    Abstract: Constituent power is the power to create new constitutions. Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have reverted to it to defend the legality of transforming the constitutional order through procedures not contemplated in the constitution's amendment rule, but considered participatory enough to be equivalent to 'the people in action', and these0attempts have sometimes been sanctioned by courts. 0

    Abstract: 'Aloha' is at once the most significant and the most misunderstood word in the indigenous Hawaiian lexicon. For Kanaka Maoli people, the concept of 'aloha' is a representation and articulation of their identity, despite its misappropriation and commandeering by non-native audiences in the form of things like the 'hula girl' of popular culture. Considering the way aloha is embodied, performed, and interpreted in native Hawaiian literature, music, plays, dance, drag performance, and even ghost tours from the twentieth century to the present, Stephanie Nohelani Teves shows that misunderstanding of the concept by non-native audiences has not prevented the Kanaka Maoli from using it to create and empower community and articulate its distinct Indigenous meaning.

    Abstract: Given the vast inventory of verbal and visual images of nonhuman animals disseminated for millennia to debase and bestialize Jews (the Bestiarium Judaicum), this work asks: What is at play when Jewish-identified writers employ such figures in their narratives and poems? Bringing together Jewish cultural studies, examining how Jews have negotiated Jew-Gentile difference, and critical animal studies, analyzing the functions served by asserting human-animal difference, this monograph focuses on the writings of primarily Germanophone authors, including Sigmund Freud, Heinrich Heine, Franz Kafka, Gertrud Kolmar, H. Leivick, Felix Salten, and Curt Siodmak. It ferrets out of their nonhuman-animal constructions their responses to the bestial answers upon which the Jewish and animal questions converged and by which varieties of the species 'Jew' were depicted.

    Abstract: Comparative constitutional law has a long pedigree, but the comparative study of constitution-making has emerged and taken form only in the last quarter-century. While much of the initial impetus came from the study of the American and French constituent assemblies in the late eighteenth century, this volume exemplifies the large comparative scope of current research. The contributors discuss constituent assemblies in South East Asia, North Africa and the Middle East, Latin America, and in Nordic countries. Among the new insights they provide is a better understanding of how constituent assemblies may fail, either by not producing a document at all or by adopting a constitution that fails to serve as a neutral framework for ordinary politics. In a theoretical afterword, Jon Elster, an inspirational thinker on the current topic, offers an analysis of the micro-foundations of constitution-making, with special emphasis on the role of crises-generated passions.

    Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. Diego Acosta uses this analysis to assess whether the laws are truly innovative and exceptional, as well as evaluating their feasibility, strengths and weaknesses.     Abstract: The book explores how international organizations (IOs) have expanded their powers over time without formally amending their founding treaties. IOs intervene in military, financial, economic, political, social, and cultural affairs, and increasingly take on roles not explicitly assigned to them by law. The proposed book will contend that this 'mission creep' has allowed IOs to intervene internationally, most often in the Global South, in a way that has allowed them to recast institutions within and interactions among states, societies, and peoples on a broadly Western, liberal model. Adopting a historical and interdisciplinary, socio-legal approach, it supports this claim through detailed investigations of historical episodes involving three very different organizations: the International Labour Organization in the interwar period; the United Nations in the two decades following the Second World War; and the World Bank from the 1950s through to the 1990s. The book draws on a wide range of original institutional and archival materials, bringing to light little-known aspects of each organization's activities, identifying continuities in the ideas and practices of international governance across the twentieth century, and speaking to a range of pressing theoretical questions in present-day international law and international relations --Front flap of the book

    Abstract: German constitutionalism has gained a central place in the global comparative debate, but what underpins it remains imperfectly understood. Its distinctive understanding of the rule of law and the widespread support for its powerful Constitutional Court are typically explains in one of two ways: either as a story of change in a reaction to National Socialism or as the continuation of an older nineteenth-century line of constitutional thought that emphasizes the function of constitutional law as a constraint on state power. But while both narratives account for some important features, their explanatory value is ultimately overrated. This book adopts a broader comparative perspective to understand the rise of the German Constitutional Court. It interprets the particular features of German constitutional jurisprudence and the Court's strength as a reconciliation of two different legal paradigms: first, a hierarchical legal culture, as opposed to a more co-coordinated understanding of legal authority such as prevails in the United States; and, secondly, a more recent paradigm of transformative constitutionalism, which is most often associated with countries like South Africa and India. -- From book jacket

    Abstract: In this book, David Bello offers a new and radical interpretation of how China's last dynasty, the Qing (1644–1911), relied on the interrelationship between ecology and ethnicity to incorporate the country's far-flung borderlands into the dynasty's expanding empire. The dynasty tried to manage the sustainable survival and compatibility of discrete borderland ethnic regimes in Manchuria, Inner Mongolia, and Yunnan within a corporatist 'Han Chinese' imperial political order. This unprecedented imperial unification resulted in the great human and ecological diversity that exists today. Using natural science literature in conjunction with under-utilized and new sources in the Manchu language, Bello demonstrates how Qing expansion and consolidation of empire was dependent on a precise and intense manipulation of regional environmental relationships

    Abstract: The former Soviet empire spanned eleven time zones and contained half the world's forests; vast deposits of oil, gas and coal; various ores; major rivers such as the Volga, Don and Angara; and extensive biodiversity. These resources and animals, as well as the people who lived in the former Soviet Union - Slavs, Armenians, Georgians, Azeris, Kazakhs and Tajiks, indigenous Nenets and Chukchi - were threatened by environmental degradation and extensive pollution. This environmental history of the former Soviet Union explores the impact that state economic development programs had on the environment. The authors consider the impact of Bolshevik ideology on the establishment of an extensive system of nature preserves, the effect of Stalinist practices of industrialization and collectivization on nature, and the rise of public involvement under Khrushchev and Brezhnev, and changes to policies and practices with the rise of Gorbachev and the break-up of the USSR.

    Abstract: The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration.

In contrast, modern societies create open access to economic and political organizations, fostering political and economic competition. The book provides a framework for understanding the two types of social orders, why open access societies are both politically and economically more developed, and how some 25 countries have made the transition between the two types

    Abstract: The Killing Trap, first published in 2005, offers a comparative analysis of the genocides, politicides and ethnic cleansings of the twentieth century, which are estimated to have cost upwards of forty million lives. The book seeks to understand both the occurrence and magnitude of genocide, based on the conviction that such comparative analysis may contribute towards prevention of genocide in the future. Manus Midlarsky compares socio-economic circumstances and international contexts and includes in his analysis the Jews of Europe, Armenians in the Ottoman Empire, Tutsi in Rwanda, black Africans in Darfur, Cambodians, Bosnians, and the victims of conflict in Ireland. The occurrence of genocide is explained by means of a framework that gives equal emphasis to the non-occurrence of genocide, a critical element not found in other comparisons, and victims are given a prominence equal to that of perpetrators in understanding the magnitude of genocide

    Abstract: Literacy and Literacies is an engaging account of literacy and its relation to power. The book develops a synthesis of literacy studies, moving beyond received categories, and exploring the domain of power through questions of colonialism, modern state formation, educational systems and official versus popular literacies. Collins and Blot offer in-depth critical discussion of particular cases and discuss the role of literacies in the formation of class, gender, and ethnic identity. Through their analysis of two domains - those of literacies and power, and of literacies and subjectivity - they challenge received assumptions about literacy, intellectual development and social progress and argue that neither 'universalist' nor 'particularist' accounts offer satisfactory approaches to the phenomenon.     Abstract: In this book, Thomas Buoye examines the impact of large-scale economic change on social conflict in eighteenth-century China. He draws upon a large body of actual, documented homicide cases originating in property disputes to recreate the social tensions of rural China during the Qianlong reign (1736–1795). The development of property rights, a process that had begun in the Ming dynasty, was accompanied by other changes that fostered disruption and conflict, including an explosion in the population growth and the increasing strain on land and resources, and increasing commercialization in agriculture. Buoye challenges the 'markets' and 'moral economy' theories of economic behaviour. Applying the theories of Douglass North for the first time to this subject, he uses an institutional framework to explain seemingly irrational economic choices. Buoye examines demographic and technological factors, ideology, and political and economic institutions in rural China to understand the link between economic and social change

    Abstract: English Population History from Family Reconstitution 1580–1837 is the most important single contribution to English historical demography since Wrigley and Schofield's Population History of England. It represents the culmination of work carried out at the Cambridge Group for the History of Population and Social Structure over the past quarter-century. This work demonstrates the value of the technique of family reconstitution as a means of obtaining accurate and detailed information about fertility, morality, and nuptiality in the past. Indeed, more is now known about many aspects of English demography in the parish register period than about the post-1837 period when the Registrar-General collected and published information. Using data from 26 parishes, the authors show clearly that their results are representative not only of the demographic situation of the parishes from which the data were drawn, but also of the country as a whole.     Abstract: The birthplace of the nation-state and modern nationalism at the end of the eighteenth century, Europe was supposed to be their graveyard at the end of the twentieth.     Abstract: Marc Bloch has been very influential in the development of both history and social science. Comparative historians, historical geographers, and historical sociologists have all pointed to his work as a model. This book is the first detailed examination of the relationship of his work to both Durkheimian sociology and Vidalian geography. Through a careful examination of the debates in which he was involved and the institutional circumstances in which he worked, it places Bloch's work within its intellectual context, and assesses the nature of his contribution. Professor Friedman argues that, despite the frequent claims of scholars in history, sociology and geography, Bloch did not adopt either the Durkheimian or Vidalian approach. Both disciplines were central to his intellectual development, but Bloch's relationships to the two disciplines were interdependent, and the result was his own highly acclaimed and unique approach

    Abstract: Cultural Politics at the Fin de Siècle scrutinises ways in which current conflicts of 'race', class, and gender have their origins in the cultural politics of the last fin de siècle, whose influence stretched from the 1890s, when economic depression signalled the end of Britain's role as 'the workshop of the world', to 1914 when world war accelerated imperial decline. This collaborative venture by new and established scholars includes discussion of the 'New Woman', the reconstruction of masculinities, and of feminism and empire. The imperialist theme is pursued in essays on Yeats and Ireland, Gilbert and Sullivan, and the figure of the vampire. The rise of socialism and psychoanalysis, and the relationship between nascent modernism and late twentieth-century postmodernism are also addressed in this radical account

    Abstract: Until the late 1960s, most Western scholars studying the history, culture, social and political life and economy of Russia and the Soviet Union, paid scant attention to the participation and experience of women. The multifarious ways in which gender roles and perceptions of gender were influenced by and in turn influenced the heterogeneous cultures of the Soviet empire were largely ignored. However, this neglect has slowly been rectified and now the study of women and gender relations has become one of the most productive fields of research into Russian and Soviet society. This volume demonstrates the originality and diversity of this recent research. Written by leading Western scholars, it spans the last decade of tsarist Russia, the 1917 revolutions and the Soviet period.     Abstract: This is the first English translation of the first work of Otto von Gierke, arguably the greatest historian of ideas of the nineteenth century. Community in Historical Perspective includes much of the first volume of Das Deutsche Genossenschaftsrecht, originally published in 1868, and the texts translated here have become essential reading for anyone interested not only in the history of ideas and alternatives to conventional socialism and liberalism, but also, as recent experience has shown, contemporary European affairs. Von Gierke's represented an unparalleled attempt to justify a political programme of structural pluralism, and to interpret the entire course of European history from the Dark Ages onwards as a progressive interaction between 'fellowship' (or 'comradeship') and 'lordship' (or 'sovereignty'). This interaction was to generate a polity of autonomous associations within a constitutional state based upon consent and federal unity, and von Gierke here laid the basis for a distinctively Germanic programme of federalism and quasi-pluralism, with a strongly nationalist emphasis upon the unique capacity of Germans, despite long periods of absolute rule, for corporate self-management

    Abstract: This book investigates the ways in which literacy was important in early mediaeval Europe, and examines the context of literacy, its uses, levels, and distribution, in a number of different early mediaeval societies between c. 400 and c. 1000. The studies, by leading scholars in the field, set out to provide the factual basis from which assessments of the significance of literacy in the early mediaeval world can be made, as well as analysing the significance of literacy, its implications, and its consequences for the societies in which we observe it. In all cases, the studies represent recent research and bring evidence such as the recent archaeological discoveries at San Vincenzo al Volturno to the subject. They provide fascinating insight into the attitudes of early mediaeval societies towards the written word and the degree to which these attitudes were formed. This period is shown as fundamental for the subsequent uses of literacy in mediaeval and modern Europe

    Abstract: In this collection of innovative essays an international team of contributors provides theoretical, methodological and substantive empirical analysis of migration in Latin America. Ranging in time from the sixteenth through the mid-nineteenth century, the studies will attract the attention of all Latin American specialists. They provide conclusive evidence of the ubiquity of migration in the early modern period, challenging views of immobile peasants held in the grip of static colonialism. They show that to migrate was one of the most important means of coping with Spanish colonialism. The essays are written from a multi-disciplinary perspective and thus provide data and interpretations that are novel and represent important contributions to colonial Latin American studies. They address the basic questions of who migrated, why did they migrate, how can one interpret migration fields, what role did economic opportunity or ecological conditions play, and not least, what was the impact of migrants on non-migrant communities in both rural and urban areas.     Abstract: This book examines the social history and historical geography of the most important agricultural pressure groups in France since about 1918. Some were practical and pragmatic groups (co-operatives, banks and mutual-aid associations), others were inspired by right- or left-wing political movements (the Peasant Corporation under Vichy), yet others were sponsored by the Catholic Church (the Young Christian Farmers). Whatever their origins, all were important in shaping the evolution of French farming this century. The transformation of an isolated, autarkic peasantry into highly efficient agricultural producers, the role of the state in influencing agricultural modernization and the place of the European community in French political and agricultural life have been affected by an increasingly complex and interlinked network of organizations that are the subject of this book. Their history and geography are revealing indicators of the social, cultural and economic evolution of rural France and, by combining an historical approach with a consideration of their contemporary role, the book serves to elucidate their role in shaping the countryside of the future

    Abstract: This book follows the social, economic and demographic transformations of the Alpine area from the late Middle Ages. Its aim is to reassess the image of the upland community which emerges from the work of historians, geographers and social anthropologists. The book therefore deals at length with such problems as the causes and consequences of emigration and patterns of marriage and inheritance in favouring or hampering the adjustments of local populations to changing economic or ecological circumstances, and tackles the vexed question of the relative importance of cultural and environmental factors in shaping family forms and community structures. Although its foundation lies in a long period of anthropological fieldwork conducted in an Alpine community, Upland Communities relies on the methods and conceptual tools of historical demography. Combined with a long-term historical perspective, its broad comparative approach unveils an unexpected diversity in regional and spatial demographic patterns and questions a number of deep-rooted but ultimately misleading notions concerning mountain society and its alleged backwardness in the past

    Abstract: This book provides a detailed examination of the demographic behavior of families during the eighteenth and nineteenth centuries in a sample of fourteen villages in five different regions of Germany. It is based on the reconstituted family histories of vital events (births, deaths and marriages) compiled by genealogies for the entire populations of these villages. The book applies the type of micro-level analysis possible with family reconstitution data for the crucial period leading to and encompassing the early stages of the demographic transition, including the initial onset of the decline of fertility to low modern levels. The analysis explores many aspects of demographic behavior which have been largely ignored by previous macro-level investigations of the demographic transition. These include infant and child mortality, maternal mortality, marriage, marital dissolution, bridal pregnancy and illegitimacy. The core of the study, however, deals with marital reproduction, examining the modernization of reproductive behavior in terms of the transition from a situation of natural fertility to one characterized by pervasive family limitation

    Abstract: In the seventeenth and eighteenth centuries, widespread fear of criminal assault motivated the publication of hundreds of pamphlets tracing the lives and misdeeds of London's most notorious rogues. Turned to Account is a study that focuses on the popular genre of criminal biography, examining how it played upon and reflected English society's fears and interest in aberrant behaviour. The author has not produced a criminal history, but an intriguing distillation of some 2,000 separate narratives describing the lives, deeds, and dying words of thieves, murderers, and various scoundrels. Lincoln Faller examines ways in which ordinary Englishmen read, wrote, and presumably thought on the subject of criminal actions and character. He completes his treatment by showing how the pamphlets served to delineate the lines of socially acceptable behaviour. Faller has chosen his examples with skill and economy to produce a comprehensive and interesting work

    Abstract: Adultery, fornication, breach of marriage contract, sexual slander - these, along with religious offences of various kinds, were typical of the cases dealt with by the ecclesiastical courts in Elizabethan and early Stuart England. What was it like to live in a society in which personal morality was regulated by law in this fashion? How far-reaching was such surveillance in actual practice? How did ordinary people view the courts - as useful institutions upholding accepted standards, or as an alien system purveying unwanted values? How effective were the church courts in influencing attitudes and behaviour?     Abstract: This book assesses the impact of writing on human societies, both in the Ancient Near East and in twentieth-century Africa, and highlights some general features of social systems that have been influenced by this major change in the mode of communication. Such features are central to any attempt at the theoretical definition of human society and such constituent phenomena as religious and legal systems, and in this study Professor Goody explores the role of a specific mechanism, the introduction of writing and the development of a written tradition, in the explanation of some important social differences and similarities. Goody argues that a shift of emphasis from productive to certain communicative processes is essential to account adequately for major changes in human societies. Whilst there have been previous descussions of the effect of literacy upon social organisation, no study has hitherto presented the general synthesis developed here

    Abstract: This book is a study of the effect of occupation on industrial behaviour and how occupation affects social, community and family life. The fishing industry was one of the last to experience the Industrial Revolution. In East Anglia, steam propulsion was introduced within the working life of the oldest of those interviewed for this book, and a number of radical changes in working practices, capital cost and technical development were concentrated into the brief period 1880–1914. As these changes occurred with different timing and force in the two major sectors of the industry - trawling and drifting - East Anglia is an ideal location in which to consider the effect of the forces and relations of production: the fishermen's industrial, social and political attitudes are related to their specific work experience
