    Kurzfassung: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

Presenting the complete translated and annotated text of the Inquisition trial of Crispina Peres, an African woman born in the Guinea-Bissau region, of a Portuguese father and an African mother, it documents the Portuguese Inquisition's religious persecution of Africans on African soil. Set in a slave port in 17th century West Africa, the trial focuses on the worldview of an African woman accused of engaging in African rites and witchcraft, who is imprisoned and brought before Inquisitioners in Lisbon. It highlights her resourcefulness, resilience and spirited defence of her innocence, providing precious details on her life, household, work, health and social and commercial networks in this understudied African region.

    Kurzfassung: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Kurzfassung: "To survive, let alone flourish, we need to be sure of - securely tied to - at least one other person. We also need to be sure of our general acceptance within the wider social world. This book explores the normative implications of taking our core social needs seriously. Chapter 1 sketches out what those needs are, and Chapter 2 shows that they ground a fundamental, but largely neglected human right against social deprivation. Chapter 3 then argues that this human right includes a right to sustain the people we care about, and that often, when we are denied the resources to sustain others, we endure social contribution injustice. Chapters 4 - 6 explore the tension between our needs for social inclusion and our needs for interactive and associative freedom, showing that social inclusion must take priority. While Chapters 5 and 6 defend a narrow account of freedom of association, Chapter 7 shows that the moral ballgame changes once we have made morally messy associative decisions. Sometimes we have rights remain in associations that we had no right to form. Finally, Chapter 8 exposes the distinct social injustices that we do to people whom we deem to be socially threatening. Overall, the book identifies ways to change our social and political practices, and our personal perspectives, to better honour the fact that we are fundamentally social beings."

    Kurzfassung: Jon Yablonski erklärt in diesem Buch, wie UX-Designerinnen Grundprinzipien aus der Psychologie nutzen können, um eine bessere User Experience zu generieren. Anstatt Benutzerinnen zu zwingen, sich an das Design eines Produkts (z. B. App) anzupassen, hilft dieser praktische Leitfaden dabei, das Design danach auszurichten, wie Benutzer*innen sich verhalten und mit digitalen Schnittstellen interagieren, um ihre Nutzung einfacher und angenehmer zu gestalten. Dabei greift der Autor auf bekannte Regeln und Prinzipien aus der psychologischen Forschung zurück und überträgt sie in die UX-Design-Welt. So sprechen wir beispielsweise einer App mit schönem Design mehr Kompetenz zu und verzeihen ihr eher Fehler, oder erwarten von einem Onlineshop, dass der Kaufprozess so funktionieren, wie wir es von anderen Shops gewohnt sind. Außerdem können wir eine große Menge an Informationen besser speichern und verarbeiten, wenn sie in Chunks gegliedert sind, weshalb etwa Texte, die mithilfe von Überschriften und Absätzen gegliedert sind, eine höhere UX generieren als ein langer Fließtext, der die User überfordert. Nachdem der Autor die verschiedenen Prinzipien erklärt und an anschaulichen, einfach nachzuvollziehenden Beispielen demonstriert hat, zeigt er, wie man diese Prinzipien praktisch für die eigene Arbeit und im Team nutzen kann. Zusätzlich geht er auch auf die ethischen Komponenten ein (Beispiele: Endlos-Scrollen, Like-Button).

    Kurzfassung: Constituent power is the power to create new constitutions. Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have reverted to it to defend the legality of transforming the constitutional order through procedures not contemplated in the constitution's amendment rule, but considered participatory enough to be equivalent to 'the people in action', and these0attempts have sometimes been sanctioned by courts. 0

    Kurzfassung: This volume provides the first comprehensive analysis of international legal debates between 1955 and 1975 related to the formal decolonization process. It is during this era, couched between classic European imperialism and a new form of US-led Western hegemony, that fundamental legal debates took place over a new international legal order for a decolonised world. The book argues that this era presents in essence a battle, a battle that was fought out in particular over the premises and principles of international law by diplomats, lawyers, and scholars. In a moment of relative weakness of European powers, 'newly independent states' and international lawyers from the South fundamentally challenged traditional Western perceptions of international legal structures engaging in fundamental controversies over a new international law. The legal outcomes of this battle have shaped the world we live in today. Contributions from a global set of authors cover contemporary debates on concepts central to the time, such as self-determination, sources and concessions, non-intervention, wars of national liberation, multinational corporations, and the law of the sea. They also discuss influential institutions, such as the United Nations, International Court of Justice, and World Bank. The volume also incorporates contemporary regional approaches to international law in the 'decolonization era' and portraits of important scholars from the Global South.

    Kurzfassung: This title examines the concept of intersectional discrimination and why it has been difficult for jurisdictions around the world to redress it in discrimination law. 'Intersectionality' was coined by Kimberlé Crenshaw in 1989. 30 years since its conception, the term has become a buzzword in sociology, anthropology, feminist studies, psychology, literature, and politics. But it remains marginal in the discourse of discrimination law, where it was first conceived. Traversing its long and rich history of development, the book explains what intersectionality is as a theory and as a category of discrimination. It then explains what it takes for discrimination law to be reimagined from the perspective of intersectionality in reference to comparative laws in the US, UK, South Africa, Canada, India, and the jurisprudence of the European Courts and international human rights treaty bodies.

In 'Robo Sapiens Japanicus', Jennifer Robertson casts a critical eye on press releases and public relations videos that misrepresent robots as being as versatile and agile as their science fiction counterparts. An ethnography and sociocultural history of governmental and academic discourse of human-robot relations in Japan, this work explores how actual robotshumanoids, androids, and animaloids are 'imagineered' in ways that reinforce the conventional sex/gender system and political-economic status quo.

    Kurzfassung: International organizations (IOs) matter. This book uncovers the regular working world of IOs, examining whether, to what extent, and how these 'global governing bodies' can act independently of the will of states. This book explores this issue by asking who or what shapes their decisions; how and when decisions are made; how players interact within an IO; and how the interactions vary across IOs. The Working World of International Organizations examines three working groups in the higher echelons of IOs - state representatives, as proxy of states, serving in the Executive Boards or General Councils, chief officers of IOs, and the staff of the permanent secretariat. The book demonstrates that none of them are unified; in each there are contested ideas about strategy and appropriate projects, and analyses their interactions to explain who is able to shape or influence decisions. Six representative IOs are studied to identify the relevant critical determinants that shape the behaviour of players. The volume explores how these players have an impact over three dilemmas that are common to all IOs: priority and agenda setting, financing, and the centralization or decentralization of operations.

    Kurzfassung: "Human rights have a rich life in the world around us. Political rhetoric pays tribute to them, or scorns them. Citizens and activists strive for them. The law enshrines them. And they live inside us too. For many of us, human rights form part of how we understand the world and what must (or must not) be done within it. The ubiquity of human rights raises questions for the philosopher. If we want to understand these rights, where do we look? As a set of moral norms, it is tempting to think they can be grasped strictly from the armchair, say, by appeal to moral intuition. But what, if anything, can that kind of inquiry tell us about the human rights of contemporary politics, law, and civil society - that is, human rights as we ordinarily know them? This volume brings together a distinguished, interdisciplinary group of scholars to address philosophical questions raised by the complex status of human rights as both moral rights, on the one hand, and legally, politically, and historically practised rights, on the other. Its original chapters, each accompanied by a critical commentary, explore topics including: the purpose and methods of a philosophical theory of human rights; the "Orthodox-Political" debate; the relevance of history to philosophy; the relationship between moral and legal human rights; and the value of political critiques of human rights."--
