    Abstract: "Since the 1980s the study of genocide has exploded, both historically and geographically, to encompass earlier epochs, other continents, and new cases. The concept of genocide has proved its worth, but that expansion has also compounded the tensions between a rigid legal concept and the manifold realities researchers have discovered. The legal and political benefits that accompany genocide status have also reduced complex discussions of historical events to a simplistic binary--is it genocide or not--a situation often influenced by powerful political pressures. Genocide addresses these tensions and tests the limits of the concept in cases ranging from the role of sexual violence during the Holocaust and state-induced mass starvation in Kazakh and Ukrainian history to what the Armenian, Rwandan, and Burundi experiences reveal about the uses and pitfalls of reading history and conducting politics through the lens of genocide. Contributors examine the pressures that great powers have exerted in shaping the concept; the reaction Raphaël Lemkin, originator of the word "genocide," had to the United Nations' final resolution on the subject; France's long-held choice not to use the concept of genocide in its courtrooms; the role of transformative social projects and use of genocide memory in politics; and the relation of genocide to mass violence targeting specific groups. Throughout, this comprehensive text offers innovative solutions to address the limitations of the genocide concept, while preserving its usefulness as an analytical framework."--

    Abstract: Over the last two decades, fighting modern slavery and human trafficking has become a cause célèbre. Yet large numbers of researchers, non-governmental organizations, trade unions, workers, and others who would seem like natural allies in the fight against modern slavery and trafficking are hugely skeptical of these movements. They object to how the problems are framed, and are skeptical of the "new abolitionist" movement. Why? This book tackles key controversies surrounding the anti-slavery and anti-trafficking movements head on. Champions and skeptics explore the fissures and fault lines that surround efforts to fight modern slavery and human trafficking today. These include: whether efforts to fight modern slavery displace or crowd out support for labor and migrant rights; whether and to what extent efforts to fight modern slavery mask, naturalize, and distract from racial, gendered, and economic inequality; and whether contemporary anti-slavery and anti-trafficking crusaders' use of history are accurate and appropriate

    Abstract: »Schuld« ist ein Basisbegriff in vielen Wissenschaftszweigen. Offensichtlich ist die Funktion von Schuld in der Rechtswissenschaft, wo sie einerseits im Strafrecht und andererseits im Zivilrecht das Fundament für die Rechtsmaterie bildet. In der Philosophie befasst sich vor allem die Ethik mit der wie auch immer definierten Schuld. Die antiken Tragödien drehen sich um verschuldetes wie unverschuldetes Unheil. In der Geschichtswissenschaft wird etwa die Frage nach der Kriegsschuld seit jeher intensiv erörtert. In der Wissenschaftsgeschichte wird über die mit wissenschaftlichen Entdeckungen einhergehende Schuld disputiert. Soziologie, Kunst- und Kulturwissenschaften befassen sich mit in den heutigen pluralistischen Gesellschaften medial und diskursiv präsenten Formen von Schuld. In der Medizin und in den Naturwissenschaften wird die Quantifizierung und Messbarkeit von Schuld sowie ihr eventueller evolutionärer Vorteil erforscht. Und in der Theologie ist die persönliche Schuld Maßstab für die Beurteilung des Menschen am dies irae. Diese Wissensfelder werden in dem vorliegenden Band miteinander in Beziehung und somit ein fruchtbarer interdisziplinärer Diskurs ins Werk gesetzt.

    Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: In a book that confronts our society's obsession with violence, Maria Tatar seeks the meaning behind one of the most disturbing images of twentieth-century Western culture: the violated female corpse. This image is so prevalent in painting, literature, film, and, most recently, in mass media, that we rarely question what is at stake in its representation. Tatar, however, challenges us to consider what is taking place - both artistically and socially - in the construction and circulation of scenes depicting sexual murder.     Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: This volume in honour of Stephen Ellis is a follow-up to the public presentation of his book on the history of organised crime in Nigeria This Present Darkness (Hurst, 2016) at the University of Lagos, Nigeria on 28 October 2016. In addition to four papers, and a book review presented at this colloquium, other contributions about crime in Nigeria have been added, written by Nigerian authors. In July 2015 Stephen died, and he has worked on This Present Darkness almost to his last moments, as a senior researcher of the African Studies Centre in Leiden.     Abstract: Angesichts moderner Medizintechnik verfassen immer mehr Menschen in Deutschland eine Patientenverfügung, damit sie im Zweifelsfall sterben dürfen. Allerdings ist die Patientenverfügung weit weniger Ausdruck eines autonomen Patientenwillens, als sie scheint. Dieser Band zeichnet basierend auf zahlreichen Gesprächen aus kulturanthropologischer Perspektive die Entstehungsgeschichten einzelner Patientenverfügungen nach. Dabei werden hintergründige Wirkmechanismen offengelegt, vor denen sich Individuen in einem komplexen Gefüge aus Interaktionen, Wissenshierarchien und gesellschaftlichen Verhaltensnormen als präventiv handelnde Akteure konstituieren. Der Fokus liegt auf potenziellen Bruchstellen im "Gemeinschaftsprojekt Patientenverfügung", für die die Autorin konstruktive Lösungsansätze entwickelt. Quelle: Verlagsangabe.

    Abstract: Employers employ various means to obstruct or prevent the election of works councils. This book discusses why the current protection regulations in favour of the election of works councils — especially those incorporated into the Works Constitution Act and the election regulations — are insufficient in practice, even though they do contain a sufficient basis for prohibition in theory. First, it examines the basics of the electoral process and the role of the parties involved (the works council, the employers and the labour unions). Subsequently, the book gives an outline of the respective means by which employers influence the election of works councils. In addition to examining current possible defence measures against such obstruction, the author discusses both prospective legislative and factual measures, such as the formation of specialised public prosecution offices and the extension of special protection against unfair dismissal.
    Abstract: In der betrieblichen Praxis wenden Arbeitgeber diverse Maßnahmen an, um die Wahl eines Betriebsrats zu be- oder verhindern. Dieses Werk erörtert, warum die gegenwärtige Ausgestaltung juristischer Schutzvorschriften – insbesondere im Betriebsverfassungsgesetz und in der Wahlordnung – zugunsten der Betriebsratswahl nicht ausreicht, obwohl diese in ihrer abstrakten Geltung ein hinreichendes Verbot beinhalten. Dazu werden zunächst grundlegend der Wahlablauf sowie die Rolle der einzelnen Akteure, mithin des Betriebsrats, des Arbeitgebers und der Gewerkschaft beleuchtet. Weiterhin erfolgt ein Überblick über einzelne Maßnahmen des Arbeitgebers zur Beeinflussung der Betriebsratswahl. Neben der Untersuchung gegenwärtig möglicher Abwehrhandlungen werden ebenso gesetzgeberische und faktische Maßnahmen für die Zukunft diskutiert, wie u.a. die Einrichtung von Schwerpunktstaatsanwaltschaften und die Ausweitung des besonderen Kündigungsschutzes.

    Abstract: In der rechtsvergleichenden Studie arbeitet der amerikanische Historiker heraus, in welch starkem Umfang die rassistischen Gesetze des NS-Staates durch die Einwanderungsgesetzgebung der USA und die rassistischen Gesetze der US-Südstaaten beeinflusst wurden. Rezension: Mit dieser sehr gut lesbaren, sorgfältig gearbeiteten rechtsvergleichenden Spezialstudie liefert der amerikanische Rechtshistoriker eine kleine Sensation. In einer sehr differenzierten Argumentation arbeitet Whitman heraus, dass die Rassengesetzgebung des NS-Staats in erheblicher Weise durch amerikanische Vorbilder, die auch einem Zeitgeist entsprachen, beeinflusst wurde. Die gegen die schwarze Bevölkerung gerichtete Gesetzgebung der US-Südstaaten wurde von massgeblichen NS-Juristen ebenso aufmerksam studiert wie die diskriminierenden Einwanderungsgesetze, die besonders Ost- und Südeuropäer betrafen. Whitman, der sein möglicherweise überraschtes (amerikanisches) Publikum immer wieder direkt anspricht, zieht Parallelen und zeigt Verbindungslinien auf, arbeitet jedoch auch deutlich die Unterschiede heraus: In den USA mündeten die rassistischen Gesetze eben nicht in einen Genozid und der liberale Rechtsstaat setzte ihnen Grenzen.
