, including the laws underlying principles, and focuses on a number of specific procedural and substantive legal issues. As to procedural issues, it examines the available complaints and disciplinary procedures as well as procedures applicable to the designation of States for the enforcement of the tribunals sentences. In respect of substantive law, it examines the detainees right to contact with the outside world, including contact with their relatives, with their lawyers and with the media. The book will be an extremely useful guidance for practitioners in applying the law and principles of the tribunals detention law, particularly because it is the first monograph written on the topic.

    Abstract: Counterclaims, the right of a State sued by another State to bring its own counter-suit in the course of the same trial, may offer an opportunity to mitigate the effects of the original suit and help to resolve disputes between States that have more than one aspect. In recent years, counterclaims have been frequently presented at the International Court of Justice (ICJ). This book examines the counterclaims presented at the ICJ and at its predecessor, the Permanent Court of International Justice (PCIJ), during its 65 years of existence.     Abstract: Hauptbeschreibung Jedes Rechtsgebiet hat sein Grenzrecht. Ein Internationales Öffentliches Recht (mit den Teilgebieten Internationales Verfassungsrecht und Internationales Verwaltungsrecht) ist genauso erforderlich wie ein Internationales Privatrecht oder ein Internationales Strafrecht. Deutsches Öffentliches Recht muss die Frage seines Wirkungskreises definieren und es muss klären, in welchem Umfang ausländisches öffentliches Recht im eigenen Wirkbereich zugelassen wird.Jörg Menzel erarbeitet die Grundlagen und Themen eines Internationalen Öffentlichen Rechts und liefert damit die erste Gesamtdarstellung auf diesem Gebiet. Er widmet sich nach ausführlicher Grundlegung den überstaatlichen (völker- und europarechtlichen) Vorgaben und sodann im Einzelnen dem deutschen Internationalen Verfassungs- und Verwaltungsrecht. Hierbei verfolgt er einen Ansatz, der auf dem Prinzip des offenen Staates und der daraus resultierenden grundsätzlich positiven Grundeinstellung der Rechtsordnungen zueinander beruht, die auch das öffentliche Recht nicht ausspart. Der Autor zeigt auf, dass Internationales Privatrecht und Internationales Öffentliches Recht weniger gegensätzlich sind als häufig kolportiert, weil die ihnen zugrunde liegenden Grundgedanken nicht verschieden sind. Er geht den Strukturen eines Internationalen Öffentlichen Rechts ebenso nach wie vielfältigen Details und weist nach, dass es im Öffentlichen Recht Prinzipien zu diskutieren gibt - auch wenn dort die Strukturen zum Teil anders sind als im IPR.

    Abstract: This systematic analysis of State complicity in international law focuses on the rules of State responsibility. Combining a theoretical perspective on complicity based on the concept of the international rule of law with a thorough analysis of international practice, Helmut Philip Aust establishes what forms of support for wrongful conduct entail responsibility of complicit States and sheds light on the consequences of complicity in terms of reparation and implementation. Furthermore, he highlights how international law provides for varying degrees of responsibility in cases of complicity, depending on whether peremptory norms have been violated or special subject areas such as the law of collective security are involved. The book shows that the concept of State complicity is firmly grounded in international law, and that the international rule of law may serve as a conceptual paradigm for today's international legal order.

    Abstract: "The book looks at the outreach and communication strategies employed by internationalised courts to try to understand the wider impact of international justice. This book critically examines the role of outreach within international justice focusing specifically on the role of outreach at the Special Court for Sierra Leone (SCSL). It contributes to understanding of the relationship between international courts and the affected populations; an area currently underexplored and little understood. The assumption that justice brings peace underpins much of the thinking, and indeed action, of international justice, yet little is known if this is actually the case. Significant questions surrounding the link between peace and justice remain: do trials deter would-be war criminals; is justice possible for the most heinous crimes; can international justice replace local justice? This book explores these questions in relation to recent developments in international justice that have both informed and shaped the creation of the hybrid tribunal in Sierra Leone. Through empirical analysis, 〈EM〉Transitional Justice, Peace and Accountability〈/EM〉, answers these questions and provides an insight into individual and community perceptions of international justice.This book will be of much interest to students of transitional justice, war crimes, peace and conflict studies, human rights, international law, and IR in general"--

    Abstract: This book explores the contentious topic of how collective and community issues should be protected and enforced in international law. Elena Katselli Proukaki takes a detailed look at the issue of third-State countermeasures, and considers the work the International Law Commission has done in this area. The volume addresses both the theory and practice of third-State countermeasures within international law. Critically reviewing the conclusions of the International Law Commission on the non-existence of a right to third-State countermeasures, it includes consideration of examples of State practice not previously covered in the literature of this topic. In taking a thorough view of the issues involved the author identifies concerns about third-State countermeasures which remain unanswered, and considers the possible legal ramifications arising from a clash between a right to third-State countermeasures and obligations arising from other international norms. Die Aufwertung der Menschenrechtsidee ist allerdings nicht ohne Ambivalenz, denn gerade im Kontext globaler Auseinandersetzungen wird sie allzu gerne zur hegemonialen Selbstermächtigung missbraucht. Das Buch widmet sich diesem Problem und fragt nach einer interkulturell sensiblen Begründung und institutionellen Ausgestaltung des menschenrechtsbezogenen Völkerrechts. Es wird einerseits in rechtssoziologischer Perspektive argumentiert, dass die zunehmend transnational organisierte Menschenrechtsbewegung Ausdruck eines die Evolution des Rechts vorantreibenden Konfliktlernens ist, indem Unrechtserfahrungen in Autonomieansprüche transformiert und auf die Struktur des Rechts bezogen werden. Andererseits ist die Genese und Durchsetzung von Menschenrechten in rechtssystematischer Perspektive als eine von hegemonialen Missbräuchen bedrohte Herrschaftspraxis zu beschreiben, weshalb befürwortet wird, Menschenrechtspolitiken nicht nur zu konstitutionalisieren, sondern sie auch zu demokratisieren.
