    Kurzfassung: Which factors influence the implementation of climate change measures in the EU? Are there already any indications prior to directive/law approval of (national) implementation difficulties that could later emerge? What are the prerequisites of successful implementation? How can we model implementation? Implementing Climate Change Measures in the EU provides answers to these questions and introduces an all new implementation model.
    Kurzfassung: What changed in the United States with Hurricane Katrina was a feeling that we have entered a period of consequences. - Al Gore On February 05, 2007, the Intergovernmental Panel on Climate Change (IPCC) published the executive summary of its fourth assessment report (to be published April 06, 2007). In the summary, it not only acknowledged that climate change is happening at an accelerated rate, but also that its consequences would be dreary: changes in precipitation and in wind patterns, a rise of the sea levels, and desert- cation will globally impact the frequency of disasters and impair living standards. Whether or not we believe climate change is happening, over the past two years, we have witnessed a rise of the topic from oblivion to ubiquity and have experienced a growing emphasis on ?nding measures to prevent climate change. There is an unprecedented agreement among environmentalists, politicians, the public, and industry that we have to take effective action. Politicians are putting their creative plans to action unusually fast: Australia bans the light bulb, B- gium switches off lamps along lighted highways, and the US introduces daylight savings time two weeks earlier than in previous years. Industry, the most unlikely candidate for support, is rallying together in action groups like US-Cap or 2 Grad, and more and more consumers are offsetting their emissions through websites like myclimate. Merle Grobbel holds a PhD in Political Science (Public Policy) and works as a consultant for McKinsey Company.

    Kurzfassung: This book studies the normative intersection between integration, immigration and nationality in the European Union (EU). It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy

    Kurzfassung: European Labour Law explores how individual European national legal systems, in symbiosis with the European Union, produce a transnational labour law system that is distinct and genuinely European in character. Professor Brian Bercusson describes the evolution of this system, its national, transnational and global contexts and its institutional and substantive structures. The collective industrial-relations dimension of employment is examined, and the labour law of the EU as manifested in, for example, European works councils is analysed. Important subjects which have traditionally received little attention in some European labour law systems are covered, for example, the fragmentation of the workforce into atypical forms of employment. Attention is also given to the enforcement of European labour law through administrative or judicial mechanisms and the European social dialogue at intersectoral and sectoral levels. This new edition has been extensively updated, as the EU's influence on this area of social policy continues to grow

    Kurzfassung: Soziale Konstrukte wie (europäische) Öffentlichkeiten entstehen nicht allein durch die Generierung und massenmediale Vermittlung politischer Inhalte, sondern letztlich in den kommunikativen Praktiken und Anschlusshandlungen der Menschen auf der Publikumsebene. Ziel dieser Arbeit ist es, die Rolle des Publikums bei der Herstellung europäischer Öffentlichkeit theoretisch und empirisch herauszuarbeiten. Es wird ein pragmatischer Theorieansatz entwickelt, demzufolge die Menschen auf der Basis ihrer Medienrezeptionen Betroffenheit von EU-politischen Entscheidungen und Problemlagen wahrnehmen und in entsprechende Diskurse eintreten. Durch die diskursive Aneignung und Lokalisierung des Rezipierten in ihren jeweiligen politischen, kulturellen und sozialen Kontexten werden die Mediennutzer von Mitgliedern eines Medienpublikums zu denen eines Öffentlichkeit konstituierenden Bürgerpublikums. Empirisch untersucht werden die Aneignungs- und Sinngebungsprozesse durch das Publikum sodann im Rahmen qualitativer Fallstudien am Beispiel der EU-Verfassungsdebatte in Frankreich, Italien und Deutschland.

    Kurzfassung: Geringfügig überarbeitete Fassung eines Vortrags, den die Autorin, stellvertretende Vorsitzende der Deutschen UNESCO-Kommission, am 27. Februar 2008 zur Öffentlichen Anhörung durch das Europäische Parlament in Brüssel ge­hal­ten hat zum Thema: "Die Umsetzung des UNESCO-Übereinkommens über den Schutz und die Förderung der Vielfalt kultureller Ausdrucksformen durch die Europäische Gemeinschaft." Ihr Fazit: "Der Beitritt aller 27 EU-Mitgliedsstaaten binnen eines Jahres zur Konvention macht deut­lich: Die Magna Charta internationale Kulturpolitik hat einen Paradigmenwechsel eingeläutet: Weg von der Ausschließlichkeit eines Wirtschaftsregimes hin zu einer differenzierten und kulturellen Betrachtung unserer Entwicklung. Aus der Forschung wissen wir: Innovationen entstehen in der Verbindung von Bekannten mit dem Neuen. Die Aufgabe ist, einen eben so breiten Konsens herzustellen wie jenen, auf dem seit sechzig Jahren die internationale Handelsordnung ruht."

    Kurzfassung: This publication deals with the European dimension of tort law. It provides a critical analysis of the acquis communautaire, asking if and to what extent the provisions and case law in the field of tort law are based on a conclusive system and are in accord with the national legal systems. It thus evaluates whether the acquis communautaire form the beginning of a comprehensive and coherent EC tort law or if the single directives and regulations are contradictory and lack a general concept that is yet to be found. To gain an overview of 'EC Tort Law' certain provisions and decisions were analysed by a group of authors under thirteen elements that form the basis of tort law e.g. fault/strict liability, causation, damage, damages and limitation of actions. An analysis of these aspects was then undertaken by another group of authors each focusing on their respective legal families within the European Union. The publication also contains a section on terminological issues in EC tort law.

    Kurzfassung: Hauptbeschreibung In den vergangenen Jahrzehnten hat die deutsche Asylrechtsprechung ein festes Gerüst asylrechtlicher Rechtsfiguren und Auslegungsgrundsätze geschaffen, dessen tragende Pfeiler auf einer in weiten Teilen völlig eigenständigen Interpretation maßgeblicher Vorschriften der Genfer Flüchtlingskonvention beruhen. Der Prozess der Harmonisierung des Flüchtlingsrechts auf europäischer Ebene und vor allem die Richtlinie 2004/83/EG des Rates vom 29.04.2004 (Qualifikationsrichtlinie) als eines der zentralen Elemente dieser Asylrechtsharmonisierung verlangen der deutschen Asylrechtsprechung eine grundlegende Revision und Neuorientierung ab. Vor diesem Hintergrund geht die Autorin, selbst Richterin am Verwaltungsgericht, am Beispiel des Widerrufs von Flüchtlingsanerkennungen im Einzelnen der Frage der Völkerrechts- und Europarechtskonformität der deutschen Rechtsprechung nach. Annegret Titze legt dabei besonderes Gewicht auf die dogmatische Entfaltung der für alle Auslegungsfragen im materiellen Asylrecht nunmehr maßgeblichen methodischen Grundlagen, die bei der Auslegung von Völkervertragsrecht einerseits und der Auslegung von EG-Recht andererseits sowie bei der Verzahnung beider Rechtskreise im Bereich der Qualifikationsrichtlinie zu beachten sind.     Kurzfassung: Die Europäisierung des Rechts in der Europäischen Union führt zu tiefgreifenden Veränderungen in den Rechtsordnungen ihrer Mitgliedsstaaten. Besondere Schwierigkeiten wirft sie für die Staaten Mittel- und Osteuropas auf, die der Europäischen Union erst seit kurzem beigetreten sind. Der vorliegende Band behandelt die Auswirkungen der Europäisierung auf die deutsche und die ungarische Rechtsordnung aus rechtshistorischer, zivilrechtlicher und öffentlich-rechtlicher Perspektive und lässt sie dadurch in ihrer Vielfalt plastisch hervortreten. Die Schwerpunkte der insgesamt 18 Beiträge liegen im Bereich der Rechtsgeschichte, des allgemeinen Zivilrechts, des Gesellschaftsrechts, des geistigen Eigentums, des Zivil- sowie des Verwaltungsprozessrechts, und erörtern auch die Problematik der Diskriminierungsverbote und schließlich die Souveränitätskonzeption. Der Band versammelt die Vorträge des Deutsch-Ungarischen Kolloquiums der Juristischen Fakultäten der Universität Göttingen und der Eötvös Loránd Universität Budapest über die Europäisierung des Rechts, das im Oktober 2007 in Budapest stattfand. Dieses gemeinsame Kolloquium ist die jüngste Frucht der langjährigen Kooperation der beiden Fakultäten in Forschung und Lehre. Band 5 der Reihe αGöttinger Juristische Schriften. Die Reihe wird von der Juristischen Fakultät der Georg-August-Universität herausgegeben und macht Veranstaltungen an der Fakultät einer interessierten Öffentlichkeit zugänglich.

    Kurzfassung: Recent developments in the European integration process have raised, amongst many other things, the issue of linguistic diversity, for some a stumbling block to the creation of a European democratic polity and its legal and social institutions. The solution to the 'question of language', involves an understanding of the role played by natural languages and the consequent design of policies and institutional mechanisms to facilitate inter-linguistic and intercultural communication. This is not an exclusively European problem, and nor is it entirely new, for it is also the problem of linguistic majorities and minorities within unitary nation-states. However, the effects of globalization and the diffusion of multiculturalism within nation-states have given renewed emphasis to the question of language in diverse societies. Facing the question anew involves reconsidering traditional ideas about social communication and the public sphere, about opinion-formation and diffusion, about the protection of cultural and linguistic minorities, and about the role that language plays in the process of formation of political and legal cultures. This volume is intended as a multidisciplinary contribution towards studying and assessing the range of problems that form the 'language question' in Europe and diverse societies
