    Abstract: Religions are increasingly being regarded as relevant partners in international development cooperation due to their special attributes. However, to date there has been little research into what the special attributes of religious development agencies actually are or how such organisations employ them. What resources do religious NGOs draw on in development cooperation? How do such NGOs differ from other development agencies? Does their engagement make a considerable difference to collaborative development work? Using empirical case studies and theoretical analysis, the contributions in this book address these questions. In doing so, they examine different religions and their collaborative development work in various regions of the world, and chart the most recent changes in religions.

The New Conscientious Objection versus the Old The new generation of conscience based objections differs sharply from its predecessors in that it involves claims that are interventionist and intrusive as opposed to claims aimed at withdrawal and absence from discrete areas of mainstream collective undertakings. Typical of the past, are conscientious objectors who sought to be excused from serving in the military or from going to war, or else from pledging allegiance to their country's flag in public gatherings. In contrast, today's most notorious conscientious objectors seek exemption from generally applicable laws requiring employers to provide contraception coverage in the medical insurance benefits they must extend to their women employees; or from providing services offered to the general public, such as cakes or flowers for wedding celebrations or hotel rooms with large beds, to individuals belonging to sexual minorities; or from issuing marriage or civil union licenses in their capacity as state employees to same-sex couples"--

On the one hand, the connection of international law and religion has been little explored.     Abstract: This book provides an account and explanation of a fundamental dilemma facing secular states: the "legitimacy gap" left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The "secular" in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a "substantive" legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of "procedural" legitimacy (people, rights, and culture) in different ways: the "neutral model" (constitutions based on the "displacement of culture"); the "multicultural model" (constitutions based on diversity and pluralism); and the "asymmetric model" (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards "nationalization" linked to a particular national identity (as in France and, to some extent, in India)-or towards "de-secularization", whereby secularism is displaced by particular cultural norms, as in Malaysia --Front flap of book

    Abstract: This book is devoted to the study of the interplay between religious rules and State law. It explores how State recognition of religious rules can affect the degree of legal diversity that is available to citizens and why such recognition sometime results in more individual and collective freedom and sometime in a threat to equality of citizens before the law. The first part of the book contains a few contributions that place this discussion within the wider debate on legal pluralism. While State law and religious rules are two normative systems among many others, the specific characteristics of the latter are at the heart of tensions that emerge with increasing frequency in many countries.     Abstract: This book examines in detail both historical and current legal concepts of ‘religious cultural heritage’ within the context of the European continent. The latter group is primarily based on the variety of sacred cultural elements emanating from the different religious traditions of the peoples of Europe, which are deemed worthy of protection and preservation due to their outstanding value, in terms of their social, cultural and religious significance. In view of this, the study provides evidence of the European States’ active involvement with their sacred/cultural treasures, on the basis of the political and legal foundations of neutrality and pluralism. Furthermore, the book analyzes all relevant international legislative instruments (i.e. the plethora of EU, CoE and UNESCO norms), as well as all major European legislative patterns, in light of their significance for the aforementioned aspects of pluralism and neutrality. The interdisciplinary references listed at the end of each chapter provide an additional incentive for further reading on the subject matter. The most important finding to emerge from the study is that there is a shared legal ethos in Europe that imposes a duty of appropriate care concerning the vast variety of sacred cultural goods, and the religious cultural heritage in general, as an invaluable repository of European cultural capital. It also considers the sui generis nature of this capital: like any other type of asset, it may deteriorate or fade over time, necessitating investment in its preservation or refurbishment; nevertheless, like no other, this particular capital maintains a distinct cultural value, as it contains an additional characteristic of ‘sacredness’ expressed in the form of its ‘religious character,’ the latter being analyzed as a triptych of religious memory, religious aesthetics and religious beliefs

    Abstract: "Traditional African beliefs, together with African cultural traditions, are enjoying a new-found respect in South Africa, due in large part to the advent of the country's democratic constitution. In fact, a large majority of the South African population adheres to some form of traditional belief, often in combination with observance of other religions. Even so, the traditional faiths are poorly understood and, in spite of constitutional guarantees, receive far from equal treatment, a situation quite at odds with the country's commitment to equality and religious and cultural diversity. Throughout Africa, there is a strong tendency to confound indigenous beliefs with culture. Because religion is always taken more seriously than culture, this means that traditional beliefs do not attract the respect they deserve. While there are numerous works on the subject of religion in Africa, there are no works on traditional African religions and their legal implications. The issue is nevertheless of serious political and legal concern in South Africa, since it raises diverse questions involving freedom of religion, the equal treatment of religions, traditional healing, witchcraft, animal sacrifice, circumcision, marriage and burial. The overall purpose of the title is to consider whether indigenous African religions, independent African churches and traditional practices deserve constitutional protection and recognition by the state. If recognised, they will then become subject to certain state controls and benefits: the need for registration; the licensing of ministers as marriage officers (with consequences for the validity of customary and other marriages); and significantly, of course, tax exemptions. This title thus explores the legal and constitutional implications of traditional religion and, in particular, the state's intervention in religious matters."--Publisher's description

    Abstract: Taxes are sometimes so fundamental to domestic systems that they are almost impossible to change, as when the tax system is part of a nation's majority religion or is linked to another value deeply rooted in local communities, such as housing or farming. There is a danger in the WTO, a Geneva-based entity, making decisions for people living in distant locations with regard to tax issues related to their local needs and wants. The Saudi Arabian tax system exemplifies the tension between religion, tax and trade, because tax has a role in the country's religion and is an essential part of its laws. Therefore, there is a need for maintaining a delicate balance between local needs and international commitments with respect to taxation. This book aims to show directions in which legal order can be preserved as much as possible from within each country, and yet not imposed upon them, and which will help build a peaceful bridge between local and international factors that are important to shaping the global order.
