    Kurzfassung: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Kurzfassung: "Beginning with the 1990s, the subject of caste has seen a profound increase in interest among scholars. What was until then approached as a fossilized tradition of the ritual-obsessed Hindus refusing to see the progressive spirits of the emerging world and studied as a branch of anthropology, suddenly began to be seen as a complex reality deeply embedded in a range of institutions and social practices, attracting scholars from a wide range of disciplines--sociology, political science, history, literature, and even economics. Underlying this opening of the subject of caste were many factors: epistemic, empirical, and political. Caste is no longer approached through the classical binaries of 'traditional' and 'modern'; the 'East' and the 'West'; or the 'closed' and 'open' systems of stratification. With the growing consolidation of caste-based identities among those ranked lower down in the hierarchy since the 1990s, raising questions of citizenship and dignity, the subject has acquired a new salience. As the emerging research shows, the realities of caste on the ground have always been diverse across regions, often contested and ever changing.     Kurzfassung: The 'Jewish mother' figure is a hallmark of Jewish culture, one which appears in the works of rabbis, artists, poets, and activists across time and place. While depictions of mothers and motherhood abound in Jewish writings, they vary significantly according to social context. These representations therefore offer important insights into the Jewish cultural imagination, and the ways in which writers resort to the figure of the Jewish mother to comprehend and construct their world. This book highlights the complex network of symbols and images associated with Jewish mothers and motherhood as well as the vast array of social, historical, and cultural patterns that characterizations of mothers reflect.

At various points in Jewish history, the primary mode of transmission has changed in response to political, geographical, technological, and cultural shifts. Contemporary textual transmission in Jewish culture has been influenced by secularization, the return to Hebrew and the emergence of modern Yiddish, and the new centers of Jewish life in the United States and in Israel, as well as by advancements in print technology and the invention of the Internet. This volume deals with various aspects of textual transmission in Jewish culture in the last two centuries.

Presenting the complete translated and annotated text of the Inquisition trial of Crispina Peres, an African woman born in the Guinea-Bissau region, of a Portuguese father and an African mother, it documents the Portuguese Inquisition's religious persecution of Africans on African soil. Set in a slave port in 17th century West Africa, the trial focuses on the worldview of an African woman accused of engaging in African rites and witchcraft, who is imprisoned and brought before Inquisitioners in Lisbon. It highlights her resourcefulness, resilience and spirited defence of her innocence, providing precious details on her life, household, work, health and social and commercial networks in this understudied African region.

Wie wird das Begleiten vermittelt, welche Bedeutungen erhält das Sterben und welcher gesellschaftliche Umgang mit der Endlichkeit wird dabei sichtbar? Diese ethnographische Studie widmet sich einem sozialen Bereich, der explizit macht, was in verwandten Feldern implizit bleibt.

The liberty to speak freely is often questioned; what is the relationship between this freedom and other rights and values, how far does this freedom extend, and how is it applied to contemporary challenges? They examine anti-Jewish discrimination using a two-pronged approach. First, they combine and integrate ideas and theories from classic studies of anti-Semitism with social science theories on the causes of discrimination. Second, they use previously unavailable data on discrimination against Jews in 76 countries with significant Jewish minority populations to analyse the patterns and causes of discrimination.

    Kurzfassung: "To survive, let alone flourish, we need to be sure of - securely tied to - at least one other person. We also need to be sure of our general acceptance within the wider social world. This book explores the normative implications of taking our core social needs seriously. Chapter 1 sketches out what those needs are, and Chapter 2 shows that they ground a fundamental, but largely neglected human right against social deprivation. Chapter 3 then argues that this human right includes a right to sustain the people we care about, and that often, when we are denied the resources to sustain others, we endure social contribution injustice. Chapters 4 - 6 explore the tension between our needs for social inclusion and our needs for interactive and associative freedom, showing that social inclusion must take priority. While Chapters 5 and 6 defend a narrow account of freedom of association, Chapter 7 shows that the moral ballgame changes once we have made morally messy associative decisions. Sometimes we have rights remain in associations that we had no right to form. Finally, Chapter 8 exposes the distinct social injustices that we do to people whom we deem to be socially threatening. Overall, the book identifies ways to change our social and political practices, and our personal perspectives, to better honour the fact that we are fundamentally social beings."

    Kurzfassung: Centering Pakistan in a story of transnational Islam stretching from South Asia to the Middle East, Simon Wolfgang Fuchs offers the first in-depth ethnographic history of the intellectual production of Shi'is and their religious competitors in this 'Land of the Pure.' The notion of Pakistan as the pinnacle of modern global Muslim aspiration forms a crucial component of this story. It has empowered Shi'is, who form about twenty percent of the country's population, to advance alternative conceptions of their religious hierarchy while claiming the support of towering grand ayatollahs in Iran and Iraq. Fuchs shows how popular Pakistani preachers and scholars have boldly tapped into the esoteric potential of Shi'ism, occupying a creative and at times disruptive role as brokers, translators, and self-confident pioneers of contemporary Islamic thought.

    Kurzfassung: Global legal pluralism has become one of the leading analytical frameworks for understanding and conceptualizing law in the 21st century. Wherever one looks, there is conflict among multiple legal regimes - some of which are state-based; some are built and maintained by nonstate actors; some fall within the purview of local authorities and jurisdictional entities; and some involve international courts, tribunals, and arbitral bodies, as well as regulatory organisations. Global legal pluralism has provided, first and foremost, a set of useful analytical tools for describing this conflict among legal and quasi-legal systems.

    Kurzfassung: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Kurzfassung: Long description: Bei einer Bestattung sind es Dinge der materialen Kultur, die sorgsam aufbewahrt werden: Fotos, Kleidungsstücke, Briefe, Erinnerungsurnen oder -diamanten. Diese Artefakte haben für die Angehörigen die Bedeutung von Privat-Reliquien. Während die katholische Kirche in der kultischen Verehrung heiliger Überreste eine lange Tradition pflegt, kultiviert der Protestantismus diese Praxis nicht. In der spätmodernen Religions- und Bestattungspraxis fließen die konfessionellen Kontraste jedoch ineinander. Das Wiederaufkommen des Nahverhältnisses von Dingen und Menschen in der Sepulkralkultur signalisiert theologischen, religions- und kulturwissenschaftlichen Klärungsbedarf, dem sich die Beiträger_innen des Bandes verständigungsorientiert im interdisziplinären Diskurs annehmen
    Kurzfassung: Biographical note: Thomas Klie (Dr. theol.), geb. 1956, ist Professor für Praktische Theologie an der Theologischen Fakultät an der Universität Rostock. Seine Forschungsschwerpunkte sind Pastoral- und Religionsästhetik, spätmoderne Religions- und Kasualkultur und Religionshybride, Performanztheorie und Sepulkralkultur. Jakob Kühn (Dipl. theol.), geb. 1988, ist wissenschaftlicher Mitarbeiter für Praktische Theologie an der Theologischen Fakultät an der Universität Rostock und promoviert zum Thema Kasualrede. Seine Forschungsschwerpunkte sind Homiletik, Kasualtheorie sowie Sepulkralkultur

    Kurzfassung: In the past twenty years, international criminal law has become one of the main areas of international legal scholarship and practice. Most textbooks in the field describe the evolution of international criminal tribunals, the elements of the core international crimes, the applicable modes of liability and defences, and the role of states in prosecuting international crimes. The Oxford Handbook of International Criminal Law, however, takes a theoretically informed and refreshingly critical look at the most controversial issues in international criminal law, challenging prevailing practices, orthodoxies, and received wisdoms. Some of the contributions to the Handbook come from scholars within the field, but many come from outside of international criminal law, or indeed from outside law itself. The chapters are grounded in history, geography, philosophy, and international relations. The result is a Handbook that expands the discipline and should fundamentally alter how international criminal law is understood.
