    Abstract: The study provides an extensive legal, geopolitical and historical analysis of all controversial issues making up the Greek-Turkish maritime dispute: the delimitation of territorial waters, the national airspace, the delineation of exclusive economic zones and continental shelf as well as the issue of military presence on the Eastern Aegean islands and its relation to the Greek sovereignty over them. By immersing thoroughly into international jurisprudence, international treaties and historical facts, the book offers a detailed survey of legal precedents and legal regimes over similar issues worldwide. In this way, the reader has the opportunity to ascertain where every single legal and historical argument has been drawn from and its relevance in the international jurisprudence. Consequently, it follows the evolution of the dispute together with all its twists from 1973 to 2022 that saw a new low in the historically tense Greek-Turkish relationship. The book finally re-examines the dispute in the light of the new green energy geopolitics and the ongoing climate crisis and comes up with some suggestions for an alternative paradigm of co-existence in the Aegean Sea which in the author’s view is urgent and inevitable. .

    Abstract: Die Geschichte der Bundesrepublik ist maßgeblich vom Grundgesetz und der Rechtsprechung des Bundesverfassungsgerichts geprägt worden. In den Darstellungen der Historiker kommt das jedoch nur unvollkommen zum Ausdruck.     Abstract: Over the last two decades, fighting modern slavery and human trafficking has become a cause célèbre. Yet large numbers of researchers, non-governmental organizations, trade unions, workers, and others who would seem like natural allies in the fight against modern slavery and trafficking are hugely skeptical of these movements. They object to how the problems are framed, and are skeptical of the "new abolitionist" movement. Why? This book tackles key controversies surrounding the anti-slavery and anti-trafficking movements head on. Champions and skeptics explore the fissures and fault lines that surround efforts to fight modern slavery and human trafficking today.     Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience. On 10 December 2020, the book was officially launched with a webinar which brought together the editors of the book and prof. Stephan Parmentier (KU Leuven) and prof.     Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: Just what is a right? Jakob Weissinger approaches this central problem of jurisprudence by critically examining the purpose of such normative concepts and carefully analysing the fundamental elements of normative practice like actions, decisions, the logic of norms and values as well as the plurality of normative practice. Interlinking the insights won, he outlines a stand-alone theory of rights which emphasises the empowering dimension of rights in the process of justifying (legal) rules. Not only does he question well-established theories, such as Hohfeld's famous analysis of legal conceptions, but aspires to set future debates in legal theory, especially those surrounding rights such as the long-standing dispute between interest and choice theories of rights, on new and more solid meta-theoretical ground.

    Abstract: As the power and sophistication of of 'big data' and predictive analytics has continued to expand, so too has policy and public concern about the use of algorithms in contemporary life. This is hardly surprising given our increasing reliance on algorithms in daily life, touching policy sectors from healthcare, transport, finance, consumer retail, manufacturing education, and employment through to public service provision and the operation of the criminal justicesystem. This has prompted concerns about the need and importance of holding algorithmic power to account, yet it is far from clear that existing legal and other oversight mechanisms are up to the task. This collection of essays, edited by two leading regulatory governance scholars, offers a critical0exploration of 'algorithmic regulation', understood both as a means for co-ordinating and regulating social action and decision-making, as well as the need for institutional mechanisms through which the power of algorithms and algorithmic systems might themselves be regulated.     Abstract: Die ›freiheitliche demokratische Grundordnung‹ (fdGO) ist Kern der ›wehrhaften Demokratie‹ der Bundesrepublik. Als zu schützendes Rechtsgut ist sie in den Art. 18 und 21 GG benannt. Sie legitimiert exekutive und judikative sowie Abwehr- und Überwachungsmaßnahmen gegen politische Akteur/innen. Die vorliegende Arbeit vollzieht die Genese der fdGO als überpositives Rechtsgut nach, das heißt, wie sie vom unklaren Begriff im Verfassungstext zu einer verallgemeinerten Formel geworden ist. Als Quellen dienen Verfassungs- und Gesetzgebungsprozesse sowie juristische Kommentarliteratur und Gerichtsurteile. Methodisch wird die juristische Argumentationsweise politikwissenschaftlich kontextualisiert – auch um einen politikwissenschaftlichen Zugang zu Rechtstexten zu entwickeln. Im Fokus stehen die Debatten im Parlamentarischen Rat, der Gesetzgebungsprozess des 1. Strafrechtsänderungsgesetzes von 1951, die Parteiverbotsurteile des Bundesverfassungsgerichts und die ersten Kommentare zum Grundgesetz. Zudem stehen das Konzept der ›wehrhaften Demokratie‹ und die dazugehörigen geschichtspolitischen Legitimationen mit Bezug zu Weimarer Republik und Nationalsozialismus auf dem Prüfstand. Die Autorin gleicht die verschiedenen Positionen im staatsrechtstheoretischen »Weimarer Methodenstreit« mit nationalsozialistischen Rechtsauffassungen ab und zeigt so Traditionslinien auf, die sich auch in den Begründungen des Konzepts der ›wehrhaften Demokratie‹ wiederfinden. Deutlich wird dabei, dass die Narrative von der ›wehrlosen‹ Weimarer Republik und der ›legalen‹ Machtübernahme des Nationalsozialismus juristisch- zeitgeschichtlich überprüft werden müssen. Nach der historischen Kontextualisierung der fdGO werden ihre Ausbreitung und Anwendung in verschiedene Rechts- und Politikbereiche beleuchtet. Abschließend fragt die Studie nach den Konsequenzen des juristischen Blicks für politisches Handeln.

    Abstract: Im derzeitigen Katalog der Menschenrechte fehlt ein zentrales Recht, das Hannah Arendt das »Recht auf Rechte« nennt. Dadurch bleibt vielen Menschen, wenn sie nicht Staatsbürger_innen eines Landes sind, in der nationalstaatlichen Praxis das Recht auf politische Mitgestaltung vorenthalten. 70 Jahre nach der Verabschiedung der Allgemeinen Erklärung der Menschenrechte ist daher eine kritische Revision des Menschenrechtsverständnisses dringend erforderlich. Franziska Martinsen erläutert aus radikaldemokratietheoretischer Perspektive, dass Menschenrechte erst dann, wenn sie weniger als humanitäre denn als originär politische Rechte verstanden werden, ihr ermächtigendes Potenzial weltweit entfalten können

    Abstract: This book analyses the extent and the modalities of the securitization of asylum-seekers and refugees in the EU. Itargues that the development of the EU asylum policy, far from 'securitizing' asylum-seekers and refugees, has led to the strengthening and codification of several rights for these two categories of persons. However, the securitization of terrorism and the links that have been constructed between asylum, irregular migration and terrorism in the wake of the various terrorist attacks that have taken place in Europe in the last few years have had a significant impact on the ability of asylum-seekers to gain access to asylum systems in the EU. From a theoretical point of view, the book develops an original analytical framework that draws upon and further develops security studies- more precisely securitization theory- by connecting it to the literature on policy venues and venue-shopping. It therefore makes a significant contribution to the debates on both securitization and migration. Empirically examining the entire development of the EU's policy towards asylum-seekers and refugees, from its origins in 1993, this book will be of great interest to students of European and EU politics, refugees, migration, security, terrorism and counter-terrorism, security studies and International Relations

    Abstract: This book offers a unique and insightful econometric evaluation of the policies used to fight transnational terrorism between 1990 and 2014. It uses the tools of modern economics, game theory and structural econometrics to analyze the roles of foreign aid, educational capital, and military intervention. Jean-Paul Azam and Véronique Thelen analyze panel data over 25 years across 124 countries. They prove that foreign aid plays a key role in inducing recipient governments to protect the donors' political and economic interests within their sphere of influence. Demonstrating that countries endowed with better educational capital export fewer terrorist attacks, they also illustrate that, in contrast, military intervention is counter-productive in abating terrorism. Recognizing the strides taken by the Obama administration to increase the role of foreign aid and reduce the use of military interventions, this book shows the significant impact this has had in reducing the number of transnational terrorist attacks per source country, and suggests further developments in this vein. Practical and timely, this book will be of particular interest to students and scholars of economics and political science, as well as those working on the wider issue of terrorism.     Abstract: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Abstract: Amicus curiae participation in international courts is steadily growing since the late 1990 despite lack of clarity on the concept's nature, function and utility in international dispute settlement. Does amicus curiae infuse international judicial proceedings with alternative views, including the public interest in a case, as often advocated by NGOs? Does it increase the legitimacy and transparency of international dispute settlement, or the coherence of international law? Or is it an unhelpful impostor that impedes negotiated solutions and derails the proceedings at the expense of the parties to advance its own agenda? By way of an empirical-comparative analysis of the laws and practices of the ICJ, the ITLOS, the ECtHR, the IACtHR, the IACtHPR, WTO panels and the Appellate Body, and investment arbitration the dissertation examines the status quo of amicus curiae before international courts and tribunals to determine if the current amicus curiae practice is of added value to international proceedings and international dispute settlement in general. The dissertation shows that there is no common concept of international amicus curiae, but that amicus curiae before the international courts examined share a few characteristics. A proposed functional systematization highlights overlaps and diverging uses of the concept before international courts and helps scholars and practitioners to assess the opportunities and limits of the concept. Analysis of the concept's current regulatory framework and its substantive effectiveness reveals a hesitation in particular by courts with a strong adversarial tradition to take into account the views of a non-party despite the positive experience with the concept in regional human rights courts. The dissertation concludes that neither the expectations nor the concerns attached to amicus curiae participation in international proceedings have materialized. It argues that the concept can contribute to improved decisions and decision-making in international dispute settlement if regulated and used properly

    Abstract: Areas of limited statehood, in which the territorial State lacks effective control, either completely or in part, challenge International Humanitarian Law in various ways. This volume explores if and how the law adapts to these challenges on the basis of mainly two legal issues: detention and investment protection in (non-)international armed conflict. Does a sufficient legal basis exist for the former? Is it International Humanitarian Law that determines what the investor is owed under a 'full protection and security' standard? More fundamentally, the contributions strive to shed light on these practical legal issues in a manner that is also historically and theoretically informed. How can international law be effective in areas of limited statehood, in particular as regards non-State actors? Can the law provide incentives for compliance? Is it in need of being developed? If so, who enjoys the legitimacy to do so?

    Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--
