    Abstract: International human rights law has emerged as an academic subject in its own right, separate from, but still related to international law. This book explains the distinctive nature of this discipline by examining the influence of the idea of human rights on general international law. Rather than make use of a particular moral philosophy or political theory, it explains human rights by examining the way the term is deployed in legal practice, on the understanding that words are given meaning through their use. Relying on complexity theory to make sense of the legal practice of the United Nations, the core human rights treaties, and customary international law, the work demonstrates the emergence of the moral concept of human rights as a fact of the social world.     Abstract: Durch die Analyse der Beziehungen zwischen NGOs, dem UN-Sicherheitsrat und den Menschenrechten wird in diesem Buch argumentiert, dass sowohl NGOs als auch der UN-Sicherheitsrat die Menschenrechtssemantik selektiv in Bezug auf die Orte und Akteure, die sie betreffen, anwenden. Es beobachtet Wissen und Macht als Kräfte, die sich gegenseitig beeinflussen, was eine Erklärung dafür sein kann, wie Global Governance funktioniert. Darüber hinaus untersucht das Buch die Idee, dass Recht, abgesehen von der Durchdringung traditioneller Strukturen, von der Basis der Gesellschaft in Richtung institutioneller Bereiche aufsteigen kann. In diesem Zusammenhang schlägt der Autor vor, dass das Zusammenspiel zwischen nichtstaatlichen Akteuren und politischen Institutionen die Bottom-up-Prozesse im Zusammenhang mit der Gesetzgebung und der Gestaltung politischer Entscheidungen fördert. In Anbetracht der kritischen Probleme, die sowohl die NRO als auch der UN-Sicherheitsrat in Bezug auf Repräsentation und Reaktionsfähigkeit haben, stellt die Arbeit fest, dass die Beziehung zwischen ihnen auf eine ausschließende, technokratische und arkane Weise stattfindet.

    Abstract: Das Buch untersucht das menschenrechtliche Verbot der Diskriminierung aufgrund der Rasse einschließlich der Schutzvorschriften gegen Hassrede und beleuchtet umfassend die relevanten Entscheidungen unterschiedlicher nationaler und internationaler Gerichte. Es folgt dabei einem interdisziplinären und rechtsvergleichenden Ansatz, der sozial- und kulturwissenschaftliche Theorien und Befunde einbezieht, um rechtsdogmatische Fragen im Bereich des Antidiskriminierungsrechts zu erörtern. Die Entscheidungen ausländischer Gerichte werden schlaglichtartig dargestellt, soweit sie für die Analyse relevant sind. Zugrunde liegt die Frage, was heute unter Rassismus zu verstehen ist und ob Phänomene wie Ausländer- und Fremdenfeindlichkeit sowie Rechtsextremismus darunter fallen. Insbesondere Rasse als Rechtsbegriff wird ausführlich besprochen. Zentrale Bezugspunkte für die folgende Auseinandersetzung mit dem „Recht gegen rassische Diskriminierung“ sind die Europäische Rasserichtlinie (Richtlinie 2000/43/EG), die Antirassismuskonventionen der Vereinten Nationen und die Europäische Menschenrechtskonvention (EMRK). Das deutsche Grundgesetz wendet sich in Art. 3 Abs. 3 S. 1 GG gegen Rassismus, aber eine umfangreiche Dogmatik, die dem heutigen Phänomen des Rassismus gerecht werden kann, fehlt. Das vorliegende Werk leistet mithilfe eines menschenrechtsinformierten und differenzierten Verständnisses von Rassismus hierzu einen wichtigen Beitrag. Damit soll die These begründet werden, dass nur ein strukturelles Verständnis von Rassismus das Recht gegen Rassismus wirksam werden lässt.

    Abstract: Von Staaten können Gefahren ausgehen und Völkerrechtsbrüche begangen werden, auf die andere Staaten zum Schutz ihrer selbst und ihrer Bewohner reagieren müssen. Zugleich sind die Staaten durch die Globalisierung wirtschaftlich auf das Engste vernetzt und vom grenzüberschreitenden Handel abhängig geworden. Damit sind Wirtschaftssanktionen das Mittel der Wahl, um Gefahren zu begegnen und das Völkerrecht durchzusetzen. Staatenbezogene Sanktionen treffen zuerst die Bevölkerung des Zielstaates. Das traditionelle formale Verständnis der Staatensouveränität konnte keine effektiven rechtlichen Rahmenbedingungen hervorbringen. Neuere völkerrechtliche Entwicklungen stellen das Individuum generell in den Vordergrund, materialisieren die Souveränität vor dem Hintergrund der responsibility to protect mit menschenrechtlichen Schutzpflichten und betonen die Frage der Verhältnismäßigkeit. Matthias Valta behandelt das Welthandelsrecht, das Interventionsverbot, das Recht der Gegenmaßnahmen und die Grund- und Menschenrechte, differenziert zwischen Völkerrecht, Europarecht und deutschem Recht und betrachtet exemplarisch vier Fallstudien aus dem Irak, Iran, Kuba und Russland.

At the same time, they have excluded others through forced assimilation, ethnic cleansing, or even genocide. From Greek rebels, American settlers, and Brazilian abolitionists in the nineteenth century to anticolonial Africans and Zionists in the twentieth, nationalists have confronted a crucial question: Who has the “right to have rights?” A World Divided tells these stories in colorful accounts focusing on people who were at the center of events. And it shows that rights are dynamic. Proclaimed originally for propertied white men, rights were quickly demanded by others, including women, American Indians, and black slaves. Internet companies manage the web-based public infrastructure, the public sphere, and public life. As such, their practices have significant consequences for human rights, both in terms of the opportunities they offer and the potential harm they can cause. At the same time, human rights law is state-centric in nature and holds no direct obligations for companies. This book takes the necessary step of examining the role, responsibilities and practices of these private actors vis-à-vis human rights standards and norms. Part of public life and discourse has always unfolded within commercial domains, but the current situation is different in scope and character. In the online realm the vast majority of social interactions, discussions, expressions, controversies, etc. take place within platforms and services provided for by private companies. Moreover, the communications that people provide when socializing online are an essential part of the online business model, used to generate revenue. As such, it is a fundamentally different business model than that of mass media in the pre-internet age. Where newspaper revenue is linked to selling a relatively well-known product, the revenue model of a social media platform is intrinsically linked to the communications, behavior and social life of its users in a way that is largely invisible to the user.     Abstract: Drawing on detailed archival research on the parallel histories of human rights and neoliberalism, Jessica Whyte uncovers the place of human rights in neoliberal attempts to develop a moral framework for a market society. In the wake of the Second World War, neoliberals saw demands for new rights to social welfare and self-determination as threats to “civilisation”. Yet, rather than rejecting rights, they developed a distinctive account of human rights as tools to depoliticise civil society, protect private investments and shape liberal subjects.

    Abstract: "Rights Make Might examines why the three most salient minority groups in Japan all expanded their activism since the late 1970s and chronicles the galvanizing effects of global human rights ideas and institutions on local social movements. The prehistory of the three groups reveals that minority politics in Japan before the 1970s featured politically dormant Ainu - an indigenous people in northern Japan -, active but unsuccessful Koreans - a stateless colonial legacy group -, and active and established Burakumin - a former outcaste group that still faced social discrimination. Despite the unfavorable domestic political environment, the infusion of global human rights ideas and the opening of international human rights arenas as new venues for contestation transformed minority activists' movement actorhood, or subjective understanding about their position and entitled rights in Japan, as well as the views of the Japanese public and political establishment toward those groups, thus catalyzing substantial gains for all three groups. Having benefited from global human rights, all three groups also repaid their debt by contributing to the consolidation and expansion of global human rights principles and instruments. Drawing on interviews and archival data, Rights Make Might offers a detailed historical and comparative analysis of the co-constitutive relationship between international human rights activities and local politics that contributes to our understanding of international norms, multilateral institutions, social movements, human rights, and ethno-racial politics."

    Abstract: "Rethinking the Balance between Religion, Identity, and Equality Introduction: The New Generation of Conscience Objections in Legal, Political and Cultural Context Susanna Mancini and Michel Rosenfeld I. The New Conscientious Objection versus the Old The new generation of conscience based objections differs sharply from its predecessors in that it involves claims that are interventionist and intrusive as opposed to claims aimed at withdrawal and absence from discrete areas of mainstream collective undertakings. Typical of the past, are conscientious objectors who sought to be excused from serving in the military or from going to war, or else from pledging allegiance to their country's flag in public gatherings.     Abstract: "Children make up half of the world's refugees and over 40 per cent of the world's asylum seekers. Yet, children are largely invisible in historical and contemporary refugee law. Furthermore, there has been very limited interaction between the burgeoning children's rights framework, in particular the Convention on the Rights of the Child (CRC), and the 1951 Convention relating to the Status of Refugees (Refugee Convention). This book explores the possibility of a children's rights approach to the interpretation of the Refugee Convention and within that what such an approach might look like. In order to construct a children's rights approach, the conceptualisations of children outside the legal discipline, within international children's rights law and then within refugee law and refugee discourse are analysed. The approach taken is socio-legal and comparative in nature and the suitability of the Refugee Convention as a framework for the interpretation of child claims is examined. The book analyses to what extent the Refugee Convention is capable of dealing with claims from children based on the modern conceptualisation of children which is underscored by two competing ideologies - the child as a vulnerable object in law to be protected and the child as subject with rights and the capacity to exercise their agency. The influence each regime has had on the other is also analysed. The work discusses how a children's rights approach might improve outcomes for child applicants. The book makes an original contribution to child refugee discourse and as such will be an invaluable resource for academics, researchers and policy-makers working in the areas of migration and asylum law, children's rights, and international human rights law' --

The case studies included illustrate the need to vary the application of human rights in differing cultural environments, and the book suggests a new framework: a flexible universalism that returns to basics-focusing on the great evils of the human condition. This approach will help the human rights movement succeed in a multipolar era.

    Abstract: The contributors of the volume analyse the effect of the ECHR and international human rights on the national and European legal order from different angles. Special emphasis is given on the Union’s accession to the ECHR and the scrutiny of ECJ’s opinion 2/13. The impact of the human rights provisions of the accession agreement with Ukraine is shown besides some more general issues of human rights protection in national jurisdictions, namely Germany, Poland, Slovenia and Turkey for providing a comparative overview of the various challenges countries with different backgrounds face in the implementation of human rights, including social human rights. All authors are academics working in the field of human right protection and the aim is to provide the reader with a better understanding of the challenges of international human rights protection.

    Abstract: "The rights of indigenous peoples under international law have seen significant change in recent years, as various international bodies have attempted to address the question of how best to protect and enforce their rights. The United Nations Declaration on the Rights of Indigenous Peoples is the strongest statement thus far by the international community on this issue. The Declaration was adopted by the United Nations on 13 September 2007, and sets out the individual and collective rights of indigenous peoples, as well as their rights to culture, identity, language, employment, health, education, and other issues. While it is not a legally binding instrument under international law, it represents the development of international legal norms designed to eliminate human rights violations against indigenous peoples, and to help them in combating discrimination and marginalisation. This comprehensive commentary on the Declaration analyses in detail both the substantive content of the Declaration and the position of the Declaration within existing international law. It considers the background to the text of every Article of the Declaration, including the travaux préparatoire, the relevant drafting history, and the context in which the provision came to be included in the Declaration. It sets out each provision's content, interpretation, its relationship with other principles of international law, and its legal status. It also discusses the significance and outlook for each of the rights analysed. The book assesses the practice of relevant regional and international bodies in enforcing the rights of indigenous peoples, providing an understanding of the practical application of the Declaration's principles"

    Abstract: To which extent is it legitimate, in view of freedom of conscience and religion, to sanction individuals for refusing to take part in an activity they claim to be incompatible with their moral or religious convictions? To answer this question, this study first clarifies some of the concepts of conscientious objection. Then it examines the case law of international bodies and draws distinctions in order to differentiate several types of objections, hence identifying the evaluation criteria applicable to the respect that each one deserves. Finally, this study proposes indications as to the rights and obligations of the State in front of those different types of objections. --
