    Kurzfassung: La Bulgarie est l'un des quatre pays non membres de l'OCDE à avoir signé en décembre 1997 la Convention sur la lutte contre la corruption d'agents publics étrangers dans les transactions commerciales internationales (la Convention de l'OCDE), en compagnie des trente pays de l'OCDE. Par la suite, la Bulgarie a promulgué une loi de transposition de la convention au moyen de la Loi portant amendement du code pénal bulgare. La Bulgarie a ratifié la Convention de l'OCDE et déposé son instrument de ratification auprès de l'OCDE à la fin décembre 1998. Sont étudiées dans ce rapport les dispositions juridiques et les institutions en place en Bulgarie pour combattre la corruption d'agents publics étrangers et mesurer l'efficacité de ce dispositif. On y examine les mécanismes introduits tant au sein des administrations publiques que dans le secteur privé pour prévenir et détecter des faits de corruption d'agents publics étrangers. Ce rapport traite aussi de l'efficacité des mécanismes d’enquête et de poursuite de l’infraction de corruption étrangère et des infractions connexes notamment en matière de fraude et de blanchiment d'argent. Le rapport se termine avec des recommandations spécifiques, aussi bien en ce qui concerne la prévention et la détection que les poursuites et les sanctions appliquées en pratique. On y trouvera également les prescriptions juridiques essentielles destinées à dissuader, prévenir et combattre la corruption telles qu’elles ont été communiquées par la Bulgarie lors du processus d’examen. L’examen de la mise en œuvre par la Bulgarie des dispositions anti-corruption de l’OCDE entre dans le cadre d’un mandat plus large du Groupe de travail de l’OCDE sur la corruption dans le cadre de transactions commerciales internationales. Ce groupe est chargé d’une surveillance et d’un suivi systématiques et détaillés de l’ensemble des pays signataires de la Convention de l’OCDE sur la lutte contre la corruption étrangère. Das Forum für Finanzmarktstabilität hat die Grundsätze in den Katalog der zwölf Kernstandards für solide Finanzsysteme aufgenommen. Die Grundsätze bilden ferner die Ausgangsbasis eines umfassenden Programms der Zusammenarbeit zwischen OECD- und Nicht-OECD-Ländern und dienen als Grundlage für das Corporate-Governance-Modul der Weltbank/IWF-Berichte über die Einhaltung von Standards und Kodizes (Reports on the Observance of Standards and Codes ROSC).

    Kurzfassung: C'est en décembre 1997 que la Finlande a signé, en compagnie de trente-trois autres pays, la Convention sur la lutte contre la corruption d'agents publics étrangers dans les transactions commerciales internationales (la Convention de l'OCDE). Après la promulgation de la loi de transposition nécessaire, la Finlande a ratifié la Convention de l'OCDE et déposé son instrument de ratification auprès de l'OCDE en décembre 1998. Sont étudiées dans ce rapport les dispositions juridiques et les institutions en place en Finlande pour combattre la corruption d'agents publics étrangers et mesurer l'efficacité de ce dispositif. On y examine les mécanismes introduits tant au sein des administrations publiques que dans le secteur privé pour prévenir et détecter des faits de corruption d'agents publics étrangers. Ce rapport traite aussi de l'efficacité des mécanismes d’enquête et de poursuite de l’infraction de corruption étrangère et des infractions connexes notamment en matière de fraude et de blanchiment d'argent. Le rapport se termine avec des recommandations spécifiques, aussi bien en ce qui concerne la prévention et la détection que les poursuites et les sanctions appliquées en pratique. On y trouvera également les prescriptions juridiques essentielles destinées à dissuader, prévenir et combattre la corruption telles qu’elles ont été communiquées par la Finlande lors du processus d’examen. L’examen de la mise en œuvre par la Finlande des dispositions anti-corruption de l’OCDE entre dans le cadre d’un mandat plus large du Groupe de travail de l’OCDE sur la corruption dans le cadre de transactions commerciales internationales. Ce groupe est chargé d’une surveillance et d’un suivi systématiques et détaillés de l’ensemble des pays signataires de la Convention de l’OCDE sur la lutte contre la corruption étrangère. Jusqu’ici, le Groupe de travail a examiné l’application et la mise en œuvre de la Convention en Bulgarie, en Finlande, en Allemagne, en Islande et aux États-Unis. D’ici 2007, les examens des 30 autres pays seront réalisés.

Les régulateurs des industries d’équipements collectifs publics se heurtent à un problème crucial : la réglementation des termes et conditions dans lesquels des entreprises en concurrence ont accès à des intrants clés fournis par des concurrents. Le développement de la concurrence et le succès de la libéralisation dépendent souvent des termes de l’accès et des conditions choisies, aussi les pouvoirs publics sont-ils soucieux de faire le bon choix. Préparé par le comité de la concurrence de l’OCDE, ce rapport traite du secteur des télécommunications et cherche à approfondir la compréhension de la réglementation de l’accès. Les problèmes d’accès ne sont pas des plus faciles pour les autorités de tutelle et les responsables de la politique de la concurrence : ils peuvent en effet être techniquement délicats et donner lieu à des polémiques retentissantes sur le plan pratique. En abordant la question sous ces deux angles, ce rapport cherche à aider les autorités de tutelle et les pouvoirs publics à tirer les leçons de l’expérience de l’OCDE pour obtenir des résultats efficients et compétitifs.

They have disrupted vital systems such as transport and energy supplies and spilled over into neighbouring as well as distant regions. They have also generated widespread anxiety, and in some cases created deep-seated public mistrust of governments' ability to protect their citizens. This book is based on a report prepared between May and July 2003 by a multi-disciplinary team of experts from inside and outside of the OECD. It examines the economic and social impacts of past large-scale disasters, and draws a number of key lessons for the future. Its focus is on better prevention of disasters, and on restoring trust and securing recovery in their aftermath.

    Kurzfassung: Metropolitan areas in many OECD countries are fragmented into various territorial units, which do not correspond to the larger geography of economic and social problems. While the ensuing mismatch is not a new phenomenon, increasingly, fragmentation appears as one of the root causes of metropolitan dysfunctions, such as internal fiscal disparities, urban sprawl, and spatial polarisation, which in turn constitute an obstacle for competitiveness. This review examines the case of the metropolitan region of Montreal which has undergone one of the most radical institutional reforms in OECD countries. On the one hand, the amalgamations of municipalities led to the creation of the two new cities of Montreal and Longueuil. On the other hand, a new metropolitan body was set up to cover the whole functional and economic area — the Montreal Metropolitan Community (CMM). These institutional reforms provide a valuable opportunity to meet the challenges of Montreal's competitiveness. The new governance framework needs however to be consolidated, especially with regards to clarification of competencies and fiscal responsibilities and resources. Streamlining institutional structures and fiscal resources will not be enough. Implementing and not simply elaborating a comprehensive economic strategy for the whole metropolitan region will be the main challenge for Montreal in the following years.

    Kurzfassung: Regulatory Reform in Japan was among the first in a series of in-depth country reviews on regulatory reform. Since 1999, when the review was published, the Japanese government has introduced a number of measures to enhance regulatory quality and to promote regulatory reform, competition policy and market openness. This publication assesses the progress made, identifies some of the lessons that can be learned about the implementation process and indicates what more can be done in light of current challenges. The monitoring exercise covers the core issues of capacity for regulatory quality, competition and market openness. This study updates information about competition policy in Japan, and such trade-related matters as internationally harmonised measures and conformity assessment processes. It calls attention to the linkages between regulatory policies and tools, and the application of competition and market-openness principles. Innovative efforts, such as the Special Zones initiative, also receive attention. The overall concern is how further progress on regulatory reform can enhance Japan’s growth potential. The report brings out many of the lessons of implementation, which take account of the specificities of the Japanese context, but can be of wider value in other countries as well. What began in the 1990s as an effort to remove regulatory barriers is gaining momentum. Regulatory reform is a dynamic process aimed at improving regulatory tools and institutions, reassessing existing regulations in light of current economic and social developments, and assessing the impact of new regulations while they are in preparation. These tasks call for a whole-of-government approach, which is one of the main challenges for Japan’s next three-year Programme for Regulatory Reform.

    Kurzfassung: In October 2001, the Stability Pact and the OECD launched the Regulatory Governance Initiative (RGI) to strengthen the institutional, knowledge and process capacities for developing and implementing more efficient and effective regulation, supportive of sound and competitive markets. The RGI is one of the policy implementation initiatives under the Investment Compact (the South East Europe Compact for Reform, Investment, Integrity and Growth) of the Stability Pact. This report of the Regulatory Governance Initiative provides an assessment on the progress of regulatory governance reforms in South East Europe (SEE), and the remaining reform challenges. It includes the Governance Action Plans developed by the SEE countries. Short-term reform priorities identified by the countries provide the basis for the Agenda for Regional Action, an overview of main governance reform trends in the SEE region and recommendations for the successful implementation of reforms. The report responds to the decision, taken by the Ministers from South East Europe (SEE) at the meeting in Vienna in July 2003, to place major emphasis on reviewing progress in the area of governance at their 2004 Ministerial meeting. It aims to inform policy-makers, donors, investors and the international community of progress in regulatory governance reforms in South East Europe. Practitioners in the region can draw on this report as a guide for their work in the future.

    Kurzfassung: Deutschlands Wirtschaft hat viele Jahrzehnte lang ausgezeichnete Ergebnisse erzielt. Der Ordnungsrahmen und das Regulierungssystem des Landes zeichnen sich durch besondere historisch gewachsene Stärken aus, nämlich klare, wohl durchdachte wettbewerbsrechtliche und wettbewerbspolitische Strukturen sowie ein solides Fundament von Regulierungsinstrumenten. Es ist mithin nicht weiter verwunderlich, dass die Regulierungsqualität in einem der Rechtsstaatlichkeit verpflichteten Land wie Deutschland mit seiner traditionell bewährten Verwaltung eines der zentralen Ziele ist. Regulierungsreformen, die auf diesen traditionellen Stärken aufbauen, können die Funktionsweise der Märkte verbessern helfen. Die Bundesregierung hat in jüngster Zeit ein breites Spektrum von Reformen, darunter die „Agenda 2010", mit dem Ziel eingeleitet, die Beschäftigung zu erhöhen, die öffentlichen Ausgaben zu reduzieren und die mit der raschen demographischen Alterung verbundenen Probleme zu meistern. Neben Arbeitsmarktreformen steht die Einführung von mehr Wettbewerb auf wichtigen Produktmärkten, so z.B. im Einzelhandel und im Handwerk, auf dem Programm. Bei der Öffnung der Infrastrukturmärkte müssen ebenfalls noch erhebliche Fortschritte erzielt werden. Der vorliegende Bericht plädiert für eine Anpassung des traditionellen Ordnungsrahmens an die neuen Gegebenheiten, damit die erforderlichen Umstellungen zügiger, zu möglichst geringen Kosten für die Volkswirtschaft sowie unter Einbeziehung aller wichtigen Akteure realisiert werden können. Eine bessere Aufklärung über Reformziele und -nutzen wird dazu beitragen, die Dynamik des Reformprozesses aufrechtzuerhalten und die Akzeptanz in der Bevölkerung zu sichern.     Kurzfassung: Dans de nombreux pays de l'OCDE, les zones métropolitaines sont morcelées en diverses unités territoriales qui ne correspondent pas à la zone géographique plus large où se posent les problèmes économiques et sociaux. Si le déséquilibre qui en découle n'est pas un phénomène nouveau, le morcellement apparaît de plus en plus comme une des causes majeures des dysfonctionnements des grandes villes comme les disparités fiscales internes, l’étalement urbain et la polarisation spatiale qui constituent à leur tour un obstacle à la compétitivité. Ce rapport examine le cas de la région métropolitaine de Montréal qui a connu l'une des plus audacieuses réformes institutionnelles parmi les pays de l'OCDE. D'un côté, on a procédé à des fusions de municipalités pour créer deux nouvelles villes : Montréal et Longueuil. De l'autre, la grande région économique fonctionnelle s'est dotée d'une nouvelle structure, la Communauté métropolitaine de Montréal, représentant 63 municipalités. Ces réformes institutionnelles constituent une occasion appréciable de relever le défi de la compétitivité de Montréal. Certains aspects du nouveau cadre de gouvernance métropolitaine demandent cependant à être consolidés, en particulier en ce qui concerne la clarification des compétences, des responsabilités et des ressources fiscales. La rationalisation des structures institutionnelles et des ressources fiscales ne sera toutefois pas suffisante. La mise en œuvre, et pas seulement l’élaboration, d’une stratégie économique globale pour toute la région métropolitaine constituera pour Montréal le principal défi à relever dans les années à venir. L’Examen Territorial de Montréal s’inscrit dans un programme plus vaste d’examens territoriaux nationaux et thématiques, menés par le Comité des Politiques de Développement Territorial de l’OCDE. L’objectif général des examens territoriaux est de fournir des recommandations pratiques aux gouvernements dans trois domaines: la gouvernance à plusieurs niveaux, le développement durable aux échelons régional et local, et les réseaux régionaux au service de la compétitivité.

The regulation of the terms and conditions under which competing firms have access to essential inputs provided by rivals has become the single biggest issue facing regulators of public utility industries. Development of competition and the success of liberalisation often depend on the access terms and conditions chosen, and public policy interest in getting these terms and conditions right is important. Prepared by the OECD’s Competition Committee, this report focuses on the telecommunications industry and seeks to deepen the understanding of access regulation. Access issues are not easy issues for regulators and competition policy-makers - they can be both difficult technically and the source of noisy disputes in practice. By bringing together theory and practice, this report seeks to help regulators and policy-makers learn from OECD experience to achieve efficient and competitive outcomes.

    Kurzfassung: OECD's comprehensive territorial review of the Oresund region of Denmark and Sweden. Competitiveness is increasingly cited as the key objective of regional economic policy. In the same way that company executives strive to improve their market share and national governments are introducing competitiveness strategies, policy makers in urban areas are looking for ways to increase or maintain the competitive edge of their cities. This is a daunting task in any situation, but particularly so when, as in this case, the functional economic area concerned stretches across national boundaries. The constituent regions of Öresund, comprising the island of Zealand in Denmark, home of Copenhagen, and Sweden’s Skåne region which hosts the country’s third biggest city, Malmö are both wealthy areas. It is a “learning region” and has a strong presence in some high technology sectors. As such, the key to future growth is not simply the creation of a fixed link between the two parts of the region or improved flexibility in an expanded labour market. The region must look outward and compete with other metropolitan areas to retain and augment the assets that give it, at present, a strong competitive position in the “new economy”.

    Kurzfassung: Au cours des vingt dernières années, rares sont les réformes du secteur public qui ont retenu davantage l’attention et suscité davantage la controverse que les réformes visant l’élaboration et la gestion de la régulation. Le développement des politiques de la régulation - politiques qui visent expressément à améliorer en permanence la qualité de l’environnement réglementaire - montre comment les notions de « déréglementation » ou de « simplification des formalités administratives » ont rapidement cédé la place à un concept central de bonne gouvernance. Ce concept est fondé sur l’idée que les pratiques réglementaires peuvent sensiblement améliorer la performance des marchés, l’efficacité du secteur public et la satisfaction des citoyens en associant déréglementation, re-réglementation et amélioration de la qualité de la régulation, avec l’appui d’institutions nouvelles et meilleures. Ce rapport retrace l’évolution et l’émergence du concept de gouvernance de la régulation. Il fait le point sur la mise en œuvre de politiques de régulation dans les pays de l’OCDE et identifie les principaux enjeux auxquels les responsables de la qualité et efficacité de la régulation vont être confrontés au cours des années à venir.

    Kurzfassung: Ce rapport est consacré aux évolutions récentes de la structure des marchés des valeurs d’État et des opérations de gestion de la dette publique dans les pays de l’OCDE. Il met également en évidence les problèmes structurels fondamentaux posés aux pouvoirs publics sur les marchés émergents de la dette. Au fil des ans, les gestionnaires de la dette publique des pays de l’OCDE ont mis au point des pratiques exemplaires d’émission, de gestion et de retrait de titres de la dette publique au prix le moins onéreux possible et moyennant des risques acceptables. Ces pratiques s’inscrivaient, pour une large part, dans un contexte de déficits considérables et persistants des finances publiques. Or, avec le passage à une situation d’excédents budgétaires, il a fallu élaborer des techniques nouvelles pour faire face aux répercussions de ce changement (anomalies dans la détermination des prix et contraction de la liquidité sur les marchés de référence traditionnels). Ce rapport analyse par ailleurs l’impact des systèmes électroniques avancés sur les marchés primaire et secondaire. C’est ainsi qu’à l’avenir, des systèmes électroniques d’enchères perfectionnés permettront aux investisseurs institutionnels de soumissionner directement lors des adjudications et de contourner ainsi les spécialistes de valeurs d’État. De même, les systèmes électroniques de négociation vont inéluctablement bouleverser les marchés secondaires des valeurs à revenu fixe. En arrière-plan de ces défis, on voit de plus en plus d’émetteurs souverains des pays de l’OCDE accorder plus d’autonomie à leurs services de gestion de la dette publique, en mettant plus fortement l’accent sur l’évaluation et la gestion des risques. Ce rapport examine enfin l’introduction de nouveaux instruments (les obligations indexées et les instruments dérivés) ainsi que les mesures touchant aux relations avec les investisseurs.     Kurzfassung: A la fin des années 1990, la Région du Grand Helsinki s’est affirmée comme un pôle économique compétitif à l’échelle internationale. Cet examen passe en revue les facteurs ayant contribué à cette réussite et les nouveaux enjeux qui en découlent en matière de développement. L’économie finlandaise est fortement tributaire du secteur de la téléphonie mobile et des télécommunications en général, ce qui préoccupe sérieusement les pouvoirs publics. Aujourd’hui, le positionnement stratégique de la grappe industrielle du secteur des TIC finlandais se fonde sur un scénario associant profits élevés et prise de risques considérables. Le maintien de la compétitivité de la région sur le long terme exige une stratégie de diversification plus fine, autrement dit le développement des activités du secteur des TIC bien au-delà du cadre de la grappe industrielle actuelle. L’inclusion sociale constitue également une question cruciale. La persistance du chômage chez les personnes à faible niveau de formation et les disparités croissantes en matière de revenu nécessitent une restructuration des politiques appliquées dans le passé. La Région du Grand Helsinki doit trouver de nouvelles façons de promouvoir la cohésion sociale. Conséquence de l’accroissement de la compétitivité économique, la rapidité de la croissance démographique exige de réitérer les engagements en faveur d’une croissance maîtrisée et d’un développement compact. Tous ces enjeux nécessitent une meilleure coordination métropolitaine, les besoins en la matière étant ici examinés successivement. L’examen territorial d'Helsinki s’inscrit dans un programme plus vaste d’examens territoriaux nationaux et thématiques, menés par le Comité des Politiques de Développement Territorial de l’OCDE. L’objectif général de la série des examens régionaux thématiques est de fournir des recommandations pratiques de politique aux gouvernements dans trois domaines: la gouvernance à plusieurs niveaux, le développement durable aux échelons régional et local, et les réseaux régionaux au service de la compétitivité.

The Vienna-Bratislava region on the Austrian-Slovak border rapidly increased its competitiveness after 1989, following a 40 year separation by the Iron Curtain. As a result of the removal of many national and international barriers, trade flows and foreign direct investment have flourished, and regional growth, above national averages, has reduced internal disparities. However, new obstacles to further integration have emerged. Institutional reforms and stronger cross-border collaboration will enable the region to improve transport infrastructure, tackle restrictions on labour mobility, and better link the learning and productive systems on both sides of the border.

    Kurzfassung: The Greater Helsinki Region emerged from the 1990s as an internationally competitive economy. This review examines the factors contributing to this success and the new development challenges it has created. One critical policy question is the Finnish dependence on the telecom/mobile industry. The current strategic positioning of the Finnish ICT cluster builds on a high-return/high-risk scenario. Long-term regional competitiveness requires a more focused strategy of diversification, i.e. developing ICT activities beyond the current cluster scope. Social inclusion is another crucial issue. Persistent unemployment among the less educated population and growing income disparities are calling for the restructuring of past policies. The Greater Helsinki Region needs to find ways to promote new opportunities of social cohesion. Rapid population growth has resulted from greater economic competitiveness requiring renewed commitment to managed growth and compact development. All of these challenges create needs for greater metropolitan co-ordination that are examined in turn.

    Kurzfassung: Les systèmes scientifiques de bon nombre de pays de l’OCDE subissent une pression croissante qui les pousse à évoluer. Cette pression reflète des défis nouveaux qui vont bien au-delà de l’importante question de la garantie d’un financement durable pour la recherche dans son ensemble. En effet, il s’agit d’aborder ces défis dans la perspective plus globale de la gouvernance de la recherche publique, afin de prendre en compte des questions plus générales liées : aux processus décisionnels qui régissent l’établissement des priorités ; à l’affectation des crédits au secteur de la recherche publique ; à la gestion des institutions de recherche et à l’évaluation de leurs performances en termes de contribution à la création du savoir, de croissance économique et de réponse aux besoins de la société. Ce rapport traite de la recherche du secteur public. Il passe en revue tous les défis auxquels sont confrontés les pays de l’OCDE dans la gouvernance de leurs systèmes scientifiques. Il examine les nouvelles mesures prises par les pouvoirs publics de ces pays et indique quelles sont les meilleures pratiques pour faire face à ces défis. Enfin, il en tire des enseignements quant au processus de réforme. Des chapitres complémentaires fournissent des descriptions et des analyses détaillées des structures des systèmes scientifiques, des procédures d’établissement des priorités, de l’évolution du financement et de la gestion des ressources humaines en matière de R-D. The spread of new information and communication technologies has spurred major changes at all levels of society and notably in citizen expectations. E-government initiatives can bolster government effectiveness in important ways like facilitating cross-agency cooperation on complex problems, fostering a customer focus for services, and building relationships with private sector partners. Delay in implementing e-government reforms can thus handicap economic development in this increasingly competitive, rapidly changing world.

    Kurzfassung: Parmi les pays de l'OCDE, la Turquie est venue relativement tardivement à la réforme de la réglementation. Elle en a pourtant bien besoin. Depuis trente ans, l'économie turque souffre d'instabilité macroéconomique et d'inflation chronique, avec ce que cela implique à la fois au niveau des investissements et de la croissance. Les structures de gouvernance et de réglementation, restées peu efficaces, ont aussi contribué à la crise économique de 2001. Et pourtant, cet examen constate les efforts extrêmement encourageants actuellement entrepris pour réformer les secteurs économiques clés, l'administration publique et les cadres réglementaires. Ils semblent marquer une nette rupture avec le passé. Des éléments importants, tels qu'une politique de la concurrence claire, sont déjà en place. La lutte contre la corruption, entre autres, figure parmi les priorités, et des amendements à la constitution redéfinissent la relation entre les citoyens et l'État. La « dépolitisation » du secteur public et son renouvellement sur la base du mérite sont en cours. La réussite future dépendra de façon capitale de la poursuite de la mise en oeuvre du programme. En particulier, une volonté politique soutenue est indispensable bien au-delà du redressement consécutif à la récente crise. La Turquie est l'un des nombreux pays de l'OCDE à avoir demandé à cette Organisation d'examiner ses pratiques, institutions et réformes réglementaires nationales. Cet ouvrage présente une analyse et une évaluation générales, à l'échelle macroéconomique, des résultats et des enjeux de la réforme de la réglementation dans des domaines comme la qualité du secteur public, la politique de la concurrence et l'ouverture des marchés. Il met tout particulièrement l'accent sur les progrès de la réglementation dans les secteurs de l'électricité, du gaz, du transport routier de marchandises et des télécommunications.     Kurzfassung: This book examines the major rural developments and the issues that policy makers have been dealing with across the OECD over the last two decades. The OECD Conference, held in Siena, Italy, in July 2002, on the Future of Rural Policy, identified the need for rural policies to look beyond agriculture and offer new trajectories of development. It concluded that the major shift necessary to guarantee the future vitality of rural regions is the diversification of their economies. The papers examine key critical issues, including the EU LEADER Community Initiative and the Mexican Micro-region programme and provide a new approach that recognises the importance of the interdependence between rural and urban areas, fostering investment (rather than distributing subsidies). This approach also emphasises governance structures that get the locals involved in grass root initiatives to develop and implement new policies. This book is for practitioners and policy makers involved in grass root policies.

It gathered close to one hundred participants from 28 countries among both OECD member countries and those of South East Europe, with equal numbers of practitioners from government and from civil society.

Since adoption of its 1998 recommendation on effective action against hard-core cartels, the OECD has been leading an international effort to restrict their activities. This report reviews progress in combating hard-core cartels notably through strengthened sanctions against companies and individuals. It also quantifies the harm cartels cause and identifies improved methods of investigation. Despite recent progress in several jurisdictions, much remains to be done and this report outlines and identifies the challenges that lie ahead.

    Kurzfassung: Un État providence développé et une économie de marché ouverte ont permis au Danemark d'offrir un niveau de vie relativement élevé. La réforme de la réglementation s’y est concrétisée par de multiples mesures pragmatiques qui ont favorisé la vigueur de l’économie, la maîtrise de l’adaptation économique et sociale au changement, ainsi que l’efficacité des services publics. Cependant, les secteurs abrités, notamment le tertiaire, pâtissent encore de la coopération et de la fixation des prix, ce qui ne favorise guère la baisse des prix à la consommation. Le régime de la concurrence, ainsi que certains régimes réglementaires sectoriels, par exemple celui de l’énergie, sont plus faibles que dans de nombreux autres pays. La poursuite des réformes de l’offre et des marchés pourrait contribuer à pérenniser les performances économiques, tandis qu’un effort d’ouverture à la concurrence dans les services publics permettrait d'accroître le volume et la qualité des prestations. Le Danemark, comme plusieurs pays Membres, a demandé à l'OCDE de procéder à un examen général de ses pratiques réglementaires nationales et de ses réformes internes de la réglementation. Cet ouvrage présente une évaluation approfondie de la réforme de la réglementation dans des domaines cadres comme la qualité du secteur public, la politique de la concurrence et sa mise en œuvre et l’ouverture des marchés. Il comprend aussi des chapitres sectoriels, portant par exemple sur l’électricité et sur les télécommunications, ainsi qu’une évaluation du contexte macroéconomique de la réforme. Les politiques recommandées offrent un plan d'action équilibré à court et à long terme, fondé sur les meilleures pratiques réglementaires à l’échelon international.     Kurzfassung: This publication presents five governmental experiments aimed at promoting sustainable development in Canada, Germany, Japan, the Netherlands and the United Kingdom. These countries were selected on the basis of their diversity in terms of size and natural conditions. They also display a variety of economic, environmental and social conditions and cultural patterns. The five case studies illustrate specific institutional and decision-making efforts to adapt governance frameworks in order to respond to sustainable development challenges. The country studies are introduced by an analytical section, which focuses mainly on the way governments (at all levels) could develop integrated approaches to decision-making, on how they could ensure effective participation of civil society, and how they could improve their capacity to "take a longer-term view" - that is to design policies that remain sustainable over the longer-term.

    Kurzfassung: La réforme de la réglementation a commencé en Irlande plus tard que dans de nombreux autres pays, mais elle progresse maintenant sur un large front. A la suite des performances économiques remarquables que le pays a enregistrées durant les années 90, la réforme de la réglementation aide à maîtriser les conséquences de cet essor et à pérenniser l’expansion. La réforme lève d’importants obstacles à la poursuite de la croissance, qu’ils tiennent à l’infrastructure ou à l’action publique. Elle favorise des gains d'efficacité qui contribuent à la maîtrise de l'inflation et elle instaure une économie plus compétitive et plus flexible qui peut innover, s’adapter et continuer de prospérer tandis qu’évolueront les moteurs de son expansion. Mais beaucoup reste à faire. Des goulots d’étranglement dans l'équipement d’infrastructure, ainsi que la pénurie de main-d’œuvre et l’insuffisance des moyens d'action du secteur public, brident encore la croissance. Le manque de concurrence dans certains secteurs clés compromet les performances à venir. Prenant acte des progrès substantiels réalisés ces dernières années, le présent rapport recommande une stratégie de réforme de la réglementation plus cohérente et plus déterminée.A l’instar d’autres pays Membres, l’Irlande a demandé à l'OCDE de procéder à un examen général de ses pratiques réglementaires nationales et de ses réformes internes de la réglementation. Cet ouvrage présente une évaluation approfondie de la réforme de la réglementation dans des domaines cadres comme la qualité du secteur public, la politique de la concurrence et sa mise en œuvre et l’ouverture des marchés. Il comprend aussi des chapitres sectoriels, portant par exemple sur les télécommunications, l’électricité, le gaz, les pharmacies et les services juridiques, ainsi qu’une évaluation du contexte macroéconomique de la réforme.
