Abstract: The capacity to abuse, or in general affect the enjoyment of human, labour andenvironmental rights has risen with the increased social and economic powerthat multinational companies wield in the global economy. At the same time,it appears that it is difficult to regulate the activities of multinational companiesin such a way that they conform to international human, labour and environmentalrights standards. This has partially to do with the organization of companiesinto groups of separate legal persons, incorporated in different states, aswell as with the complexity of the corporate supply chain. Absent a businessand human rights treaty, a more coherent legal and policy approach is required.Faced with the challenge of how to effectively access the right to remedy inthe European Union for human rights abuses committed by EU companies innon-EU states, a diverse research consortium of academic and legal institutionswas formed. The consortium, coordinated by the Globernance Institute forDemocratic Governance, became the recipient of a 2013 Civil Justice ActionGrant from the European Commission Directorate General for Justice. A mandatewas thus issued for research, training and dissemination so as to bringvisibility to the challenge posed and moreover, to provide some solutions forthe removal of barriers to judicial and non-judicial remedy for victims of business relatedhuman rights abuses in non-EU states. The project commenced inSeptember 2014 and over the course of two years the consortium conductedresearch along four specific lines in parallel with various training sessions acrossEU Member States. The research conducted focused primarily on judicial remedies, both jurisdictionalbarriers and applicable law barriers; non-judicial remedies, both to company based grievance. The results of this research endeavour make up the content ofthis report whose aim is to provide a scholarly foundation for policy proposalsby identifying specific challenges relevant to access to justice in the EuropeanUnion and to provide recommendations on how to remove legal and practicalbarriers so as to provide access to remedy for victims of business-related humanrights abuses in non-EU states

Abstract: Warfare in the twenty-first century presents significant challenges to the modern state. Serious questions have arisen about the use of drones, target selection, civilian exposure to harm, intervening for humanitarian reasons, and war as a means of forcing regime change. In Just War and Human Rights Todd Burkhardt argues that updating the laws of war and reforming just war theory is needed. A twenty-year veteran of the US Army, Burkhardt claims that war is impermissible unless it is engaged, fought, and concluded with right intention. A state must not only have a just cause and limit its war-making activity in order to vindicate the just cause, but it must also seek to vindicate its just cause in a way that yields a just and lasting peace. A just and lasting peace is motivated by the just war tenet of right intention and predicated on the realization of human rights. Therefore, human rights should not only dictate how a state treats its own people but also how a state treats the people of other countries, insulating them and protecting innocent civilians from the harms of war. --

Abstract: This book demonstrates the importance of a duty-based approach to morality. The dominance of what has been labeled “rights talk” leads to the neglect of duties without corresponding rights (e.g., duties of virtue) and stimulates the proliferation of questionable human rights. Therefore, this book argues for a duty-based perspective on morality in order to, first, salvage duties of virtue, and, second, counter the trend of rights-proliferation by providing some conceptual clarity concerning rights and duties that will enable us to differentiate between genuine and spurious rights-claims. The argument for this duty-based perspective is made by examining two particularly contentious duties: duties to aid the global poor and civic duties. These two duties serve as case studies and are explored from the perspectives of political theory, jurisprudence and moral philosophy. The argument is made that both these duties can only be adequately defined and allocated if we adopt the perspective of duties, as the predominant perspective of rights either does not recognize them to be duties at all or else leaves their content and allocation indefinite. This renewed focus on duties does not wish to diminish the importance of rights. Rather, the duty-based perspective on morality will strengthen human rights discourse by distinguishing more strictly between genuine and inauthentic rights. Furthermore, a duty-based approach enriches our moral landscape by recognizing both duties of justice and duties of virtue. The latter duties are not less important or supererogatory, but function as indispensable complements to the duties prescribed by justice. In this perceptive and exceptionally lucid book, Eric Boot argues that a duty-focused approach to morality will remedy the shortcomings he finds in the standard accounts of human rights. The study tackles staple philosophical topics such as the contrasts between duties of virtue and duties of justice and imperfect and perfect obligations. But more importantly perhaps, it also confronts the practical question of what our human rights duties are and how we ought to act on them. Boot's book is a splendid example of how philosophy can engage and clarify real world problems. Kok-Chor Tan, Department of Philosophy, University of Pennsylvania A lively and enjoyable defence of the importance of our having duties to fellow human beings in severe poverty. Abstract: "This book explores the right to democracy in international law and contemporary democratic theory, asking whether international law encompasses a substantive or procedural understanding of the notion. The book considers whether there can be considered to be a basis for the right to democracy in international customary law through identification of the relevant state practice and opinio juris, as well as through an evaluation of the Universal Declaration of Human Rights and whether the relevant provisions might be interpreted as forming customary law. The book then goes on to explore the relevant provisions in international treaties including the International Covenant on Civil and Political Rights before looking at the role of regional organizations and human rights regimes including the European Court of Human Rights and the Arab human rights regime. [The author] draws on the work of John Rawls in order to put forward a theoretical basis for the right to democracy."--

Abstract: Methodological discussion has largely been neglected in human rights research, with legal scholars in particular tending to address research methods and methodological reflection implicitly rather than explicitly. This book advances thinking on human rights methodology, offering instruction and guidance on the methodological approaches to human rights research. Seeking to bridge the methodological deficit often compounded by the interdisciplinary nature of human rights research, contributions by leading scholars in a range of evolving fields, provide an up-to-date assessment of human rights methods. The various chapters apply these methods to different substantive areas including discrimination, the right to food, the right to water, public health and gender. This book gives a comprehensive treatment of disciplinary approaches, discusses methodological options and provides advice on how best to conduct human rights research in the crossroads of different academic disciplines. Accessible and engaging, this book will be of keen interest to students and scholars working in human rights research, both those approaching it from a legal standpoint and those of other social science disciplines. Both practical and timely, the book will also lend itself to human rights practitioners and policy-makers --Back cover of book

Abstract: Providing an analysis of global regulation and the impact of international organizations on domestic laws, this collection grew out of a central objective to explore methods of domestic engagement with international trade and human rights norms, and the inherent difficulties in establishing balanced links between these two international law regimes. The common thread of the papers in this collection is a focus on the application of socio-legal normative paradigms in building knowledge and policy support for coordinating local performance with international trade and human rights standards in ways that are mutually sustaining.--

Abstract: The various reports on cultural rights by UN Special Rapporteur Faridah Shaheed have provided a new universal standard for topics ranging from cultural diversity, cultural heritage, the right to artistic freedom and the effects of today's intellectual property regimes. This book's team of international contributors reflects upon the many aspects of cultural rights discussed in Faridah Shaheed's reports and discusses how cultural rights support cultural diversity, foster intercultural dialogue and contribute to inclusive social, economic and political development. Drawing from a range of disciplines, the contributing authors explore the meaning and position of cultural rights and the implications these may have for international relations, the international legal order and cross-cultural understanding, while also offering recommendations for the future. Key topics discussed include the link between culture and science, gender and human rights, rights to artistic freedom, the importance of historical narratives and the impact of advertising and marketing on the enjoyment of cultural rights. This worthwhile contribution to the current cultural rights debate will be of interest to academics and students teaching and studying in the fields of culture, heritage and human rights as well as policymakers who are working within cultural rights related issues.--

Abstract: To which extent is it legitimate, in view of freedom of conscience and religion, to sanction individuals for refusing to take part in an activity they claim to be incompatible with their moral or religious convictions? To answer this question, this study first clarifies some of the concepts of conscientious objection. Then it examines the case law of international bodies and draws distinctions in order to differentiate several types of objections, hence identifying the evaluation criteria applicable to the respect that each one deserves. Finally, this study proposes indications as to the rights and obligations of the State in front of those different types of objections. --

Note: Liberalism and our modern allegiance to human rights rest on a foundational commitment to moral equality. But why, given our differences, must we always treat one another as equals? Most who have attempted to answer this question have appealed to the idea of dignity, the idea that all human beings possess an intrinsic worth--grounded in capacities, for example, to reflect, reason, or love--that raises us up in the order of nature. In Humanity without Dignity, Andrea Sangiovanni rejects this predominant view and offers a radical alternative. He argues that, to understand our commitment, we must begin with a consideration not of equality but inequality. Rather than search for a chimerical value-bestowing capacity possessed to an equal extent by each one of us, we ought to ask: Why and when is it wrong to treat others as inferior? He comes to the conclusion that our commitment to moral equality is best explained by a rejection of cruelty rather than a celebration of rational capacity. He then traces the impact of this fundamental shift for our understanding of human rights, and the place of anti-discrimination norms in that understanding.

Abstract: The discourse on the human right to water presents deliberations on the concept, content and rationale for the right, with little attention to the practical question of translating the right into reality. This book aims to fill this void by focusing on ‘realization’ of the right by its holders, examining how effective the mechanisms are for ‘implementing’ the right in enabling its universal realization. In a quest to answer this question, the book draws a conceptual differentiation between ‘implementation’ and ‘realization’ of the right, arguing that unlike implementation - which is an objective process of creation - and implementation of measures such as legal frameworks, institutional structures or policy and action guidelines, realization of the right is a subjective process that extends much beyond. It takes shape within specific contextual settings which may include varied situations, yet remains neglected in the related academic and action forums. This book attempts to address this void by discussing some of the most significant contexts and the underlying problems and concerns that strongly influence realization of the human right to water. It contends that if the right is to be truly realized, these different contexts - which can be further classified as 'objective' and 'subjective' - must be understood, analysed and appropriately addressed before framing and implementing relevant action. The book further situates the human right to water discourse in a broader interdisciplinary perspective, expanding its scope beyond the narrower legal dimensions, linking it to the wider field of water resources management/governance. Through the novel ideas it proposes, the book makes an innovative and unique contribution in the field of human right to water which is of great scientific value

Abstract: This book investigates how human rights law can be applied to corporate entities. To date there have been insufficient international legal mechanisms to bring corporations to justice for their misconduct abroad. The book argues that rather than trying to solve the problem locally, an international approach to corporate human rights compliance needs to be sought to prevent future corporate human rights abuses. Implementing effective and enforceable human rights compliance policies at corporate level allows businesses to prevent negative human rights impacts such as loss of revenue, high litigation costs and damage to reputation. By considering human rights to be an inherent part of their business strategy, corporations will be well equipped to meet national and regional business and human rights standards, which will inevitably be implemented in the next few years. This approach, in turn, also furthers the fundamental aim of international human rights law.

Abstract: This book looks at the centerpiece of the international women’s rights discourse, the Convention on the Elimination of all Forms of Discrimination against Women (CEDAW), and asks to what extent it affects the lives of women worldwide. Rather than assuming a trickle-down effect, the author discusses specific methods which have made CEDAW resonate. These methods include attempts to influence the international level by clarifying the meaning of women’s rights and strengthening the Convention’s monitoring procedure, and building connections between international and domestic contexts that enable diverse actors to engage with CEDAW. This analysis shows that while the Convention has worldwide impact, this impact is fundamentally dependent on context-specific values and agency. Hence, rather than thinking of women’s rights exclusively as normative content, Zwingel suggests to see them as in process. This book will especially appeal to students and scholars interested in transnational feminism and gender and global governance

Abstract: "Human rights and inclusion are the leading legal paradigms of our time and are considered to be the cornerstone of democracy. In legal discourses on rights, freedom of religion occupies a pivotal position, receiving increasing attention from legal bodies. This book critically evaluates the emerging legal principles and standards that are applied to religious freedom in Europe. Focusing on religious pluralism as an interpretational principle stemming from attempts to define the boundaries of freedom of religion, it examines the expansion of religious pluralism as an underlying principle of different rights regimes and constitutional traditions. It is, however, the static and liberal shape this principle has assumed that is taken up critically here: in order to address how difference is vulnerable to elimination rather than recognition; and through the lens of a contemporary ethics of alterity to reconstruct the possibility of a true religious pluralism

Abstract: This book focuses on the most important implications of the "fair hearing" right for conducting civil proceedings. It provides a thorough and critical analysis of the case law of the European Court of Human Rights (the Strasbourg Court) regarding Article 6 of the European Convention on Human Rights. It puts forward a generally applicable framework for the analysis of the various procedural issues to which the "fair hearing" right may give rise, then applies that framework to discuss a selection of specific procedural issues. The book investigates several important questions of general scope in the context of ECHR Article 6, such as: What is the relevance of case law regarding criminal proceedings when the "fair hearing" right is applied to civil proceedings? How does the Strasbourg Court actually proceed when evaluating whether specific court proceedings have been "fair"? What are the roles of fundamental concepts such as the "margin of appreciation" and proportionality in this regard? In the subsequent discussion of specific procedural issues, the focus is on the balance that must be struck between procedural safeguards and the objectives of efficiency and economy. The book considers specific procedural issues such as: When must an oral hearing be held in order for civil proceedings to be "fair"? When will a refusal of specific evidence render civil proceedings unfair? When is a civil litigant entitled to l egal aid? As such, the book not only presents current case law; it also compares various strands of the case law regarding the "fair hearing" right, and argues that the Strasbourg Court's approach to various pertinent issues needs to become more consistent. Offering an in-depth examination of the Strasbourg Court's case law regarding ECHR Article 6, this book should be consulted by anyone interested in fundamental fair trial rights.

Abstract: This book addresses the interpretation and application of human rights norms by International Criminal Tribunals (ICTs). Such Tribunals are widely heralded as human rights defenders. At the same time, however, they employ activities that necessary entail the risk of human rights violations: they conduct criminal investigations, arrest and detain individuals, and put them on trial. This book investigates this flip-side of the ICTs’ relationship with international human rights law, and focuses on the ICTs’ own interpretation and application of human rights norms. First, the book addresses whether and how ICTs are bound by human rights law, since unlike states they do not sign or ratify human rights conventions. Second, the book provides an in-depth analysis of the way in which ICTs interpret and apply human rights norms, compared to the way in which these norms are interpreted in a traditional state-context. Relying on the unique circumstances in which they operate, ICTs have often deviated from generally accepted interpretations of human rights. The author critically examines this so-called contextual approach and seeks to recommend ways in which ICTs can improve their interpretative practice by giving due regard to the context in which they operate, while still providing adequate human rights protection. Addressing the ICTs’ possible leeway in terms of contextualization, this book contributes to the broader debate about adherence to human rights norms in international law.
- (Vorwort, Seite 7)

Abstract: "Written largely by Canadian scholars for Canadian students, Human Rights: Current Issues and Controversies is an overview of contemporary human rights concerns that aims to introduce readers to the human rights instruments--provincial, national, and international--that protect Canadians. The volume begins with an overview of the history of human rights before moving on to discuss such important topics as the relationship between political institutions and rights protection, rights issues pertaining to specific communities, and cross-cutting rights issues that affect most or all citizens. Contemporary and comprehensive, Human Rights: Current Issues and Controversies is a valuable resource for undergraduate and graduate students studying human rights."--

Abstract: "On 14 June 1993, the Secretary-General of the United Nations Boutros Boutros-Ghali delivered the opening address to the World Conference on Human Rights held in Vienna. The world had undergone massive political transformations in the preceding four years and the Vienna conference's purpose was to lay new foundations for international human rights protection in the post-Cold War era. Since 1945, the evolution of international human rights had been closely linked to the United Nations. The Cold War and North-South debates had for almost 50 years determined the uneasy existence of human rights at the United Nations"--
Abstract: "This book fundamentally reinterprets the history of international human rights in the post-1945 era by documenting how pivotal the Global South was for their breakthrough. In stark contrast to other contemporary human rights historians who have focused almost exclusively on the 1940s and the 1970s - heavily privileging Western agency - Steven L. B. Jensen convincingly argues that it was in the 1960s that universal human rights had their breakthrough. This is a ground-breaking work that places race and religion at the center of these developments and focuses on a core group of states who led the human rights breakthrough, namely Jamaica, Liberia, Ghana, and the Philippines. They transformed the norms upon which the international community today is built. Their efforts in the 1960s post-colonial moment laid the foundation - in profound and surprising ways - for the so-called human rights revolution in the 1970s, when Western activists and states began to embrace human rights"--

Abstract: This volume investigates the development of the concepts and practices of “humanity” from the sixteenth century up to the present. By taking a comparative and interdisciplinary approach, the contributers focus on Europe as well as Europe’s relations to other world regions in the process that shaped “humanity”. They show how this emerging concept led to the overcoming of fundamental divisions in many spheres on the one hand and the formation of new hierarchies on the other

Abstract: This interdisciplinary study engages law, history, and political theory in a first attempt to crystallize the lessons the global 'refugee crisis' can teach us about the nature of international law. It connects the dots between the actions of Jewish migrants to Palestine after WWII, Vietnamese 'boatpeople', Haitian refugees seeking to reach Florida, Middle Eastern migrants and refugees bound to Australia, and Syrian refugees currently crossing the Mediterranean, and then legal responses by states and international organizations to these movements. Through its account of maritime migration, the book proposes a theory of human rights modelled around an encounter between individuals in which one of the parties is at great risk. It weaves together primary sources, insights from the work of twentieth-century thinkers such as Hannah Arendt and Emmanuel Levinas, and other legal materials to form a rich account of an issue of increasing global concern

It weaves together primary sources, insights from the work of twentieth-century thinkers such as Hannah Arendt and Emmanuel Levinas, and other legal materials to form a rich account of an issue of increasing global concern.
