    Abstract: In July 2010, Terry Jones, the pastor of a small fundamentalist church in Florida, announced plans to burn two hundred Qur'ans on the anniversary of the September 11 attacks. Though he ended up canceling the stunt in the face of widespread public backlash, his threat sparked violent protests across the Muslim world that left at least twenty people dead. In Terrified, Christopher Bail demonstrates how the beliefs of fanatics like Jones are inspired by a rapidly expanding network of anti-Muslim organizations that exert profound influence on American understanding of Islam. Bail traces how the anti-Muslim narrative of the political fringe has captivated large segments of the American media, government, and general public, validating the views of extremists who argue that the United States is at war with Islam and marginalizing mainstream Muslim-Americans who are uniquely positioned to discredit such claims. Drawing on cultural sociology, social network theory, and social psychology, he shows how anti-Muslim organizations gained visibility in the public sphere, commandeered a sense of legitimacy, and redefined the contours of contemporary debate, shifting it ever outward toward the fringe. Bail illustrates his pioneering theoretical argument through a big-data analysis of more than one hundred organizations struggling to shape public discourse about Islam, tracing their impact on hundreds of thousands of newspaper articles, television transcripts, legislative debates, and social media messages produced since the September 11 attacks. The book also features in-depth interviews with the leaders of these organizations, providing a rare look at how anti-Muslim organizations entered the American mainstream.

    Abstract: Ohne eine allgemein anerkannte reichsrechtliche Grundlage unterwarf Preußen zwischen 1792 und 1798 die seinen fränkischen Provinzen benachbarten reichsritterschaftlichen Güter mit Gewalt seiner Landeshoheit. Damit erschütterte es die Reichsverfassung in ihren Grundfesten und beschleunigte das Ende des Alten Reiches. Dabei geht sie nicht nur auf die diplomatischen, militärischen, reichsgerichtlichen und publizistischen Mittel ein, mit denen Berlin und die Reichsritterschaft um die »Reichsunmittelbarkeit« der Rittergüter rangen. Sie zeichnet auch die sozialen, politischen und reichsrechtlichen Entwicklungen nach, die die preußischen »Mediatisierungen« erst ermöglichten.   Ohne eine allgemein anerkannte reichsrechtliche Grundlage unterwarf Preußen zwischen 1792 und 1798 die seinen fränkischen Provinzen benachbarten reichsritterschaftlichen Güter mit Gewalt seiner Landeshoheit. Damit erschütterte es die Reichsverfassung in ihren Grundfesten und beschleunigte das Ende des Alten Reiches. Mit Hilfe von Quellen in- und ausländischer Archive rekonstruiert diese Arbeit die Ereignisse zwischen den Jahren 1792 bis 1798 und unterzieht sie einer Neubewertung. Insgesamt stellt die Verfasserin die universitäre Rechtspflege in den Kontext der frühneuzeitlichen Untergerichtsbarkeit und deren Formen der Konfliktbeilegung. Sie zeigt den umwälzenden Vorgang der Rezeption nicht aus Sicht der höchsten Reichsgerichte, sondern aus Perspektive eines Untergerichts. Eingehend erläutert und verglichen werden die unterschiedlichen Ansätze zur verfassungsrechtlichen Bewertung von Videoüberwachungen in den beiden Ländern, und es werden die ersten Ansätze einer Normierung in den USA vorgestellt. Die durch die einzelnen deutschen Bundesländer geschaffenen Ermächtigungsnormen werden genauer betrachtet und auf ihre Verfassungsmäßigkeit hin untersucht. Die Kinder werden so zu Opfern, wenngleich in ganz unterschiedlicher Intensität. Freiwillige Hilfs- und Unterstützungsleistungen von Seiten des Staates stehen zwar zur Verfügung, erreichen aber oftmals die Kinder nicht rechtzeitig oder vollumfänglich. Gegen den Willen der Eltern kann der Staat bislang nur in eng begrenzten Ausnahmefällen eingreifen. Die traditionelle Verfassungsinterpretation geht von einer klaren Grenzziehung zwischen elterlichem Erziehungsgrundrecht (Art. 6 Abs. 2 S. 1 GG) und staatlichem Wächteramt, insbesondere im Vorschulalter, aus. Das Elterngrundrecht - als Garant des Kindeswohls gedacht - zwinge den Staat, sich weit möglichst vom Elternhaus fernzuhalten. Die Autorin fragt nach Modifikationen der Gefährdungs- und damit Eingriffsschwelle. Neben der argumentativen Aufarbeitung dieses verfassungsrechtlichen Spannungsfeldes zielt die vorliegende Arbeit darauf, den Eltern-Kind-Bereich aus öffentlich-rechtlicher Sicht zu beleuchten; denn bislang dominiert die zivilrechtliche Perspektive des Familienrechts. Die sich aus der verfassungsrechtlichen Beurteilung ergebende Defizitanalyse wirft unterschiedliche Fragen auf: Welche Wendepunkte kann der Staat nutzen, um gefährdete Kinder frühzeitiger als bisher zu erreichen? Once a territory outside the geopolitical and cultural borders of the United States, the deserts of the West and Southwest have since emerged as canonical American landscapes. Drawing on the critical concepts of American studies and on questions and problems raised in recent debates on ecocriticism, The Poetics and Politics of the Desert investigates the spatial rhetoric of America as it developed in view of arid landscapes since the mid-nineteenth century. Gersdorf argues that the integration of the desert into America catered to the entire spectrum of ideological and political responses to the history and culture of the US, maintaining that the Americanization of this landscape was and continues to be staged within the idiomatic parameters and in reaction to the discursive authority of four spatial metaphors: garden, wilderness, Orient, and heterotopia.

    Abstract: Prophecy is the fundamental idiom of American politics-a biblical rhetoric about redeeming the crimes, suffering, and promise of a special people. Yet American prophecy and its great practitioners-from Frederick Douglass and Henry Thoreau to Martin Luther King, James Baldwin, and Toni Morrison-are rarely addressed, let alone analyzed, by political theorists. This paradox is at the heart of American Prophecy, a work in which George Shulman unpacks and critiques the political meaning of American prophetic rhetoric. In the face of religious fundamentalisms that associate prophecy and redemption with dogmatism and domination, American Prophecy finds connections between prophetic language and democratic politics, particularly racial politics. Exploring how American critics of white supremacy have repeatedly reworked biblical prophecy, Shulman demonstrates how these writers and thinkers have transformed prophecy into a political language and given redemption a political meaning. To examine how antiracism is linked to prophecy as a vernacular idiom is to rethink political theology, recast democratic theory, and reassess the bearing of religion on American political culture. Still, prophetic language is not always liberatory, and American Prophecy maintains a critical dispassion about a rhetoric that is both prevalent and problematic.

Die Verwaltung indessen, die damals ihre modern-bürokratische Form entwickelte, wird von der historischen Forschung kaum mit jenen liberalen Öffentlichkeitsforderungen in Verbindung gebracht. Ist das gegenwärtig wieder viel untersuchte Thema Verwaltung und Öffentlichkeit zu Recht kein Thema (rechts-)historischer Forschung? Die Autorin zeigt zunächst, dass es durchaus einen zeitgenössischen Publizitätsdiskurs gab, der sich gerade auch auf Verwaltung bezog. Aber kam dieser auch in der Praxis von Recht und Verwaltung an? Da Öffentlichkeiten sich in Kommunikationen manifestieren, werden zwei Felder von Verwaltungskommunikation genauer untersucht: die Publikation staatlichen Handelns durch die Verwaltung sowie die Entwicklung konkreter Verwaltungsverfahren, innerhalb derer die Verwaltung mit Bürgern kommuniziert. Im Zentrum stehen dabei jeweils die Rolle von Recht und Rechtspraxis. Es ergibt sich ein komplexes Bild von Motiven und Intensitäten der Einbeziehung oder gar Beteiligung von Bürgern. Bis heute genutzte Techniken, Medien und Verfahren wurden damals mit Hilfe von Recht konzipiert und eingeübt. Sie sind nicht, wie manchmal behauptet, ausschließlich mit Demokratie verbunden.

    Abstract: Why do Americans read contemporary fiction? This question seems simple, but is it? Do Americans read for the purpose of aesthetic appreciation? To satisfy their own insatiable intellectual curiosities? While other forms of media have come to monopolize consumers' leisure time, in the past two decades book clubs have proliferated, Amazon has sponsored thriving online discussions, Oprah Winfrey has inspired millions of viewers to read both contemporary works and classics, and novels have retained their devoted following within middlebrow communities.   In Reading as Therapy, Timothy Aubry argues that contemporary fiction serves primarily as a therapeutic tool for lonely, dissatisfied middle-class American readers, one that validates their own private dysfunctions while supporting elusive communities of strangers unified by shared feelings. Aubry persuasively makes the case that contemporary literature's persistent appeal depends upon its capacity to perform a therapeutic function.   Aubry traces the growth and proliferation of psychological concepts focused on the subjective interior within mainstream, middle-class society and the impact this has had on contemporary fiction.     Abstract: America's sense of space has always been tied to what Hayden White called the "narrativization" of real events. If the awe-inspiring manifestations of nature in America (Niagara Falls, Virginia's Natural Bridge, the Grand Canyon, etc.) were often used as a foil for projecting utopian visions and idealizations of the nation's exceptional place among the nations of the world, the rapid technological progress and its concomitant appropriation of natural spaces served equally well, as David Nye argues, to promote the dominant cultural idiom of exploration and conquest.From the beginning, American attitudes towards space were thus utterly contradictory if not paradoxical; a paradox that scholars tried to capture in such hybrid concepts as the "middle landscape" (Leo Marx), an "engineered New Earth" (Cecelia Tichi), or the "technological sublime" (David Nye). Not only was America's concept of space paradoxical, it has always also been a contested terrain, a site of continuous social and cultural conflict. Many foundational issues in American history (the dislocation of Native and African Americans, the geo-political implications of nation-building, immigration and transmigration, the increasing division and "clustering" of contemporary American society, etc.) involve differing ideals and notions of space. Quite literally, space and its various ideological appropriations formed the arena where America's search for identity (national, political, cultural) has been staged.     Abstract: This volume of essays examines the forced dispossession caused by the Middle Passage. The book analyzes the texts, religious rites, economic exchanges, dance, and music it elicited, both on the transatlantic journey and on the American continent. The totality of this collection establishes a broad topographical and temporal context for the Passage that extends from the interior of Africa across the Atlantic and to the interior of the Americas, and from the beginning of the Passage to the present day. A collective narrative of itinerant cultural consciousness as represented in histories, myths, and arts, these contributions conceptualize the meaning of the Middle Passage for African American and American history, literature, and life.

    Abstract: From the Beat poets' incarnation of the "white Negro" through Iron John and the Men's Movement to the paranoid masculinity of Timothy McVeigh, white men in this country have increasingly imagined themselves as victims. In Taking It Like a Man, David Savran explores the social and sexual tensions that have helped to produce this phenomenon. Beginning with the 1940s, when many white, middle-class men moved into a rule-bound, corporate culture, Savran sifts through literary, cinematic, and journalistic examples that construct the white man as victimized, feminized, internally divided, and self-destructive. Savran considers how this widely perceived loss of male power has played itself out on both psychoanalytical and political levels as he draws upon various concepts of masochism--the most counterintuitive of the so-called perversions and the one most insistently associated with femininity. Savran begins with the writings and self-mythologization of Beat writers William Burroughs, Allen Ginsberg, and Jack Kerouac. Although their independent, law-defying lifestyles seemed distinctively and ruggedly masculine, their literary art and personal relations with other men in fact allowed them to take up social and psychic positions associated with women and racial minorities. Arguing that this dissident masculinity has become increasingly central to U.S. culture, Savran analyzes the success of Sam Shepard as both writer and star, as well as the emergence of a new kind of action hero in movies like Rambo and Twister. He contends that with the limited success of the civil rights and women's movements, white masculinity has been reconfigured to reflect the fantasy that the white male has become the victim of the scant progress made by African Americans and women.     Abstract: This book traces a provocative line from Emerson's work on race, reform, and identity to work by three influential African- American thinkers--W. E. B. Du Bois, Martin Luther King Jr., and Cornel West--each of whom offers subtle engagement with both the tradition of written protest and thecritique of liberalism Emerson shaped. Emerson has been cast in recent debate as either an antinomian or an ideologue--as either subversive of institutional controls or indebted to capitalism. Here, Patterson contributes a more nuanced view, probing Emerson's record and its cultural and historicalmatrix to document a fundamental rhetoric of contradiction--a strategic aligning of opposed political concepts--that enabled him to both affirm and critique elements of the liberal democratic model. Challenging the prevailing assumption that border studies occurs only in "the borderlands" where Mexico and the United States meet, the authors gathered in this volume examine the multiple borders that define the United States and the Americas, including the Mason-Dixon line, the U.S.-Canadian border, the shifting boundaries of urban diasporas, and the colonization and confinement of American Indians. The texts assembled here examine the way border studies beckons us to rethink all objects of study and intellectual disciplines as versions of a border problematic. These writers-drawn from anthropology, history, and language studies-critique the terrain, limits, and possibilities of border theory.
