    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation.     Abstract: Das Buch schreibt die Entstehungsgeschichte des Kulturgüterschutzes im Völkerrecht aus einer postkolonialen Perspektive neu. Im Gegensatz zur bisherigen Historiographie von „Kultur“ im Völkerrecht argumentiert die vorliegende Studie, dass der eurozentrische „Kulturstandard“ des 19. und 20. Jahrhundert maßgeblich in Wechselwirkung mit der Entwicklung des Kulturgüterschutzes stand. Verschiedene Akteure nutzten das Recht auf unterschiedliche Weise, um an dem „Zivilisationsdiskurs“ teilzuhaben. Das Ziel des Buchs ist es, ein neues Narrativ in die Geschichte des Kulturgüterschutzes einzuführen. Das dominante Fortschrittsnarrativ soll durch eine kritische Genealogie des Völkerrechts ersetzt werden, welche die hegemonialen Strukturen der Vergangenheit und Gegenwart aufdeckt. Sebastian M. Spitra ist wissenschaftlicher Mitarbeiter am Institut für Rechts- und Verfassungsgeschichte der Universität Wien und Grotius Fellow der University of Michigan Law School.
    Abstract: This book analyses the development of the norms of protecting cultural heritage from a postcolonial perspective. In contrast to the traditional historiography of ‘culture’ in international law, it reveals how the highly problematic and Eurocentric ‘standard of civilisation’ in the 19th and 20th centuries served as a driving force for the formation of cultural heritage protection norms. Various actors used the law in different ways to take part in this discourse on ‘civilisation’. The aim of this book is to lay down a new narrative on the history of the protection of world cultural heritage. It endeavours to replace the inherent politics of the dominant narrative on progress with a critical genealogy which reveals the long-lasting hegemonic structures of today’s international law. Sebastian M. Spitra is a research fellow at the Department of Legal and Constitutional History at the University of Vienna and a Grotius fellow at the University of Michigan Law School.

    Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Abstract: Krisen werden regelmäßig als Ausnahmen wahrgenommen. Dies erklärt auch, warum sich die rechtliche Auseinandersetzung mit Krisen auf Notstandskonzepte konzentriert. Gleichzeitig hat der Ausnahmezustand im Sinne Carl Schmitts Konjunktur, um bestimmte Krisenphänomene zu erklären. Zu diesen Phänomenen gehört, dass sich das Verständnis und damit der Inhalt bestehender Rechtsnormen in Krisen wandelt. Diese Auslegungsänderungen, häufig auch als Rechtsbrüche angeprangert, werden vor allem durch nichtrechtliche Einflüsse erklärt. Jasper Finke hingegen versteht Auslegungsänderungen in Krisenzeiten als Teil des Rechts. Ausgangspunkt hierfür ist ein Krisenverständnis, für das der Begriff der Erwartung zentral ist. Bei Krisen handelt es sich um Anpassungsprozesse dieser zunächst enttäuschten Erwartungen. Als Normalitätserwartung sind sie aber auch Bestandteil der Auslegung einer Norm. Ändern sich die Erwartungen, spiegelt sich dies im Inhalt der Norm wider.
    Abstract: Conceptualizing crises as part of the normality-exception dichotomy turns a blind eye to the long-term effects of crises, especially the impact they have on the meaning of existing legislation. Jasper Finke reveals why changing interpretations in response to a crisis are to be understood as a process that is inherent to law and not something that is imposed on law.

    Abstract: Thomas Kleinlein analysiert die unterschiedlichen Potentiale für eine dialogische und pluralistische Grundrechtsjudikatur, die föderalen Grundrechtssystemen innewohnen. Gegenstand seiner Untersuchung sind Deutschland, die USA und die EU. Als Alternative zu einem verbreiteten staats- und souveränitätszentrierten Verständnis schlägt er eine föderale Theorie der Mehrebenen-Grundrechtsjudikatur vor. Mit einer solchen föderalen Sichtweise lassen sich dogmatische Figuren, über die Anwendungsbereiche, Kontrollmaßstäbe und -intensität definiert werden, als Ausdruck der institutionellen Strukturen und der Interaktion der beteiligten Gerichte begreifen. Praktischer Ertrag der Forschung sind Vorschläge, die Gerichten in Mehrebenen-Strukturen Orientierung bieten können, vor allem angesichts der aktuellen Herausforderungen, mit denen der Grundrechtsschutz in Europa konfrontiert ist.
    Abstract: Thomas Kleinlein examines the federal fundamental rights systems of Germany, the USA and the EU, comparing their varying potential for a dialogic and pluralistic judicature. His resulting suggestions could serve as guidelines for action in multilayered structures.

Ein Schwerpunkt der Untersuchung liegt auf dem Schnittpunkt von Einwanderung und dem Schutz der nationalen Sicherheit. Bei der Ausbalancierung der hier vorzufindenden gegenläufigen Interessen spielen Verfahrensrechte eine erhebliche Rolle. Die Autorin geht daher der Frage nach, ob bzw. welche materiellen und prozessualen Rechte einer einreisewilligen Person in einem Konsulat des Zielstaates auf ausländischem Territorium im Visumverfahren zustehen und welche Rechte der stammberechtigten Person in dem Zielstaat selbst zukommen. Die Beantwortung der Frage wird maßgeblich durch die Einbindung eines Staates in eine internationale bzw. supranationale Rechtsordnung bestimmt, weshalb ein besonderer Fokus auf dem Völkerrecht, dem Unionsrecht und dem europäischen Menschenrechtsregime liegt.

    Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: Überbelegte Gefängnisse in den USA und anderswo, brennende Autos in den Banlieues von Paris, Verfolgung illegaler MigrantInnen... gibt es einen Zusammenhang? Ausgehend von der US-amerikanischen Situation macht der Autor einen Trend aus, Armut, gesellschaftliche Prekarisierung zu kriminalisieren: Gesellschaftliche Problemgruppen werden kriminalisiert und weggesperrt. Lange ist bekannt, dass in den USA Afro-Amerikaner überdurchschnittlich häufig straffällig und auch zu Gefängnisstrafen verurteilt werden - eine Entwicklung, die im Umgang auch (west)europäischer Polizei und Rechtsprechung mit "Verbrechern" aus sozial schwachen Gruppen ihren Widerhall findet. Wegsperren als Lösung sozialer Probleme? Dieses Buch liefert einen wichtigen Beitrag zur Analyse von Staat und Gesellschaft im Zeitalter des neoliberalen Siegeszugs. Doch der Band zeigt auch einen Weg aus dieser schon beinahe pornographisch anmutenden Begeisterung von Strafe, das die politischen Eliten in aller Welt dazu verleitet, die Gefängnisse als soziale "Staubsauger" zu verwenden, deren Aufgabe es ist, die hässlichen Überreste der Überflüssigen der neoliberalen Gesellschaft verschwinden zu lassen. Tim Kelsall examines some of the challenges posed by the fact that the Court operated in a largely unfamiliar culture, in which the way local people thought about rights, agency and truth-telling sometimes differed radically from the way international lawyers think about these things.     Abstract: Economic sanctions are increasingly being used to combat rogue states, international terrorists and economic criminals. This book offers a new assessment of economic sanctions as a public policy tool and identifies the key legal and regulatory issues in the design of economic sanctions policy in the post 9-11 environment. Kern Alexander places the use of economic sanctions in a broad international context to highlight the gaps in existing international sanctions programmes and the need to develop more effective and efficient multilateral institutions in this area. Moreover, this book identifies weaknesses of US unilateral and extraterritorial sanctions and the legal framework which supports their application. This perspective is especially important given the growing concern with states such as Iran and North Korea and the ongoing interest in how to combat weapons of mass destruction, transnational economic crime and terrorist financing. Kern suggests that although multilateral institutions have a role to play in monitoring the implementation of sanctions, the impetus for effective economic sanctions policy must come from national policymakers and regulators

    Abstract: Human trafficking is one of the most extreme forms of exploitation in the 21st century. It, therefore, is one of the most urgent political challenges of our global age. Christal Morehouse evaluates the anti-human trafficking policy in the United States of America and the Federal Republic of Germany. The author uncovers policy gaps and hidden policy agendas which weaken the German and American governments’ ability to combat human trafficking.     Abstract: Die Beschwörung einer »Leitkultur« und die Warnungen vor den Gefahren einer Parallelgesellschaft sind für die Integration von Migranten mehr hinderlich als befördernd. Werner Schiffauer plädiert mit diesem Buch dagegen für einen neuen Realismus, für eine Kultur des genauen Hinsehens. Mit Blick auf die Lebensrealität in Einwanderervierteln und islamischen Gemeinden zeigt er, wie gesellschaftliche Solidarität auch in Situationen kultureller Differenz entstehen und behauptet werden kann.
