    Abstract: On 2 April 1997, the National Assembly adopted a new Constitution. It replaced the Constitutional Law on the Relationships between the Legislative and Executive Powers and on Local Self-government, known as the Small Constitution, which had been in force since 1992. The new Constitution was approved in a popular referendum on 26 May 1997, signed by the President and published on 16 July 1997. The Constitution finally entered into force on 17 October 1997. The new Constitution had been under discussion since 1989, but several earlier attempts to adopt a new constitution had failed. According to the new constitutional provisions, constitutional amendments may only be proposed by at least one-fifth of the statutory number of Sejm deputies, by the Senate, or by the President of the Republic. A Bill to amend the Constitution needs to be adopted by the Sejm by a majority of at least two-thirds of the votes and in the presence of at least half of the statutory number of deputies, and by the Senate by an absolute majority of votes in the presence of at least half the statutory number of senators. If changes are to be made to chapters I, II or XII of the Constitution, the initiators of such changes may call for a popular confirmatory referendum. Poland has traditionally been part of the continental law tradition. Even under communism, the country did not break with this legal heritage. The legal system of Poland is based on a hierarchy of legal norms.

    Abstract: The constitution establishes the principle of legal continuity of the Republic of Estonia, which was proclaimed independent on 24 February 1918, occupied by the Soviet Union on 17 June 1940 and subsequently annexed thereto on 6 August 1940. The constitution reflects the idea of legal restoration, which served as a basis for the return to independence and liberation from the Soviet Union on 21 August 1991. The Riigikogu has recently begun to consider the results of a review carried out by the government expert committee on constitutional revision. The committee’s proposals, if adopted, would not alter the basic principles of the constitution but would reinforce the parliamentary and constitutional system of government. The most important proposals are the establishment of a separate constitutional court, reinforcement of civil control over the defence forces, and attribution of the powers of an ombudsman to the legal chancellor. Moreover, amendments may have to be made in view of the accession of Estonia to the European Union; these amendments touch upon a basic principle of the constitution, the principle of sovereignty.

Depuis le commencement de la transformation démocratique en Bulgarie, quatre élections législatives générales ont eu lieu, à savoir les élections à ce que l’on a alors appelé la Grande Assemblée nationale de juin 1990, puis les élections à l’assemblée nationale en octobre 1991, décembre 1994 et dernièrement avril 1997. Les prochaines élections législatives sont prévues pour le printemps 2001. Les élections présidentielles ont eu lieu en janvier 1992 et novembre 1996. Les prochaines élections présidentielles se dérouleront en automne 2001. Les élections démocratiques locales ont eu lieu en octobre 1991 et novembre 1995, et les prochaines élections locales se dérouleront en automne 1999.

    Abstract: Le 11 mars 1990, le Conseil suprême a adopté la loi fondamentale provisoire de la République de Lituanie, qui a été considérée comme la constitution et a suspendu de ce fait la constitution antérieure du 12 mai 1938. La loi fondamentale provisoire ne représentait toutefois qu’un Acte constitutionnel à caractère provisoire ; elle ne modifiait point la structure du pouvoir de l’État, et toutes les institutions propres à un État démocratique n’étaient pas rétablies. La loi fondamentale provisoire est restée en vigueur jusqu’à l’automne 1992. Le 25 octobre 1992 les citoyens ont voté dans un référendum pour approuver la constitution de la République de Lituanie, qui a rétabli toutes les institutions traditionnelles de l’État, à savoir le Seimas, le président, le gouvernement et les tribunaux. La constitution a en outre introduit de nouvelles institutions pour aider au fonctionnement démocratique de l’État, notamment la cour constitutionnelle, le médiateur et le contrôle d’État. Le statut de la cour constitutionnelle et les procédures de mise en oeuvre de ses pouvoirs sont fixés par la loi sur la cour constitutionnelle de Lituanie adoptée par le parlement le 3 février 1993. La constitution a également introduit le principe de l’autonomie des collectivités locales.

Les Principes de gouvernement d’entreprise de l’OCDE ont été approuvés par les ministres à la réunion du Conseil de l'OCDE au niveau ministériel des 26-27 mai 1999. Ils sont le fruit du mandat donné à l’Organisation par le Conseil de l'OCDE réuni au niveau des ministres en 1998 afin de définir les normes et lignes directrices d’un système de gouvernement d’entreprise de qualité.

With tariff reductions, trade negotiators are looking increasingly at non-border policies that distort trade and at non-governmental barriers to trade. And, as official barriers to trade and investment fall, firms may have a greater incentive to engage in anti-competitive conduct to protect markets. Hence the need for coherent trade and competition policies. Trade and competition policies each seek to improve the allocation of resources; they complement and reinforce each other. These papers from the OECD Joint Group on Trade and competition examine aspects of those complementarities and relationships and in so doing draw on the OECD’s capacity to analyse questions in a multidisciplinary way. This book -- which includes a whole chapter on the telecommunications sector -- throws new light on all these issues in the lead up to the WTO's new round of negotiations. But whatever the outcome of Seattle, the questions raised in this volume will remain relevant.

    Abstract: The Dutch experience in regulatory reform has vital lessons about the modernisation of the European welfare state and its integration into the European single market. Regulatory reform is the most recent element in the reshaping of the Dutch model. Following reforms to labour markets and the social welfare system in the 1980s, Dutch governments in the 1990s have sought a "new balance between protection and dynamism" based on competition policy, regulatory reform, and market openness. Today, the Netherlands ranks among the top OECD countries by many measures of economic performance, including employment growth. Though still in its early phases, regulatory reform has already produced major gains for the Netherlands in terms of competitiveness, flexibility, and consumer benefits. Yet major challenges are still to be faced. Some important reforms have been slow, indicating that the balance between domestic consensus-building and policy responsiveness is still being adjusted in the modern Dutch model. Further reforms in many areas will bring important gains in boosting the employment rate, improving sectoral performance, and providing social protection at lower cost. The Netherlands is one of the first OECD countries to request a broad review by the OECD of its national regulatory practices and domestic regulatory reforms. This report -- the result of intensive assessment by the OECD and review by its Member countries -- is unique in that it presents an integrated assessment of regulatory reform in framework areas such as the macroeconomic context, the quality of the public sector, competition policy and enforcement, and integration of market openness principles in regulatory processes, and in sectors such as electricity and telecommunications. The policy recommendations present a balanced plan of action for both short and longer-term based on best international regulatory practices.

    Abstract: The Republic of Bulgaria was restored in January 1990, following amendments to the communist-inspired constitution, which put an end to the single-party rule of the Bulgarian Communist Party, and the conclusion of the round table agreement between the communist government and representatives of the democratic opposition. The new Bulgarian Constitution was adopted by the Grand National Assembly in July 1991. It marked the return to multi-party democracy. Since the beginning of democratic transformation in Bulgaria, four general parliamentary elections have been held, including the elections to what was then called the Grand National Assembly of June 1990, and elections to the national assembly in October 1991, December 1994 and, most recently, April 1997. The next parliamentary elections are scheduled for spring 2001. Presidential elections were held in January 1992 and November 1996. The next elections for the presidency will be held in autumn 2001. Democratic local government elections took place in October 1991 and in November 1995. The next round of local elections will take place in the autumn of 1999.

    Abstract: La Lettonie est une république parlementaire créée le 18 novembre 1918 et dont la constitution (Satversme) a été adoptée le 15 février 1922. Sa souveraineté et son indépendance ont pris fin de facto avec l’occupation par l’URSS à partir de 1940, et elles ont été restaurées par la Déclaration sur le rétablissement de l’indépendance de la République de Lettonie datée du 4 mai 1990 et par la déclaration du 21 août 1991 restaurant de facto l’indépendance, qui ont toutes deux proclamé l’autorité de la constitution. Cette dernière a été pleinement rétablie le 6 juillet 1993 lorsque le parlement (Saeima) s’est réuni après les premières élections démocratiques qui se sont déroulées depuis les années 30. Le 17 juillet 1999 Vaira Vike-Freiberga a été élue avec 53 votes par la Saeima de 100 membres, et est ainsi devenue la première femme élue président d’un pays de l’ancienne Union soviétique.

    Abstract: OECD's 1999 review of regulatory reform in Japan. It finds that regulatory reform is at the heart of Japan’s strategy for economic recovery and long-term growth. Identified as a priority by the Japanese Government as early as 1994, considerable progress in regulatory reform has already been made. But today it is essential that regulatory reform be deepened and accelerated. This report calls for a "sharp break" with the regulatory practices and doctrines of the past. Energetic measures, including both sectoral reform and reform of framework conditions, need to be adopted quickly to complete the transition from a state-led growth model, now largely ineffective, to a market-driven growth model, the only model capable of laying the foundation for sustainable competitiveness and prosperity in Japan. Japan was one of the first OECD countries to request a broad review by the OECD of its national regulatory practices and domestic regulatory reforms. This report -- the result of intensive assessment by the OECD and review by its Member countries -- is unique in that it presents an integrated assessment of regulatory reform in framework areas such as the macroeconomic context, the quality of the public sector, competition policy and enforcement, and integration of market openness principles in regulatory processes, and in sectors such as electricity and telecommunications. The policy recommendations present a balanced plan of action for both short and longer-term based on best international regulatory practices.

    Abstract: Latvia is a parliamentary republic first established on 18 November 1918, whose constitution (Satversme) was adopted on 15 February 1922. Its de facto sovereignty and independence ended with the USSR’s occupation as from 1940 and were restored by the Declaration of the Renewal of the Independence of the Republic of Latvia dated 4 May 1990 and the 21 August 1991 declaration re-establishing de facto independence, both of which proclaimed the authority of the Satversme. The Satversme was fully reinstated on 6 July 1993 when the parliament (Saeima) convened after the first democratic elections since the 1930s. On 17 June 1999, the 100-member Saeima cast 53 votes for Vaira Vike-Freiberga, who became the first woman to be elected president in the former Soviet Union.

    Abstract: Political Background Until 25 June 1991, Slovenia was a constituent republic of the former Socialist Federal Republic of Yugoslavia. The first multiparty elections in Slovenia took place in the spring of 1990. On 23 December 1991, a new constitution was adopted. It created a modern democratic constitutional order and established the basis for a parliamentary system of government. The first parliamentary elections following independence took place in December 1992. The most recent presidential elections took place in November 1997. Milan Kucan was re-elected as president in the first round with more than 55 per cent of the vote. The next presidential elections are scheduled for November 2001. The most recent parliamentary elections took place in November 1996. Approximately thirty political parties fielded candidates in the elections. Following the elections, the Liberal Democrats entered into a coalition with the Slovenian People’s Party and the DeSUS Party. The leader of the Liberal Democrats, Janez Drnovšek, was re-elected as prime minister.

    Abstract: Le 2 avril 1997 l’Assemblée nationale a adopté une nouvelle Constitution. La nouvelle Constitution a été approuvée par référendum populaire le 26 mai 1997, signée par le Président et publiée le 16 juillet 1997. Elle est finalement entrée en vigueur le 17 octobre 1997. Elle était en discussion depuis 1989, mais plusieurs tentatives antérieures visant à adopter un nouveau texte avaient échoué. En vertu des dispositions de la nouvelle Constitution, des amendements ne peuvent être proposés que par un minimum d’un cinquième du nombre officiel de députés du Sejm, par le Sénat, ou par le Président de la République. Un projet d’amendement de la Constitution doit obligatoirement être adopté par le Sejm à la majorité d’au moins deux tiers des voix et en présence d’au moins la moitié du nombre officiel de députés ; pour le Sénat il faut une approbation à la majorité absolue des voix en présence d’au moins la moitié du nombre officiel de sénateurs. Si des changements doivent être apportés aux chapitres I, II ou XII de la Constitution, leurs promoteurs peuvent demander la tenue d’un référendum populaire de confirmation. La Pologne a traditionnellement fait partie de la tradition juridique continentale. Même du temps du communisme, le pays n’a pas rompu avec cet héritage juridique. Le système juridique polonais repose sur une hiérarchie de normes de droit.

As more and more countries have adopted market-based approaches to economic policy, there has been an increasing awareness of the importance of private corporations for the welfare of individuals. A good corporate governance regime is central to the efficient use of corporate capital. Good corporate governance also helps to ensure that corporations take into account the interests of a wide rage of constituencies, as well as of the communities within which they operate, and that their boards are accountable to the company and the shareholders. This, in turn, helps to assure that corporations operate for the benefit of society as a whole. It helps to maintain the confidence of investors - both foreign and domestic - and to attract more long-term capital. The OECD Principles of Corporate Governance were endorsed by ministers at the OECD Council meeting at ministerial level on 26-27 May 1999. They were developed in response to a mandate given to the Organisation by the OECD Council meeting at ministerial level in 1998 to develop a set of standards and guidelines on good corporate governance.

Formerly inward-looking and heavily regulated, the Mexican economy today is relatively open and market-based. The rapid pace, broad scope, and depth of regulatory reforms exceed those of most OECD countries. These reforms have already produced major benefits for Mexico, not least by increasing economic flexibility so that Mexico rebounds more quickly from economic crises. But benefits of reforms have been slowed by the macroeconomic crises of the 1990s. Sustained attention is needed now to complete and implement reforms to establish conditions for vigorous market competition and entry, while strengthening the capacity of the Mexican state to use high quality and transparent regulatory instruments in carrying out public policies. A multi-year period of policy stability supportive of market-led growth could produce enduring and broad-based benefits for Mexican consumers and businesses.     Abstract: On 11 March 1990, the Supreme Council adopted the Provisional Basic Law of the Republic of Lithuania, which was viewed as the constitution, thereby suspending the former constitution of 12 May 1938. However, the Provisional Basic Law was only a constitutional Act of a transitional character; it did not change the structure of state power, and not all of the institutions characteristic of a democratic state were re-established. The Provisional Basic Law remained in force until the autumn of 1992. On 25 October 1992 citizens voted in a referendum to approve the constitution of the Republic of Lithuania, which re-established all the traditional state institutions, i.e. the Seimas, the presidency, the government, and the judiciary. In addition, the constitution introduced some new institutions to support the democratic functioning of the state, including the constitutional court, the ombudsman, and the state control department. The constitutional court’s status and procedures for executing its powers are established by the Law on the Constitutional Court of Lithuania, which the parliament adopted on 3 February 1993. The constitution also introduced the principle of independence for local governments.

Les élections législatives les plus récentes remontent à novembre 1996. Une trentaine de partis politiques présentèrent des candidats. Depuis son adoption la Constitution n’a fait l’objet d’aucun amendement. La Constitution pose le principe de la continuité juridique de la République de l’Estonie, dont l’indépendance a été proclamée le 24 février 1918, qui fut ensuite occupée par l’Union soviétique le 17 juin 1940 pour être annexée ensuite à cette dernière le 6 août 1940. La Constitution reflète l’idée de restauration juridique, qui a servi de base au retour à l’indépendance et à la libération vis-à-vis de l’Union soviétique le 21 août 1991. Le Riigikogu a récemment entamé l’examen des résultats d’une étude effectuée par la Commission gouvernementale d’experts sur la révision constitutionnelle. Si les propositions de la Commission sont adoptées, elles ne changeraient pas les principes de base de la Constitution mais renforceraient le système de gouvernement parlementaire et constitutionnel. Les propositions les plus importantes concernent la création d’un conseil constitutionnel distinct, le renforcement du contrôle civil exercé sur les forces de défense, et l’attribution des compétences d’un médiateur au Chancelier législatif. Il est en outre possible que des amendements soient nécessaires du fait de l’adhésion de l’Estonie à l’Union européenne ; ces amendements ont trait à un principe de base de la Constitution, le principe de souveraineté.

    Abstract: To further benefit from trade liberalisation, developed and developing countries must get their policies right, in trade and other spheres, such as the web of domestic regulations that affect commerce within and between countries. In the run-up to the November 1999 WTO Ministerial in Seattle, Washington, and a possible new round of multilateral trade negotiations, a Conference on trade and competition was held on 29-30 June 1999 at the OECD to explore the various options towards better coherence between trade and competition policies. This Conference provided OECD countries and 30 non-member countries, academics and representatives of business, trade unions and advocacy groups a unique opportunity to discuss ways to strengthen trade and competition policies in the interests of more open global markets. They examined the effects of trade measures on competition. They also debated whether private anticompetitive practices, and certain domestic regulations, point to the need for multilateral trade and competition rules. This publication summarises those discussions and includes keynote addresses by Sir Leon Brittan and U.S. Assistant Attorney General for Antitrust Joel Klein, as well as an issues paper drafted by the OECD Secretariat to serve as a background note for the Conference.

    Abstract: In many OECD countries, issues in fiscal federalism feature prominently in the political debate. Policy discussions in this area should preferably be supported by internationally comparable statistical information on fiscal relations between levels of government, both in the areas of taxation and spending. The annual OECD Revenue Statistics publication reports tax revenues by sub-sector of general government. However, it does not indicate the degree of control state and local governments exercise over their tax revenues. Because such data are not available on an internationally comparable level from other sources, the OECD has developed a framework to assess and analyze the degree of control that sub-central governments have over their taxes. Results shown in this book serve to illustrate the great variety in tax autonomy at the level of sub-central government. This volume contains a description of fiscal relations in most of the nineteen countries concerned and it provides a set of detailed tables for each country, with revenues split by 1) level of sub-central government; 2) OECD classification of taxes; and 3) category of tax autonomy, following the framework developed by the Working Party on Tax Policy Analysis and Tax Statistics.

    Abstract: August 1999 - Whatever their nature, interventions to reduce poverty should be designed not only to have an immediate impact on poverty, but also to foster a rich network of cross-cutting ties within society and between society's formal and informal institutions. Using the lens of social capital - especially bridging or cross-cutting ties that cut across social groups and between social groups and government - provides new insights into policy design. Solidarity within social groups creates ties (bonding social capital) that bring people and resources together. In unequal societies, ties that cut across groups (bridging social capital) are essential for social cohesion and for poverty reduction. The nature of interaction between state and society is characterized as complementarity and substitution. When states are functional, the informal and formal work well together - for example, government support for community-based development. When states become dysfunctional, the informal institutions become a substitute and are reduced to serving a defensive or survival function. To move toward economic and social well-being, states must support inclusive development. Investments in the organizational capacity of the poor are critical. Interventions are also required to foster bridging ties across social groups - ethnic, religious, caste, or racial groups. Such interventions can stem from the state, private sector, or civil society and include: ° Changes in rules to include groups previously excluded from formal systems of finance, education, and governance, at all levels. ° Political pluralism and citizenship rights. ° Fairness before the law for all social groups. ° Availability of public spaces that bring social groups together. ° Infrastructure that eases communication. ° Education, media, and public information policies that reinforce norms and values of tolerance and diversity.     Abstract: June 2000 - Economists in the field of industrial organization, antitrust, and regulation have long recognized certain factors as potent determinants of opportunistic behavior, corruption, and capture of government officials. Only now are these relationships becoming conventional wisdom among specialists in economies in transition. Ten years into the transition, corruption is so pervasive that it could jeopardize the best-intentioned reform efforts. Broadman and Recanatini present an analytical framework for examining the role market institutions play in rent-seeking and illicit behavior. Using recently available data on the incidence of corruption and on institutional development, they provide preliminary evidence on the link between the development of market institutions and incentives for corruption. Virtually all of the indicators they examine appear to be important, but three are statistically significant: · The intensity of barriers to the entry of new business. · The effectiveness of the legal system. · The efficacy and competitiveness of services provided by infrastructure monopolies. The main lesson emerging from their analysis: a well established system of market institutions - clear and transparent rules, fully functioning checks and balances (including strong enforcement mechanisms), and a robust competitive environment - reduces opportunities for rent-seeking and hence incentives for corruption. Both the design and effective implementation of such measures are important if a market system is to be effective. It is not enough, for example, to enact first-rate laws if they are not enforced. The local political economy greatly affects whether a given policy reform will curtail corruption. Especially important are the following factors in the political economy: · The credibility of the government's commitment to carrying out announced reforms. · The degree to which government officials are captured by the entities they regulate or oversee. · The stability of the government itself. · The political power of entrenched vested interests. Economists in the field of industrial organization, antitrust, and regulation have long recognized these factors as potent determinants of opportunistic behavior, corruption, and capture of government officials. Only now are they becoming conventional wisdom among specialists in economies in transition.     Abstract: July 2000 - Do higher levels of aid erode the very quality of governance poor countries need for sustained and rapid income growth? Good governance-in the form of institutions that establish predictable, impartial, and consistently enforced rules for investors-is crucial for the sustained and rapid growth of per capita incomes in poor countries. Aid dependence can undermine institutional quality by weakening accountability, encouraging rent seeking and corruption, fomenting conflict over control of aid funds, siphoning off scarce talent from the bureaucracy, and alleviating pressures to reform inefficient policies and institutions. Knack's analyses of cross-country data provide evidence that higher aid levels erode the quality of governance, as measured by indexes of bureaucratic quality, corruption, and the rule of law. This negative relationship strengthens when instruments for aid are used to correct for potential reverse causality. It is robust to changes in the sample and to several alternative forms of estimation. Recent studies have concluded that aid's impact on economic growth and infant mortality is conditional on policy and institutional gaps. Knack's results indicate that the size of the institutional gap itself increases with aid levels.     Abstract: Turning the economies of Sub-Saharan Africa around requires badly needed national policy reform-abandoning the region's restrictive fiscal, monetary, property, and wage policies and trade barriers. - Economists often argue that the level and structure of a country's trade barriers and the quality of its governance policies (for example, regulating foreign investment or limiting commercial activity with red tape) have a major influence on its economic growth and performance. One problem testing those relations empirically was the unavailability of objective cross-country indices of the quality of governance and statistics on developing countries' trade barriers. Ng and Yeats use new sources of empirical information to test the influence of trade and governance policies on economic performance. They use a model similar to those used in the literature on causes and implications of economic growth but focus more heavily on the World Bank's index of the speed with which countries are integrating into the world economy. Their results show that countries that adopted less restrictive governance and trade policies achieved significantly higher levels of per capita GDP; experienced higher growth rates for exports, imports, and GDP; and were more successful integrating with the world economy. Regression results indicate that national trade and governance regulations explain over 60 percent of the variance in some measures of economic performance, implying that a country's own national policies shape its rate of development, industrialization, and growth. Their tests provide new insights into the phenomenon of economic convergence, showing that poorer open countries are integrating more rapidly into the global economy than others. This finding parallels what others have observed about economic growth rates. They test their empirical results in a case study asking whether inappropriate national policies have caused Sub-Saharan Africa's dismal economic performance. The evidence strongly supports this proposition. Indices of the quality of national governance show that African countries have generally adopted the most inappropriate (restrictive) fiscal, monetary, property, and wage policies and that their own trade barriers (including customs procedures constraining commercial activity) are among the world's highest. Improving African trade and governance policies to levels currently prevailing in such (non-exceptional) countries as Jordan, Panama, and Sri Lanka would be consistent with a sevenfold increase in per capita GDP (to about

    Abstract: A revised version was published as The Political Economy of Expenditures by the Peruvian Social Fund (FONCODES), 1991-95. American Political Science Review 94 (2, June): 289-304, 2000. - As the literature on political influences on the allocation of discretionary funds predicts, spending by the Peruvian Social Fund, FONCODES, increased significantly before elections. FONCODES projects were also directed at provinces where the marginal political impact of expenditures was likely to be greatest. President Alberto Fujimori created the Peruvian Social Fund (FONCODES) in 1991 with the stated objectives of generating employment, helping to alleviate poverty, and improving access to social services. Schady uses province-level data on monthly expenditures, socioeconomic indicators, and electoral outcomes to analyze political influences on the timing and geographic distribution of FONCODES expenditures between 1991 and 1995. He finds that: ° FONCODES expenditures increased significantly before elections. ° FONCODES projects were directed at poor provinces, as well as provinces in which the marginal political impact of expenditures was likely to be greatest. The results are robust to many specifications and controls. The Peruvian data thus support predictions made in the literature on political business cycles as well as the literature on political influences on the allocation of discretionary funds.     Abstract: In efforts to reform the administration of tax systems, the World Bank can substantially improve project design, execution, and effectiveness by adopting a more concerted approach to institutional analysis. - The main constraint on World Bank operations in tax and customs administration is the Bank's inadequate institutional framework for accumulating knowledge from loan operations, concludes this review of the Bank's record on reform of tax systems in the 1990s. The Bank's theoretical basis for reforming tax and customs administration is still rudimentary. Recent theories stress the importance of institutions that harness voice and improve transparency and contestability, but there is little evidence that reform of these factors alone makes tax administration more effective. Improvements are needed in pre-project diagnosis and project design, especially for examining accountability, administration costs, managerial autonomy, performance incentives for staff, taxpayer equity and services, and environmental factors. Pre-project work could draw more systematically on lessons from previous experience. Institutional components of project design have been biased toward organization, manpower upgrading, and procedures related to information technology. Too little attention has been paid to improving accountability, administrative cost-effectiveness, and anticorruption institution-building. Projects have made inadequate use of different kinds of performance indicators, with little uniformity in those applied. Methods used to evaluate project outcomes could be better and more uniform. Suggestions for future Bank operations: · Doing better background work and articulating a strategy and comprehensive framework for Bank involvement in reform of tax administration. · Possibly supporting and strengthening regional tax administration associations, which could serve as catalysts for change. · Strengthening partnering and supporting private sector consultant organizations, so they can manage major components of administrative reform. · Institutionalizing the accumulation of knowledge about tax administration (which might require changing staff recruitment, the mix of staff skills, and training plans). The authors provide recommendations for improving project diagnosis, design, performance indicators, and appraisal, as well as a short list of projects that serve as guides to good practice.     Abstract: February 2000 - Some say that democracy is more likely to survive under parliamentary governments. That result is not robust to the use of different variables from the Database of Political Institutions, a large new cross-country database that may illuminate many other issues affecting and affected by political institutions. This paper introduces a large new cross-country database on political institutions: the Database on Political Institutions (DPI). Beck, Clarke, Groff, Keefer, and Walsh summarize key variables (many of them new), compare this data set with others, and explore the range of issues for which the data should prove invaluable. Among the novel variables they introduce: · Several measures of tenure, stability, and checks and balances. · Identification of parties with the government coalition or the opposition. · Fragmentation of opposition and government parties in legislatures. The authors illustrate the application of DPI variables to several problems in political economy. Stepan and Skach, for example, find that democracy is more likely to survive under parliamentary governments than presidential systems. But this result is not robust to the use of different variables from the DPI, which raises puzzles for future research. Similarly, Roubini and Sachs find that divided governments in the OECD run higher budget deficits after fiscal shocks. Replication of their work using DPI indicators of divided government indicates otherwise, again suggesting issues for future research. Among questions in political science and economics that this database may illuminate: the determinants of democratic consolidation, the political conditions for economic reform, the political and institutional roots of corruption, and the elements of appropriate and institutionally sensitive design of economic policy.     Abstract: April 2000 - In a new approach to measuring typically subjective variables, BEEPS - the 1999 Business Environment and Enterprise Performance Survey, the transition economies component of the World Business Environment Survey - quantitatively assesses governance from the perspective of about 3,000 firms in 20 countries. Unbundling the measurement of governance and corruption empirically suggests the importance of grand corruption in some countries, manifested in state capture by the corporate sector - through the purchase of decrees and legislation - and by graft in procurement. As a symptom of fundamental institutional weaknesses, corruption needs to be viewed within a broader governance framework. It thrives where the state is unable to reign over its bureaucracy, to protect property and contractual rights, or to provide institutions that support the rule of law. Furthermore, governance failures at the national level cannot be isolated from the interface between the corporate and state sectors, in particular from the heretofore underemphasized influence that firms may exert on the state. Under certain conditions, corporate strategies may exacerbate misgovernance at the national level. An in-depth empirical assessment of the links between corporate behavior and national governance can thus provide particular insights. The 1999 Business Environment and Enterprise Performance Survey (BEEPS) - the transition economies component of the ongoing World Business Environment Survey - assesses in detail the various dimensions of governance from the perspective of about 3,000 firms in 20 countries. After introducing the survey framework and measurement approach, Hellman, Jones, Kaufmann, and Schankerman present the survey results, focusing on governance, corruption, and state capture. By unbundling governance into its many dimensions, BEEPS permits an in-depth empirical assessment. The authors pay special attention to certain forms of grand corruption, notably state capture by parts of the corporate sector - that is, the propensity of firms to shape the underlying rules of the game by purchasing decrees, legislation, and influence at the central bank, which is found to be prevalent in a number of transition economies. The survey also measures other dimensions of grand corruption, including those associated with public procurement, and quantifies the more traditional (pettier) forms of corruption. Cross-country surveys may suffer from bias if firms tend to systematically over- or underestimate the extent of problems within their country. The authors provide a new test for this potential bias, finding little evidence of country perception bias in BEEPS.     Abstract: November 1999 - In the past, financial supervision tended to be organized around specialist agencies for the banking, securities, and insurance sectors. In recent years, several countries have moved toward integrating these different supervisory functions in a single agency. Drawing on Northern European experience - where three Scandinavian countries have practiced integrated supervision for the past 10 years - Taylor and Fleming address three policy-related issues associated with the integrated model: · Under what conditions should (or should not) a country consider moving toward an integrated model of financial supervision? Clearly, for a small transition or developing economy, or an economy with a small financial sector, the economies of scale from establishing an integrated agency outweigh the costs of moving to such a model. A strong case can also be made for an integrated approach in a financial sector dominated by banks, with little role for capital markets or a highly integrated financial sector. · How should an integrated agency be structured, organized, and managed? There is no single obviously correct organizational structure, and existing agencies are experimenting with a variety of forms. An institutionally based structure has the virtue of simplicity and can be implemented fairly quickly, but tends to preserve the cultures and identities of the predecessor agencies more than is optimal. Whatever the structure, integrated supervision requires active management to secure the potential benefits that the approach offers. · How should the integration process be implemented? While the decision to move to an integrated agency must be carefully thought through in the context of the country concerned, the more difficult part is implementation, which must be sensitively managed. Once the decision has been made, implementation should take place as quickly as possible. A well-conceived change management process should aim to overcome the cultural barriers associated with the previous fragmented structure. Taylor and Fleming's review of Northern European experience with integration of financial supervision raises a range of questions relevant to developing and transition economies, which they discuss.     Abstract: Banks restructured after East Asia's crisis of 1997 - most of them family-owned or company-owned and almost never foreign-owned - tended to be heavy risk takers. Most of them had excessive credit growth. - Laeven uses a linear programming technique (data envelopment analysis) to estimate the inefficiencies of banks in Indonesia, the Republic of Korea, Malaysia, the Philippines, and Thailand. He applies this technique to the precrisis period 1992-96. Assessing a bank's overall performance requires assessing both efficiency and risk factors, so Laeven also introduces a measure of risk taking. This risk measure helps predict which banks were restructured after the crisis of 1997. Laeven finds that foreign-owned banks took little risk relative to other banks in East Asia, and that family-owned and company-owned banks were among the highest risk takers. Banks restructured after the 1997 crisis had excessive credit growth, were mostly family-owned or company-owned, and were almost never foreign-owned.     Abstract: May 2000 - Like many Central Asian republics, Uzbekistan has adopted a gradual, cautious approach in its transition to a market economy. It has had some success attaining macroeconomic stability, but microeconomic reforms have lagged behind. It is time to accelerate structural reform. In Uzbekistan state enterprises are being changed into shareholding companies, and private enterprises account for 45 percent of all registered firms. But business decisions to set prices, output, and investment are often not market-based, nor wholly within the purview of businesses, especially those in commercial manufacturing and services. Lines of authority for corporate governance - from state enterprises to private enterprises - are ill-defined, so there is little discipline on corporate performance and little separation between government and business. Nascent frameworks have been created for competition policy (for firms in the commercial sector) and regulatory policy (governing utilities in the infrastructure monopoly sector). But implementation and enforcement have been hampered by old-style instruments (such as price controls) rooted in central planning, by lack of a strong independent regulatory rule-making authority, by the limited understanding of the basic concepts of competition and regulatory reform, and by weak institutional capabilities for analyzing market structure and business performance. Based on fieldwork in Uzbekistan, Broadman recommends: · Deepening senior policy officials' understanding of, and appreciation of the benefits from, enterprise competition and how it affects economic growth. · Reforming competition policy institutions and legal frameworks in line with the country's goal of strengthening structural reforms and improving macroeconomic policy. · Improving the ability of government and associated institutions to assess Uzbekistan's industrial market structure and the determinants of enterprise conduct and performance. · Making the authority responsible for competition and regulatory policymaking into an independent agency - a champion of competition - answerable directly to the prime minister. · Strengthening incentives and institutions for corporate governance and bringing them in line with international practice. · Subjecting infrastructure monopolies to systemic competitive restructuring and unbundling, where appropriate. For other utilities, depoliticize tariff setting and implementation of regulations; ensure that price, output, and investment decisions by service suppliers are procompetitive (creating a level playing field among users); and increase transparency and accountability to the public.     Abstract: June 2000 - What explains the spread of both democracy and financial openness at this time in history, given the constraining impact of financial market integration on national policy autonomy? International policy coordination is part of the answer, but not all. Also important is the presence of cost-effective redistributive schemes that provide insurance against the risk of financial instability. The debate about the relationship between democratic forms of government and the free movement of capital across borders dates to the 18th century. It has regained prominence as capital on a massive scale has become increasingly mobile and as free economies experience continuous pressure from rapidly changing technology, market integration, changing consumer preferences, and intensified competition. These changes imply greater uncertainty about citizens' future income positions, which could prompt them to seek insurance through the marketplace or through constitutionally arranged income redistribution. As more countries move toward democracy, the availability of such insurance mechanisms to citizens is key if political pressure for capital controls is to be averted and if public support for an open, liberal international financial order is to be maintained. Dailami briefly reviews how today's international financial system evolved from one of mostly closed capital accounts immediately after World War II to today's enormous, largely free-flowing market. Drawing on insights from the literature on public choice and constitutional political economy, Dailami develops an analytical framework for a welfare cost-benefit analysis of financial openness to international capital flows. The main welfare benefits of financial openness derive from greater economic efficiency and increased opportunities for risk diversification. The welfare costs relate to the cost of insurance used as a mechanism for coping with the risks of financial volatility. These insurance costs are the economic losses associated with redistribution, including moral hazard, rent-seeking, and rent-avoidance. A cross-sectional analysis of a large sample of developed and developing countries shows the positive correlation between democracy (as defined by political and civil liberty) and financial openness. More rigorous econometric investigation using logit analysis and controlling for level of income also shows that redistributive social policies are key in determining the likelihood that countries can successfully combine an openness to international capital mobility with democratic forms of government. Trois centres de gouvernement des pays de l'Union européenne — Allemagne, Belgique, Grèce — ont également participés aux travaux, de même que des experts venus du Canada, du Danemark, de France et de Suède. Tout naturellement, comme l'avaient fait à Paris l'année précédente leurs homologues français, les responsables du pays hôte ont présenté aux participants les grandes lignes de leur organisation et les changements importants qui lui ont été apportés récemment. Ces changements s'inscrivent dans le cadre plus général de la réforme de l'administration d'État réalisé en Pologne. Ils se traduisent, au niveau du centre du gouvernement, par le renforcement de la position du Premier ministre et par une délimitation plus claire des responsabilités politiques et administratives. Deux thèmes de réflexion avaient été retenus pour cette rencontre : la gestion des gouvernements de coalition et le management des transitions entre gouvernements. Ces deux thèmes n'ont pas été choisis au hasard : on en trouve des applications concrètes dans tous les pays qui font partie du Programme SIGMA, ils intéressent très directement les centres de gouvernement et les problèmes qu'ils soulèvent sont de nature comparable. Dans les deux cas, en effet, il s'agit en définitive de concilier les exigences de la démocratie et celles de l'efficacité. La démocratie implique le pluralisme des forces politiques et elle rend légitime leur alternance au pouvoir. Mais, par la même, elle introduit dans le fonctionnement des institutions, à un moment où la conduite de la transition appelle de la part des gouvernements une direction ferme et une action continue, des germes de faiblesse ou de fragilité. Un gouvernement de coalition peut avoir des difficultés à parler d'une seule voix. Des changements d'équipe trop fréquents peuvent nuire à la continuité des actions engagées. Ces risques sont inhérents à la démocratie et ils doivent être bien entendu acceptés. Mais il est aussi du rôle des centres des gouvernements de chercher à minimiser les effets négatifs qu'ils pourraient avoir sur la bonne conduite des politiques publiques.

    Abstract: Nine central and eastern European countries — Albania, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania and the Slovak Republic — were represented in Warsaw at the meeting of senior officials from centres of government, organised by the SIGMA Programme and held on 27 and 28 February 1997. Three European Union centres of government — Belgium, Germany, Greece — also took part in the work, as did experts from Canada, Denmark, France and Sweden. As their French counterparts had done in Paris the previous year, the host country officials described the broad lines of their organisation and informed participants about the major changes that had been made recently. In Poland, these come under the more general heading of the reform of state economic administration and result, at centre of government level, in the strengthening of the position of the Polish Prime Minister and a clearer demarcation of political and administrative responsibilities. Two topics had been selected for the meeting: “Policy-Making and Decision-Making in a Coalition System”, and “Managing Government Transitions”. The two issues were not chosen by accident: actual examples are to be found in all the countries participating in the SIGMA Programme, they are of direct interest to centres of government, and the problems they raise are comparable in nature. In the case of both topics, it is a question of reconciling the exigencies of democracy and efficiency. Democracy implies political pluralism and legitimises the principle that power can be held on an alternating basis. By the same token, however, it sows seeds of weakness or frailty in the functioning of a country’s institutions just when the process of transition requires governments to demonstrate firmness and continuity. A coalition government can find it difficult to speak with a single voice. When teams change too often, continuity can be jeopardised. These are the risks inherent in democracy and they have of course to be accepted, but it is also the role of centres of government to seek to minimise any negative effects they can have on the proper conduct of public policies.

    Abstract: Globalisation has had positive effects on the development of tax systems and has encouraged countries to engage in base broadening and rate reducing tax reforms. However, it has also created an environment in which tax havens thrive and in which governments may be induced to adopt harmful preferential tax regimes to attract mobile activities. Tax competition in the form of harmful tax practices can distort trade and investment patterns, erode national tax bases and shift part of the tax burden onto less mobile tax bases, such as labor and consumption, thus adversely affecting employment and undermining the fairness of tax structures. The Report emphasises that governments must intensify their cooperative actions to curb harmful tax practices. To achieve this, OECD Member governments have developed "Guidelines on Harmful Preferential Tax Regimes". These Guidelines will discourage the spread of harmful preferential tax regimes and encourage countries with such regimes to eliminate them. To counteract both tax havens and harmful preferential tax regimes, Member governments have also agreed to pursue vigorously the implementation of the other Recommendations in the Report, including entering into a dialogue with non-member countries.

Il a été décidé, dès l'origine, que l'étude serait concentrée sur le contrôle des activités de la banque centrale et non pas sur les activités bancaires. Autrement dit, les aspects du système bancaire tels que la structure de la réglementation des institutions financières ou la surveillance du secteur financier ont été exclus, en dépit de leur intérêt et de leur pertinence, du champ de la présente étude ou ne feront l'objet que de brèves allusions. L'étude est par ailleurs limitée à quatre États Membres de l'Union européenne (Allemagne, Irlande, Pays-Bas et Suède) qui ne représentent pas toute la panoplie des systèmes existant dans l'Union. Il faut rappeler aussi que les pratiques actuelles pourraient subir d'importantes transformations à la suite de l'institution de l'Union économique et monétaire européenne.     Abstract: La mondialisation a eu des effets positifs sur le développement des systèmes fiscaux et a encouragé les pays à engager des réformes fiscales destinées à élargir leurs bases d'imposition et réduire leurs taux d'imposition. Cependant, elle a aussi créé un environnement dans lequel les paradis fiscaux se multiplient et des gouvernements peuvent être incités à adopter des régimes fiscaux préférentiels dommageables afin d'attirer les activités mobiles. Lorsqu'elle prend cette forme, la concurrence fiscale risque d'entraîner des distorsions dans les échanges et les investissements, de saper les bases d'imposition nationales et de déplacer une partie de la charge fiscale vers des bases d'imposition moins mobiles telles que le travail ou la consommation, au détriment de l'emploi et de l'équité des structures fiscales. Le rapport met en évidence que les gouvernements doivent intensifier leur coopération pour réduire les pratiques fiscales dommageables. A cette fin, les gouvernements des pays de l'OCDE ont mis au point des "Principes directeurs sur les régimes fiscaux préférentiels dommageables". Ces Principes directeurs décourageront la prolifération des régimes fiscaux préférentiels dommageables et encourageront les pays dotés de tels régimes à les éliminer. Pour lutter à la fois contre les paradis fiscaux et les régimes fiscaux préférentiels dommageables, les gouvernements membres conviennent également de poursuivre activement la mise en oeuvre des autres Recommandations formulées dans le Rapport, notamment en nouant un dialogue avec les pays non membres.

    Abstract: Central Bank Audit Practices describes common approaches, practices and trends relevant to the audit of central banks, with a view to supporting public administration reform efforts in central and eastern European countries. The study provides a basis for further discussion between decision-makers and practitioners on how the audit regime could be developed to ensure good governance of central banks. This study originates from a discussion on today’s important audit issues which was arranged by the European Court of Auditors together with the presidents of supreme audit institutions (SAIs) of central and eastern European countries and held in Luxembourg on 21-23 October 1996. Follow-up discussions between representatives of SAIs and central banks and SIGMA made it apparent that a focused comparative study could be of high value to officials with responsibilities for the design of audit strategies and policies, as well as to auditors. From the outset it was decided that the study should focus on auditing of central bank activities and not on banking. This meant that aspects of the banking system, such as the regulatory structure of financial institutions or supervision of the financial sector, although very interesting and relevant, have been excluded from the scope of the study or are only briefly mentioned. The study is furthermore limited in that it provides an overview of four European Union Member States (Germany, Ireland, the Netherlands and Sweden). These countries do not represent the entire variation to be found in the EU. The reader is also asked to keep in mind that current practices might undergo important changes as a result of the introduction of the European Economic and Monetary Union.

Trois raisons au moins expliquent cette approche: la volonté de garantir l'indépendance des fonctionnaires; celle de rendre plus attrayante une carrière dans le secteur public; celle enfin de repousser à une date ultérieure le paiement du coût des rémunérations actuellement octroyées. Dans la plupart des pays Membres de l'OCDE, les fonctionnaires sont couverts par des régimes de retraite particuliers et spécialement conçus. Ces régimes sont, ou totalement indépendants, ou complémentaires du régime général national. Les avantages qu'ils accordent varient d'un pays à l'autre, de même que leurs principes de financement. Il peut aussi, dans un même pays, exister plusieurs régimes pour les différentes catégories de fonctionnaires et d’employés de l'Etat. Des régimes par "répartition" financés sur le budget annuel de l'Etat existent dans plusieurs pays Membres de l'OCDE. Lorsque ces régimes ont été mis en place, les effectifs de la fonction publique étaient peu nombreux et il n'y avait pas de régime de retraite général, pour l'ensemble de la population active. Au cours des trente dernières années, l'accroissement rapide des effectifs de la fonction publique, dans les pays occidentaux, n'a pas eu d'incidence majeure sur le coût des pensions de retraite des régimes par répartition en raison de l’incidence de la croissance démographique et, jusqu'à une date récente, le financement des pensions est demeuré inchangé dans de nombreux pays. Le mécanisme régissant les régimes de retraite fonctionne sur le long terme; par ailleurs, la détermination des fonctionnaires et de leurs syndicats à les maintenir en l'état est grande: il est ainsi d’autant plus difficile de les modifier . Avec le changement de la tendance démographique, les régimes de retraite sont devenus une lourde charge pour le budget. Les régimes de retraite de la fonction publique supportent des frais de fonctionnement importants et impliquent de lourds engagements à long terme. C'est pourquoi de nombreux pays Membres de l’ODE s'efforcent aujourd'hui de trouver de nouvelles solutions pour couvrir leurs coûts de financement. Différentes techniques de financement et techniques actuarielles peuvent être utilisées à cet effet.

The country reports offer a full account of law drafting regulations and drafting practice in Albania, Bulgaria, Estonia, Lithuania, Slovakia and Slovenia. While reforming regulatory programmes in any democracy is a major endeavour replete with potential pitfalls, central and eastern European countries confront even greater challenges in this area. They must build up regulatory frameworks for economic and political conditions radically different than those which existed just a few years before. In particular, these countries must align their regulatory practices with those of the European Union. This implies the creation of new institutions, and control and monitoring systems.

In Poland a new Civil Service Act came into force in January 1997 (certain provisions came into force 30 days after the Act’s promulgation); and in Albania the current situation in the administration is difficult to assess due to recent political upheaval. When this report was prepared in 1996, Albania, Estonia and Hungary all had civil service laws in force, while in Poland the1982 Act on Civil Servants still regulated employment in the state administration. The report’s purpose is to determine to what extent the implementation of a specific law for employment in the administration would lead to significant changes in personnel management or in the preconditions for management, selection and promotion of staff. This report is therefore about public personnel management systems, management procedures and management practices and how they either support or hinder professionalism and appropriate conduct. To a certain extent it is also about the legislation and institutions as well as the training necessary to promote suitable civil service behaviour. The study was based on a common guideline document developed together with experts from the four countries. These experts are Odeta Dibra, Lawyer, Albania (now with UNESCO); Professor Georg Sootla, Tallinn Pedagogical University, Estonia; Istvan Borbiro, Lawyer, Jutasi & Partners, Hungary; and Wojciech Marchlewski, Co-operation and Partnership, Poland. The four experts used the guideline document as a reference tool for conducting interviews in the administrations of their countries and for reporting their findings.

This is followed by a checklist of questions which law drafters in particular may find useful in the drafting process. These questions concern the general approach to secondary regulation rather than the substantive contents of instruments dealing with particular topics. Such contents are necessarily dictated by the contents and details of the primary legislation and are likely to vary considerably from one country to another. This checklist, as for the primary legislation checklist, is not intended as directions for approaching these matters but rather as guidance to best practice.     Abstract: This publication is a tool for designers of new civil service pension schemes in central and eastern Europe. It presents civil service pension schemes in five OECD Member countries and ten central and eastern European countries. In most central and eastern European countries, people employed in the public administration are covered under common national pension schemes, usually defined in a common pension law. As part of efforts to improve the professionalisation and quality of public administration, countries are defining civil service categories of personnel through civil service legislation. Some countries will introduce specific pension provisions for the public administration employees subject to this legislation. There are at least three obvious reasons for this: to secure the independence of civil servants, to make a public sector career more attractive, and to shift the costs of current remuneration into the future. In most OECD Member countries, civil servants have separate and specially designed pension schemes. These are either totally independent of the common national pension schemes or complementary to them. Conditions vary between countries and so do principles for financing. In one country there might also be several schemes for various categories of state officials and employees. “Pay-as-you-go” schemes financed by the annual state budget exist in several OECD Member countries. When they were introduced, national civil services were small and common pension schemes for the working population at large were lacking. Over the last 30 years, the rapid growth of western public services has not had any major impact on pension costs in pay-as-you-go schemes for demographic reasons and, until recently, the financing of pensions has in many countries stayed unchanged. The long-term nature of pension schemes and the strong interest that civil servants and their unions have in keeping them intact has added to the difficulty of changing them. With changing demography, pensions are becoming a heavy burden on the budget. Pensions imply both considerable running costs and heavy long-term liabilities. That is why many OECD Member countries today are trying to find new solutions to fund the financing costs. Different funding and actuarial techniques can be used to achieve this.

SIGMA has been requested by several of its beneficiary countries to assist them in this extremely difficult task to set up efficient and effective structures and procedures for law drafting. Besides several workshops which have been carried out regarding crucial issues in law drafting, this checklist has been developed to provide countries with an additional means for self assessment. This checklist offers a means for evaluating structures, procedures and techniques for preparing and drafting legislation, and for identifying methodologies that may be helpful when changes are under consideration. Law drafting comprises two stages: policy development, and preparation of the legislative text to give effect to the policy adopted. The checklist is primarily concerned with the latter. The checklist draws upon experience gathered in OECD and central and eastern European countries. In particular, it takes into account work carried out by the Regulatory Management and Reform Group of the OECD’s Public Management Service (PUMA) and concerns of the EU Phare Programme voiced in the context of the approximation of law with regard to EU accession.

    Abstract: Compliance with the European Union’s budgetary, financial control and audit requirements is one of the basic obligations of EU membership. SIGMA examines this in two publications that chronicle the experiences of seven EU Member States, including its three newest adherents, in integrating EU budgetary, financial control and audit procedures and requirements with national ones. The publications also describe central regulations and procedures used by the European Commission and the European Court of Audit. The present publication complements SIGMA Paper No. 20 Effects of European Union Accession—Part 2, External Audit, on the impact of accession on external audit. The purpose of these publications is to assist central and eastern European countries that have applied for membership of the European Union in discerning the ideas at stake, to give comparative information on the various approaches and solutions used by Member States and to sum up the experiences gained and lessons learned. The approach is to provide an overview of the topic and analyse key issues for reflection and debate. The focus is on practical experiences gained and conclusions drawn by those who have been involved in the daily work of adaptation and development of the government administration in the seven countries. The two publications also provide insight into the implementation policies adopted and an overview of the regulations and procedures used.     Abstract: Les pays d’Europe centrale et orientale doivent repenser leur législation et l’adapter aux critères de l’Union européenne dans la perspective de leur adhésion. L’élaboration d’une législation de bonne qualité, facile à appliquer, revêt donc une importance majeure. En publiant cette liste de critères de référence, SIGMA propose une méthodologie pour évaluer le cadre institutionnel, les procédures et les techniques d’élaboration des lois adoptés par les pays d’Europe centrale et orientale et vise à recenser les outils auxquels il peut être utile de recourir lorsque des modifications de la législation sont envisagées. SIGMA appuie sa démarche sur l’expérience et les pratiques des pays Membres de l’OCDE, ainsi que sur celles des pays d’Europe centrale et orientale. Cette liste ne se veut pas un exposé de ce qu’il convient de faire, ni un guide sur la façon de traiter certaines activités particulières. Elle vise davantage à dresser un inventaire détaillé des multiples points à prendre en considération pour produire une législation de qualité. Il va de soi que les choix faits dans ce contexte doivent refléter les spécificités locales. Cette publication repose sur un questionnaire établi dans le cadre d’un projet sur la rédaction des lois et la gestion de la réglementation dans les pays d’Europe centrale et orientale que SIGMA a lancé en 1997. Ce projet a donné lieu a la publication d’un document SIGMA intitulé “La rédaction des lois et la gestion de la réglementation dans les pays d’Europe centrale et orientale” qu’il est possible de se procurer sur simple demande auprès de SIGMA. La liste des critères de référence, établie par le Professeur Keith Patchett de l’université de Pays de Galles pour le compte de SIGMA, contient des questions sur la définition de l’action gouvernementale, la structure organisationnelle, les effectifs, les procédures actuelles d’élaboration de la législation et l’évaluation de leur impact. Afin de mettre à disposition des pays d’Europe centrale et orientale un outil méthodologique pratique, la liste de critères de référence adopte une structure qui s’efforce de refléter du mieux possible la chronologie de l’élaboration des instruments juridiques.

    Abstract: Assessing the Impacts of Proposed Laws and Regulations deals with policy assessment and Regulatory Impact Analysis (RIA), or the ex ante assessment of how proposed legislation and regulations will affect a country’s economy, society, budget and existing laws, international agreements, etc. Through RIA governments can improve the quality of their interventions by ensuring that the impacts, both intended and unintended, of proposed legislation and regulations are assessed in advance, and form an input into decision-making. This is especially relevant for countries of Central and Eastern Europe in light of European Integration and the need for economic management. This publication is a follow-up to a seminar that was held in Riga on 2 and 3 October 1996 for public officials of Estonia, Latvia and Lithuania. It comprises a brief description of the highlights of the seminar discussions and the three papers that were prepared for the seminar by experts from Canada, France and the United States. Canada and the United States are leaders in RIA technology, and France is adopting new methodologies.

Le personnel y est constamment confronté à un cadre réglementaire en évolution constante qu'il s'agit de mettre en oeuvre et de faire respecter; il lui faut également faire face à de nouvelles demandes émanant aussi bien d'un secteur privé en expansion que de l'ensemble des citoyens. De tels défis ne peuvent être relevés qu'avec un personnel hautement qualifié et mettant sans cesse à jour ses qualifications. Un solide système de formation permanente est donc indispensable pour que les agents publics ne se laissent pas dépasser par un contexte en transformation rapide. Cette brève étude a pour objet de mettre en lumière les éléments clés des systèmes de formation, ainsi que les avantages et les inconvénients des solutions mises au point dans les pays de l'OCDE, de façon à aider les pays d'Europe centrale et orientale à créer un système de formation de qualité tout en évitant les erreurs déjà commises dans les pays de l'OCDE.

En Pologne, une nouvelle Loi sur la Fonction publique est entrée en vigueur en janvier 1997 (certaines dispositions sont entrées en vigueur 30 jours après la promulgation de la loi). En Albanie, la situation actuelle de l’administration publique est difficile à appréhender depuis les récents désordres politiques. En 1996, alors que ce rapport était en cours de préparation, une législation sur la fonction publique était en vigueur en Albanie, en Estonie et en Hongrie. En Pologne, l’emploi dans l’administration publique était encore régi par la loi de 1982 sur les fonctionnaires.

    Abstract: Over the past decade, the European Commission, as the institution responsible for implementing the Community Budget, has taken an increasingly active interest in the effectiveness of the control measures applied by Member States to Community funds. Indeed, it is in the common interest of the Member States to exercise proper supervision of Community funds. The responses of EU Member States’ Supreme Audit Institutions (SAIs) to the Commission’s external audit procedures and requirements are divergent for various reasons, including legislative ones. This issue overview paper draws on the separate country papers which describe in more detail the different experiences of selected national SAIs in their co-operation with the Commission’s services and the European Court of Auditors (ECA). The present publication complements SIGMA Paper No. 19 Effects of European Union Accession — Part 1, Budgeting and Financial Control on the impact of accession on budgeting and financial control. In both cases, the approach adopted has been analysis of selected issues for reflection and debate.

    Abstract: The public service in central and eastern Europe has to adapt to an enormous number of changes in a very short time. These challenges can only be met if the staff is highly qualified and constantly updating their qualifications. A sound system of in-service training is therefore crucial to keep the personnel within the public service on equal footing with the rapidly changing environment. This short paper is meant to point out the determining components of training systems, and advantages and disadvantages of possible solutions as they were developed in OECD countries, in order to assist countries in central and eastern Europe to set up a sound training system, while avoiding mistakes already experienced in OECD countries.

Le présent document commence par une section narrative décrivant les types d’instruments ordinairement utilisés à cet effet dans les pays Membres de l’OCDE et les facteurs généralement pris en compte au moment de la préparation et de la rédaction d’instruments de cette nature. Cette section narrative est suivie d’une liste de critères auxquels les auteurs de ces textes, notamment, pourraient juger utile de se référer au cours de leur travail. Il s’agit davantage de la façon générale d’aborder la rédaction de ces textes d’application que du fond des instruments traitant de tel ou tel sujet. Le fond est nécessairement dicté par le contenu général et les détails de la loi elle-même et il varie dans l’ensemble beaucoup d’un pays à l’autre. De même que dans le cas de la liste de critères de référence relative au statut de la fonction publique voté par le Parlement, le propos de la présente liste n’est pas de donner des directives impératives sur la manière d’aborder ces questions mais plutôt de proposer des conseils sur les meilleures pratiques à suivre. Il appartiendra à chacun, en fonction des circonstances locales, de faire son choix.

    Abstract: This publication is the product of a project which SIGMA started in autumn 1995. The country papers were completed in late spring 1996, and since that time some countries have reviewed their training strategies. Lithuania, for example, has adopted a regulation concerning the qualification of civil servants, which includes training. The rationale for launching this project was the recognised need for more detailed information on training systems and on the organisation of training in central and eastern European countries. This information is essential to the efforts by countries in transition, working in collaboration with the donor community, to develop demand-driven training strategies, efficient structures for civil service training, and cost-effective and sustainable training activities.
