    Abstract: "Japan's Household Registration System (koseki seido) is an extremely powerful state instrument, and is socially entrenched with a long history of population governance, social control and the maintenance of social order. It provides identity whilst at the same time imposing identity upon everyone registered, and in turn, the state receives validity and legitimacy from the registration of its inhabitants. The study of the procedures and mechanisms for identifying and documenting people provides an important window into understanding statecraft, and by examining the koseki system, this book provides a keen insight into social and political change in Japan.By looking through the lens of the koseki system, the book takes both an historical as well as a contemporary approach to understanding Japanese society. In doing so, it develops our understanding of contemporary Japan within the historical context of population management and social control; reveals the social effects and influence of the koseki system throughout its history; and presents new insights into citizenship, nationality and identity. Furthermore, this book develops our knowledge of state functions and indeed the nation state itself, through engaging critically with important issues relating to the koseki while at the same time providing a platform for further investigation. The contributors to this volume utilise a variety of disciplinary areas including history, gender studies, sociology, law and anthropology, and each chapter provides insights that bring us closer to a comprehensive grasp of the role, effects and historical background of what is a crucial and influential instrument of the Japanese state.This book will be of great interest to students and scholars of Japanese history, Japanese culture and society, Japanese studies, Asian social policy and demography more generally. Modern technological development has been both rapid and fundamentally transformative of the means and methods of warfare, and of the broader environment in which warfare is conducted. In many cases, technological development has been stimulated by, and dedicated to, addressing military requirements. On other occasions, technological developments outside the military sphere affect or inform the conduct of warfare and military expectations. The introduction of new technologies such as information technology, space technologies, nanotechnology and robotic technologies into our civil life, and into warfare, is expected to influence the application and interpretation of the existing rules of the law of armed conflict.     Abstract: This volume contributes to the on-going legal discussion on pressing procedural and substantial law issues in the ambit of international human rights and civil liberties. While the 20th century has seen the true awakening of human rights, the 21st century poses new challenges to this ever-unfolding area of law. Not only do international tribunals and quasi-tribunals worldwide and domestic US and European continental courts have to deal with increasing numbers of complaints and petitions from individuals and groups on a vast array of societal problems, the legal issues put to them are sometimes extremely difficult to resolve as they relate to very sensitive issues. This book examines issues ranging from the status of human rights under US law to the status of the ECHR in the broader context of international law. It looks at the role of positive obligations in the case law of the Strasbourg Court, as well the impact of its case-law on childbirth and push-back operation towards boat people, but also at the growing unwillingness of ECHR member states to cooperate with the Strasbourg Court.     Abstract: The book “Criminal proceedings, languages and the European Union: linguistic and legal issues” - the first attempt on this subject - deals with the current situation in the jurislinguistic studies, which cover comparative law, language and translation, towards the aim of the circulation of equivalent legal concepts in systems which are still very different from one another. In the absence of common cultures and languages, in criminal procedure it is possible to distinguish features that are typical of common law systems and features that are typical of civil law systems, according to the two different models of adversarial and inquisitorial trials. Therefore, the most problematic challenges are for the European Union legislator to define generic measures that can be easily implemented at the national level, and for the individual Member States to choose corresponding domestic measures that can best implement these broad definitions, so as to pursue objectives set at the European level. In this scenario, the book assesses the new framework within which criminal lawyers and practitioners need to operate under the Lisbon Treaty (Part I), and focuses on the different versions of its provisions concerning cooperation in criminal matters, which will need to be implemented at the national level (Part III). The book analyses the issues raised by multilingualism in the EU decision-making process and subsequent interpretation of legal acts from the viewpoint of all the players involved (EU officials, civil, penal and linguistic lawyers: Part II), explores the possible impact of the EU legal acts concerning environmental protection, where the study of ascending and descending circulation of polysemantic words is especially relevant (Part IV), and investigates the new legal and linguistic concepts in the field of data retention, protection of victims, European investigation orders and coercive measures (Part V)

The following situations are typical. A French law school is teaching French law in the English language to foreign exchange students. Some US legal scholars are exploring the possibility of developing a generic or transnational constitutional law. German judges are referring to foreign law in a criminal case involving an honour killing committed in Germany with a view to ascertaining the relevance of religious prescriptions. European lawyers are actively working on the creation of a common private law to be translated into the 23 official languages of the European Union. Since 2004, the World Bank has been issuing reports ranking the attractiveness of different legal cultures for doing business. Contributing to the academic debate as well as to the practice of transitional justice, this book is an important contribution to a dynamic field. These include retributive measures, such as tribunals and court trials, as well as restorative or transformative initiatives in view of enhancing community relations, such as truth commissions or memory work. Yet, despite the range of activities conducted globally and the vibrant academic debate on the topic, there are but few attempts to conceptualise transitional justice theoretically. Transitional Justice Theories fills this gap. The first part of the book theorises transitional justice through the notion of transition. Using the concepts of social learning, social trust, implicit memory, and collective trauma, the chapters attempt to identify distinct features of the transitional moment and theoretically capture relevant social processes on a micro- and macro-level. The second part focuses on the notion of justice, outlining different understandings, such as restorative, transformative, and reparative; and discussing the use of these concepts in different settings and by different agents. The third part considers the academic as well as political discourses on transitional justice from the perspective of critical social theories, including feminism and postcolonialism.     Abstract: Robotische Systeme bahnen sich beständig Ihren Weg in die verschiedenen Bereiche menschlichen Lebens. Der Einsatz dieser Maschinen ist längst nicht mehr auf den industriellen Bereich beschränkt. Vielfältige Anwendungsmöglichkeiten bieten auch der militärische, medizinische und häusliche Bereich. Die Allgegenwärtigkeit dieser Technologie prägt in zunehmendem Maße unseren Alltag. Das Werk „Robotik im Kontext von Recht und Moral" beschäftigt sich mit dem technischen Fortschritt auf dem Gebiet der Robotik und seinen Auswirkungen auf die Gesellschaft. Dabei wird insbesondere der Frage nachgegangen, ob die bislang geltenden rechtlichen und moralischen Konzepte auf die Interaktion zwischen Mensch und Maschine anwendbar sind oder vielmehr neue Ansätze gefunden werden müssen.
