    Abstract: Zur Bewältigung von Organisierter (Drogen)Kriminalität finden zeitlich und finanziell aufwändige, meist verdeckte Ermittlungen gegen eine Vielzahl von Akteuren statt. Um diese Hintergrundermittlungen nicht vorzeitig aufzudecken, wird die sog. ›Legendierte Kontrolle‹ eingesetzt, bei der die Ermittlungsbehörden eine Durchsuchung als allgemeine Verkehrskontrolle tarnen. Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt. Ein besonderer Schwerpunkt liegt auf der Frage, ob entgegen dem Grundsatz der Aktenwahrheit eine legendierte, also unzutreffende oder unvollständige Aktenführung erlaubt sein kann. Hier werden die Grenzen der staatlichen Täuschungsbefugnis – trotz der Maxime einer effektiven Strafverfolgung – gegenüber Beschuldigten herausgearbeitet

    Abstract: Wenigen anderen Ethnologen in der Bundesrepublik Deutschland war es vergönnt, so wie Rüdiger Schott durch eigene Aktivitäten als individuelle Forscherpersönlichkeit maßgebend zum Aufbau und Ausbau ihrer Disziplin beizutragen. Dieser Umstand verdankt sich einerseits den von ihm seit den 60er Jahren durchgeführten Feldforschungen bei den Bulsa in Nordghana und den in den 80er Jahren angestellten ethnographischen Erhebungen bei den Lyela in Burkina Faso (vormals: Obervolta), die ihm internationale Reputation und hohe wissenschaftliche Anerkennung eingetragen haben, andererseits der permanenten Umsetzung der erreichten Forschungsergebnisse in die akademische Lehre und in weitere Forschungen, die heute als beispielhaft gelten.
    Abstract: Nicht von ungefähr gehört das Seminar für Völkerkunde der Universität Münster, das von Rüdiger Schott begründet wurde und im April 1990 auf sein 25jähriges Bestehen zurückblicken konnte, gegenwärtig zu den auch im Ausland wohlbekannten deutschen Forschungsstätten seines Fachgebiets. Dies ist nicht zuletzt deswegen der Fall, weil Schott von Anbeginn seine ethnologischen Forschungen in ständigem Austausch mit einer Reihe benachbarter Disziplinen, insbesondere mit den sozialen Handlungswissenschaften betrieben hat, wie beispielsweise mit den Wirtschaftswissenschaften und der Soziologie, der Rechtswissenschaft und den Religionswissenschaften.
    Abstract: Seine Befähigung und bis auf den heutigen Tag praktizierte Bereitschaft zur Kooperation mit diesen Nachbardisziplinen basiert auf der Einsicht, daß die Ethnologie ihre eigene Identität nur gewinnen und fortentwickeln kann, wenn sie sich auch auf der Ebene der Ausbildung ihrer analytischen Denkansätze und Grundbegriffe hierfür hinreichend kontaktfähig hält. Was Person, Leben und Werk von Rüdiger Schott angeht, so sind die äußeren Rahmendaten seines bisherigen Forscher- und Universitätslebens rasch berichtet. Jedoch wird eine auf die Forschungsinhalte und die erzielten Ergebnisse gerichtete Analyse den von ihm vorgelegten Resultaten kaum gerecht, wenn sie sich nur auf deren Relevanz für die Ethnologie als solche beschränken wollte.

    Abstract: The distinction between humans and the natural world is an artefact and more a matter of linguistic communication than a conceptual separation. This Element proposes ecosemiotics as an epistemological tool to better understand the relationship between human and natural processes. Ecosemiotics with its affinity to the humanities, is presented here as the best disciplinary approach for interpreting complex environmental conditions for a broad audience, across a multitude of temporal and spatial scales. It is proposed as an intellectual bridge between divergent sciences to incorporate within a unique framework different paradigms.     Abstract: This book adds to the growing literature on dynamics of regional development in the global South by mapping the politics and processes contributing to the distinct developmental trajectory of Tamil Nadu, southern India. Using a novel interpretive framework and drawing upon fresh data and literature, it seeks to explain the social and economic development of the state in terms of populist mobilization against caste-based inequalities. Dominant policy narratives on inclusive growth assume a sequential logic whereby returns to growth are used to invest in socially inclusive policies. By focusing more on redistribution of access to opportunities in the modern economy, Tamil Nadu has sustained a relatively more inclusive and dynamic growth process. Democratization of economic opportunities has made such broad-based growth possible even as interventions in social sectors reinforce the former. The book thus also speaks to the nascent literature on the relationship between the logic of modernisation and status based inequalities in the global South.

From the perspective of law alone, business falls within the general sphere of private law, further broken down into discrete sub-spheres, particularly corporate law and commercial law. The human rights component is situated in constitutional and international law. Prima facie, 'business' and 'human rights' fall into distinct spheres of regulation and differ in their primary sources. If law were simply approached from a compartmentalized perspective, business would be of no relevance to human rights and vice versa.     Abstract: Humans may live in the Anthropocene, but this does not affect all in the same way. How would the Anthropocene look if, instead of searching its traces in the geosphere, researchers would look for them in the organosphere, in the ecologies of humans in their entanglements with the environment? Looking at this embodied stratigraphy of power and toxicity, more than the Anthropocene, we will discover the Wasteocene. The imposition of wasting relationships on subaltern human and more-than-human communities implies the construction of toxic ecologies made of contaminating substances and narratives. While official accounts have systematically erased any trace of those wasting relationships, another kind of narrative has been written in flesh, blood, and cells. Traveling between Naples (Italy) and Agbogbloshie (Ghana), science fiction and epidemic outbreaks, this Element will take the readers into the bowels of the Wasteocene, but it will also indicate the commoning practices which are dismantling it

    Abstract: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

    Abstract: This collection explores some of the many ways in which constitutional orders engage with, and are shaped by, their exteriors. Constitutional and legal theory often marginalize 'foreign' elements, such as norms originating in other legal systems, the movement of individuals across borders, or the application of domestic law to foreign affairs. In The Double-Facing Constitution, these instances of boundary crossing lie at the heart of an alternative understanding of constitutions as permeable membranes, through which norms can and sometimes must travel. Constitutional orders are facing both inwards and outwards - and the outside world influences their interiors just as much as their internal orders help shape their surroundings.     Abstract: Migration and Integration clarifies and proposes answers for all of the politically toxic questions associated with large-scale migration from the Global South to the Western liberal democracies. Driven by the conviction that the Alt-Right is using the issues of migration and integration effectively to batter the defenses of liberal democracy, Professor Tom Farer argues that despite its strength, the moral case for open borders should be rejected and that while broadly tolerant of different life styles, the state should enforce core liberal values. Examining closely the policies and practices of various European states, Farer draws on their experience, contrasts it with that of the United States, and provides a detailed strategy for addressing the issues of who should be allowed to enter, how migrant families should be integrated and cultural conflicts resolved. This remarkable elaboration of a liberal position on migration and integration to which moderate conservatives could adhere combines powerful analysis with passionate advocacy.

    Abstract: The 1947 Partition had a major impact on issues of citizenship and rights in India and Pakistan in the decades that followed. Boundaries of Belonging shows how citizenship evolves at a time of political transition and what this meant for ordinary people, by directing attention away from South Asia's Partition 'hotspots' - Bengal and Punjab - to Partition's 'hinterlands' of Uttar Pradesh and Sindh. The analysis, based on rich archival research and fieldwork, brings out commonalities, differences, and the mutual co-construction of the 'citizen' in both places. It also reveals the way in which developments across the border, such as communal violence, could directly impact on minority rights in its neighbour. Questioning stereotypes of an increasingly 'authoritarian' Pakistan and 'democratic' India, Sarah Ansari and William Gould make a major contribution to recent scholarship that suggests the differences between India and Pakistan are overstated

Leading commentators, United Kingdom courts, and the European Court of Human Rights have de-emphasised the special importance of religious liberty. They frequently contend it falls within a more general concern for personal autonomy. In this liberal egalitarian account, religious liberty claims are often rejected when faced with competing individual interests - the neutral secular state must protect us against the liberty-constraining acts of religions. Joel Harrison challenges this account. He argues that it is rooted in a theologically derived narrative of secularisation: rather than being neutral, it rests on a specific construction of 'secular' and 'religious' spheres. This challenge makes space for an alternative theological, political, and legal vision.     Abstract: "This book has been brought to life in a period where transnational solidarity and cooperation seemed to be moving backwards rather than forwards. This was among others reflected in the so called refugee crisis in Europe in 2015. After the Brexit referendum in the United Kingdom in June 2016, and presidential elections in the US later the same year, the political agenda took a turn towards focusing primarily on the internal national perspective in relation to areas such as environmental protection, aid to countries in the Third World and trade with the outside world. It still remains to be seen when and how the United Kingdom will be leaving the European Union. In general, the EU has experienced a number of crises, among others an economic and financial crisis and later the refugee crisis, during the past years. These crises have challenged transnational solidarity in Europe. This development in Europe and the World stresses the question, whether and how transnational solidarity is possible. This book is motivated by these developments and discusses and attempts to answer this question. Our main presumption is that solidarity can create stability and sustainability (social, economic, environmental, peace etc.), within states, regions and globally, why it is crucial to gain more knowledge about it. Realization of the UN Sustainability Goals 2017 and 2030 go hand in hand with solidarity at both local, regional and global levels.     Abstract: Usually, when we discuss racial injustice, we discuss racism in our public or political life. This means that we often focus on how the state discriminates on the basis of race in its application and enforcement of laws and policies. This book draws on the synergy of political theory and civil rights law to expand the boundary of racial justice and consider the way in which racial discrimination happens outside the governmental or public sphere. 'Private racism' is about recognizing that racial injustice also occurs in our private lives, including the television and movie industry, cyberspace, our intimate and sexual lives, and the reproductive market.     Abstract: Supranational governance is being challenged by politicians and citizens around the EU as over-centralized and undemocratic. This book is premised on the idea that polycentric governance, developed by Vincent and Elinor Ostrom, is a fruitful place to start for addressing this challenge. Assessing the presence of, and potential for, polycentric governance within the EU means approaching established principles and practices from a new perspective. While the debate on these issues is rich, longstanding and interdisciplinary, it has proven difficult to sidestep the 'renationalisation/federalisation' dichotomy. The aim of this volume is not to reject the EU's institutional structure but provide a different benchmark for the assessment of its functioning. Polycentric theory highlights the importance of multilevel horizontal relationships within the EU - between states, but also between many sub-state actors, all the way down to individuals. This helps us answer the question: how do we achieve self-governance in an interdependent world?

    Abstract: The expectation of reciprocity continues to be an important factor when states' consider their legal obligations in armed conflicts. In this monograph, Peeler looks at the text and negotiations around the 1949 Geneva Conventions and the Protocols Additional to the Geneva Conventions from 1977 to demonstrate the many places where international humanitarian law maintains expectations of reciprocity. This complements an examination of US policy regarding its Prisoner of War obligations in both the Vietnam War and the Global War on Terror, demonstrating how states make use of the expectation of reciprocity found in international humanitarian law to respond to continued non-compliance by an enemy.
