    Abstract: The introduction of the 'Common Consolidated Corporate Tax Base' as a means for an efficient and equitable taxation of multinational enterprises in Europe represents the most important issue of European business taxation. Starting in 2001, the Commission and the Member States have cooperated in order to develop an innovative technique for the measurement and the allocation of business profits within the European Union. This venture is not only the most ambitious political project of the current European Commission, it also challenges traditional legal and economic concepts of business taxation. This book contains the proceedings of an International Tax Conference, organised under the auspices of the German Presidency in the European Union and designed in cooperation with the Centre for European Economic Research (Mannheim) and the Max Planck Institute for Intellectual Property, Competition and Tax Law (Munich) including presentations from European and American academics and tax practitioners.

    Abstract: Diese Studie analysiert das dialogische Zusammenspiel zwischen den europäischen und türkischen Diskursen um den möglichen EU-Beitritt der Türkei. Die Differenzen stellen in der Perspektive postkolonialer Theorien ein ambivalentes und formatives Moment für die Bildung einer europäischen Identität dar: Die Europäer nehmen die Beitrittsverhandlungen zum Anlass, über ihr Selbstverständnis zu reflektieren, wobei diverse Ost-West-Repräsentationen kommuniziert und strukturiert werden. Die muslimischen Migranten in Europa und die Minderheiten in der Türkei fungieren dabei als interne Symptome, die die Unvollständigkeit der europäischen bzw. türkischen Identitäten sichtbar machen

    Abstract: Eine ethnographische Studie zu bolivianischen Migrantinnen, die in Barcelona als undokumentierte "Domestic Workers" (private Kinder- und Altenbetreuung, sowie Haushaltshilfe) arbeiten, um mit ihrem Einkommen den Lebensunterhalt ihrer Familien im Herkunftsland zu sichern. Die Arbeit analysiert Motive und Entscheidungsprozesse des Migrationsprojekts aus einer gendersensiblen Perspektive und stellt die Strategien zur Grenzüberwindung in den Rahmen von verschärften EU-Grenzregimen. Weiter wird die prekäre Wohn- und Arbeitssituation der "illegalen" MigrantInnen, insbesondere der Arbeitsplatz Privathaushalt, thematisiert und die Rolle von Hilfsorganisationen kritisch beleuchtet.

    Abstract: Der Unabhängige Staat Samoa gehört, gemessen am Bruttosozialprodukt, zu den 50 ärmsten Ländern der Erde. Auch wenn diese Bewertung zu einseitig ist und eine Klassifizierung nach den Kriterien des Human Development Index (HDI) ein deutlich positiveres Bild zeichnet, ist Samoa seit seiner Unabhängigkeit im Jahre 1962 von ausländischer Hilfe abhängig. Die Gründe dafür sind vielfältig und liegen sicherlich nicht nur in der kolonialen Vergangenheit der Inselgruppe. Die große Entfernung zu den internationalen Handelsrouten und die relative Häufung von Naturkatastrophen sind nur zwei von zahlreichen Faktoren, welche die wirtschaftliche Entwicklung immer wieder behindert haben. Die Europäische Union zählt seit 1970 (Abkommen von Lomé) zu den wichtigsten Partnern Samoas auf dem Gebiet der Entwicklungs-zusammenarbeit und hat vor allem auf dem Sektor Wasserversorgung ländlicher Gemeinden erfolgreiche Arbeit geleistet.

    Abstract: Dieses Buch behandelt die Arbeitsmigration aus Polen nach Deutschland nach der EU-Osterweiterung im Mai 2004. Einzelne Beiträge befassen sich mit der neuen rechtlichen Lage und der damit verbundenen Verschiebung der Wanderungsströme in Richtung der Länder, die ihre Arbeitsmärkte öffneten. Des Weiteren widmen sich die Autoren den unterschiedlichen Migrantengruppen und diskutieren die Struktur und die Formen der neuen Migration sowie die Rolle der Migrationsnetzwerke. Dabei liegt der Fokus auf den transnationalen Praktiken der Migranten und ihrer sozialen Positionierung. Im Anschluss werden die Folgen der Arbeitswanderung in einem offenen europäischen Raum sowie die Herausforderungen der transnationalen Migration für das Verständnis der sozialen Integration in Europa erörtert

    Abstract: Tort law interacts strongly with public regulation. Is the breach of a statutory duty in itself a sufficient basis for liability? Does the fact that some acts are allowed by a permit issued by public agencies exempt them from liability altogether? These questions and similar problems on the borderline between tort and regulatory law serve as a basis for in-depth analyses by several scholars specialized in this field. This book thus systematically analyses the interaction of administrative law and tort law. The focus is mainly on safety regulations and provisions aimed at environmental protection. This publication contains reports from 9 countries of the European Union, from Norway, Switzerland and the USA, three special reports from the perspectives of administrative and regulatory law and of the insurance as well as an economic analysis. The results are summarised in a comparative report, followed by conclusions.

    Abstract: The twin concepts of "Culture" and "Identity" are inescapable in any discussion of European Integration and yet over the last ten years their meaning has become increasingly contested. By combining an anthropological and political perspective, the authors challenge the traditional boundaries within the issue of the construction of Europe. In the first part, historians and anthropologists from various national traditions discuss the process of the construction of Europe and its implications for cultural identities. The second section examines a number of topics at the core of the process of Europeanization and presents up-to-date information on each of these issues: political parties, regions, football, cities, the Euro, ethnicity, heritage and European cinema. Emphasis is be placed on the political structuring of cultural identities by contrasting top-down and bottom-up processes that define the tensions between the unity and diversity of the European Community.

    Abstract: Recent developments in the European integration process have raised, amongst many other things, the issue of linguistic diversity, for some a stumbling block to the creation of a European democratic polity and its legal and social institutions. The solution to the 'question of language', involves an understanding of the role played by natural languages and the consequent design of policies and institutional mechanisms to facilitate inter-linguistic and intercultural communication. This is not an exclusively European problem, and nor is it entirely new, for it is also the problem of linguistic majorities and minorities within unitary nation-states. However, the effects of globalization and the diffusion of multiculturalism within nation-states have given renewed emphasis to the question of language in diverse societies. Facing the question anew involves reconsidering traditional ideas about social communication and the public sphere, about opinion-formation and diffusion, about the protection of cultural and linguistic minorities, and about the role that language plays in the process of formation of political and legal cultures. This volume is intended as a multidisciplinary contribution towards studying and assessing the range of problems that form the 'language question' in Europe and diverse societies

    Abstract: Die Daseinsvorsorge durch den öffentlich-rechtlichen Rundfunk ist, zumeist unter dem Stichwort der Grundversorgung, Gegenstand vieler rundfunkrechtlicher Untersuchungen. Während als Maßstab in der Regel jedoch das nationale Verfassungsrecht herangezogen wird, richtet die Verfasserin dieser Arbeit nach einer rechtsvergleichenden Analyse der Rundfunkordnungen in Deutschland und Frankreich ihr Hauptaugenmerk auf das europäische Gemeinschaftsrecht. Die Untersuchung anhand der Dienstleistungsfreiheit und des Beihilfesystems des Gemeinschaftsrechts zeigt auf, inwiefern die unterschiedliche Behandlung von öffentlich-rechtlichem und privatem Rundfunk im dualen Rundfunksystem bedenklich erscheint. Vor diesem Hintergrund werden insbesondere mit Blick auf das Zeitalter der Digitalisierung Alternativen zum derzeitigen System entwickelt.
