It provides a more nuanced, systematic and contextualized comparison of normalization in two countries. Through analyzing policy and legislative documents, participant observation and interviews, it seeks to understand how normalization is implemented differently in prison legislation, policies and practices and compares the two societies for context. It also considers the material prison environment, security, the social environment and the use of time in prison. It provides insights into how normalization can be successfully and holistically implemented in both policy and practice, to contribute to a more ‘pure’ form of liberty deprivation as punishment without too many unintended effects. Helene De Vos is an affiliated senior researcher at KU Leuven, Belgium, and the executive director of RESCALED. What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: The unmatched technological achievements in artificial intelligence (AI), robotics, computer science, and related fields over the last few decades can be considered a success story.     Abstract: Dieses Lehrbuch stellt zunächst eine Reihe von klassischen philosophischen Ansätzen vor, um zu zeigen, dass sie als Grundlage für die Menschenrechte ungeeignet sind. Nur das Konzept der Menschenwürde - basierend auf der kantischen Unterscheidung von Preis und Würde – ist als Grundlage geeignet. Die Ableitung der Menschenrechte aus dem Prinzip der Menschenwürde erlaubt es, das entscheidende Merkmal der Menschenrechte zu identifizieren, nämlich den Schutz der Personalität. Dies wiederum ermöglicht es, (1) die Menschenrechte sinnvoll zu interpretieren, (2) zwischen echten und unechten moralischen Menschenrechten zu unterscheiden, (3) den Schutzumfang vieler kodifizierter Menschenrechte nach den Kriterien „Kern“ und „Hof“ zu differenzieren und bietet (4) einen Ausgangspunkt für die „Entdeckung“ neuer, ungeschriebener Menschenrechte. Diese philosophische Grundlage ermöglicht eine grundlegende Neubewertung der Rechtsprechung zu den Menschenrechten, die es letztlich ermöglichen wird, sie im Hinblick auf Rechtssicherheit, Klarheit und Schlüssigkeit zu verbessern. Das Lehrbuch richtet sich in erster Linie an fortgeschrittene Studierende der Rechtswissenschaft, die an einem tieferen Verständnis der Menschenrechte interessiert sind. Es eignet sich aber auch für Studierende der Geisteswissenschaften und für alle, die im politischen oder sozialen Bereich tätig sind und sich mit Menschenrechten und deren Durchsetzung befassen.     Abstract: This book offers a distinctive approach to the key international instrument on indigenous rights, the United Nations Declaration on the Rights of Indigenous Peoples (Declaration) based on a new account of the political history of the international indigenous movement as it intersected with the Declaration's negotiation. The current orthodoxy is to read the Declaration as containing human rights adapted to the indigenous situation. However, this reading does not do full justice to the complexity and diversity of indigenous peoples' participation in the Declaration negotiations. Instead, I argue that the Declaration should be subject to a novel, mixed-model reading that views the Declaration as embodying two distinct normative strands that serve different types of indigenous peoples. Not only is this model supported by the Declaration's political history and legal argument, it provides a new and compelling theory of the bases of international indigenous rights while clarifying the vexed question of who qualifies as indigenous for the purposes of international law.

    Abstract: This book considers contested responsibilities between the public and private sectors over the use of online data, detailing exactly how digital human rights evolved in specific European states and gradually became a part of the European Union framework of legal protections. The author uniquely examines why and how European lawmakers linked digital data protection to fundamental human rights, something heretofore not explained in other works on general data governance and data privacy. In particular, this work examines the utilization of national and European Union institutional arrangements as a location for activism by legal and academic consultants and by first-mover states who legislated digital human rights beginning in the 1970s. By tracing the way that EU Member States and non-state actors utilized the structure of EU bodies to create the new norm of digital human rights, readers will learn about the process of expanding the scope of human rights protections within multiple dimensions of European political space. The project will be informative to scholar, student, and layperson, as it examines a new and evolving area of technology governance – the human rights of digital data use by the public and private sectors. Rebekah Dowd is an Assistant Professor of Political Science at Midwestern University in Texas. Rebekah’s research focuses on human rights within data policy, the online behavior of individuals and states, and policy decision-making by European politicians. Dr. Dowd teaches courses in global studies, international relations, comparative and foundational politics, European politics, and international political economy.

    Abstract: “Can I choose to die?” As the number of requests for euthanasia and physician-assisted suicide continues to rise, human rights law faces a new conflict: the right to die vs. the right to life… The right to die or, in other words, ‘the right to choose the time and manner of one’s own death’ is a question of personal autonomy and its limits. This book provides a comprehensive understanding of the right to die and sheds light on its possible future under the European Convention on Human Rights. After setting a clear framework by defining the key terminology, the book takes a two-part approach to achieving its aim. The first part focuses on the right to die in practice by examining selected jurisdictions. Switzerland, which is famous for its assisted suicide organizations, and the Netherlands, which was the first country to legalize euthanasia, are examined in detail. Belgium, Germany, the United Kingdom, and -as an exception to the Convention perspective - Canada are also included. While this examination offers a better understanding of what the right to die looks like in practice, it also provides insights on the slippery slope argument, which serves as a counterweight to personal autonomy, without making a definitive statement on its validity. This part also illustrates the different paths that led or did not lead to the right to die in practice. The second part is an analysis of the European Court of Human Rights case law on the right to die. The Court has made important statements in only very cases, while its caution when approaching such a delicate and controversial topic among its 47 members is understandably emphasized. This analysis of the Court’s approach to the balancing of personal autonomy against other interests allows us to take a look back at the practice in more permissive jurisdictions through the lens of the Convention. Taken together, the book’s two parts provide valuable lessons for countries that decide to practice assisted dying, which are outlined in the conclusion. In addition, given that a purely legal approach can only offer a partial picture, the book argues that an interdisciplinary approach would be much more favorable in terms of providing the necessary basis for the right to die debate.

    Abstract: "The dissolution of the Ottoman Empire, through the British mandate and the establishment of the state of Israel, created a reality in which no Muslim legislator existed in the country. Thus, the chief judge—Qadi al Qudat, due to the dire need for reforms in the Sharia' family law and in order to minimize the intervention of the non-Muslim—Israeli legislator in the divine family law, took it upon himself to initiate the reforms. As such, this experience is considered the world-wide pioneerand unique in its scope. The reforms were done in accordance with the Islamic rules of renewal and are derived from the Islamic jurisprudence—sharia' itself. This process was done in two tracks: first, decisions of the High Court of Appeals would be followed by the lower courts as binding precedents. Second, the president of the High Sharia' court issued judicial decrees guidelines to the lower courts, driven by the Maslaha - the public interest - in various matters of Islamic law such as promoting women status, children's rights and the preservation of Islamic sites and cemeteries sanctity."

    Abstract: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

Human rights courts are thus increasingly faced with the difficult task of deciding these cases, which raise a number of complex and contested legal questions. 0To what extent can courts accommodate cultural diversity, protect all kinds of groups or interfere in socio-economic policy? This book argues that one of the problems encountered in dealing with such cases is the courts? tendency to assess them from a compartmentalised or fragmentary perspective. 0To counterbalance this tendency, an innovative, integrated and person-centered approach to adjudicating claims of cultural difference and economic disadvantage is put forward. Drawing on the concepts of intersectionality, indivisibility and normative interdependence, the book presents specific notions and methods for approaching the appreciation of rights holders, harms and norms in a holistic manner. A wide selection of case law from both the European and the Inter-American courts of human rights supports the normative framework developed in this book.     Abstract: The electoral successes of right-wing populists since 2016 have unsettled world politics. The spread of populism poses dangers for human rights within each country, and also threatens the international system for protecting human rights. Human Rights in a Time of Populism examines causes, consequences, and responses to populism in a global context from a human rights perspective. It combines legal analysis with insights from political science, international relations, and political philosophy. Authors make practical recommendations on how the human rights challenges caused by populism should be confronted.     Abstract: This book critically examines the relationship between protecting human rights and building peace in post-violence societies. It explores the conditions that must be present, and strategies that should be adopted, for the former to contribute to the latter. The author argues that human rights can aid peacebuilding efforts by helping victims of past violence to articulate their grievance, and by encouraging the state to respond to and provide them with a meaningful remedy. This usually happens either through a process of adjudication, whereby human rights can offer guidance to the judiciary as to the best way to address such grievances, or through the passing and implementation of human rights laws and policies that seek to promote peace. However, this positive relationship between human rights and peace is both qualified and context specific. Through an interdisciplinary and comparative analysis of four case studies, the book identifies the conditions that can support the effective use of human rights as peacebuilding tools. Developing these, the book recommends a series of strategies that peacebuilders should adopt and rely on.

    Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Abstract: This book stems from the worrying scale and intensity of conflicts, humanitarian crises, and human rights violations around the world, which can be seen in a wide range of global hotspots including Venezuela, Yemen, Syria, Myanmar, Sudan, Eritrea, and numerous others. These developments are also relevant for Europe, given the large-scale migrations they can produce. In order to effectively respond to them, it has become imperative to analyse ways in which space data and technologies can be used to uphold human rights and monitor violations. Various international tribunals, such as the International Court of Justice (ICJ) and the International Criminal Court (ICC), are increasingly relying on satellite data and especially images when considering human rights violations cases. This use of space-related technologies represents a trend that promises to continue as the range and accuracy of space-derived data improves. Further, satellite data has important legal implications because it allows the fulfilment of international obligations to be monitored, and offers a powerful tool for dispute resolution. Accordingly, this book examines the use of satellite images for cases concerning human rights violations, since the multitude of humanitarian crises worldwide demonstrate that it is of the utmost importance to analyse how space law, policies and space-related applications could further support the implementation and monitoring of the observance of human rights, thus contributing to enhanced security and sustainable development. A range of relevant areas, such as migration, refugees (including settlements and whether they are adequately supplied with basic necessities), water distribution and quality, housing and settlement monitoring are crucial aspects addressed in this book.     Abstract: Menschen müssen vor Gewalt geschützt werden – aber wie und von wem? Das von den UN anerkannte Konzept der Responsibility to Protect (R2P) sieht vor, dass Staaten und internationale Organisationen Verantwortung für diesen Schutz übernehmen. Spätestens die Kontroversen um die Militärintervention in Libyen 2011 haben allerdings gezeigt, dass über Art und Ausübung jener Verantwortung keine Einigkeit besteht. Dabei geht es nicht nur um das Was und Wie, sondern auch um das Warum: Gibt es kulturübergreifend akzeptable Gründe für eine staatliche und internationale Schutzverantwortung? Das Buch gibt einen Überblick über Entstehung und Entwicklung der R2P, analysiert die darin vorgenommenen Zuschreibungen von Verantwortung und sucht nach einer interkulturell tragfähigen ethischen Begründung. Es ergänzt damit die friedensethische Diskussion, die sich bislang vor allem auf die Frage der Gewaltanwendung im Rahmen der R2P konzentriert hat.

Adopting an original theoretical framework, the author demonstrates that legal empowerment can change the distribution of power in a given refugee situation, facilitating the exercise of individual agency and assisting in the reform of the opportunity structure available to the individual. Thus, by helping to increase the capability of refugees to participate actively in the decisions that most affect their core rights and interests, participatory approaches to legal empowerment can also assist in securing other capabilities, ultimately ensuring that refugees are able to live dignified lives while in protracted exile.     Abstract: Die Entwicklung des internationalen Rechts ist eng mit der Annexion außereuropäischer Gebiete verknüpft – und damit auch mit der systematischen Unterdrückung und Entrechtung der dort lebenden Menschen. Bis heute, so Wolfgang Kaleck und Karina Theurer, seien koloniale Machtstrukturen im Recht enthalten und legitimierten dadurch auch gegenwärtige Situationen von Ausbeutung und Ungleichheit. Kaleck und Theurer verbinden in ihrem Band theoretische Ansätze mit der Praxis und beziehen auch die Perspektiven von Aktivistinnen und Anwälten ein. Deutlich wird: Gewalt und Willkür der Kolonialisierung wurde seit dem 16. Jahrhundert im internationalen Recht formell legitimiert und dadurch als Unrecht "unsichtbar". Eine Aufarbeitung der Kolonialvergangenheit und das Sichtbarmachen der rassistischen Spuren, die diese im Recht hinterlassen hat, sei für eine langfristige Dekolonialisierung des Rechts daher dringend notwendig.

    Abstract: Das Buch untersucht das menschenrechtliche Verbot der Diskriminierung aufgrund der Rasse einschließlich der Schutzvorschriften gegen Hassrede und beleuchtet umfassend die relevanten Entscheidungen unterschiedlicher nationaler und internationaler Gerichte. Es folgt dabei einem interdisziplinären und rechtsvergleichenden Ansatz, der sozial- und kulturwissenschaftliche Theorien und Befunde einbezieht, um rechtsdogmatische Fragen im Bereich des Antidiskriminierungsrechts zu erörtern. Die Entscheidungen ausländischer Gerichte werden schlaglichtartig dargestellt, soweit sie für die Analyse relevant sind. Zugrunde liegt die Frage, was heute unter Rassismus zu verstehen ist und ob Phänomene wie Ausländer- und Fremdenfeindlichkeit sowie Rechtsextremismus darunter fallen. Insbesondere Rasse als Rechtsbegriff wird ausführlich besprochen. Zentrale Bezugspunkte für die folgende Auseinandersetzung mit dem „Recht gegen rassische Diskriminierung“ sind die Europäische Rasserichtlinie (Richtlinie 2000/43/EG), die Antirassismuskonventionen der Vereinten Nationen und die Europäische Menschenrechtskonvention (EMRK). Das deutsche Grundgesetz wendet sich in Art. 3 Abs. 3 S. 1 GG gegen Rassismus, aber eine umfangreiche Dogmatik, die dem heutigen Phänomen des Rassismus gerecht werden kann, fehlt. Das vorliegende Werk leistet mithilfe eines menschenrechtsinformierten und differenzierten Verständnisses von Rassismus hierzu einen wichtigen Beitrag. Damit soll die These begründet werden, dass nur ein strukturelles Verständnis von Rassismus das Recht gegen Rassismus wirksam werden lässt.

    Abstract: Durch die Analyse der Beziehungen zwischen NGOs, dem UN-Sicherheitsrat und den Menschenrechten wird in diesem Buch argumentiert, dass sowohl NGOs als auch der UN-Sicherheitsrat die Menschenrechtssemantik selektiv in Bezug auf die Orte und Akteure, die sie betreffen, anwenden. Es beobachtet Wissen und Macht als Kräfte, die sich gegenseitig beeinflussen, was eine Erklärung dafür sein kann, wie Global Governance funktioniert. Darüber hinaus untersucht das Buch die Idee, dass Recht, abgesehen von der Durchdringung traditioneller Strukturen, von der Basis der Gesellschaft in Richtung institutioneller Bereiche aufsteigen kann. In diesem Zusammenhang schlägt der Autor vor, dass das Zusammenspiel zwischen nichtstaatlichen Akteuren und politischen Institutionen die Bottom-up-Prozesse im Zusammenhang mit der Gesetzgebung und der Gestaltung politischer Entscheidungen fördert. In Anbetracht der kritischen Probleme, die sowohl die NRO als auch der UN-Sicherheitsrat in Bezug auf Repräsentation und Reaktionsfähigkeit haben, stellt die Arbeit fest, dass die Beziehung zwischen ihnen auf eine ausschließende, technokratische und arkane Weise stattfindet.

    Abstract: International human rights law has emerged as an academic subject in its own right, separate from, but still related to international law. This book explains the distinctive nature of this discipline by examining the influence of the idea of human rights on general international law. Rather than make use of a particular moral philosophy or political theory, it explains human rights by examining the way the term is deployed in legal practice, on the understanding that words are given meaning through their use. Relying on complexity theory to make sense of the legal practice of the United Nations, the core human rights treaties, and customary international law, the work demonstrates the emergence of the moral concept of human rights as a fact of the social world. It reveals the dynamic nature of this concept, and the influence of the idea on the legal practice, a fact that explains the fragmentation of international law and special nature of international human rights law.

    Abstract: Von Staaten können Gefahren ausgehen und Völkerrechtsbrüche begangen werden, auf die andere Staaten zum Schutz ihrer selbst und ihrer Bewohner reagieren müssen. Zugleich sind die Staaten durch die Globalisierung wirtschaftlich auf das Engste vernetzt und vom grenzüberschreitenden Handel abhängig geworden. Damit sind Wirtschaftssanktionen das Mittel der Wahl, um Gefahren zu begegnen und das Völkerrecht durchzusetzen. Staatenbezogene Sanktionen treffen zuerst die Bevölkerung des Zielstaates. Das traditionelle formale Verständnis der Staatensouveränität konnte keine effektiven rechtlichen Rahmenbedingungen hervorbringen. Neuere völkerrechtliche Entwicklungen stellen das Individuum generell in den Vordergrund, materialisieren die Souveränität vor dem Hintergrund der responsibility to protect mit menschenrechtlichen Schutzpflichten und betonen die Frage der Verhältnismäßigkeit. Matthias Valta behandelt das Welthandelsrecht, das Interventionsverbot, das Recht der Gegenmaßnahmen und die Grund- und Menschenrechte, differenziert zwischen Völkerrecht, Europarecht und deutschem Recht und betrachtet exemplarisch vier Fallstudien aus dem Irak, Iran, Kuba und Russland.
    Abstract: In times of worldwide economic interdependence, economic sanctions are the instrument of choice to counter violations of international law by states, even if they affect the population first. International trade law, an increasing materialization of sovereignty and the non-intervention principle, the law of counter-measures, basic and human rights and proportionality provide the basis as well as limitations for their use.

But the reality is far more problematic, as Eric Weitz shows in this compelling global history of the fate of human rights in a world of nation-states. Through vivid histories drawn from virtually every continent, A World Divided describes how, since the eighteenth century, nationalists have struggled to establish their own states that grant human rights to some people. At the same time, they have excluded others through forced assimilation, ethnic cleansing, or even genocide. From Greek rebels, American settlers, and Brazilian abolitionists in the nineteenth century to anticolonial Africans and Zionists in the twentieth, nationalists have confronted a crucial question: Who has the “right to have rights?” A World Divided tells these stories in colorful accounts focusing on people who were at the center of events. And it shows that rights are dynamic. Proclaimed originally for propertied white men, rights were quickly demanded by others, including women, American Indians, and black slaves. A World Divided also explains the origins of many of today’s crises, from the existence of more than 65 million refugees and migrants worldwide to the growth of right-wing nationalism.
