    Abstract: "Custom was fundamental to medieval legal practice. Whether in a property dispute or a trial for murder, the aggrieved and accused would go to lay court where cases were resolved according to custom. What custom meant, however, went through a radical shift in the medieval period. Between the twelfth and thirteenth centuries, custom went from being a largely oral and performed practice to one that was also conceptualized in writing. Based on French lawbooks known as coutumiers, Ada Maria Kuskowski traces the repercussions this transformation - in the form of custom from unwritten to written and in the language of law from elite Latin to common vernacular - had on the cultural world of law.     Abstract: This brief maps the available data augmented by expert interviews on the impact of the Covid-19 measures on DV in eight European Member States during the first lock-down. The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Abstract: Das Werk behandelt das Tragen eines Kopftuchs durch Lehrerinnen und Schülerinnen in der öffentlichen Verwaltung und in der Justiz. Eingehend behandelt werden die Interpretation des muslimischen Kopftuchs (Symbol der Unterdrückung von Frauen und des politischen Islam?) und das Neutralitätsgebot aus verfassungsrechtlicher und sozialwissenschaftlicher Sicht. Untersucht wird die Entwicklung des laizistischen Modells in Frankreich und der Versuch einer Übertragung dieses Modells auf Deutschland (Berliner Neutralitätsgesetz, Verbot des Kopftuchs von Schülerinnen). Auch das neue Bundesgesetz zum Erscheinungsbild von Beamtinnen und Beamten wird untersucht und auf die Notwendigkeit einer Neujustierung des überkommenen Neutralitätsverständnisses hingewiesen.
    Abstract: The work deals with the wearing of a headscarf by female teachers and students, in public administration and in the judiciary. The interpretation of the Muslim headscarf (symbol of the oppression of women and political Islam?) and the neutrality requirement from a constitutional and sociological perspective are dealt with in depth. The development of the laicist model in France and the attempt to transfer this model to Germany (Berlin neutrality law, ban on the headscarves for schoolgirls) are examined. The new federal law on the appearance of civil servants is also dealt with, as well as the need for a readjustment of the traditional understanding of neutrality.

    Abstract: "Should an employee be allowed to wear a religious symbol at work? Should a religious employer be allowed to impose constraints on employees' private lives for the sake of enforcing a religious work ethos? Should an employee or service provider be allowed, on religious grounds, to refuse to work with customers of the opposite sex or of a same-sex sexual orientation? This book explores how judges decide these issues and defends a democratic approach, which is conducive to a more democratic understanding of our vivre ensemble. The normative democratic approach proposed in this book is grounded on a sociological and historical analysis of two national stories of the relationships between law, religion, diversity and the State, the British (mainly English) and the French stories. The book then puts the democratic paradigm to the test, by looking at cases involving clashes between religious freedoms and competing rights in the workplace. Contrary to the current alternative between the "accommodationist view", which defers to religious requests, and the "analogous" view, which undermines the importance of religious freedom for pluralism, this book offers a third way. It fills a gap in the literature on the relationships between law and religious freedoms and provides guidelines for judges confronted with difficult cases"--

    Abstract: Durch die Analyse der Beziehungen zwischen NGOs, dem UN-Sicherheitsrat und den Menschenrechten wird in diesem Buch argumentiert, dass sowohl NGOs als auch der UN-Sicherheitsrat die Menschenrechtssemantik selektiv in Bezug auf die Orte und Akteure, die sie betreffen, anwenden. Es beobachtet Wissen und Macht als Kräfte, die sich gegenseitig beeinflussen, was eine Erklärung dafür sein kann, wie Global Governance funktioniert. Darüber hinaus untersucht das Buch die Idee, dass Recht, abgesehen von der Durchdringung traditioneller Strukturen, von der Basis der Gesellschaft in Richtung institutioneller Bereiche aufsteigen kann. In diesem Zusammenhang schlägt der Autor vor, dass das Zusammenspiel zwischen nichtstaatlichen Akteuren und politischen Institutionen die Bottom-up-Prozesse im Zusammenhang mit der Gesetzgebung und der Gestaltung politischer Entscheidungen fördert. In Anbetracht der kritischen Probleme, die sowohl die NRO als auch der UN-Sicherheitsrat in Bezug auf Repräsentation und Reaktionsfähigkeit haben, stellt die Arbeit fest, dass die Beziehung zwischen ihnen auf eine ausschließende, technokratische und arkane Weise stattfindet.

    Abstract: In dieser rechtsvergleichenden Studie entwickelt Antje G. I. Tölle einen Vorschlag de lege ferenda für den Vertragsschluss im elektronischen Geschäftsverkehr, der auf einer Abwägung zwischen den widerstreitenden Interessen nach Sicherheit und Flexibilität beruht. Dabei ordnet er etwa das Downloadshopping als verbindliches Angebot ein und ermöglicht seine Rücknahme. Weitere Themenkomplexe sind der Zugang und Widerruf eines Angebots, sein Erlöschen durch Zeitablauf, Ablehnung oder Verlust der Geschäftsfähigkeit oder den Tod. Für die Analyse werden insgesamt sechs europäische Rechtsordnungen, namentlich Deutschland, England, Frankreich, die Schweiz, die Niederlande und Ungarn herangezogen. Darüber hinaus berücksichtigt die Studie die europäischen Modellgesetze der PECL, des DCFR und des GEK zusammen mit dem UN-Kaufrecht neben diversen historischen Regelwerken wie etwa dem Allgemeinen Preußischen Landrecht oder dem Bürgerlichen Gesetzbuch Sachsens. It seems a new world order of fundamentalist violence and meaningless atrocity is upon us, whilst civilised instruments for cooperation and compromise are becoming increasingly ineffective. In this timely book, Stephen Chan explores the historical and philosophical roots of difference and discord in the international system. He begins with the introduction of the Westphalian system, showing how, throughout the 20th century, new states - from the Middle East, Asia and Africa - entered that system with reservations, preconditions, and great efforts to introduce new forms of concerts and congresses but without seriously challenging the international status-quo. By contrast, the 21st century has brought turmoil and change in the form of militant Islam - be it the Taleban, Al Qaeda, or ISIS - whose varied roots and fluid emergence have so far prevented the West from being able to understand and combat it. Developing Kissinger's suspicion of Saudi Arabia as an Islamic state in Westphalian dress, Chan argues that what is at stake today is not the development of a new Caliphate or an old radicalism - but the effort to supplant and replace the Westphalian system itself. This is the complex and challenging reality to which a truly modern and persuasively relevant plural international relations must now adapt. Whether it can do so remains to be seen"--

Specifically, it seeks to further explicate the social dimensions of power as the capacity to shape how actors think about the world, in contrast to the more typical conception emphasizing material properties such as military or economic capabilities. Participating in international institutions and being seen as 'law-abiding' is a potent source of status for states and non-state actors alike. In engaging with the law, actors are inducted into a complex set of collective expectations that profoundly shape the way they frame their interests and pursue their policy goals. This process is first examined theoretically, and then through a detailed evaluation of two prominent-and challenging-multilateral institutions, the ban on antipersonnel mines and the International Criminal Court

Jahrhundert die Drittwirkung der Grundrechte entdeckt wurde. Die Beziehungen wechseln freilich mit den Begleitumständen. Sie stellten sich in Frankreich, wo der Übergang von monarchischem Absolutismus und ständisch-feudaler Gesellschaftsordnung zur bürgerlichen Staats- und Sozialordnung in einem revolutionären Akt des bereits emanzipierten Bürgertums herbeigeführt wurde, anders dar als in Deutschland, wo die Umstellung von der Obrigkeit ausging und sich in einem langen, rechtsförmigen Prozess evolutiv vollzog. Die Formationsphase der bürgerlichen Gesellschaft zwischen Revolutionen und Restauration enthält dafür vielfältiges Anschauungsmaterial, das auch die Grundlage für Analysen der weiteren Entwicklung des Verhältnisses der beiden

    Abstract: Die Forschungsarbeit analysiert vergleichend die straf- und gefahrenabwehrrechtlichen Vorschriften sowie die Polizeipraktiken hinsichtlich des Umgangs mit „Gefährdern“ in den Bereichen Terrorismus, Fußballgewalt und Rückfall von haftentlassenen Sexualstraftätern. Die Verfasserin stellt fest, dass sich gemeinsame rechtspolitische Ansätze zur Schaffung von Sicherheit in diesen Systemen finden lassen. Anhand der rechtsvergleichenden Ergebnisse zeigt die Autorin neue Entwicklungen im Strafrecht auf und diskutiert die Existenz eines sog. Sicherheitsstrafrechts. Da Terrorismus, Hooliganismus und Sexualgewalt die nationalen Rechtssysteme vor neue Herausforderungen stellen, ist die Frage, wie die Rechtssysteme Deutschlands, Frankreichs und Englands mit dieser Gefahr von schwerer Gewalt umgehen, von entscheidender Bedeutung.     Abstract: "Do the United States and France, both post-industrial democracies, differ in their views and laws concerning discrimination? Marie Mercat-Bruns, a Franco-American scholar, examines the differences in how the two countries approach discrimination. Bringing together prominent legal scholars--including Robert Post, Linda Krieger, Martha Minow, Reva Siegel, Susan Sturm, Richard Ford, and others--Mercat-Bruns demonstrates how the two nations have adopted divergent strategies. The United States continues, with mixed success at "colorblind" policies, to deal with issues of diversity in university enrollment, class action sex-discrimination lawsuits, and rampant police violence against African American men and women. In France, the country has banned the full-face veil while making efforts to present itself as a secular republic. Young men and women whose parents and grandparents came from sub-Sahara and North Africa are stuck coping with a society that fails to take into account the barriers to employment and education they face. Discrimination at Work provides an incisive comparative analysis of how the nature of discrimination in both countries has changed, now often hidden, or steeped in deep unconscious bias. While it is rare for employers in both countries to openly discriminate, deep systemic discrimination exists, rooted in structural and environmental causes and the ways each state has dealt with difference in general.     Abstract: This volume is an updated and expanded version of the authors original book, first published by Martinus Nijhoff Publishers and based on his cum laude doctoral dissertation. That volume discussed how the Five Principles of Peaceful Coexistence drowned in the first war between a communist and a non-aligned state. This new edition reproduces the original text, but supplements it considerably in light of subsequent developments and official records and reports only later released or leaked to the public. It places Sino-Indian relations in the wider, current context of the rise of China, the position of Tibet and the disorganised state of Asia. The border dispute did not prevent substantial economic relations developing between the two countries and visits taking place at the highest political level. But it still gives rise to almost daily incursions, and in the current climate, the risk of a clash is growing, as forces have been strengthened and most of the Line of Actual Control has not been demarcated.     Abstract: Whether in global markets, in the EU, or in international law - constitutions are long being formed beyond the state with severe consequences. In this post-democratic constitutionalism, a market-liberal program is given the status of an unquestionable consensus, reinforced by a higher-ranking law. Kolja Möller connects system theory, post-Marxist resources, and democracy theory to show, using different examples: Neither returning to national democracy nor spreading individual global citizen rights will improve this situation. Instead, a deposing power is needed to resolve the substantive over-formation of constitutions beyond the state. The new and critical constitutional theory thus created challenges the current diagnoses of declining status of democracy, and sheds a new light on the "democratic deficit" of globalization

    Abstract: Über Kopftuch und Burka werden in Deutschland wie in Frankreich seit Jahren heftige Debatten geführt. Auslöser waren hierfür in Deutschland Entscheidungen des Bundesverfassungsgerichts aus den Jahren 2003 und 2015. In Frankreich erregen zwei Gesetze die Gemüter: das Kopftuchverbot für Schülerinnen 2004; ein generelles Verbot, mit einem Gesichtsschleier in der Öffentlichkeit aufzutreten, 2010. Nachdem der Europäische Gerichtshof für Menschenrechte dieses Verbot nicht beanstandet hatte, wurde auch in Deutschland ein Burka-Verbot gefordert. Die Kontroverse um Kopftuch und Burka stellt aber nur ein Symptom dahinter liegender Probleme dar: Wieviel Homogenität ist für ein friedliches Zusammenleben in einer multireligiösen Gesellschaft erforderlich? Auf wieviel Toleranz ist sie angewiesen? Aber auch, wo sind deren Grenzen? Die Antworten werden auch bestimmt durch das Verständnis des Verhältnisses von Staat und Religion, das Ausmaß an Laizität. Deren Konzepte in Frankreich und Deutschland nähern sich gerade angesichts der Verbreitung des Islam in beiden Ländern ungeachtet unterschiedlicher historischer Ausgangspunkte an. Durch den starken Zustrom an Flüchtlingen haben diese Fragen eine ungeahnte Aktualität erfahren
