    Abstract: This brief maps the available data augmented by expert interviews on the impact of the Covid-19 measures on DV in eight European Member States during the first lock-down. The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Abstract: "Custom was fundamental to medieval legal practice. Whether in a property dispute or a trial for murder, the aggrieved and accused would go to lay court where cases were resolved according to custom. What custom meant, however, went through a radical shift in the medieval period. Between the twelfth and thirteenth centuries, custom went from being a largely oral and performed practice to one that was also conceptualized in writing. Based on French lawbooks known as coutumiers, Ada Maria Kuskowski traces the repercussions this transformation - in the form of custom from unwritten to written and in the language of law from elite Latin to common vernacular - had on the cultural world of law. Vernacular Law offers a new understanding of the formation of a new field of knowledge: authors combined ideas, experience and critical thought to write lawbooks that made disparate customs into the field known as customary law"--

    Abstract: "The Legitimacy of European Constitutional Orders is a systematic and comparative study of European constitutional orders, taking into consideration the national constitutional traditions of European countries, as well as the defining power of EU law.     Abstract: The study provides an extensive legal, geopolitical and historical analysis of all controversial issues making up the Greek-Turkish maritime dispute: the delimitation of territorial waters, the national airspace, the delineation of exclusive economic zones and continental shelf as well as the issue of military presence on the Eastern Aegean islands and its relation to the Greek sovereignty over them. By immersing thoroughly into international jurisprudence, international treaties and historical facts, the book offers a detailed survey of legal precedents and legal regimes over similar issues worldwide. In this way, the reader has the opportunity to ascertain where every single legal and historical argument has been drawn from and its relevance in the international jurisprudence. Consequently, it follows the evolution of the dispute together with all its twists from 1973 to 2022 that saw a new low in the historically tense Greek-Turkish relationship. The book finally re-examines the dispute in the light of the new green energy geopolitics and the ongoing climate crisis and comes up with some suggestions for an alternative paradigm of co-existence in the Aegean Sea which in the author’s view is urgent and inevitable. .

    Abstract: Das Werk behandelt das Tragen eines Kopftuchs durch Lehrerinnen und Schülerinnen in der öffentlichen Verwaltung und in der Justiz. Eingehend behandelt werden die Interpretation des muslimischen Kopftuchs (Symbol der Unterdrückung von Frauen und des politischen Islam?) und das Neutralitätsgebot aus verfassungsrechtlicher und sozialwissenschaftlicher Sicht. Untersucht wird die Entwicklung des laizistischen Modells in Frankreich und der Versuch einer Übertragung dieses Modells auf Deutschland (Berliner Neutralitätsgesetz, Verbot des Kopftuchs von Schülerinnen). Auch das neue Bundesgesetz zum Erscheinungsbild von Beamtinnen und Beamten wird untersucht und auf die Notwendigkeit einer Neujustierung des überkommenen Neutralitätsverständnisses hingewiesen.
    Abstract: The work deals with the wearing of a headscarf by female teachers and students, in public administration and in the judiciary. The interpretation of the Muslim headscarf (symbol of the oppression of women and political Islam?) and the neutrality requirement from a constitutional and sociological perspective are dealt with in depth. The development of the laicist model in France and the attempt to transfer this model to Germany (Berlin neutrality law, ban on the headscarves for schoolgirls) are examined. The new federal law on the appearance of civil servants is also dealt with, as well as the need for a readjustment of the traditional understanding of neutrality.

    Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience. Yet large numbers of researchers, non-governmental organizations, trade unions, workers, and others who would seem like natural allies in the fight against modern slavery and trafficking are hugely skeptical of these movements. They object to how the problems are framed, and are skeptical of the "new abolitionist" movement. Why? This book tackles key controversies surrounding the anti-slavery and anti-trafficking movements head on. Champions and skeptics explore the fissures and fault lines that surround efforts to fight modern slavery and human trafficking today. These include: whether efforts to fight modern slavery displace or crowd out support for labor and migrant rights; whether and to what extent efforts to fight modern slavery mask, naturalize, and distract from racial, gendered, and economic inequality; and whether contemporary anti-slavery and anti-trafficking crusaders' use of history are accurate and appropriate

    Abstract: "Should an employee be allowed to wear a religious symbol at work? Should a religious employer be allowed to impose constraints on employees' private lives for the sake of enforcing a religious work ethos? Should an employee or service provider be allowed, on religious grounds, to refuse to work with customers of the opposite sex or of a same-sex sexual orientation? This book explores how judges decide these issues and defends a democratic approach, which is conducive to a more democratic understanding of our vivre ensemble. The normative democratic approach proposed in this book is grounded on a sociological and historical analysis of two national stories of the relationships between law, religion, diversity and the State, the British (mainly English) and the French stories. The book then puts the democratic paradigm to the test, by looking at cases involving clashes between religious freedoms and competing rights in the workplace. Contrary to the current alternative between the "accommodationist view", which defers to religious requests, and the "analogous" view, which undermines the importance of religious freedom for pluralism, this book offers a third way. It fills a gap in the literature on the relationships between law and religious freedoms and provides guidelines for judges confronted with difficult cases"--

    Abstract: Welche Bedeutung hat die Staatsbürgerschaft für Schwarze Deutsche? Emmanuel Ndahayo liefert mit seiner Studie einen wichtigen Beitrag zur Erforschung sozialer Ungleichheit und gesellschaftlicher Teilhabe im Kontext von Migration und Eingliederungsprozessen, die in besonderem Maße von Rassismus, (post-)kolonialistischen Ansichten und fragilen Inklusionsformen betroffen sind. Die Analyse der sozialen Lage von eingebürgerten Deutschen afrikanischer Herkunft schließt eine Forschungslücke. Die empirische Untersuchung mit Hilfe qualitativer Interviews bietet daher wichtige Erkenntnisse nicht nur für die Sozialwissenschaft, sondern auch für Praktiker*innen in der Integrationspolitik.

    Abstract: Die ›freiheitliche demokratische Grundordnung‹ (fdGO) ist Kern der ›wehrhaften Demokratie‹ der Bundesrepublik. Als zu schützendes Rechtsgut ist sie in den Art. 18 und 21 GG benannt. Sie legitimiert exekutive und judikative sowie Abwehr- und Überwachungsmaßnahmen gegen politische Akteur/innen. Die vorliegende Arbeit vollzieht die Genese der fdGO als überpositives Rechtsgut nach, das heißt, wie sie vom unklaren Begriff im Verfassungstext zu einer verallgemeinerten Formel geworden ist. Als Quellen dienen Verfassungs- und Gesetzgebungsprozesse sowie juristische Kommentarliteratur und Gerichtsurteile. Methodisch wird die juristische Argumentationsweise politikwissenschaftlich kontextualisiert – auch um einen politikwissenschaftlichen Zugang zu Rechtstexten zu entwickeln. Im Fokus stehen die Debatten im Parlamentarischen Rat, der Gesetzgebungsprozess des 1. Strafrechtsänderungsgesetzes von 1951, die Parteiverbotsurteile des Bundesverfassungsgerichts und die ersten Kommentare zum Grundgesetz. Zudem stehen das Konzept der ›wehrhaften Demokratie‹ und die dazugehörigen geschichtspolitischen Legitimationen mit Bezug zu Weimarer Republik und Nationalsozialismus auf dem Prüfstand. Die Autorin gleicht die verschiedenen Positionen im staatsrechtstheoretischen »Weimarer Methodenstreit« mit nationalsozialistischen Rechtsauffassungen ab und zeigt so Traditionslinien auf, die sich auch in den Begründungen des Konzepts der ›wehrhaften Demokratie‹ wiederfinden. Deutlich wird dabei, dass die Narrative von der ›wehrlosen‹ Weimarer Republik und der ›legalen‹ Machtübernahme des Nationalsozialismus juristisch- zeitgeschichtlich überprüft werden müssen. Nach der historischen Kontextualisierung der fdGO werden ihre Ausbreitung und Anwendung in verschiedene Rechts- und Politikbereiche beleuchtet. Abschließend fragt die Studie nach den Konsequenzen des juristischen Blicks für politisches Handeln.

Er führt in einer tour d'horizon sachlich und differenziert durch die aktuellen juristischen und politischen Diskussionen. Denn "die" Scharia gibt es ebenso wenig wie "den" Islam.

New or reformed constitutions have proliferated, protecting social, economic, and political rights. While constitutional courts in Latin America have traditionally been used as ways to limit power and preserve the status quo, the evidence shows that they are evolving into a functioning part of contemporary politics and a central component of a system of constitutional justice. This book lays bare the political roots of this transformation, outlining a new way to understand judicial design and the very purpose of constitutional justice. Authors Daniel M. Brinks and Abby Blass use case studies drawn from nineteen Latin American countries over forty years to reveal the ideas behind the new systems of constitutional justice. They show how constitutional designers entrust their hopes and fears to dynamic governance systems, in hopes of directing the development of constitutional meaning over time"--
    Abstract: "This project started many years ago, as an article-length project on the apparent diffusion of new models of courts throughout Latin America. A paper Dan Brinks was writing for APSA dovetailed with a paper Abby Blass was writing for a graduate seminar, and the project evolved through conversations between the two authors after that. Both Abby and Dan had other projects to attend to, so the collaboration moved slowly, but we both felt it was intellectually productive. In its early stages in particular, each of the authors contributed important elements and carried out a mutual back and forth that makes it difficult to separate each author's contributions to the initial conceptualization and measurement exercises. Similarly, the basic argument evolved out of conversations between the authors, with each pushing the other to clarify and specify the argument further. Through conceiving and writing the pieces we have called "Conceptualization" (now an article in the International Journal of Constitutional Law, and largely contained in chapter 2 and the Appendix) and "Determinants" (the theory and quantitative analysis that underpins chapters 3 and 4), we collaborated fully. This is the core of the intellectual contribution of the book, and our joint work on these pieces is the principal, though not the only, reason Abby is credited as a co-author"--

Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns.     Abstract: In dieser rechtsvergleichenden Studie entwickelt Antje G. I. Tölle einen Vorschlag de lege ferenda für den Vertragsschluss im elektronischen Geschäftsverkehr, der auf einer Abwägung zwischen den widerstreitenden Interessen nach Sicherheit und Flexibilität beruht. Dabei ordnet er etwa das Downloadshopping als verbindliches Angebot ein und ermöglicht seine Rücknahme. Weitere Themenkomplexe sind der Zugang und Widerruf eines Angebots, sein Erlöschen durch Zeitablauf, Ablehnung oder Verlust der Geschäftsfähigkeit oder den Tod. Für die Analyse werden insgesamt sechs europäische Rechtsordnungen, namentlich Deutschland, England, Frankreich, die Schweiz, die Niederlande und Ungarn herangezogen.     Abstract: Wie verändert sich die Demokratie durch die Digitalisierung? Dieser Frage geht das Buch aus verfassungsrechtlicher, technikrechtlicher, politikwissenschaftlicher und psychologischer Sicht nach. Dazu arbeitet es zunächst die Charakteristika von Digitalisierung heraus. Es fragt, wie sich die Digitalisierung auf das Denken, das Verhalten und die (politische) Kommunikation auswirkt. Auf dieser Grundlage vertritt der Autor die These, dass sich die Demokratie grundlegend verändern muss und wird. Im letzten Teil skizziert er, wie die Demokratie konkret im digitalen Zeitalter funktionieren könnte.

Anhand der rechtsvergleichenden Ergebnisse zeigt die Autorin neue Entwicklungen im Strafrecht auf und diskutiert die Existenz eines sog. Sicherheitsstrafrechts. Da Terrorismus, Hooliganismus und Sexualgewalt die nationalen Rechtssysteme vor neue Herausforderungen stellen, ist die Frage, wie die Rechtssysteme Deutschlands, Frankreichs und Englands mit dieser Gefahr von schwerer Gewalt umgehen, von entscheidender Bedeutung.     Abstract: Verfassungsgeschichte und Privatrechtsgeschichte gehen gewöhnlich getrennte Wege. Doch werden sie damit ihren Gegenständen nicht gerecht, denn Verfassung und Privatrecht stehen in enger Beziehung zueinander, und das nicht erst, seit im 20. Jahrhundert die Drittwirkung der Grundrechte entdeckt wurde. Die Beziehungen wechseln freilich mit den Begleitumständen. Sie stellten sich in Frankreich, wo der Übergang von monarchischem Absolutismus und ständisch-feudaler Gesellschaftsordnung zur bürgerlichen Staats- und Sozialordnung in einem revolutionären Akt des bereits emanzipierten Bürgertums herbeigeführt wurde, anders dar als in Deutschland, wo die Umstellung von der Obrigkeit ausging und sich in einem langen, rechtsförmigen Prozess evolutiv vollzog. Die Formationsphase der bürgerlichen Gesellschaft zwischen Revolutionen und Restauration enthält dafür vielfältiges Anschauungsmaterial, das auch die Grundlage für Analysen der weiteren Entwicklung des Verhältnisses der beiden
